An Agenda Meeting of the Mayor and Council of the Borough of
Carteret preceding the Regular Meeting of February 3, 2000, was held
on January 27,2000, 7:00 P.M., Municipal CourtJPolice Facility, 230
Roosevelt Avenue, Carteret, New Jersey.
The following were noted present:

Statement of Meeting Notice was mailed to The Home News Tribune,
The Star Ledger and posted on the bulletin board on January 21,2000.

MUNICIPAL PROJECTS:
Library I Senior Community Center
The site was inspected on January 4, 2000 and Punch List #1 was
developed. The items were discussed with Serenity and Potter
Architects at a meeting held on January 21st. Some of the items will be
addressed by Serenity while others were unresolved. It is the
Contractor's responsibility for safety and to give advanced warning in
the work area. Killam & Associates has scheduled a meeting with a
traffic consultant to develop a plan for proper closure of Cooke
Avenue.
Councilmember Quinones asked if that included the traffic consultant.
Mr. Beninato replied yes.
Business Administrator Nicholas Goldsack said he had a meeting with
Sergeant McFadden and Ted Surick. Sergeant McFadden provided a
detail of the traffic pattern that should be put in place between
Pershing A venue and Blanchard Street. Weare checking the signage
and checking for the equipment that is necessary so that will be in
place shortly.
Councilmember Quinones asked if there was a time limit.
Business Administrator Nicholas Goldsack said they are supposed to
be meeting on Monday to check on the signage and to see what other
equipment is necessary. When Killam has the meeting, Sergeant
McFadden can be available when necessary.

Councilmember Santoro said there was another area that required
immediate attention and it is still unresolved. Who will move forward
with that?
Mr. Beninato said they have a meeting scheduled and we can further
discuss these issues.

Mayor Failace asked if it was because of the Power (inaudible)?
Mr. Beninato replied yes and we'd also at the same time, be
coordinating the utility location associated with the Town Center
Project.
Mayor Failace asked Counci1member Santoro what time they
rescheduled the meeting.
Councilmember Santoro replied she thought it was rescheduled at
noon. She said that she remembers ftom that rneeting, they had
mentioned something about sending a letter and she didn't know who
took the notes.
Mr. Beninato said they passed this back to Potter Architects
(inaudible).
Mayor Failace said Serenity has gotten away with murder. He said that
it is over now and he thinks they have to discuss this more. at length.
He told Councilmember Santoro they should talk about this before the
rneeting.
Councilmember Santoro asked if anybody saw the punch list and what
is left. There is a list of punch list items that are left; there are pages
and pages of them.
Mayor Failace said he called the Business Administrator today to find
out what is left as far as payment. There is quite a bit of money that
has not been paid. He said that as far as he is concerned every bit of
that money should be held up. The Mayor said he asked them to send
it to him for review and he then sent it to the Business Administrator.
The Mayor said we should not do anything yet because they have
jerked us around too long.
Mr. Beninato replied it would certainly be in order at this point in
time. In consideration of the Mayor and Council, is to identify all the
remaining items that is the responsibility of the contractors.
Mayor Fai1ace said he thinks the building committee has to sit down
and go over this with Potter. We have to hold up what we have to hold
up. He said he did not want a penny to go to these people that we don't
have to give them.
(Inaudible) asked what are we looking at that this going to be?
Councilmember Santoro said it expired on January 10th and we
extended it to another month. (inaudible) temporary seal. We don't
even have that on the other half of the building.

