The following were noted present: Mayor James A. Failace Council member James O'Brien Jack Fazekas Remy Quinones Janet Santoro " " Also noted present was Borough Administrator Nick Goldsack. Noted absent were Councilmembers Crilley and Sohayda. Statement of Meeting Notice: mailed to The Home News Tribune, The Star Ledger and posted on the bulletin board on March 3, 2000. To Address Governing Body: a) Borough Engineer b) Anthony Neibert c) Daphne Miles d) James McGovern, Esq. a) Borough Engineer Al Beninato- MUNICIPAL PROJECTS - Killam has obtained a Grant from the NJ Economic Development Authority under the NJDEP Brownfield funding program for the Waterfront Park Project Site. Engineering has completed the Preliminary Assessment phase of the work and the report was forwarded, reviewed and accepted by the NJDEP. During the completion of the work it was identified that the scope of work under the next phase, the Site Investigation would increase. There was a request from the NJDEP for an increase in the approved Grant allotment. The Borough received notice that the increase of $29,427.00 was approved by the State. The NJEDA indicated that the Borough should complete the Grant closure documents that include the original approved amount of $65,469.00 rather then wait up to eight (8) months while the Grant amount is revised to reflect the increase of $94,896.00. Once the Grant documents are closed the NJEDA will increase the amount. 1. To complete the Grant closure documents several Borough Resolutions are required. The first Resolution should authorize the Mayor to execute the Grant closure documents and the Borough to accept the Grant monies. The second Resolution should authorize Killam to proceed with the Site Investigation phase for the NJDEP approved lump amount of $84,400.00. This is the revised Grant amount of $94,896.00 less the amount previously authorized for the PA phase ($5,025.00), less payments due to the NJDEP ($4,471.00) and the NJEDA ($1,000.00). MARCH 9, 2000 AGENDA MEETI NG ROLL CALL NOTED ABSENT STATEMENT OF MEETING NOTICE TO ADDRESS GOVERNING BODY BOROUGH ENGINEER MARCH 9, 2000 (CONTINUED) UNDERGROUND STORAGE TANK REMOV AL CONTRACT #00-1- Killam is near completion of the design phase for Contract #00-1 and the completion of the contract bid documents should be within the next one (I) to two (2) weeks. Killam requested, with the Borough's approval, authorization to advertise and bid Contract #00-1. BOROUGH ENGINEER TOWN CENTER PROJECT- CONTRACT #99-21- Killam is nearing the completion of the design phase for the Town Center Project. The project should be completed within the next two-(2) weeks. Killam requested authorization to advertise and bid Contract #99-21. POLICE STATION COMPUTER ROOM VENTILATION, NEW GAS FIRED BOILER & SPORTS RECREATION CENTER HOT WATER HEATER - Quotations were solicited from several contractors, there was no response. One (I) local contractor was interested in providing a quotation. Quotes from AERCO Heating & Cooling will be presented to the Borough for consideration. BOROUGH HALL RENOV A TION PROJECT - A meeting with three architectural firms were held on February 25th to discuss Borough Hall renovations. The proposal will include professional and construction cost for three (3) alternatives: 1) renovate existing structure 2) renovate and expand the existing structure to house more or all of the Borough's Departments and 3) demolish and construct a new Borough Hall and meeting the space requirements. Final proposals are due March 24, 2000. Each firm will provide a presentation at a Council Meeting, which will include discussion on the alternatives. BOROUGH HALL MICROBIAL TESTING - Killam has obtained a quotation from Tiffany-Bader Environmental for re-sampling the air quality on the first floor of Borough Hall. The first floor is currently sealed and under negative air pressure with rental air filters. The Borough has stated that they would like to gut the first floor if the microbial readings are acceptable, in preparation for the renovation project. Killam recommends that the Borough authorize TBE to perform the sampling in the amount of $3,660.00. MIDDLESEX COUNTY PUBLIC HEALTH DEPARTMENT - AIR POLLUTION CONTROL ACT VIOLATION - Several Borough facilities have been inspected by the Middlesex County Health Department for air pollution. The Borough has been cited for non-permitted air pollution source at the Police Department and the FireHouse. They need to renew air permits at the Roosevelt Avenue Pump Station and the Public Works Garage. Killam will prepare permit forms and renewal forms for execution by the Borough. A memo will be prepared and forwarded to the Borough early next week. It includes a list of permit fees that are required. The Borough must comply with the County's requests by March 31, 2000. 