CITY OF TIFFIN ORDINANCE NO. 2014-356

AN ORDINANCE AMENDING THE MUNICIPAL CODE OF TIFFIN,
IOWA, SECTION 92.04(B) OF CHAPTER 92, TO INCLUDE AN
INSUFFICIENT FUNDS CHARGE.

BE IT ENACTED=by the City Council of the City of Tiffin, Iowa:
Section I. Purpose: The purpose of this ordinance is to amend Section
92.04(B) of Chapter 92 of the Municipal Code of Tiffin, Iowa, by including an
insufficient funds,charge.
Section II. Amendment. Chapter 92.04(B)ds hereby amended as follows:
CHAPTER 92 I
WATER RATES
92.04. SERVICE DISCONTINUED. Water service to delinquent customers
shall be discontinued in accordance with the following:
4. Fees.
B. A service charge of $25.00 shall be assessed to any
customer .whose` payment is not honored by the customer's financial
institution for any reason when presented. If two or more payments are .
dishonored, payments for that account shall'be made by cash or money
order only. ,
Section III. Repealer. All ordinances or parts of ordinances in conflict with the
provisions ofthis Ordinance are hereby repealed.
Section IV. Severability Clause. If any section; provision or part of,this '
ordinance shall be adjudged invalid or unconstitutional,`such adjudication shall not
affect the validity of the ordinance as a whole or any section, provision or part thereof
not adjudged invalid or unconstitutional.
Section V. When Effective. This ordinance shall be in effect after its final
passage, approval,and posting as provided by law.
On the 14t day of May 2014, at a'regular meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Ryan introduced Ordinance No. 2014-356, and moved that it be
given its first reading. The motion was seconded by Councilperson Upton.
Ayes: Kahler, Ryan, Petersen, Bartels, Upton

Nays: Upton _
Five members of the Council being present and having voted "Aye", Mayor Steve
Berner declared the motion carried, and Ordinance No 2014j356,.was read the first.

On the 28th day of May 2014, at a'regular meeting of the Tiffin City Council, Tiffin, f
= Iowa, Councilperson Upton introduced Ordinance No. 2014-356,,add moved that it .
be given its second reading. The motion was seconded by Councilperson Petersen.
Ayes: Kahler, Ryan; Petersen, Bartels, Upton

Five members of the Council being present and having voted"Aye ','Mayor Steve
Berner declared.the motion carried, and Ordinance No. 2014-356, was read the
second time and discussed and placed on record. ,x r, •
On the 11th day of June 2014, at a regular meetings of the Tiffin City,Council, Tiffin,
Iowa, Councilperson Ryan introduced Ordinance No. 2014-356, and moved that it be
given its third and last reading. The motion was seconded'by Councilperson Mahler.'
• Ayes: Kahler, Ryan, Bartels, Upton .
Nays: none ,
Absent: Petersen °
Four members of the.Council being,present and having voted "Aye", Mayor Steve
. Berner declared the motion carried, and the ordinance was passed and adopted. `
Whereupon the Mayor declared that Ordinance No. 2014-356 be adopted and
signified his approval of same by fixing his signature thereto. Passed by the Council
on the 11th day,of June 2014 and approved by the Mayor on the 16th'day of June 2014. •

I, Michon Jackson, Clerk/Administrator of the City of Tiffin, Iowa, state that an
ordinance entitled AN ORDINANCE AMENDING THE MUNICIPAL CODE
OF TIFFIN, IOWA, SECTION 92.04(B) OF CHAPTER 92, TO INCLUDE AN
INSUFFICIENT FUNDS CHARGE and known as No. 2014-356 was duly passed
by the`Council on the 11th day of June 2014, and signed by the Mayor on the 30th day
of June 2014, and published on the 30th day of June 2014, by posting copies thereof in
three public places within the limits of the City of Tiffin, Iowa. That I posted copies-
of Ordinance No. 2014=356 in the following places:
The Depot, Tiffin, Iowa
Casey's, Tiffin,'Ibwa
Solon State Bank, Tiffin, Iowa
