Board Members present: Mary Chaffee, RN,PhD,Chairman;Joanne Hughes, Vice Chairman,Lemuel Skidmore,MS,MPH:Annie Sherwood(RN;Pat Ottolini,RN,MPA,CHA Call to order: Chairman called the meeting to order at 7:00pm. Others present: Nancy Ellis Ice,MPH, CHO,RS,Health Director; Tammi Mason, Senior Department Assistant; 1 1. Piublic hearing and possible vote on the proposed Recycling Center Regulation Mary Chaffee gave a brief background on this, stating that the Board has been working on this regulation for about 8 months. The draft regulation that is being proposed tonight has been looked over by town counsel, members of the Recycling Committee. Mary Chaffee asked if there were any public comments. There were none. There were some minor edits to the draft regulation. Motion: Approve the Recycling Center Regulation as corrected tonight. Motion: . H Second: AS Vote: 5-0-0 Action: Motion carried 2. Discussion on age change for Restricting the Sale and Use of Tobacco Products&Nicotine Delivery Nancy Icea stated that she would like to change the age to purchase tobacco products from 18 to 21. The proposed change was not coming from the Cape Cod Regional Tobacco Control Program(CCRTCP)or the Massachusetts Tobacco Control Program. It stemmed from 2 doctors that are promoting the change. Nancy Ice did say that she had not been contacted by the doctors. Bob Colette,Director of the CCRTCP spoke about this topic and told the Board that across Massachusetts,there are about 12 towns that have adopted this change. Because it is a relatively new change,there is no evidence that the change is working at this time. DJ Wilson,Tobacco Control Director of the Mass Municipal Association also spoke a bit about the potential change. Annie Sh rwood asked about community push back and asked about any feedback that has been received. There hasn't been any that anyone w s aware of. Lemuel Skidmore spoke about his hesitation on going along with this. Joanne Hughes spoke about Brewster becoming a different community in the summer and people not knowing about the change. The steps that would need to be taken are: review by Town Counsel,public hearing,and then a vote by the Board. The majority of board is in favor of changing the age. 3. Iarry Dino Viprino-Resilient Family Farms-local variance request(Animal Regulations) Barry Viprino is asking for a variance to keep a pen for his pigs,cows and chickens. There will be a barn on the property but that is only for storing of animal feed and is not in an area where he would need to request a variance. There are currently pigs and rabbits on the property. He would like cows in the future. He could put them further from the wetland but the Conservation Commission has asked him not to move the trees and that is why he needs the variance for the pens.The wetland has not been delineated yet so Mr. Viprino has no exact number for how far away the pens are. Mr.Viprino stated that he had sent out certified letters but did not bring the green card receipts with him tonight. Mary Chaffee asked if Mr.Viprino was the legal owner of the property. He stated that he is currently in a lease with the owner to buy it from him. There was a lengthy discussion on how many animals would be on the property and where they would all go. Nancy Ice asked what animals were on the property now because he has not been issued a permit yet. He stated that he currently had rabbits and pigs. Mary Chaffee would like to know where the wetland is because the area that is being proposed for all this is really small in comparison to the amount of animals. Mr.Viprino said that the wetlands should be delineated within the next few months. The Board was trying to determine what to do about the pigs that are currently on the property without a permit and asked if they could go to another farm or back to where they came from. Mr.Viprino stated that due to specific laws about animal health,the only option he has now would be to send them to market. It was asked if Mr. Viprino would need any other permits from other Boards in town. He stated that he was told he was exempt due to his agricultural status. Don Arthur,Historic District Committee, explained to Mr.Viprino that any temporary or permanent structure has to go before HDC for permits. Jason Klump,Planning Board member, stated that this is an agricultural use and is exempt from regulations. Joanne Hughes told Mr. Viprino that he should double check with HDC and Building department to make sure that he doesn't need any other permits. Mr. Viprino will get in touch with the health director and figure out when to get on agenda again. 4. Discussion of the role of the BOH at an Emergency Dispensing Site Nancy Ice gave a brief overview of the Board of Health's role if there is any emergency. The role can vary depending on what the incident is There was talk about the alert that would go out if they were needed. 5. Discussion and possible vote on the revised Regulation Regarding Variance Requests This was postponed until the December 17,2013 meeting. 6. Discussion on the Zoning Board of Appeals application for White Rock Partner LLC at South Orleans Road Nancy Ice stated that she did not believe that anything on the list pertains to the BOH. The Board agreed that they would like pervious material to be used for the driveways and that there be no increase in landscaping. Informational items were noted by the board.