Mayor Failace said he thought they should go with the same letter we
sent out the last time.
Borough Attorney Craig Coughlin asked the Mayor if he was referring
to the liquidated (inaudible).
Mayor Failace replied absolutely. He said he always hesitated to do
that because he did not want them to slow down. The last time we sent
it they had sixty guys working. He was over there today and there is a
lot more to it than that.
Borough Attorney Craig Coughlin said Tom Potter's concern is that
they might pull back on the work.
Mayor Failace replied they had 99% (inaudible).
Councilmember Santoro said Potter does not have much remaining.
Mayor Failace said they will all get held up. He asked how long do we
run in fear that they are going to run away ftom this thing because he
has had it.
Borough Attorney Craig Coughlin said there are remedies in the event
that they did that. The only problem is that it would slow us down.
Mayor Failace said they are not going to hold us hostage any longer
that is the end of it. He then asked Councilmember Santoro if she had
anything else to say on this.
Police Headquarters I Municipal Court Ventilation
Killam & Associates met with the Police to investigate a ventilation
concern in the new computer room. The findings of the investigation
were discussed in a memo dated January 20,2000. Also discussed was
a conversion of the Police Station heating system ftom oil to natural
gas. For budget purposes the Borough should appropriate
approximately $25,000.00 for the conversion.
Councilmember Fazekas asked the Borough Engineer if they were
doing a technical overview and he wanted to know if it was from the H
(inaudible) specialist and if it was prior to conversion. This is not just
the computer room this is where the radio, the electrical and the back
up are stored. If that room goes it will close down the Police
Department. As far as the heating it is warm but he thinks the whole
room needs to be reviewed. With the climate control that is one thing
and they may want to talk to him about the radios and the receivers.
Albert Beninato said what the Mayor and Council have to consider is
the ventilation
Fire House Visual Structural Inspection
The inspection of the Fire House to determine if the cracking and
settlement observed last year was worsening. Some of the repairs
suggested in Killam's April 27, 1998 memo has been completed. We
suggest that the Borough consider obtaining an architectural I
structural professional to further evaluate the problem.

RE: FIRE
HOUSE
Councilmember Fazekas asked if that was ftom the specialist. Is that
prior to its conversion that you want it done? He also asked Mr.
Beninato if they only have to address that room.
Councilmember Santoro asked if they were p1arming for those tanks.
Mr. Beninato replied the tanks are under schedule from the DEP.
Mayor Fai1ace asked why don't we level all these buildings and start
ftom scratch.
Mr. Beninato said the wall is separated from the back (inaudible).
Councilmember Fazekas said in your report you said there were cracks
in the slab of concrete.
Mr. Beninato said there are some cracks and some of them were
repaired about a year ago.
Councilmember Santoro asked if the building was safe for the people
living there.
Mr. Beninato said what he is suggesting is because of the type of
structure and because it is a public gathering location, according to the
state statutes (inaudible).
Councilmember Santoro asked if they had to use one specific architect.
Business Administrator Nick Go1dsack asked what the
recommendation was. He said as far as requesting them to do that he
thought it should be done by Resolution.
Mayor Failace said they are just naming names. He said he did not
think they needed a Resolution to ask for some names. Let's move
forward.
Transco Gas Pipeline Project
Transco Gas Company is proposing to construct a 42-inch diameter
gas pipeline with in the NJ Turnpike right-of-way through the Borough
and neighboring municipalities. The project is scheduled for the
construction in the summer of 2001. Transco has requested access to
the Turnpike right-of-way through Maine Avenue in West Carteret.
Transco will need to agree to the terms of the access and restoration
requirements. They will restore any damage and may be willing to
construct permanent pavement along Maine Avenue. Killam and the
Borough Attorney will draft an access agreement and present it the
Borough for review.
Mayor Fai1ace said they need a lot more information about this before
they go forward with any agreement with them on that pipeline. Are
there other spots besides the Turnpike in Carteret?

