Discussion on Information from Town Counsel re: Section 3.5 of the Regulation Regarding Variances Requests: The Boaif d had received a copy of Town Counsel's review. Nancy Ice summarized it for the Board. Ultimately, Section 3.5 can ble varied if that is what the Board decides on. Mary Chaffee recommended that the Board discuss potential changes in the regulation at a future meeting. 2. Continued BOH local variance hearing for 0 John Wings Lane: Motion: Reopen variance hearing on 0 John Wings Lane. Motion:Annie Sherwood Second: Pat Ottolini Vote: 5-0-0 Action: Motion carried Motion: Continue hearing so that abutters can be re-notified. Motion:Joanne Hughes Second: Annie Sherwood Vote: 5-0-0 Action: Motion carried Joanne Hughes asked about the application currently in front of the Board. This will be heard again at the October 15, 2013 meeting. 3. EAS Survey-Title 5 variance hearing for 111 Charles Street: The Health Director told the Board that this item had been removed from the agenda because more soil testing needs to be done ancii new plans need to be drawn up. This will be heard at the October 15,2013 meeting. 4. Nick Moonev-BOH local variance hearing for 75 Zona Drive The variance requested is as follows: 1. Allow the SAS to be approximately 164 feet from the pond Discussion: A septic system inspection was done and the system passed with the exception of the distance from SAS to pond. Jeanne Hughes asked about groundwater. Nancy Ice stated that there is a greater than 5 foot separation from the system to groundwater. W W W.TOWN.BREWSTER.MA.US Motion: Findin g that there is more than adequate distance to groundwater, it is a relatively new system, it is a real estate transfer,no increase in flow, not economically feasible to move the system nor would there be any real benefit in moving it; approvie the variance request to allow the SAS to be 164 feet from the pond. Joel l.,amb-request to be allowed to keep existing septic system for unpermitted renovations: Mr. Lam)is appealing the Health Director's decision that this is a 2 bedroom home. Mr.Lam told the Board that he is selling his home and had previously finished his basement without permits and is now being re y wired to get all the appropriate permits. Mr. Lamb said the septic system was installed in 1987 and was designed for 329.7'gpd. He would like the Board to allow him to use this system for a 3 bedroom home which would require 330gpd. he Board did a room count and found that there were 8 rooms total,which would make this a 4 bedroom home. The Heal h Director did state that all that is required for the sale is to have a septic inspection done. If the owners want to keep the inished basement the leaching would need to be upgraded. The upgrade does not have to be done prior to the sale;the ew owners could have the upgrade done. 6. Discu sion on Town Counsel recommendations for changes to the draft Recycling Center Regulations: The Chai stated that she had received recommendations from Town Counsel,Bob Bersin, DPW Superintendent, and Meg Morris, hairman of the Recycling Commission. She will take and incorporate the changes if the Board would like. Joanne ughes stated that she felt comfortable with just making the changes that TC recommended. It could come back to the Board to be looked at again, and if the Board feels that the other recommendations should be incorporated, changes could be made. There wire a few sections that needed clarification from TC before revising the regulation. Motion: Accept Town Counsel's recommendations with the exception of the 2 sections that need clarification. Motion: Joanne Hughes Second: Annie Sherwood Vote: 5-0-0 Action: Motion carried 7.Discussion on BOH minutes format: The Char indicated she would like to see improvements in the Board's minutes. She handed out samples from Provinceown BOH and Barnstable BOH. The Chair proposed options for changing the minute's process. It was then decided that for now,the Chair would receive the minutes to review prior to distribution to all Board members. Members will thenl be able to make recommendations for edits during meetings when the minutes are approved. 8. Discussion on the draft Health Regulation relating to fertilizers: Nancy Ice explained these are model regulations developed by the Cape Cod Commission. She mentioned that it would be difficult to enforce this proposed regulation. There was discussion but no vote was taken. 9. Disci ssion on the inspection report for 306 Blueberry Pond Drive: The systm at this property is a Presby I/A system that was required to be tested when it was put in. DEP has stated that no more Testing is required. The Board never received any inspection for this property and had asked that at least one be one don before they approved no more inspections. The homeowner did have it inspected and submitted a copy to the Board. Motion: No more inspections will be required. Item,the Chair Did Not Anticipate: a. The Chair stated the PAYT opening ceremony will take place at the Recycling Center at 7:45AM on October 3, 2013. PAYT officially starts at 8:00AM. B.Nancy Ice discussed the flu clinic registration. The clinic will be held on October 16,2013 from 10 AM-noon at Our Lady of the Cape Church. Residents can register for the clinic online at the Cape Cod Medical Reserve ( orps website or go to the Town of Brewster website and follow the link.
