AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD AMENDING CHAPTER 11 BUILDING AND
HOUSING BY AMENDING SECTION 11 -1.1 (BUILDING CODE),
SECTION 11 -6.1 (ELECTRICAL CODE), SECTION 11 -9.1
(MECHANICAL CODE), SECTION 11 -10.1 (PLUMBING CODE),
OF THE LYNWOOD MUNICIPAL CODE BY ADOPTING BY
REFERENCE THE CALIFORNIA CODES OF REGULATIONS
WHEREAS, Section 17958 of the California Health and Safety Code. , requires the
local adoption of the latest model codes, which have been adopted at the State level, and
requires these regulations become effective six months after the State adoption; and
WHEREAS, the State adopted these codes on July 1, 2007 and the codes became
effective January 1, 2008; and
WHEREAS, these State mandated codes and related materials are used by the
Building Inspectors, Code Enforcement Officers, City Clerk, City Attorney, City
Prosecutor, Designers, Architects, Engineers, Developers, Contractors and the general
public; and
WHEREAS, incorporating the 2007 Edition of the California Building Standards
Codes will keep the City of Lynwood in compliance with State law; and
WHEREAS, the City's building regulations remain consistent with those of the
State, providing minimum standards to safeguard life or limb, health, property and public
welfare.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Chapter 11 Building and Housing, Section 11 -1.1 (Building Code),
Section 11 -1.1 (Adoption by Reference of the California Building Code), Section 11. 1.2
(Amendments to Building Code) and Section 11 -1.3 (Violations and Penalties) of the
Lynwood Municipal Code are hereby amended to read as follows:
11 -1.1 Adoption by Reference of the California Building Code.
Except as provided herein, the 2007 Edition of the State of California Building Code
(California Code of Regulations, Title 24, Part 2) based on the 2006 International
Building Code, including Appendix Chapter 1, Administration and Appendix I, Patio
Covers 2007 Edition, as promulgated and published by the International Code Council, is
hereby adopted by reference as though fully set forth herein, and shall constitute and is
hereby established as "the Building Code of the City of Lynwood" ( "Building Code"
herein). A copy of the 2007 Edition of the California Building Code has been deposited
in the Office of the City Clerk and shall at all times be maintained by the Lity Clerk for
use and examination by the public."
11 -1.2 Amendments to the Building Code
Section 11 -1.2 (a) Building Official is hereby amended to read as follows:
The term Building Official in Appendix Chapter 1 Section 103 shall be the Building and
Safety Manager of the City of Lynwood.
Section 11 -1.2 (b) Board of Appeals is hereby amended to read as follows:
The Board of Appeals in Appendix Chapter 1 Section 112.1 shall be the City Council of
the City of Lynwood.
Section Chapter 1 Section 112.3 is hereby deleted.
Section 11 -1.2 (d) is hereby deleted.
Section 11 -1.2 (e) is hereby amended to read as follows:
Appendix Chapter 1 Section 108.6 is hereby amended by adding the following:
All refunds of fees that are authorized by the Building Official are subject to final
approval by the City Manager.
Section 11 -1.2 (h) Adoption of Structural Amendments to the 2007 California Building
Code as published by the Los Angeles Regional Uniform Regional Code Program —
International Code Council — Los Angeles Basin Chapter is hereby added
The 2007 California Building Code is hereby amended by adopting the Structural
Amendments as published by the Los Angeles Regional Uniform Regional Code
Program — International Code Council — Los Angeles Basin Chapter published October
22, 2007 (Exhibit 1).
Section 11 -1.3 Violations and Penalties is hereby amended to read as follows:
Any person violating any of the provisions of the Building Code shall be deemed guilty
of a misdemeanor, and each such person shall be deemed guilty of a separate offense for
each and every day, or portion thereof, during which any violation of any provision of the
Building Code is committed, continued or permitted. Upon conviction, any such violation
shall be punishable as provided for in Chapter 1 of this Code.
SECTION 2. Chapter 11 Building and Housing, Section 11 -6.1 (Electrical
Code), (Adoption by Reference of the California Electrical Code) and Section 11 -6.4
(Amendments to Electrical Code) of the Lynwood Municipal Code are hereby amended
to read as follows:
11 -6.1 Adoption by Reference of the California Electrical Code.