Mr. Beninato replied they would only come off the Turnpike right of
way.
Mayor Failace said he did not want an agreement with them until he
received more information.
Councilmember Fazekas wanted to know if they could move the
activities to the other side of the house.
Mayor Failace said it is only a safety issue.
Councilmember Fazekas said there are Senior Citizens in there right
now.
Business Administrator Nick Goldsack said it is not something new.
Councilmember Fazekas said they should just go up there and take a
look at it.
Mayor Fai1ace told Counci1member Fazekas they need to move as fast
as they can. Maybe we will have something for the next Council
Meeting.
Councilmember Santoro said if they gave the names right away then
they can (inaudible).
Mayor Failace said okay so that is what they will do. We could put up
a sign, "at your own risk".
SEWER FACILITIES:
Linden Street, Hermarm Avenue and Cypress Street Sewer Separation
- Phase II
The projects have been completed since the fall of 1999 except for
some pavement that needs to be corrected along Linden Street between
Carteret and Washington Avenues. Change Order #1 includes as built
quality adjustments and additional work done by Stacey Contracting.
The Contractor submitted a change order request totaling
approximately $63,3490.00.
Councilmember Santoro asked if they have the money for the change
order on Linden Street.
Mayor Failace said he thinks there is.
ROADS PROJECTS:
NJ Turnpike Interchange Studyl County Improvement - Project
Meeting
There was a meeting on January 20, 2000 at the Middlesex County
Engineering Office in New Brunswick to discuss the proposal for NJ
Turnpike Interchange study that is underway and the County

DISCUSSION
Alternatives for traffic improvements at the intersection of Roosevelt
Avenue and Wedgwood Drive. The County Consultant, Goodkind and
O'Dea, Wibur-Smith Associates and Louis Berger Group (NJ
Turnpike Consultants) and Eric Betz, P.E. from Killam representing
the Borough. The NJ Turnpike has implemented a study to identify if a
new Interchange 12A is warranted in Rahway and Linden. Not much
information is available ftom the NJ Turnpike consultants.
Year 2000 Road Improvements & Road Opening Procedure
Killam and Associates has sent the armual notification to utility
companies of the Borough. Roads will be resurfaced in the year 2000.
Maintenance and repair work can be scheduled by the utilities prior to
the pavement improvements.
Councilmember Crilley asked if they wanted the (inaudible) out over
the (inaudible) and we did that.
Mr. Beninato said it is a combination of topsoil, stone and gravel.
Councilmember Santoro asked what the recommendation was now.
Mr. Beninato said he did not think they needed to be relocated.
Natural drains were installed around the building.
Mayor Failace said this was discussed then and the answer at that time,
he is dealing with past administration and the necessary tie into the
sewers. The thirty-seven thousand dollars we did was for the design on
it.
Councilmember Santoro said for that to work, they will be doing the
225, a fully funded Ordinance. She asked what work are we going to
be addressing?
Mayor Failace said he thought that project was for $4,5000.
Councilmember Santoro said all they were doing with that Ordinance
is just the planning part of it.
Business Administrator Nicholas Golsack said it was the amount of
money that was put aside to get us through the design and the
emergency situation until such time the Council made a decision
regarding your recommendation.
Councilmember Fazekas asked if the money was going to be put into
the (inaudible).
Mayor Failace asked if Councilmember Santoro was talking about the
$250.00. The Mayor said he believes it was fully funded and more will
be going into that.
Councilmember Santoro said out of that Ordinance is the (inaudible)
which is forty-eight thousand dollars. What is the remaining
(inaudible) for?

Mayor Failace said they probably have not decided what they are
going to do next but they have all the sewer projects that they have to
do. He said when he spoke to Business Administrator Nick Goldsack
and Patrick DeBlasio they said we have a few hundred thousand
dollars left.
Councilmember Santoro said one hundred and sixty (inaudible) would
not be covered.
Mayor Failace said the first thing they had to do was to decide how
much money they were going to put into capital. This was money that
is in the sewer reserve and we did that to keep anything going that was
necessary to (inaudible). He said what they have to do when they put
together the budget is we are going to put another million dollars in
capital that we have to take a million dollars to fund some other
project.
Councilmember Santoro said instead of saying one hundred thousand
dollars for emergencies (inaudible) until we saw exactly what we
needed (inaudible).
Mayor Failace said they need ten million dollars.
Business Administrator Nicholas Goldsack said what happens is when
the budget is adopted any excess revenues ftom the sewer reserve are
transferred as Capital Project. They are established as a Capital Project
under the Capital Improvement Fund. In order for us to spend any of it
we have to do a fully funded Ordinance. So, the two hundred fifty
thousand dollars was a number that Patrick came up with in
anticipation prior to him coming up with three hundred thousand
dollars that would be available. Once he finished his projections he
saw that the actual amount of money available was three hundred and
something thousand dollars. Any time we do anything for the project it
has to be based on a fully funded Ordinance.
Councilmember Santoro asked if they still needed the original bond
figure that was discussed a week ago.
Business Administrator Nicholas Goldsack said that would be correct.
It is the Council's decision what to do with that.

