O'Reilly- 38 Saint's Landing-continued Title 5 and Local upgrade approval variance request Matt Farrell was present. The septic system is near a coastal bank and dune. It is currently a 3 bedroom home. The owners are proposing an addition and renovation. There are 2 variances requested: SAS to be 64' from dune; septic system to be 6'below grade. MF spoke about whether or not a variance is even needed to the dune. CC has approved the wetlands delineation. NI asked about reserve area, MF stated that it is on plan no*and will fit on the property. LS asked about number of rooms. 8 total with renovations. MF stated that CC has asked that he move the septic system closer to the dune and more into the driveway to try and save treks and that would make the SAS 68'from the dune. JH spore about her concern with the size of the system. MF stated that he could rework the plan and make it a 3 bedroom system. JH, what are you doing to mitigate the depth? MF-it will be vented. If reduced to 3 bedroom system it will lower the setback to the dune. JH would like to see town water go in. It is proposed on plan. ti Motion: JH-finding that they will connect to TW, that they have gotten the greatest distance they reasonable can from wetlands and are reducing the size of the dwelling to 3 bedrooms, approve the variances with the change to 68'from SAS to dune. ESA condition will apply. AS seconded. 5 yes. 2. East Cape Engineering-88 Seaway- local upgrade approval variance request Tim Brady was present. This is an upgrade due to a Real Estate Transfer Inspection. It is an existing 3 bedroom house with 2 cesspools. The new system will be H2O rated because it is under the driveway. The size of the lot is only a little over 5000sf. The following variances are being requested: 1. Allow septic tank to be 4 feet from property line Allow SAS to be 3 feet from property line a. Allow SAS to be 6 feet from the road property line 4. Allow septic tank to be 5 feet from a crawl space $. Allow SAS to be 3 feet from the crawl space Allow a 25% reduction in the required SAS area design requirement 7. Allow no reserve area Motion: LS-finding that there are severe lot restrictions limiting the area to put a septic system in, changing from cesspools to Title 5 will be an improvement. Approve the variances. PO seconded. 5 yes. 3. Coastal Engineering- 3634 Main Street- request for Real Estate Transfer exemption John Schnaible was present. MC-disclosed that she is a client of Coastal Engineering and has filed an Ethics Disclosure form with the Town Clerk, but feels there is no reason she cannot be impartial on this request. The client, Cape Cod Bible Alliance Church is asking for a release from the Real Estate Transfer regulation, W W W.TOWN.BRE WSTER.MA.US BOH 7/16/13 Minutes Page 2 with respect to having a septic inspection. They are purchasing a house behind their current lot, it is a single family home that the church will be demolishing and using as a parking lot when they rebuild the church. There is also an oil tank that needs to be removed. They were also ordered to put a cap on the existing system it the church and are asking if they can put that on hold until the rebuilding of the church has started.' NI stated that she wouldn't have a problem with that. Motion: JH-remove oil tank as required by our regulation. Grant a waiver of 1 year for the RETI. AS seconded. 5 yes. 4. Gabrielle Sakolsky, Cape Cod Mosquito Control-update for BOH GS gavel brief overview of what she does. She spoke about the EEE incident that happened here last year. Brewster is at a moderate level for EEE. She has not had enough mosquitos to even send for testing yet. She spoke about the letter to the Barnstable County Commissioners that supports the separation of the CCMCP from the) Commonwealth of Massachusetts. Motion: LS-sign letter of support. AS seconded. 5 yes. 5. 306 Blueberry Pond Drive-discuss discontinuing testing for Presby I/A System Homeo%ner was not present. MC stated that she believed that the homeowner was in compliance because the state no longer requires inspections. The Board discussed this issue and agreed that they would like to see one test done before they make any decision. Motion: JH-defer action on request until an inspection is done and then they can come back to request no more testing. LS seconded. 5 yes. 6. Oandleberry Inn-request to amend food service permit to allow serving to the public Dave Bennett was present representing Charlotte Fyfe, owner of the Candleberry Inn. She is looking for permission to host special events for the public on a limited basis. DB went over the letter he submitted to the Board, he believes that the capacity of the septic system is ok for what is being proposed. Owners have agreed to have monthly inspections while the events are happening. NI stated that the issues are the flow. JH- system is more than adequate for what is being requested, and would be ok to allow this. Motion: AS-approve her having the special events. During the summer season the septic system will be inspected in July, August and September and then again in December. If there are no issues, this can be revi$ited at the beginning of next year. PO seconded. 5 yes. 7. Sunbird (at Halycon Farm)-mobile food permit request Jamie Sparrow, owner of Sunbird Mobile Food is requesting a mobile food permit so that she can host 1 to 2 fi dinnerslper month at Halycon farm. She stated that she currently serves between 75 and 200 in Wellfleet when open so there shouldn't be any problem serving up to 65 people from her truck at these dinners. There is a refrigerator on the truck as well as a grey water system and hand washing facilities. Her base of operation is Karoo Restaurant in Eastham. JH read the Assistant's recommendation that all serving cooking and prepping food has to take place on the truck. Motion: JH-grant the Mobile Food permit for 1 year and then revisit the issue. Sunbird must comply with all of the Assistant's requirements. PO seconded. 5 yes. 8. The Brewster Store-Tobacco Regulation violation BOH 7/16/13 Minutes Page 3 This was in response to a sale of tobacco to a minor at the store. Mary Anne & George Boyd, owners, submitted a letter asking that the fine be waived. They spoke about the training they give their employees. Motion: JH-reject the request for the forgiveness of the fine. PO seconded. Assess them the $100 fine. S yes. 9. Brewster Village Marketplace-Tobacco Regulation violation This was in response to a sale of tobacco to a minor at the store. Kelly Daly, owner spoke about the training she gives. Motion: JH-assess them the $100 fine. PO seconded. 5 yes. 10. Perretti's Market-Tobacco Regulation violation This was in response to a sale of tobacco to a minor at the store. Motion: JH-assess them the $100 fine. PO seconded. 5 yes. 11. Brewster Main Street Realty, LLC-request to modify a violation correction letter for septic system #3 at Foster Square Julie Manchester, property manager, would like to get an extension of the request to repair the septic system until September so that they don't have to open the parking lot in the middle of summer. NI stated that the system is actually functioning fine and there have been no backups. JM stated that they will monitor the existing system on a weekly basis and pump the system as needed until the septic system is replaced. There were 2 Disposal Works Construction permit applications submitted to the Health Department. Motion: JH- grant extension. Septic system shall be put in by October 30th. Monitor and pump if necessary until that time. AS-seconded. 5 yes. 12. Dwight &Joanne Ritter-complaint at 2449 Main Street Will be beard at the July 30, 2013 meeting. 13. Jpdate on 40 Sean Circle Homeowner was not present. NI handed out a memo she prepared. She told the Board that she did go for an inspection of the property on July 9th, but could not go inside. Things were pretty much the same. There were no detectable odors. Pictures of the outside were taken. NI stated that the housing code is really a benefit for tenants. There are no children in the house, at this point it really is just how she chooses to live. Board should continue monitoring the outside. Motion: JH-have NI do quarterly outside inspections and report results back to board. PO seconded. 5 yes. 14. Discuss Planning Board application-Coridian Associates, LLC, 0 Harwich Road Noted. 15.
