AT THE COMMUNITY CENTER PRESENT: Members; Dan Garren, Lance Ellis, Roy Hobbs, Mike Taylor, Robert Geray, Clerk Robyn Keyes. VISITORS: Sally Price, Tate Carter, McCarty Carter PZ member Garren welcomed everyone and PZ member Geray led the Pledge of Allegiance. Minutes. The minutes were reviewed. PZ member Ellis made a motion to approve the minutes. PZ member Taylor seconded the motion. Minutes approved. Impact Area. The Planning and Zoning Commission held a discussion about the positive and negative implications of expanding the impact area to the east and north. The commission decided to table the issue to gather more information regarding the event a development occurred in the impact areas and how it would affect the City and the utility system. Chairman Garren will draft a letter for the county proposing to extend the impact zone to the intersection of Lincoln Rd. and Bone Rd. to the east; straight north from that point to Highway 26; follow Highway 26 west to meet with the existing western boundary. The boundaries to the west and south would not change from the existing points. Chairman Garren also asked Clerk Keyes for a copy of the existing impact area agreement with the County. Chairman Garren said he would draft the letter for the next Planning and Zoning meeting to review by the other Commission members. Compliance with County Agreement and Zoning. Commission member Hobbs said he met with Steve Serr at Bonneville County Planning and Zoning, and according to Mr. Serr, the City was not compliant with the County agreement regarding zoning and ordinances. Hobbs said Mr. Serr showed him a website that listed state, county, and city zoning and ordinances, according to Mr. Serr the City of Iona did not comply with the state and county agreement, was discriminating with its zoning laws, and had unclear definitions with zoning. PZ member Ellis asked if by discrimination he meant civil rights discrimination. PZ member Hobbs said in some areas, yes. According to Mr. Serr the City could not "police" the developments, the developer was the"policeman" PZ member Taylor asked PZ member Hobbs to give an example of what Mr. Serr was referring to. PZ member Hobbs said the City could not say what type of home went in a development, the City could only put descriptions on zone. PZ member Garren said the City did put descriptions in the zoning. toN 1 PZ member Hobbs said according to Mr. Serr the City could not use 1/3 acre as a description, it instead must be square footage, and by using the description of 1/3 acre it created a density problem with zoning. Chairman Garren said the lots were described by square footage in the Code Book. PZ member Hobbs said the information on the website that Mr. Serr showed him used acreage as measurement, so the City needed to align its language with the County's. Hobbs said the density issue was; the R1 and R2 zones had the same lot width, and according to Mr. Serr they should not be the same because R2 was high density. PZ member Hobbs said the City needed to look at the County's verbiage and align its verbiage to match the County's. Clerk Keyes said she couldn't imagine everything mentioned my Mr. Serr was actually wrong because all items in the Code Book had gone through the City Attorney. PZ member Hobbs said regarding the impact area, the County looked at the City's zoning ordinances and tried to stay as close to the City's ordinances as possible. Chairman Garren said he thought one of the reasons the City wanted to expand the impact area was because the City was more restrictive than the County, and if the impact area were to grow, the City would want that growth to reflect the City's values. PZ member Hobbs said the County was aware the City wanted to increase the impact area, but according to Mr. Serr, the County was concerned with increased water capacity, sewer issues, and windmill issues. Chairman Garren asked Clerk Keyes to contact the City Attorney regarding Mr. Serr's remarks about the City being discriminatory. Clerk Keyes said she would contact talk with the Attorney. Windmill Use in Impact Area. PZ member Hobbs said he had gathered information regarding the windmills on the hill. Hobbs said there were more projected to go in that were encroaching closer to our impact area. Hobbs said there were not long-term studies available to accurately say how the windmills would impact the local area, but he was concerned with potential development in the area near the windmills. PZ member Geray said the windmills would need to be taken into consideration if the City increased the impact zone, and it comes down to merits and disadvantages of increasing the buffer zone. The Commission members decided to table the windmill discussion until the impact area agreement was decided upon. Planning and Zoning member Ellis made a motion to adjourn, PZ member Taylor seconded.