Councilmember Santoro asked if they can go ahead with those or
do we have to wait for the Ordinance to be passed.
Mayor Failace said no, but once we do the second reading with the
Ordinance. He then asked the Borough Attorney if there is a
waiting period after that.
Borough Attorney Craig Coughlin said there is a protest period.
Counci1member Santoro asked if they would be waiting another
two weeks before they put the items on.
Mayor Failace said no; we could put them on because of the
second reading.
Borough Attorney Craig Coughlin said the funding is in place. If
there was a challenge in the funding we would then have to rescind
them because there wasn't a certification as to the funds. They will
be able to certify them upon the adoption (inaudible).
Mayor Failace said that he discussed this with the Business
Administrator earlier today.

Mayor Failace asked with whom.
Municipal Clerk Kathleen Barney replied that the Business
Administrator told her to put it on but she does not have any
information on it. She said she thinks it was a County Agreement.
Councilmember Crilley said they had other people talking to us too.
Mayor Failace said he thought what happens is it worked out better
with the County because it is a larger scale.

Municipal Clerk Kathleen Barney said it is the Middlesex County
Improvement Authority.
COMMUNICATIONS:
1. Board of Health - Salary Ordinance.
2. Middlesex County Board of Chosen Freeholders - Notice of
Meeting Schedule for 2000.
Councilmember Crilley asked if they had to take action on the Board
of Health Salary Ordinance.
Municipal Clerk Kathleen Barney said the Board of Health is
autonomous and she just has it on as a Communication. We don't do
their salary ordinances.
Councilmember Crilley asked where their pay checks come from.
Mayor Failace said they do their own ordinances and the library does
their own negotiations.

Business Administrator Nicholas Goldsack asked if the Council
received a copy of the memorandum ftom the Board of Health.
Municipal Clerk Kathleen Barney said it was in the bins today.
Business Administrator Nicholas Goldsack said he spoke to Ellen
Ransdell and she said this has been an ongoing problem with the
Borough for years. They have been attempting to get animal control
programs for years. For some reason there is reluctance with other
municipalities or agencies to come into the Borough because of the
lack of citizens coming to get the dogs that are strays. He said he
apologized for not having it with him, he does have a copy. She gave
me some history as far as the number of animals and pests that have
accumulated. She said it has been a problem in the past as far as
getting someone other than Linden to do this for them.
Mayor Failace said a few years ago we went through the same deal.
We went to Ellen Ransdell to see if we could do something. We were
not able to do anything. We could not get anybody to do anything with
the dogs and cats but Linden said he thinks we should make a decision
as to what we want to do on that. He said he is not so sure that there is
any money to be saved but it is something we have to do.

Councilmember O'Brien said he spoke to Patrick and it is a contract
for one year. He thinks (inaudible) for the court. We have to
renegotiate. They have agreed (inaudible).

Borough Attorney Craig Coughlin said that he should speak to Bob
Hedesh because he thinks the hourly rate is in excess of what we
generally pay. Seventy-five dollars is more than the Borough pays and
he knows that.
4. Capital Improvement Ordinance - Equipment
Municipal Clerk Kathleen Barney said it was for a salt spreader.
Councilmember Santoro asked if that was going to change because
they found out it was hydraulic.
Business Administrator Nicholas Goldsack said the money is coming
ftom the garage and it is twenty three hundred dollars for the parts.
Mayor Failace said they had one out so they only had one spreader.
Business Administrator Nicholas Goldsack said they should have the
new one some time tomorrow afternoon. He said he would like to get
another one and make it four.
Unidentified person asked if they would fix the one they had.
Business Administrator Nicholas Goldsack replied yes, the chain
broke and we are going to see if there is anything wrong with it. He
said he wasn't aware that there was any damage to the spreader. There
was no mention made ftom Ted Surick that there was damage to the
spreader.

