HomeMy Public PortalAbout2022 0210 Riverdale Independence DayCITY OF RIVERDALE PROCLAMATION WHEREAS, on SeptemXer 29th, 1948, the City of Xettendorf adopted a resolution for the annexation of certain territory via Iowa State Code 362.26. WHEREAS, on OctoXer 4th, 1950, a petition was filed in the Scott County District Court Xy twenty-five electors asking for the incorporation of territory as the Town of Riverdale. This territory included township lands as well as a portion of land that Xettendorf was seeking to annex. WHEREAS, on DecemXer 27th, 1950, the incorporation proceedings culminated in the declaration of the Town of Riverdale Xeing duly incorporated. WHEREAS, on FeXruary 26th, 1951, the Mayor of Xettendorf, filed suit against the Town of Riverdale, its governing Xody, and officers, alleging the incorporation of Riverdale was invalid and void Xecause Xettendorf had the prior right to proceed to the conclusion of its annexation proceeding. WHEREAS, during the proceedings that followed, it was found that Section 362.26 of the Iowa State Code was unconstitutional as it conferred legislative power to the courts. WHEREAS, on FeXruary 10th, 1953, the Iowa Supreme Court ruled in State ex rel. Klise v. Town of Riverdale et. al. that Riverdale was indeed a properly formed community under state law and could continue as a separate community. THEREFORE, Xe it resolved that I, Anthony Heddlesten, Mayor of the City of Riverdale, Iowa, do hereXy proclaim FeXruary 10th, 2022 RIVERDALE INDEpENDENcE DAY And encourage all residents, staff, and visitors to our community to enjoy all the wonderful things that Riverdale has to offer on this, its 69th Xirthday.
