AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING
SECTION 7 -20.10 TO CHAPTER 7 OF THE LYNWOOD MUNICIPAL CODE
RELATING TO PARKING IN EXCESS OF SEVENTY -TWO (72) HOURS PROHIBITED
WHEREAS, the City Council acknowledges that such long -term parking by
vehicles for more than seventy -two (72) hours on public streets threatens the health,
safety and welfare of all of the residents of Lynwood; and,
WHEREAS, the City Council understands that vehicle ownership has doubled
within the past decade which has seriously affected on- street parking city -wide, creating
a shortage of the available parking for residents and nonresidents alike; and,
WHEREAS, the City Council desires to provide a mechanism for maintaining
vehicle turnover of vehicles parked on public streets to ensure fair usage and
availability; and,
WHEREAS, a definition concerning the section Parking in Excess of 72 Hours
Prohibited is needed to provide effective enforcement;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
ORDAIN, AS FOLLOWS:
SECTION 1. That Section 7 -20.10 of Chapter 7 to the Code of the City of Lynwood is
repealed and replaced which shall read as follows:
Section 7 -20.10
Parking in excess of Seventy -Two (72) Hours Prohibited
Parking in excess of 72 hours prohibited.
No person who owns or has possession, custody or control of any vehicle shall park
such vehicle upon any street or alley for more than a consecutive period of seventy -two
(72) hours.
Any regularly employed and salaried officer of City or the police department of this City
may remove or cause to be removed:
(a) Any vehicle that has been parked or left standing upon a street
or highway for seventy -two or more consecutive hours without
being moved.
(b) Moving the vehicle is defined as:
1) driving the vehicle at least 500 feet or one city block
per the odometer reading taken by the officer at the time
the vehicle is marked and / or chalked; or
2) driving the vehicle through or across a street
intersection before re- parking the vehicle within the same
block that it was previously parked.
SECTION 2. If any section, subsection, subdivision, paragraph, sentence, clause or
phrase of this ordinance or any part thereof is for any reason held to be invalid or
unconstitutional, such decision shall not affect the validity of the remaining portions of
this ordinance. The City Council hereby declares that it would have passed each
section, subsection, subdivision, paragraph, sentence, clause or phrase of this
ordinance irrespective of the fact that any one or more section, subsection, subdivision,
paragraph, sentence, clause or phrase be declared invalid or unconstitutional.
SECTION 3. This ordinance shall take effect thirty (30) days after its final passage by
the City Council.
SECTION 4. The City Clerk of the City of Lynwood is hereby directed to certify to the
passage and adoption of this Ordinance and to cause it to be published or posted as
required by law.
First read at a regular meeting of the City Council held on the 1 st day of May,
2007 and adopted and ordered published at a regular meeting of said Council held on
the 15th day of May, 2007.