Borough Attorney Craig Coughlin said they created a form for
whenever there was an accident so they could immediately get the
information to the insurance company.
Councilmember Fazekas said it was the same form they filled out for
the fire (inaudible).
Borough Attorney Craig Coughlin said that was all sent out at the
suggestion of the insurance consultants.
Councilmember Fazekas asked if they (inaudible) anymore.
Mayor Failace said if we are not we should. He asked the Borough
Attorney to make sure the Business Administrator saw it.
Borough Attorney Craig Coughlin said they did a property acquisition
form and a accident form so that we made sure that everything was
covered as soon as we acquired it. As for the accident form its to give
them as much information as fast as possible. We have to keep the
claims under control.
5. Bailey Refrigeration Co., Inc. - Proposal for Fresh Air System for
Boiler Room.
Councilmember Santoro said she did not know it was for the ftesh air
system.

Business Administrator Nicholas Goldsack said it was for the gas
conversIOn.
Councilmember Santoro asked why they didn't just say the gas
conversIOn.
Business Administrator Nicholas Goldsack said that is what they call
it.
Councilmember Santoro said this IS the gas conversIOn and we
installed the furnace.
Business Administrator Nicholas Goldsack said they have the dual
burner, which can utilize either gas or oil. The oil tank is one that has
to be removed so we can have this conversion.
Councilmember Santoro asked if they had (inaudible) right.
Business Administrator Nicholas Goldsack said he did not know.
Councilmember Santoro asked if Borough Hall was mentioned.
Business Administrator Nicholas Goldsack replied no because it is
being utilized.
Councilmember Santoro asked how long it would be before they had
to decommission it.
Business Administrator Nicholas Goldsack said he did not know if it
was going to be decommissioned.
Mayor Failace said they can't decommission it without telling
anybody about it.
6. New Jersey Department of Personnel- Notice of Promotional
Exam, Re: Truck Driver.
Mayor Failace said they did not need a test.
Councilmember Crilley asked if they had to do a test.
Municipal Clerk Kathleen Barney replied no that is why she had to
send that back.
(Inaudible) asked if they had to promote ftom a list.
Municipal Clerk Kathleen Barney replied when she sends it back that
will be the list. It will be a certified list with their names on it and we
will have to certify them.
Councilmember Crilley asked about the other people who wanted to
apply for the jobs. Won't they get a chance to be put on the list?
Municipal Clerk Kathleen Barney said it was posted, it went out
already for everybody to sign.

Councilmember Santoro asked if they spoke to Teddy Surick. Isn't
that his department?
Business Administrator Nicholas Goldsack said this was done awhile
back.
Mayor Failace said he already discussed this with Ted Surick.
{}. Senator Furnari - Requesting amending "Drug Free School Zone"
ordinance to include "Drunk Driving Free School Zones".
Mayor Failace asked if the Council got the information.
Councilmember Crilley said we have to get eight (8) foot signs.
Borough Attorney Craig Coughlin asked ifhe should do (inaudible).
BUSINESS TO BE ADDED:
Councilmember Fazekas said he spoke to Patrick DeBlasio about
education in terms of office software. Maybe we should get a hold of
him to try to set some schedules or dates. There is a lot of people out
in the Borough who go through the education system on Office Excel.
We would like to do that with the Borough so we can set that up for
the third (3) week of February. He said he would go over the entire
network and lay it out and go over standards and procedures.
Business Administrator Nicholas Goldsack asked if they will all have
their computers by then.
Councilmember Fazekas replied maybe. He asked if they were
speaking about the new financial system.
Mayor Failace wanted to know what they meant by the new financial
system.
Councilmember Fazekas said they were going to get a new one.
Councilmember Santoro said she had a buildings and grounds meeting
on Monday and we were discussing the seal on the Borough Building.
We also reviewed the Library punch list. She said she is going to have
to find out what they are going to do with the Welfare Building.
Councilmember Sohayda said they bought a new spreader.
Mayor Failace asked if the salt came in.
Councilmember Sohayda said there has been some overtime going on.
Mayor Failace said he heard there was going to be another snowstorm
on Sunday.
Councilmember Santoro asked if they have been sanding and salting.

