HomeMy Public PortalAboutOrd. 1584ORDINANCE NO. 1584 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ADDING SUBSECTIONS 2 -12.2 THROUGH 2 -12.6 TO THE LYNWOOD MUNICIPAL CODE ESTABLISHING UNIFORM POLICIES AND PROCEDURES FOR APPOINTMENT AND SERVICE ON CITY COMMISSIONS, BOARDS, AND COMMITTEES WHEREAS, it is essential to any public agency to establish standards and procedures to define roles and responsibilities of the governing board, staff, and citizens in operation of the organization; and WHEREAS, City Council is desirous of encouraging citizens from the community to participate in and serve on City standing advisory Commissions, Boards, and Committees (the "Subsidiary Public Bodies "); and WHEREAS, establishing a uniform policy and procedure for appointment to and service on Subsidiary Public Bodies will promote understanding concerning expectations for operation of the City. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD HEREBY DOES ORDAIN AS FOLLOWS: Section 1. That new Subsections 2 -12.2 through 2 -12.6 of Chapter 2 be added to the Lynwood Municipal Code which Subsections shall read as follows: 2 -12.2 "Subsidiary Public Bodies" shall mean City standing advisory Commissions, Boards, and Committees and such other Commissions, Boards and Committees as are established elsewhere in the Lynwood Municipal Code. "Subsidiary Public Bodies" do not include City commissions, boards or committees with memberships consisting solely of members of the City Council, City staff or a combination of City Council members and City staff. 2 -12.3 Membership of Subsidiary Public Bodies. Candidates for appointment to Subsidiary Public Bodies shall be nominated by a Council Member and confirmed by a vote of the Council. The appointed and confirmed candidates shall serve on the Subsidiary Public Bodies to which they have been appointed until the earlier of: 1. A replacement is presented to the Council for confirmation by the appointing Council Member; 2. The appointing Council Member's term in office has ended; or 3. The resignation of an appointee. b. Members of Subsidiary Public Bodies shall hold office until their successors are appointed, qualified and take office. C. Any and all provisions of the Lynwood Municipal Code relating to terms of office for members of Subsidiary Public Bodies are hereby repealed and shall be governed by the provisions of this Ordinance. 2 -12.5 Additional Membership. In the event any Subsidiary Public Body is to have more than five members, the City Council may, by resolution or motion, designate how many additional members are to be nominated. Any such additional members shall be subject to a confinnation vote by the Council, and their terms of office shall be in accordance with the provisions set in Section 2 -12.4, above. 2 -12.6 Inconsistencies. Except as otherwise provided for herein, the provisions of this Ordinance shall take precedence over and supersede any inconsistent provisions of the Lynwood Municipal Code relating to Subsidiary Public Bodies. Section 2. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance or any part thereof is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase be declared invalid or unconstitutional. Section 3. This Ordinance shall take effect thirty (30) days after its final passage by the City Council. Section 4. The City Clerk of the City of Lynwood is hereby directed to certify to the passage and adoption of this Ordinance and to cause it to be published or posted as required by law. First read at a regular meeting of the City Council held on the 20t1i day of June, 2006 and adopted and ordered published at a regular meeting of said Council held on the 5t" day of July, 2006.
