HomeMy Public PortalAboutOrd. 1546AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING SECTION 11 -3.4 OF THE LYNWOOD MUNICIPAL CODE BY REQUIRING COLOR REVIEW IN ALL RESIDENTIAL ZONING DESIGNATIONS FOR SECOND STORY ADDITIONS AND NEW RESIDENTIAL DWELLING UNITS. WHEREAS, the City Council has determined that color review of structures is necessary to enhance the City's reputation for attractive developments that protect property values and the general welfare of the community; and WHEREAS, the City Council has determined that color review shall apply in all zoning designations and shall apply to new structures and structures where additions are built; and WHEREAS, the City Council has determined that color review will require colors that are harmonious and aesthetically pleasing; and WHEREAS, the City Council has determined that color review is necessary to preserve harmony and is essential when existing structures are repainted, colors used are within a range that will not destroy or adversely affect the City's aesthetic goals. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Subsection 11 -3.4 of the Lynwood Municipal Code entitled "Color Review" is hereby amended to read as follows: 11 -3.4 Color Review: Residential Zones a. No person shall paint or otherwise color the exterior of any residentially zoned property for a second story addition or a new residential dwelling unit without first obtaining a permit from the Development Services Department, Planning Division. Commercial and Manufacturing Zoning Districts b. No person shall paint or otherwise color the exterior of any building or structure in a commercial or manufacturing zoning district along Long Beach Boulevard, Atlantic Avenue, Martin Luther King Jr. Boulevard, State Street, Abbott Road, Bullis Road, Wright Road, Alameda Street, Lynwood Road or Imperial Highway without first obtaining a permit from the Development Services Department, Planning Division; C. An application for such a permit shall be submitted to the Development Services Department, Planning Division, on a form provided; d. The permit shall be granted if the Development Services Department, Planning Division finds that the color or colors for the project are within a range of colors that has been approved by the City Council. The City Council, in approving a color range, shall eliminate only such colors as would be injurious to and adversely affect the aesthetic goals for the designated areas; e. Any person who is denied a permit may appeal to the Planning Commission by filing a notice thereof within fifteen (15) days after receiving notice of the Development Services Department, Planning Division decision. The Development Services Department, Planning Division shall schedule the matter before the Planning Commission at the next available meeting after receiving notice of the appeal. The decision of the Planning Commission shall be final. f. The fee for the permit shall be designed by resolution of the City Council. g. Standards to paint a new building, addition or re -paint an existing building shall be as follows: 1) The primary color of buildings shall be limited to an earthen hue background color, which is integral or applied consistently to the material. Colors include off- whites, light- grays, beiges, tans, browns or other similar subdued tones, shades or colors to include colors on approved City of Lynwood color charts. 2) Special architectural features and trim may use brighter colors an as accent. Colors shall complement the body color of the building, as well as highlight decorative details (e.g. trims, ornaments, fascias, inlays, tile, ironwork, awnings and other architectural features), as determined by the Development Services Department, Planning Division. 3) Other elements on the building and property should be compatible and /or architecturally integrated with the color and design scheme of the primary building (e.g. roofs, fences and walls, signs, trash enclosures) and any other accessory structures or features. g. Nonconforming colors shall be permitted to remain unless one of the following occurs 1) A new residence or commercial /industrial structure is developed; or 2) A second story residential addition or usable floor area in commercial or manufacturing zones is constructed; or h. Prohibited colors shall include but not be limited to: 1) Florescent colors; or 2) Bright colors (i.e. red, yellow, orange, pink, purple); or 3) An excessive combination and /or amount of colors; 4) Colors inconsistent with surrounding areas; or 5) Colors that may reduce property values or negatively impact properties in vicinity as determined by the Development Services Department, Planning Division, or the Planning Commission. Exemptions: 1) Any existing structure previously painted prior to the adoption of this ordinance.