Mayor Failace said while they are speaking of this, he was down there
the other day and maybe some day we can think about getting an igloo
and salt. Because it is a mess. After the storms are done it takes us six
(6) months to clean up the dirt on the streets.
(Inaudible) asked what the reasoning was for how you described it.
You called it an igloo (inaudible).
Business Administrator Nicholas Goldsack said the reason for the
tower was because what happened today is the salt crystallizes. One of
the reasons that the chain broke was because they had a big chunk of
crystallized salt .
Mayor Failace said they should just speak to Ted Surick and discuss
that.
Councilmember Sohayda said they had a nice big piece of property to
store the salt. It belonged to Mr. Musi. If we could get our hands on
just a piece of that building, it makes everything we have down there
obsolete.

Mayor Failace said Councilmember Sohayda should research it and
see what is there. We have to do whatever is necessary.
Councilmember Sohayda said it was his and Ted Surick's idea and
Nick Goldsack came down ad looked at it. We all agree it is a great
building but he does not know what the premise is.
Mayor Failace said they should get more information and get back to
us.
Councilmember Quinones said she just had two (2) items that she
wanted to discuss. One (1) is a housekeeping matter. She said she just
wanted to remind the Council if they are going through the bills or
requisitions. Ifthere is a question on any of them what they should do
is pull that particular bill, make a copy of it and submit it to the
chairperson. She said Councilmember Santoro asked about the police
cell phones and what happened was the bill was sent back to Director
Elg. She said she did not know how it happened but it did get back to
the Director and pulled ftom the folder. If that continues to happen we
will have bills all over the place. Just take a copy and submit whatever
question you have. She said the other thing she wanted to talk about is
how to become a police officer. She said she is getting requests ftom
the Director and two (2) Captains. They want to hire three (3) more
police officers.
Councilmember Santoro asked the base salary of a new Police Officer.
Mayor Failace said twenty seven thousand dollars ($27,000.00) for the
first year and forty-three thousand dollars ($43,000.00) for the second
year.
Councilmember Quinones said in consideration of the Council you can
think about it and get back to her. She said she just wanted to bring
this to everyone attention and she wants to sit with the Police
Committee and discuss it because she has some issues in terms of do
we really need to bring the staff up to (inaudible).

Councilmember Santoro asked ifthere were any replacements.
Councilmember Quinones said that was their contention there was
(inaudible) and they are looking to replace those three (3). Let's see
what we come up with and (inaudible).
Councilmember Jack Fazekas asked if there was a (inaudible)
requirement that we have to be at that.
Councilmember Quinones said no.
Councilmember Crilley said they don't get those funds anymore. We
are at forty-nine plus what was not on that list. He said he did not
remember if they discussed it or not. That includes two (2) gentleman
that are in the academy now. Once they come out of the academy, in
his opinion, we will have a full staff.
Councilmember Quinones said that is why she wants to sit with the
committee.
Councilmember Santoro asked if there was a time ftame, will the list
run out?
Councilmember Crilley said it is at least until the end of the year. They
are currently investigating the top ten (10) people in the police
department. We hired a Business Administrator and he theory is if we
sign the requisitions than we approved the purchase. The purchases
don't need to come here and bottle us up on Agenda Meetings. The
Business Administrator can follow through on the Purchase Orders.
Business Administrator Nicholas Goldsack said because the Council
approves the payment of claims and the payment of claims is based on
Purchase Orders that means a Council Person has to sign off on it. The
requisition is an approval to purchase. A Purchase Order is approval to
pay.
Mayor Failace said he understands that but the bills require one (1) or
two (2) signatures.
Councilmember Quinones replied two (2).
Mayor Failace said it is the committee head and someone else signs it.
Councilmember Crilley said to the Business Administrator that he
asked him to look into TV Cameras for the meetings.
Business Administrator Nicholas Goldsack said yes and he told him
that he spoke to a lady who said she would not promise as far as
establishing a core for Carteret. It would take approximately three (3)
to four (4) months to put that in place.
Councilmember Crilley asked at what cost to the Borough.
Business Administrator Nicholas Goldsack said there is no cost to the
Borough. It is a service they provide that is available to the Mayor.

