Grench, General Manager SUBJECT: Possible Acceptance of Open Space Easement At the time of the scheduling of this Special Meeting, nego- tiations are concurrently underway on a 20 acre piece of property which may bring to the District a donation of its first scenic easement. The following report is based on the assumption that negotiations will be successful. Introduction: The Basic Policy of the Midpeninsula Regional Park District lists techniques wherein the District might preserve open space other than by acquisition of fee interest. A scenic easement is one such mechanism. It is also the policy of the District to consider acquisitions outside of District boundaries under exceptional circumstances. An opportunity which appears to fit these principles has arisen within the last few days. Discussion: The District is being offered an opportunity to accept as a donation a scenic easement covering 20 acres of land (see map) off of Summit Road somewhat outside the District and near Mt. Madonna County Park. Such as easement will protect the scenic attractiveness of the area and will be the first easement of this type acquired by the District. The property is located approximately one mile northwest of the watershed of a tributary of Little Arthur Creek. The site is densely wooded, primarily with Douglas Fir and slopes steeply from a ridgetop to the canyon bottom. Due to its remoteness and undisturbed character it undoubtedly affords a pristine wildlife habitat. Originally the entire 20 acre parcel was offered to Santa Clara County as a donation, but as taxes on the property had been delinquent for five years , it was necessary for the County to accept the property by June 30 , 1975 , which is the final date before the property would revert to the State of California. It is our understanding that it was not possible for the County M-75-93 Page two to act this quickly and consequently the property was offered to the District as a donation. However, because the property is outside the District boundaries and back taxes totalling around $750 were due, it would not appear to be in the best interests of the District to acquire the property, due to the expenses involved, e.g. , back taxes, land management costs, etc. The District' s goals, however, would be served by the accept- ance of a scenic easement which would protect the natural state of the property in perpetuity. L Recommendation: The owner has agreed to donate a scenic ease- ment covering the property to the District, and, inasmuch as there is no cost to the District in this instance and the goals and objectives of the District would be fulfilled by the creation of a scenic easement, it is my recommendation that the Board of Directors adopt a resolution authorizing the acceptance of a scenic easement. RESOLUTION OF THE BOARD OF DIRECTORS OF THE MIDPENINSULA REGIONAL PARK DISTRICT ACCEPTING GIFT OF SCENIC EASEMENT AUTHORIZING PRESIDENT TO EXECUTE CERTIF- ICATE OF ACCEPTANCE WITH RESPECT THERETO The Board of Directors of the Midpeninsula Regional Park District does resolve as follows: The Board of Directors of the Midpeninsula Regional Park District does hereby accept, with gratitude, the gift of a scenic easement covering real property described on Exhibit A, affixed hereto and by this reference made a part hereof, and conveyed by that certain scenic easement deed from Merrill E. LaPoint and Dorothy J. LaPoint to the Mid- peninsula Regional Park District dated June 30, 1975. The President of the Board is authorized to execute a certificate of acceptance with respect thereto. Exhibit A DESCRIPTION All that certain parcel of land situate in the County of Santa Clara, State of California, described as follows: The East 1/2 of the Southwest 1/4 of the North- east 1/4 of Section 27 Township 10 South, Range 2 East, M.D.B. and M. Grench, General Manager SUBJECT: Assembly Bill 1164 and Other Legislation As I have previously advised you, AB 1164 , which Assembly- man Calvo has sponsored in behalf of the Midpeninsula Reg- ional Park District, has passed the Assembly and is now on the Senate floor. According to a press release (attached) from the East Bay Regional Park District, that District is in opposition to the legislation. Since it is urgent that we get support from EBRPD as soon as possible, if they will change their minds, this matter is being placed on the Special Meeting agenda for June 30 , 1975. At the same time, the procedures between the regional park districts (especially between EBRPD and MRPD) for review and possible support of legislation sponsored by a given district should be discussed. HG: jg 4 i EAST BAY REGIONAL PARK DISTRICT 11500 skyline Boulevard, Oakland 94619 (Grace Lewis--531-9300) Objection to legislation which would alter the state- code governing operation of the East Bay Regional Park District will go to Sacramento from the EBRPD Board of Directors. The bill (AB 1164) is being preacAted by Assemblyman Victor Calvo (D., Mountain View) at the instigation of the recently-formed Midpeninsula Regional Park District of Los Gatos. Essentially, the bill recommends that the Public Resources Code, which now reads "regional park district," be altered to "regional park and regional park open space district," so that the special districts authorized under this code could call themselves by any of these designations and, rather than repeat these words throughout the text, the word "district" only would be used. Director Fred Blumberg of Lafayette, chairman of the Board's Legislative Committee, expressed`concern for any change, technical or otherwise, in our enabling status." The two-county EBRPD, organized in 1934, was the only park district in California operating under this code until recent formation of other park districts, including Midpeninsula, Merin County and -he Monterey Peninsula. Board members voting in opposition to the measure were Blumberg, Paul J. Badger of Pinole, William F. Jardin of San Leandro and Clyde R. Woolridge of Oakland. John J. Leavitt of Alameda and President Dr. Howard L. Cogswell of Hayward abstained, and Mary Lee Jefferds of Berkeley voted in favor of the change. Among other measures affecting the District and parks, recreation and the environment in general--now at various stages in the legislative process in Sacrament--on which the Board took foi al action were: A The "pop-top" law (AB 1037-Assemblyman Edwin L. Z'berg, D., Sacramento) outlawing the sale of pop- top beverage containers in California.. Unanimous indoursement, on the basis that this restriction will help eliminate the litter problem throughout EBRPD's 28-park system. 0 A "state and urban park bond act" (AB 1722-Z`berg) financing a pro- gram of "acquiring, developing and restoring real property for state ard local park, beach, recreational and historical resources preservation purposes." I Unanimous. 0 A "vehicular recreational facilities" bill (SB 989-Senator John A. Nejedly, R., Walnut Creek) permitting the East Bay Regional Park District, speci- fically, to "develop, improve and maintain vehicular recreation areas and trails." MORE-- r PAGE TWO. . ..Legislation 0 A "hostel and trails" bill (SB 969-Senator Randolph Collier, D., Roseville) transferring annually $10,000,000 from the Abandoned Vehicle Trust Fund to a State and Local Trails Account for hostel facilities and recreational trails. Unanimous. 0 A "recreation fund" bill (AB 997-Z°berg) creating the California Local Government Recreation Fund, administered by the Director of Parks and Recreation, to provide funds for acquisition and/or development of recreational lands and facilities to cities, counties, recreation and park districts and regional park dis- tricts. Unanimous. An "environmental authority" bill (SB 1006-Senator James R. Mills, D., Chula Vista) creating a California Environmental Authority to administer financial assistance "to public agency and private entity environmental improvement activities." Five "ayes," with Directors Jefferds and Badger dissenting on the basis of lack of time to study the provisions. 0 A "public beach" bill (AB 1604-Assemblyman Robert H. Burke, R., Huntington Beach) providing state financial assistance for beach-related services.
