PUBLIC HEARING McMURTREY VARIANCE PRESENT: Chairman Dan Garren; members Rob Geray, Roy Hobbs, Mike Taylor, Bette Lovinus, and Clerk Robyn Keyes. VISITORS: John McMurtrey, Gretchen McMurtrey PZ member Lovinus lead with the Pledge of Allegiance. Chairman Garren asked if anyone had questions or concerns regarding last month's minutes, no one did. PZ member Taylor made a motion to approve November's minutes. PZ member Lovinus seconded the motion. All were in favor. Motion carried. Previous Action Items. Clerk Keyes said she called Steve Serr with Bonneville County Planning and Zoning regarding the Impact Area increase letter. Mr. Serr said he had not reviewed the letter yet. PZ member said there were written guidelines for reviewing the impact area and the County had 30 days to respond to written letters and requests: it had been nearly three months and still no response from the County. Garren said he would meet with the Bonneville County Planning and Zoning Board regarding the issue since the City was not getting a response from Mr. Serr. PZ member Geray suggested reviewing the impact area every three to five years as a means of addressing issues in a more timely manner with less to address each time. Public Hearing. A public hearing was held for John and Gretchen McMurtrey. The McMurtrey's were asking for a variance so they could build a house on a platted piece of land that was not on a street but on an easement that could be a future alley. After holding the hearing and reviewing the request, the Commission recommended to the Council to approve the McMurtrey's request for a variance provided the McMurtrey's create open access to the property that met the City's Code for alleys, and the City preserved easement privileges. See appendix A for hearing minutes. Title 11 Formatting Changes. The PZ members looked over the Ordinance Attorney Storer had drafted for the formatting changes to several chapters in Title 11. Attorney Storer had left out many changes the PZ had requested, and added some they had not request. PZ Chairman Garren said he would meet with Attorney Storer personally to go over the ideology behind each party's changes. PZ member Lovinus said Attorney Storer left out the prohibited uses in many chapters. PZ member Geray said he believed the prohibited uses were important to have in each chapter. PZ member Lovinus said she would go with Chairman Garren to meet with Attorney Storer. PZ member Lovinus made a motion to adjourn; Taylor seconded. Adjourned at 7:50 p.m. 1 APPENDIX A PUBLIC HEARING 6:45 P.M. McMURREY VARIANCE REQUEST PRESENT: Chairman Dan Garren, Members; Roy Hobbs, Rob Geray, Mike Taylor, Bette Lovinus, and Clerk Robyn Keyes. VISITORS: John McMurtrey, Gretchen McMurtrey. Chairman Garren welcomed everyone, went over the procedure for the public hearing, and turned the time over to the McMurtreys. John McMurtrey explained that he had a piece of land that was at the end of an undeveloped City owned easement or alley. The land had an address of 5025 Scoresby, but there was not a road to get back to the property. Mr. McMurtrey said he and his wife wanted to build a house on the land. The land had belonged to Mrs. McMurtrey's grandfather and was in a family trust. After reviewing a City map and a County plat map of the property there was a discrepancy over where the easement ended. The McMurtrey's said the easement ended at their property line and did not go onto their property, but according to all maps present the easement continued onto the McMurtrey's property. Clerk Keyes said she would research the issue and give her findings to the Council before the hearing. PZ member Geray asked if the McMurtrey's planned to build their house in the area that was shown as easement: they said they were not. PZ member Taylor had concerns with possible utilities within the easement. The McMurtrey's said there were no utilities back to the property: they would have to run the utilities back there. The main concern of the PZ members was emergency vehicle access back to the property. Chairman Garren asked the McMurtrey's if they would be willing to provide a road wide enough back to their property that met the requirements for an alley. The McMurtrey's said they were willing to do that. PZ member Taylor made a motion to approve the variance to build a home at 5025 Scoresby. PZ Chair Garren added: and the McMurtrey's installed an alley access that met the City Code requirements, while preserving easement rights to the City. PZ member Hobbs seconded the motion. All were in favor. Hearing closed at 7:15 p.m. 2 PUBLIC NOTICE The City of Iona's Planning and Zoning Commission has scheduled a public hearing on the evening of January 11, 2012 at 6:45 P.M. at the Iona Community Center, which is located at 3548 North Main Street, Iona, Idaho. The purpose of the hearing is to consider a variance request by Gretchen and Jon McMurtrey. A second public hearing is scheduled for the evening of January 17, 2011 at 7:30 P.M. at the Community Center with the City Council for final approval if so recommended by Planning and Zoning. If approved, the variance would allow Gretchen and Jon McMurtrey to build a home at 5025 Scoresby Avenue and open up an alley or private drive way from Olsen Avenue to use as access to their home. If you have any comments concerning this request, they will be considered at the public hearing. Comments may be made in writing, but must be received by the City Clerk seven days prior to the public hearing.