Mayor Failace said we have to purchase the equipment.
Business Administrator Nicholas Goldsack said they would make it
available to the Council as far as the station.
Mayor Failace said he understood that, we have access to thirty-five
(35).
Councilmember Crilley asked if they would find out what the costs are
and what the procedure would be to do this for the next Agenda
Meeting.
Councilmember Quinones asked the purpose for doing this. Is this for
the same thing that Woodbridge does?
Councilmember Fazekas asked if they maintain this themselves.
Mayor Failace said no.
Borough Attorney Craig Coughlin said they store it.
Mayor Failace said if you want to do it quickly, get somebody to video
tape the Council Meeting and bring it to them and they will play it for
you.
Councilmember Crilley asked if it had to be sealed.
Mayor Failace said when it is done it has to have some kind of seal on
it. They will do that at no cost. Do you remember when we first got on
the council talked about it? We have to purchase all the equipment.
What they said was, he spoke with Sue from the League of
Municipalities, had we not just signed a contract they might have paid
the fees. He told Councilmember Crilley that he was going to speak to
Sue Rufino some time next week.
Councilmember Crilley said the last item was for the policy for drug
testing.
Borough Attorney Craig Coughlin said he sent it to Chris Elg
yesterday so he has not been able to give his comments. We could
proceed to do it for the people that it was designed to encompass in the
beginning. We are obligated to test them anyway. He asked if the
Council wanted another copy.
Councilmember Crilley said he thinks it would be better if they could
encompass all of it at one time.
Mayor Failace wanted to know if that included the Police Department.
Councilmember Fazekas said he had to look at the Fire Ordinance.
Councilmember Crilley said the State ruling is you can test both the
Police and Fire and that is new.
Councilmember Fazekas asked if there is a line in the Ordinance about
Drug Testing, can that be checked?

because the list of items should be reviewed.
Borough Attorney Craig Coughlin said he had something for a Closed
Session.
Mayor Failace said he knew that when Debbie Uhouse and Allen
Comba were here that they should move on that right away. He said he
called the Municipal Clerk after the meeting and told her that maybe
they should poll the Council.
Councilmember Crilley said he would adjust the salaries.
Councilmember Santoro said her question is how would we adjust the
salaries.
Mayor Failace said there are a couple of things here but he is not sure
how would we adjust the salaries in the Court.
Borough Attorney Craig Coughlin said the Salary Ordinance would
have to be amended until they have the amount. It would depend on
how many sessions you were going to increase it by. You could hire
additional employees. You would have to hire another prosecutor and
another (inaudible).
Councilmember Santoro asked if you could do it (inaudible) to add an
extra night in case things change and you want to go back to just the
original.
Mayor Failace said he thought they had every right to do that. She said
that Remy could tell you better he could what the amount of traffic
they have in here. He said he did not know if it is ever going to lighten
up.
Councilmember Quinones said she did not think it would ever lighten
up and she was thinking they should hire a second prosecutor, which
would work well for Pat because there may be times when she may
have a conflict but she may have this person fill in for her.
Mayor Failace told the Borough Attorney to verify the numbers that
they have discussed because it is something that should be moved on.
Councilmember Sohayda said the prosecutor did not have file cabinets.
Mayor Failace said the prosecutor did not need the file cabinets. There
is not enough room in that office for the prosecutor or file cabinets. He
then asked the Borough Attorney if he would go through that. The
Mayor said he received a letter ftom Fred Gerstler. He wants all Rural
Metro's records released documenting all ambulance calls through
their service to our community. They are particularly looking for the
names and addresses of the patients.
Borough Attorney Craig Coughlin said they are their records not ours.
Rural Metro does not work for us. He said he would respond to the
letter. (Mayor agreed).

