The Agenda Meeting of the Mayor and Council of the Borough of
Carteret preceding the Regular Meeting, May 18, 2000, was held
on May 11,2000,7:00 P.M., Municipal Court, Police Facility, 230
Roosevelt Avenue, Carteret, New Jersey.
The following were noted present:
Councilmember Crilley

Noted Absent was Mayor James A. Failace and Councilmembers
Fazekas and O'Brien and Borough Attorney Craig Coughlin.
Mailed to the Home News Tribune, The Star Ledger and posted on
the Bulletin Board on May 11, 2000.
Borough Engineer - Albert Beninato gave his report on Municipal
Projects. He said they received Bids for the Town Revitalization
Project on May 9th. The low bidder was Marvec Construction,
with a total bid of $336,800 and they are recommending the award
of bid to them. He then went on to applications for restricted
parking for use by a Handicapped Person in front of SGS Control
Services, Inc. located at 20 Lafayette Street and he feels may be
warranted following review and concurrence by the Police
Department and the Mayor and Council.
At approximately 7:07 p.m., Mayor Failace was noted present.
Al Beninato then went on to talk about Carteret Park Tennis and
Basketball Court hnprovements, that they have a revised
construction cost estimate which includes several alternatives for
improving the seven (7) courts in Carteret Park as requested by
Councilman Crilley. After completing further research the costs
will range from $67,500 to $107,000. He said Killam can provide
the engineering design services including preparation of the
contract bid documents and assistance during bidding for a lump
sum design fee of $4,500 and we will provide construction
administration and field inspection services during construction for
a reimbursable not to exceed budget of 10% of the estimated

construction cost for the alternative selected by the Borough. He
said for the Borough to please notify them on how they wish to
proceed. He then went to speak on Sewer Facilities & Pershing
Avenue Sewer Separation -Contract No. 00-02 - Bids were
received on this project on Tuesday, May 9, 2002. The lowest
bidder was Allstate Power Vac and their recommendation was to
award the contract to the lowest responsive bidder, Allstate Power
Vac.
At approximately 7:20 p.m., Councilmember Fazekas was noted
present.
Al Beninato then went to speak on Roads Projects, about the
Borough filed an application with the NJDOT for the Closure of
Portion of Cooke Avenue between Pershing Avenue and Blanchard
Street as part of the Town Center Revitalization Project and the
NJDOT has approved it verbally and will follow up with a written
approval in its "draft" form and the NJDOT has requested that the
Borough pass an ordinance authorizing this and upon reCf';pt of
this the NJDOT will issue a "final" approval confirmation. He then
went on to speak about hnprovements to Liebig Lane/Police &
Fire Parking Lots. They have investigated these and prepared a
preliminary budget estimate for improvements to and possible
configuration of the parking lot which may also include
incorporation of Liebig Lane into the parking lot. A letter was
attached for the Borough's review and for budgeting purposes.
Upon direction from the Borough their office can provide budgets
for preparing a conceptual plan coordination related to the possible
road closure and preparing contract documents and a more detailed
construction budget.
Mayor Failace said while the Engineer was still there he explained
that last night there was a Cap Meeting and he was not able to go.
He asked Nick to go and Councilmember Santoro went. He has
since talked to some of the companies, GA TX and Staflex. etc. in
reference to the alternatives to the New Jersey Turnpike and the
problems we have down there. He said he will meet with them
again, with some of the businesses and let them know step by step
exactly what they are doing. He said he will keep in touch with the
Turnpike every couple of weeks.
Councilmember Santoro said that the Businesses concern is that
they come from a very large association and they want to know
how to join and help. They even wanted to hire lawyers to fight
their case.
Mayor Failace said he wants to set up a meeting with the
Businesses and then with the Turnpike. He is waiting on a call
from Congressman Menendez, which he thinks is in reference to
the article about the Turnpike in the newspaper. He commented
that they keep missing each others call. He said he will do as much
as he can to keep this going.