2. SEWER FACILITIES: - Cooke Avenue Sewer Rehabilitation and Pershing Avenue Area Sewer Separation - Contract #00-2 Killam is near completion of the design phase for the above projects and anticipate completion of the contract document within the next one (1) to two (2) weeks. They are requesting authorization to advertise and bid on Contract #00-2. #81 BERNARD STREET - SEWER LATERAL- The owner residing at 81 Bernard Street has contacted the Borough on several occasions regarding a backup in the sanitary sewer that serves his property. The owner contacted Roto- Rooter to clean and televise the lateral. The investigation performed by Roto-Rooter was damaged at a location near the curb line prior to the connection to the Borough sanitary sewer within Bernard Street. The Borough hired National Water Main Company and televised the sewer main along Bernard Street. No damage was done to the main sewer line. It is the Borough's policy that the property owner is responsible for their respective sewer lateral from dwelling to the connection with the Borough sanitary sewer. Upon review of the Borough's files this property was disconnected from the storm sewer and connected to the sanitary sewer under the Borough's sewer separation contract #1. The sewer lateral was connected to the sewer under a Borough Contract an exception to the Borough's policy may be in order since the lateral was altered. At approximately 7:10 P.M. Councilmembers Crilley and Sohayda were noted present. At approximately 7:22 P.M. Councilmember Fazekas was noted absent. Councilmember Santoro asked how come the out of pocket expenses are not in the engineer's contract. Borough Attorney Craig Coughlin stated that he needed the (inaudible) amount. At approximately 7:25 P.M. Council member Fazekas was noted present. 3. b) CONSTRUCTION OFFICIAL - Tony Neibert asked to change the fees for the Home Improvement Contractors and add some that they never had. The Horne Improvement Contract is $50.00 for a year. We would like it changed to $150.00 for two (2) years. He also said he would like to change the fees for searching of files, copying and lapsed permits for an additional year. Construction Official Tony Neibert spoke about the Senior Permit Clerk Title. Councilmember Fazekas was noted absent at approximately 7:55 P.M. c.) Daphne Miles presented a petition to the Mayor and Council. In reference to racial comment made by Sgt. Zubenko. Minutes for approval: February 3, 2000. Proclamation: Census 2000 Awareness Week. MATTERS FOR DISCUSSION: 1) Nicholas Goldsack - Capital Improvement Fund Ordinance $50,000.00 2) OEM Municipal Coordinator, Term to Expire 3/24/00. 3) Allied Risk Services, Inc. - Settlement - Borough Attorney Craig Coughlin will handle. 4) Senior Permit Clerk/Typing - Ordinance establishing position and salary. BUSINESS TO BE ADDED: Councilmember Santoro stated that the Board of Health wants to meet with the Mayor in reference to the budget. Mayor Failace asked if there was a different owner in the house across the street from Columbus School. Councilmember Santoro asked if the Mayor was referring to the Luxury Apartments. Mayor Failace replied no. There was a fire at the High School and the security camera caught the person. Can we coordinate the move to the Senior Center? The Mayor said he would talk to the group separately. Councilmember Sohayda stated that he looked at the house on Edwin Street. He asked if they should cut the trees and tax the property. Borough Attorney Craig Coughlin stated that there should be a title search at 66 Edwin Street. Councilmember Remy Quinones stated that Lieutenant Talalai could get a German Shepherd. We would have to pay for the additional K-9 officer duties. She said she would like to hire special officers to do the job. 5. Councilmember O'Brien asked if we received the money