George Reilly-continued variance request for Hamilton Cartway This was continued to the February 8, 2013 meeting. 2. J.M. O'Reilly-variance request for 98 Center Street Matt Farrell presented this to the Board. This is an existing 1978 4-bedroom system on a 5718sf lot. The owners are planning some renovations to the home. They are requesting the following variances: 1. SAS to be 8.5' from East property line 2. SAS to be 9' from South property line 3. SAS to be 7' from full foundation 4. SAS to be 13.66' from abutting lot to East MC questioned MF about moving the system closer to the shed on the property so it wouldn't cause that abutter any problems. MF stated that it could be done but not without other issues. Motion: LS-finding that the proposed system would provide better treatment, that there will be no increase in flow and there is limited space on the lot, approve the variances as requested. KJ seconded. 5 yes. 3. Coastal Engineering-variance request for Old Owl Pond Road John Schnaible presented this to the Board. JH asked if they had been to Conservation yet. JS stated that they would be going this evening. JH explained that the BOH required CC approval before they would approve any variance requests. JS asked that he be allowed to present this to see if the Board may have any questions. The Board agreed to let JS present the request. This is for a proposed 4 bedroom home. The property will have a well on it. The following variances are being requested: 1. SAS to be 87' +/- to the pond 2. Reserve SAS area to be 97' +/- to pond JH spoke about installing a Drip Irrigation system to help with the nutrients going into pond. Charlotte & Stu Fyfe-Candleberry Inn-food service permit application This is a request to be able to serve dinner to their Inn guests. A copy of the Assistant Health Director's review was given to the Fyfe's. There were no questions. Motion: MC-approve permit with Assistant's recommendations. KJ seconded. 5 yes. 5. Continued discussion on 40 Sean Circle NI told the Board that she had gone out for another inspection today but that she only inspected the outside because the owner was ill. NI stated that the outside didn't look like much had changed. It did look a bit better than when an inspection was done in April. There was a memo from Sherrie McCullough with regards to a conversation she had with the plumbing inspector. He had been called out to do an inspection of the hot water heater. It passed the inspection but no permit was ever pulled. He asked that the BOH let the owner know that a permit needs to be pulled. NI told the Board that the Selectmen voted to waive the fee to disposal of the big items during a two week period in February. The Board asked that NI check into the dates, should it really be February and not January? Another inspection will be scheduled and this will be brought up again at the February 5, 2013 BOH meeting. 6. Update on 77 Stony Brook Road NI told the Board that the court had given a 2 month continuance. The owner was not present at the court hearing. Only professionals can enter the house with BOH approval. NI showed the Board pictures that had been taken when she inspected the home with Town Counsel and the owner's attorney. There is another court date in March. The property will remain condemned. 7. Discussion and possible action on dogs in public parks JH explained that the Board of Selectmen had voted to appeal the court's decision and that the BOH had supported their decision. MC read a letter that had been received by the Selectmen and the Board of Health. She stated that she was reading this because it is cautionary and does signify that there is a problem at Drummer Boy Park. There were a few members of the audience that had comments to the Board of Health on their feelings about this issue. Chairman signed the bills to be paid. Informational items were noted. MC reminded the Board about the public meeting on the PAYT program on Monday, January 14, 2013. Meeting adjourned at 8:15PM If , '111 c,, � �
