A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY
OF LYNWOOD AUTHORIZING THE TRANSFER OF FUNDS TO COVER
OUTSTANDING DEBT TO MR. RAYMOND KELLY AN EMINENT DOMAIN
LAWSUIT
WHEREAS, in December, 1985 the Lynwood Redevelopment
Agency filed a complaint in Eminent Domain against Raymond Kelly
(deceased) for property located at 11136-38 Long Beach Boulevard,
Lynwood, CA; and
WHEREAS, the Agency made several attempts to settle with
Mr. Kelly but to no avail. On December 12, 1988 the case was
prepared for trial for the purpose of reaching a settlement. A
settlement price was reached in the amount of $88,750.00 (Eighty
Eight Thousand Seven Hundred Fifty Thousand Dollars)
WHEREAS, the Agency authorized the Clerk of the Court to
mail Raymond Kelly a check for the funds deposited with the Clerk
of the Court on December 17, 1985 in the amount of $70,000.00
(Seventy Thousand Dollars) together with all accured interest;
and
WHEREAS, on January 12, 1989, a check was issued to Mr.
Kelly in the amount of $23,608.97 (which represents the balance
owed $18,750.00 plus interest for three years); and
WHEREAS, on June 5, 1990 a memo was received from
Accounting informing staff that the check for the amount of
$23,608.97 (Twenty Three Thousand Six Hundred Eight Dollars and
Ninety Seven Cents) would be voided as one year had elapsed and
said check had not been cashed; and
WHEREAS, on March 17, 1992 a request was received from
the Administrator of Mr. Kelly's Estate to have said check
reissued for property located at 11136-38 Long Beach Boulevard;
and
WHEREAS, the budget for Fiscal year 1991-92 does not
include funds to cover outstanding emcumberances; and
WHEREAS, the Redevelopment Agency Budget has a projected
surplus of funds in excess of $23,608.97 (Twnety Three Thousand
Six Hundred Eight Dollars And Ninety Seven Cents in Legal
services Account; and
WHEREAS, there is a need to reissue a check in the
amount of $23,608.97 (Twenty Three Thousand Six Hundred Eight
Dollars And Ninety Seven Cents) to the Administrator of Mr. Kelly
Estate.
NOW, THEREFORE, the Redevelopment Agency of the City of
Lynwood does hereby find, proclaim, and resolve as follows:
SECTION 1. That the Executive Director of the Lynwood
Redevelopment Agency, or his designee, is hereby authorized to
transfer $23,608.97 (Twenty Three Thousand Six Hundred Eight
Dollars And Ninety Seven Cents) from Account No. 12-5020 (Legal
Services to Account No. 12-5040 (Real Estate Purchases).

SECTION 2. This resolution shall go into effect immediately upon
its adoption.
PASSED, APPROVED and ADOPTED this 5th day of May, 1992.
