Reorganization of the Board JH explained to the Board that because she had set the agenda, she would chair this meeting and that the reorganization will take effect at the next meeting. JH nominated MC for chairman. LS seconded. 5 Yes. MC nominated JH for vice chairman. AS seconded. 5 Yes. LS-Comprehensive water planning AS-Alternate for Water Quality Review Committee JH-Water Quality Review Committee MC-Recycling Commission 2. CSN Engineering-variance request for 18 Linda Circle Linda Pinto was present as well as Stephen Jones, Attorney for the owner. This variance request stemmed from a real estate transfer. The inspection passed but the leaching is only 197 feet from the pond. LP stated that putting it any further away would be hard due to lot constraints. Groundwater is 48 feet down. Water does flow towards pond but it would have to go down 48 feet and then 200 feet over to the pond. Motion: AS-Approve variance. If the system should be replaced in the future, it will be replaced maximizing the distance from the pond. LS seconded. 5 yes. 3. Public hearing on Local Regulation to Supplement Title 5 State Environmental Code re: Monitoring& Reporting Requirement George Heufelder, Director of Barnstable County Health & Environment was present. He gave a brief summary of why this was being done. Variances can be added to this program. This program will be up and ready ASAP. NI questioned about "designer"vs. installer. NI also stated that installers quite often bring in Disposal Works Construction Permit's for minor repairs that do not require engineered plans. GH stated that the Board can make a policy that exempts them. Only new systems will be entered into database NI will send this to TC and then bring back to board for any changes. 4. J.M. O'Reilly- variance request for 38 Saint's Landing This was continued until the July 2, 2013 meeting. 5. J.M. O'Reilly-informal discussion on Morrelli's Taverna Matt Farrell of J.M. O'Reilly was present. The owner is hoping to add flow to system. Currently it is an 80 seat restaurant. There is a large septic system underneath the parking lot. The owner would like to bring the W W W.TOWN.BREW STER.MA.US BOH 6/4/13 Minutes Page 2 seating up to 100 without any additional work to the septic system. MF stated that the request is based on the water flow for the restaurant which is currently about 1000 gallons per day. The system is currently sized for 2800 GPD. They are looking to do this next winter. The owner wants to know if the Board would be willing to let the seats come in without adding to the septic system. It would be a 20 -25% reduction to the system. JH stated that when this restaurant was Ardeo, they had outdoor seating which pushed them over the 80 seats already. JH can't think of any time this was approved for another restaurant. 6. Marichal Landscaping-pool variance request for 165 Canoe Pond Drive Steve Senna, pool installer. Hardship is that they can't put it in any other location due to lot constraints. A membrane would be placed around the entire sas. Mr. Senna stated that Mashpee and Barnstable Health Department's have approved this before. JH-would feel more comfortable with input from Brian Dudley, DEP and talking to the Mashpee and Barnstable health departments. Motion: LS-approve variance with the stipulation that NI is satisfied with answers from DEP, Barnstable and Mashpee. MC seconded. 5 yes. 7. Discuss Drummer Boy Park John Dickson-There is no draft regulation as of yet. A motion was made at the Selectmen's meeting that dogs would be on a 10 foot leash, all people have to pick up after the dogs, fines would be $50, no dogs on the playground. This would be interim solution to the ongoing problem. MC-it is important to look at why the ban was put in to place in the first place. JH talked about the trash barrels. They need to be water safe. MC talked about the fencing for the playground so that owners know where the dogs have to stop. NI questioned whether or not this applied to the entire park. JD-yes. NI asked: doesn't that go against the purpose of the boards ban in the first place?JH stated that it was a compromise with mitigation. MC has a concern with the length of the leash. She would suggest a 5 foot leash for better control. JD will bring that back to the BOS for consideration. The BOS and BOH will meet again on July 8, 2013 for a joint executive session. MC asked to discuss the summer meeting schedule. July meetings will be on the 16th & 30th. August meeting will be on the 13th. September will be discussed at a later meeting.