John Riggio - Requesting amending Resolution #00-32,
Relocation of Bus Stop, Re: 'corner of Noe Street and Pershing
Avenue'. The Clerk said there is two (2) different wordings and
they have to change it and amend it to include. She said she will
fax it to the attorney.
Councilman Crilley - Resolution Authorizing Referendum, Re:
Open Space Tax. Okay to be put on for a Resolution.
Office on Aging - Personnel. This will be discussed in a Closed
Session.
Resolution #00-134, Tabled 4/24/00 - Re: Improvements to
Carteret Park. This will be put on for a Resolution.
Moylan vs. Borough of Carteret - Release. This will be discussed
in a Closed Session.
Welfare Department - Change of Name. The Clerk said they have
to do that in an ordinance. This was okay to be put on.
Police Records Clerk - Posting. This will be discussed in a Clos'ed
Session.
United Carteret Hebrew School - Cancellation of Parking Lot
Lease. The Clerk explained that there is a little piece of pnperty
by their parking lot that they leased to them for a dollar a year for
all those years and now they don't want it anymore and now we
will have to maintain it. He said the attorney will have to do a
resolution to break the lease. This was okay to be put on.
Mayor Failace said that was in his discussion with Mr. Thomas
from MCEOC in reference to Head Start. He said they are looking
at that because the Jewish Community Center has altered that
building for Head Start or for possibly something to do for Head
Start. He said when he met with Mr. Thomas about a week and
one half ago they came to an agreement on a few things that they
are looking for and he will discuss this with the Council. He said
they would like a couple of pieces of property in Chrome to build
homes on. They build them and pay the full taxes on it. They just
want the property from the Borough. They want some low interest
loans to possibly bring some minority businesses back to lower
Roosevelt Avenue. They talked about setting up some sort of
committee. He said it was a very good meeting.
Attorney Coughlin said if in fact they are interested and he thinks
they may be interested in having a piece of land next to it.
Mayor Failace said he thought so. He said to hold off on this
because he is having another meeting with them this week and he
will talk to them about it and get back to us.
PMK Group - Requesting additional appropriation, $1720.80.

The Clerk said this was a resolution from 66 and 70 Cooke
Avenue, Engineering Services for proposed renovation/conversion.
They decided to hold this.
Durek & Harth, Esqs. - Request for additional appropriation, Re:
Yolk vs. Borough. Attorney Coughlin said the residual amount that
fell in excess of the resolution because the bulk in now settled. He
said he had to check with Pat Ercolino for the amount that was
originally appropriated.
ABS Enterprises - Snack Machine. Councilmember Sohayda
spoke on a snack machine that has no expense out of our pocket. It
just gets plugged in the wall and they should get between $60.00
and $250.00 a month on snacks.
Mayor Failace asked if they could do that or do you need quotes.
Attorney Coughlin said it is always safer to do that.
BUSINESS TO BE ADDED:
Councilmember Fazekas said a while back he requested a
Technical Committee. The Governing Body agreed to it. He then
went on to say that he spoke with Comcast yesterday and they
should have Internet access by June.
Councilmember Santoro said she spoke with Potter today about the
Library and she asked for an updated Punch List. She also called
Tony Neibert and he wants outstanding issues for the Library. She
then asked about the outstanding invoice for $52,000.00 for the
Library.
Nick Goldsack said that IS part of the original contract, not a
change order.
Attorney Coughlin said he wanted to know what their basis is for
us to assume the obligation to pay it.
Nick Goldsack said they received a Premium Bill for the
Sportsman for the Little League and he found the correspondence
confusing.
Councilmember Crilley said if we assume a blanket policy to cover
the Leagues it will cost half as much.
Attorney Coughlin said our premium would be $14,000.00 and
their would be $19,000.00. He said Gartland explained to him that
we h .e to raise our levels significantly to match. They are now
covering three (3) entities with higher levels ofliability.
Councilmember Crilley asked the attorney if he could sit down
with Nick Goldsack and Mr. Gartland to review these two (2)

items. They want to have it settled by the end of June. He asked to
inform the leagues of what they will be doing and they will be
setting up a meeting with them.
Councilmember Santoro spoke on another invoice for payment for
$4000.00 for furniture for the Library. She doesn't have a
requisition and we don't know where to charge it back to. They
called about payment. Nick Goldsack will check on it.
Councilmember Santoro said there is two hundred (200) yards of
carpeting left in the Library and rather than remove that carpeting,
if the Borough is interested, at $7.50 per yard, half price, to take
the remaining amount of carpeting.
Mayor Failace said they have no use for it.
Councilmember Quinones asked Brian O'Connor from the Fire
Department, in the audience, if it were true that fire trucks keep
getting brought here from West Carteret, because she is getting
complaints.
Brian O'Connor said they do come over between 9:00 and back
before 3:00 for cleaning and First Aid Equipment has to be
replaced and also for training.
Councilmember Quinones spoke about the stop sign by St. Joes
that needs to be put back and it is on private property and no one
wants to take responsibility and she has had discussions back and
forth with the Police Directors and if we put sign up there then we
have to take responsibility for maintaining it. The Council hasn't
decided if they want to do that.
Mayor Failace said he thought we had to have a stop sign there.
Councilmember Crilley said it is private property. They are
opening a Pandora's Box. He thinks what we can do is shorten the
width of that driveway so that it is for passenger cars only and not
trucks.
Mayor Failace asked what Pandora's Box they opened up.
Attorney Coughlin said we should get the owners consent and
make sure the sign is approved because he is sure this was never
DOT approved. Then we should compel the property owner to take
steps to make sure no one steps across their property if it is
creating a problem.
Councilmember Quinones asked what else they could do.
Attorney Coughlin asked if they could block it off.
Councilmember Crilley suggested closing it. It would be an
inconvenience for some people but safety wise it would be the
best. He commented that no sign put up will stay there.