Except as provided herein, the 2007 Edition of the State of California Electrical Code
(California Code of Regulations, Title 24, Part 3) based in the 2005 National Electrical
Code, including any amendments and annexes thereof, as promulgated and published by
the National Fire Protection Association, Inc., is hereby adopted by reference as though
fully set forth herein, and shall constitute and is hereby established as "the Electrical
Code of the City of Lynwood" ( "Electrical Code" herein). A copy of the 2007 Edition of
the California Electrical Code has been deposited in the Office of the City Clerk and shall
at all times be maintained by the City Clerk for use and examination by the public.
11 -6.4 Violations and Penalties.
Any person violating any of the provisions of the Electrical Code shall be deemed guilty
of a misdemeanor, and each such person shall be deemed guilty of a separate offense for
each and every day, or portion thereof, during which any violation of any provision of the
Electrical Code is committed, continued or permitted. Upon conviction, any such
violation shall be punishable as provided for in Chapter 1 of this Code.
SECTION 3. Chapter 11 Building and Housing, Section 11 -9.1 (Plumbing Code),
(Adoption by Reference of the California Plumbing Code) and Section 11 -9.4 (Violations
and Penalties) of the Lynwood Municipal Code are hereby amended to read as follows:
11 -9.1 Adoption by Reference of the California Plumbing Code.
Except as provided herein, the 2007 Edition of the State of California Plumbing Code
(California Code of Regulations, Title 24, Part 5) based in the 2006 Uniform Plumbing
Code, including any amendments and appendices thereof, as promulgated and published
by the International Association of Plumbing and Mechanical Officials, is hereby adopted
by reference as though fully set forth herein, and shall constitute and is hereby
established as "the Plumbing Code of the City of Lynwood" ( "Plumbing Code" herein).
A copy of the 2007 Edition of the California Plumbing Code has been deposited in the
Office of the City Clerk and shall at all times be maintained by the City Clerk for use and
examination by the public.
11 -9.4 Violations and Penalties.
Any person violating any of the provisions of the Electrical Code shall be deemed guilty
of a misdemeanor, and each such person shall be deemed guilty of a separate offense for
each and every day, or portion thereof, during which any violation of any provision of the
Electrical Code is committed, continued or permitted. Upon conviction, any such
violation shall be punishable as provided for in Chapter 1 of this Code.
SECTION 4. Chapter 11 Building and Housing, Section 11 -10.1 (Mechanical
Code) (Adoption by Reference of the California Mechanical Code) and Section 11 -10.4
(Violations and Penalties) of the Lynwood Municipal Code are hereby amended to read
as follows:
11.10.1 Adoption by Reference of the California Mechanical Code.
Except as provided herein, the 2007 Edition of the State of California Mechanical Code
(California Code of Regulations, Title 24, Part 4) based in the 2006 Uniform Mechanical
Code, including any amendments and appendices thereof, as promulgated and published
by the International Association of Plumbing and Mechanical Officials, is hereby adopted
by reference as though fully set forth herein, and shall constitute and is hereby
established as "the Mechanical Code of the City of Lynwood" ( "Mechanical Code"
herein). A copy of the 2007 Edition of the California Mechanical Code has been
deposited in the Office of the City Clerk and shall at all times be maintained by the City
Clerk for use and examination by the public.
11. 10.4 Violations and Penalties.
Any person violating any of the provisions of the Mechanical Code shall be deemed
guilty of a misdemeanor, and each such person shall be deemed guilty of a separate
offense for each and every day, or portion thereof, during which any violation of any
provision of the Mechanical Code is committed, continued or permitted. Upon
conviction, any such violation shall be punishable as provided for in Chapter 1 of this
Code.
SECTION 5. The adoption of this Ordinance shall fulfill the City of Lynwood's
obligation under Section 17958 of the Health and Safety Code to adopt and apply the
provisions of the California Building Standards Code to all occupancies within the City.
SECTION 6. This Ordinance shall take effect and be in force on the thirty -first
(31 st) day after its adoption.
SECTION 7: The City Clerk of the City of Lynwood is hereby directed to certify
to the passage and adoption of this Ordinance and to cause it to be published as required
by law.
First read at a regular meeting of the City Council held on the 4th day of March, 2008
and adopted and ordered published at a regular meeting of said Council held on the 15th
day of April, 2008.