that they asked for from Tropical Storm Floyd. Borough Administrator Nick Goldsack replied no, we never got that close. MARCH 9, 2000 REPORTS MATTERS FOR DISCUSSION BUSINESS TO BE ADDED BOARD OF HEALTH HIGH SCHOOL - FIRE SENIOR CENTER EDWIN STREET K-9 PAY TROPICAL STORM FLOYD MARCH 9, 2000 ROOF - OEM STOP SIGN - BOROUGH HALL FIRST AID 109 RANDOLPH ST. INSURANCE JANITOR Councilmember O'Brien asked if the roof was mended at the Office of Emergency Management. Also he would like the stop sign at the triangle by Borough Hall changed to a yield sign or the stop sign moved to a different location. Borough Attorney Craig Coughlin stated that they would have to do a study. Councilmember Crilley stated that at the last First Aid meeting there was a complaint. He said he met with the Captain of the First Aid Squad and spoke about the timelines of calls. Mayor Failace stated that Chris Elg will put the proposal together for first responder. Borough Attorney Craig Coughlin stated that the prospective buyer for 109 Randolph Street fell through. Borough Administrator Nick Goldsack stated that the Mayor and Council received letters from Gartland & Company in reference to Hospitalization, Dental and Workman's Compensation. The Borough Administrator continued to speak about coverage. Mayor Failace stated that he thought we needed to bring in a part-time janitor/security person from 5:00 P.M. to 9:00 P.M. at the Library. Councilmember Santoro stated that the day of the Library opening she watched children running wild. For security reasons alone and the fear of all the nooks and crannies in that area (inaudible). Mayor Failace stated that he agreed, so what he wants them to do is I oc k that door. Councilmember Santoro stated that they should hire a new janitor. Mayor Failace stated that he did not want to hire a full time person. As soon as the Council agrees we will hire someone. Council member Santoro asked the Borough Administrator what he thought. Borough Administrator Nick Goldsack replied that he agreed that we need someone there. Mayor Failace stated that he wants someone there to just be there and maybe do some cleaning up. 6. Council member Crilley stated that they have part time janitors working there now. Councilmember Santoro replied that they work in the morning. There is a woman who cleans up. Council member Crilley asked if there were people who clean up the community center at the firehouse. Won't they come over to the Li brary? Councilmember Santoro replied that there is an elderly gentleman who works part time. Who is going to do the Office of the Aging, the Recreation Department? Mayor Failace stated that he thinks it is a good idea but it's up to the Council. Council member Santoro asked the Borough Administrator if they can look into the hours and what's best because we do have a few needs. We need the best job description would be for the person. Mayor Failace stated that he was thinking from 5: P.M. to 9:00 P.M. There is someone around during the day so it's not such a big deal. The kids are there from 5:00 P.M. to around 9:00 P.M. so it's a good idea to have someone there. Councilmember Santoro stated that the Borough Administrator should put something together for us. She said she has been speaking to the Senior Building Maintenance Janitor Jason Abello. Councilmember Crilley asked if this person would be under Jason. He said that his concern is supervision. It's just another part-time job. Councilmember Santoro stated that the building will be used at night. Mayor Failace stated that if we need to expand the hours we'll do just that. Council member Santoro stated that she will go for it. RESOLUTION #00-87 was introduced by the Mayor and referred to the Council for action. Upon MMS&C, by Councilmember Crilley and Sohayda RESOLUTION #00-87 "RESOLUTION TO GO INTO CLOSED SESSION" MARCH 9, 2000 DISCUSSION (CONTINUED) RESOLUTION #00-87 CLOSED SESSION was adopted. Upon individual roll call vote Councilmembers Crilley, ADOPTED O'Brien, Quinones, Santoro and Sohayda voted in the affirmative. Councilmember Fazekas was noted absent. At approximately 8:35 P.M. a Closed Session was held. 7. At approximately 9:40 P.M. upon MMS&C, by Councilmembers Quinones and O'Brien and unanimous affirmative vote of the five- (5) membership present, this meeting was opened to the public.