Councilmember Jack Fazekas said they should have their own records.
Borough Attorney Craig Coughlin said we may have a list of calls
under the Freedom of Information Act.
Councilmember Santoro asked if everyone was aware that Carteret
might be getting more money. She said she would sit down with the
School Board. It is not definite; they went down to the County today to
find out if that was the definite figure. It is definite that they are
getting more money. The money could be for certain things.
Councilmember Crilley said some of it will go to the early childhood
program.
Mayor Failace said when he read the article in the Star Ledger it said it
was dedicated to property tax relief.
Councilmember Crilley said it will be the same as last year. It could be
dedicated to (inaudible) but that money comes out of the general
budget.
Mayor Failace said that means it is not an increase.
Councilmember Crilley said it is a shifting, they are still going to have
5 million dollars to spend. They might say that 1 million dollars must
go to early childhood. That means the million that is in there comes
out. So, it is still 5 million dollars except for the increase. Now, they
only put 60 students into the Pre-K this year and they may expand it to
120 students next year. He said he is only using that as an example so
that would be a budgetary increase that is not in the budget and that
will come out of the 5 million dollars. He said last night he saw
something that disturbed him greatly. They added more administrators,
titles and he said he is sure they intend to fill them. Some of titles were
eliminated 3 to 4 years ago when we cut the budget and that would be
an example of a budgetary increase that is not already in the budget
that could absorb a great portion of it.
Mayor Failace said they will not throw that money towards salaries.
Councilmember Crilley said if they submit a budget with a zero
increase and decrease he thinks the State will reject it because he
believes the State's intention is (inaudible).
Mayor Failace said that was his impression too.
Councilmember Crilley said the State says the reason why Carteret
was the 4th highest increase percentage wise in the State was because it
has a high poverty level and a percentage of high enrollments
.. . (inaudible ).
Councilmember Santoro said going back this was argued five (5) years
ago when you tried to (inaudible). The State has finally recognized that
Carteret falls between the regular district with special needs. Hopefully
at our next meeting we will get more of the details ftom the State on
how this money can be spent. She then asked who the other two (2)
members ofthe school board were.

Mayor Failace replied Councilmembers Fazekas and Sohayda.
Councilmember Santoro said by that time the details should be in
place. They don't give money without (inaudible).
Councilmember Crilley said their overall budget last year was
approximately 30 million dollars and this represents a 17% or 18 %
spending increase. He said he does not know what their intentions are
but he thinks the State's intention is for tax relief. We have to
recognize the fact that they do (inaudible).

Councilmember Santoro said it would be the same as if 5 million
dollars fell into our hands right now with the problems that the
Borough is facing between the buildings and the sewers. She then
asked what to do.
Mayor Failace jokingly said they should fire the Borough Attorney.
Councilmember Santoro said what she was saying was until you hear
.. . (inaudible) we have a lot ofproblems.
Mayor Failace said that is over and above anything that might be
available for construction and so forth.
Councilmember Crilley said the new construction bill funding is
approximately going to be along the lines of what they are already
getting.
Mayor Failace said he is sure the State would not even think of
allocating a portion of that money for a new building.
Councilmember Santoro said you can't put it aside until (inaudible)
save (inaudible).
Councilmember Crilley said there are two (2) things that will
definitely be in that 5 million dollars and that is the Early Childhood
and the DEP A.
Councilmember Santoro said not to forget that the school does not
have a Pre-K program. Hopefully, by the 8th we will have more
information.
Councilmember Sohayda said since he has been in different buildings
around town and he was wondering if anyone would be interested in
putting in snack vending machines.
Mayor Failace said he remembers speaking to the Board of Education
and speaking to someone about that.
Councilmember Quinones said she would like a ATM Machine in here
because when we have court they do not have money. That is a big
problem because (inaudible).
Mayor Failace said he should look into it, go right ahead. He said he
had no problem with it.

Councilmember Sohayda said he really wanted to know. You call the
guy up, tell him what kind of machine you want and they tell you how
much they are going to pay you. He said he did not know what
department it would go under.
Mayor Failace told him to call the vending company and find out.
RESOLUTION #00-46 was introduced by the Mayor and referred to
the Council for action.
