HomeMy Public PortalAboutOrd. 1602ORDINANCE NO. 1602 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING ZONE CHANGE NO. 2008 -01; CHANGING THE ZONING DESIGNATION FROM P -1 (PARKING) TO C -2 (LIGHT COMMERCIAL) IN CONJUNCTION WITH A PROJECT PERMITTING THE DEVELOPMENT OF THREE (3) COMMERCIAL BUILDINGS ON PROPERTY LOCATED AT 3801 -3831 MARTIN LUTHER KING JR. BOULEVARD, FURTHER DESCRIBED AS ASSESSOR PARCEL NUMBERS 6190- 021 -016, 017, 019, 020, 021 & 022, CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA. WHEREAS, the Lynwood City Council, pursuant to law conducted a duly noticed public hearing on July 1, 2008; and WHEREAS, the Lynwood City Council considered all oral and written testimony offered at the public hearing; and WHEREAS, the Lynwood Planning Commission, pursuant to law, conducted a duly noticed public hearing on June 10, 2008 and has carefully considered all oral and written testimony offered at the public hearing regarding approval of the project to develop a 15,900 square foot project subject to Conditional Use Permit No. 2008 -05, Variance No. 2008 -02, Zone Change No. 2008 -01, Tentative Parcel Map No. 2008 -02 and Negative Declaration, and has determined that a C -2 (Light Commercial) zoning designation for the subject property would be consistent with the Lynwood General Plan and would be an appropriate zone for the location and development; and WHEREAS, on May 28, 2008 the Site Plan Review Committee recommended approval of the project to develop a 15,900 square foot project subject to Conditional Use Permit No. 2008 -05, Variance No. 2008 -02, Zone Change No. 2008 -01, Tentative Parcel Map No. 2008 -02 and Negative Declaration; and WHEREAS, the Development Services Department has determined that the project will not have significant impacts on the environment. An Initial Study was performed, conditions were incorporated, and a Negative Declaration was prepared pursuant to the California Environmental Quality Act (CEQA) guidelines. Section 1. The Lynwood City Council hereby finds and determines as follows: A. A C -2 (Light Commercial) zoning designation of the subject property would be consistent with the Lynwood General Plan Land Use Map. B. The C -2 (Light Commercial) zoning designation is consistent with existing developments in the vicinity. C. The C -2 (Light Commercial) zoning will be consistent with goals and policies set forth in the Lynwood General Plan Land Use, and Economic Development Elements. D. The C -2 (Light Commercial) zoning designation will not be detrimental to the properties surrounding the site and would not negatively impact the public health, safety, or welfare or properties in the vicinity. E. The Zoning Code, Chapter 25 of Lynwood Municipal Code does not allow commercial buildings in the P -1 zone and the C -2 zoning designation would be consistent with the other parcels and consistent with the General Plan. F. The Negative Declaration was noticed as required by California Environmental Quality Act (CEQA) Section 2. The Lynwood City Council based upon the aforementioned findings and determinations, hereby approves Zone Change No. 2008 -02 changing the zoning designation for 3801 -3831 Martin Luther King Jr. Boulevard (Assessor Parcel Numbers 6190 - 021 -016, 017, 019, 020, 021 & 022) from P -1 (Parking) to C -2 (Light Commercial). Section 3. The City Clerk is hereby directed to certify the passage and adoption of this Ordinance and cause it to be published or posted as required by Law. First read at a regular meeting of the City Council held on the 1St day of July, 2008, and adopted and ordered published at a regular meeting of said City Council on the 15th day of July, 2008.