Attorney Coughlin said he would come up with some options for
them.
Councilmember Quinones said she had a request to hire Ottavia ,
who had been hired on a part time basis for the Building
Department, to be put on for full time because the office is
extraordinarily busy and they need extra held. She said she is in
support of that and she knows she is doing well.
Mayor Failace said that department certainly funds itself and more.
Coun"ilmember Santoro suggested to check with Patrick De Blasio
and see how it fits in the budget.
Councilmember Quinones asked if it is okay as far as the budget if
anyone would have a problem with it and everyone present agreed
it would be okay. She then went on to speak about the phone
system in the Building Department and that the phone system they
have at present does not support the phone calls at the volume they
have. She requested if it is not that expensive could they at least
consider putting the phone system in now for them.
Mayor Failace asked Councilmember Fazekas if they are putting
money in for the phone system.
Cour.,:Jmember Failace said he had talked to Cindy and Tony
about the phones. He said he has a meeting next week to come up
with the quotes and if it is relatively cheap, he will present the
figure and they can make a decision. He did mention that they will
be moving and then said he thought we should be coming up with
a timetable where we can start moving the people.
Mayor Failace said we should wait a little while to see if there is
any money coming from this........
Councilmember Santoro said she thought the major thing is if we
get shut down when people come in and inspect.
Mayor Failace said if in fact they do and we don't see any money
coming in they have to make a decision as to wh¡:ther we want to
go 01;' and bond and re-do this Borough Hall immediately because
he doesn't think we could wait any longer than a couple of months.
He said this town needs a good Borough Hall where everyone is
together.
Attorney Coughlin said in regard to the Drug and Alcohol Testing
Policy, to Paul Mercatanti with regard to that. Andy Casey had
some comments which he characterized as minor and relatively
straight forward and he anticipates having them next week and he
will run them by everybody and if no one has an objection on the
phone then he will put on the policy on for adoption for the next

meeting. He then went on to say that he was asked to look into the
key situation for the library and he said apparently what happened
was initially locks installed and then it was re-keyed and Avenel
Locksmith did that. They delivered the keys to Jeff Pino "ad he
turned them over to Arnold.
Councilmember Santoro said they have all the keys, it is the parts
on the doors that we are still missing.
Attorney Coughlin said he was sorry, that he thought it was the
keys and he would call them and say they have to come down here
and re-set the locks.
Mayor Failace said he met with the parents and the children in
reference to the Little League and Softball Game in Chrome Park
and the fight that broke out there. He said it was told there was a
gun somewhere and the police told us there was no gun and at the
meeting he was told no one saw a gun, someone had just said it. He
said Nick Goldsack and Chris Elg, the Police Director was with
him. He then commented that all last year they played down there
and had no problems. He said they are going to have an off duty
police officer with a car, down at the park and it would be good
and when they brought it to the police they said they wouldn't do it
as an off duty job, only with overtime. He said he thought that
stinks and that the Council and the citizens of Carteret should be
outraged by this. He said this is to make the children and their
parents feel more comfortable. He suggested sending the PBA a
letter telling them how we feel and it should be from the whole
Council. He said they will have to do this in some other way.
Councilmember Santoro asked the Mayor if he had heard from
Assemblyman Wisniewski about him going to Trenton on the
transfer.
Mayor Failace said they keep missing each others phone cans but
they will get in touch and we will find out what happened. He then
asked for a motion to go into a Closed Session for Personnel and
possible Litigation.
RESOLUTION #00-151 was introduced by the Mayor and referred
to the Council for action.
Upon MMS&C by Councilmembers Quinones and Sohayda
RESOLUTON #00-151
"RESOLUTION TO GO INTO CLOSED SESSION"
was Adopted. Upon individual roll call vote Councilmembers
Crilley, Fazekas, O'Brien, Quinones, Santoro and Sohayda voted
in the Affirmative. Councilmember O'Brien was noted Absent.

At approximately 8:25 p.m., this meeting was this meeting was
closed.
Upon MMS&C by Councilmembers Crilley and Fazekas and
unanimous affirmative vote of the five (5) Councilmembers
present this meeting was open to the public at approximately 9:50
P.M.
The Coverning Body discussed giving the Police and Fire off for
the parade.
Mayor Failace said if he checked with surrounding areas he asked
what they wanted to do.
Councilmember Fazekas said if they had surrounding areas doing
it they will do the same thing.
Councilmember Crilley said okay.
Councilmember Sohayda said he had to think about it and the
Mayor told him to call him at his job tomorrow.
Councilmember Santoro said no.
Upon MMS&C by Councilmembers Santoro and Sohayda and
unanimous affirmative vote of the five (5) Councilmembers
present, this meeting was adjourned at approximately 9:51 P.M.
