P.M. AT THE COMMUNITY CENTER PUBLIC HEARING: AMENDMENT TO R-T
ZONE
PRESENT: Chairman Dan Garren; members Roy Hobbs, Mike Taylor, Rob Geray, and
Clerk Robyn Keyes.
VISITORS: Bette Lovinus, Greg Hansen, Gerry Kirkpatrick
PZ member Garren welcomed everyone, and PZ member Hobbs led the Pledge of
Allegiance.
Clerk Keyes reported that PZ member Lance Ellis had resigned from the commission and
Bette Lovinus was visiting to gather information regarding joining the PZ commission.
Minutes. The minutes were reviewed. PZ member Taylor made a motion to approve the
minutes. PZ member Hobbs seconded the motion. Minutes approved
Impact Area Letter. PZ chairman Garren said he was still working on the letter for the
County regarding the impact area increase. The Planning and Zoning Commission held a
discussion about the positive and negative implications of expanding the impact area to
the east and north. The issue was tabled until next month.
Public Hearing Amendment to R-T Zone. A public hearing was held to consider
amending the R-T zone to allow single family dwellings. After holding the hearing the
Commission recommended to the Council to amend the R-T zone to allow single family
dwellings provided they meet the R-T zoning requirements. See appendix A for hearing
minutes.
Previous Action Items. Clerk Keyes said the Mayor recommended continuing to table
the daycare ordinance changes for awhile longer.
Reports. PZ member Geray said after looking at Title 11 in the Code Book, the
establishments of districts needed to be redefined as well as the current zoning map.
Additionally, the scope and definitions of the districts needed to be looked at for accuracy
or modifications.
The Commission members agreed to add Title 11 review to next month's agenda.
PZ member Taylor made a motion to adjourn. PZ member Geray seconded the motion.
All were in favor.

APPENDIX A
PUBLIC HEARING 7:00 P.M. R-T ZONE AMENDMENT
PRESENT: Chairman Dan Garren, Members; Roy Hobbs, Robert Geray, Mike Taylor,
and Clerk Robyn Keyes.
VISITORS: Bette Lovinus, Greg Hansen, Gerry Kirkpatrick
Chairman Garren welcomed everyone, went over the procedure for the public hearing,
and turned the time over to Greg Hansen from Rockwell Development.
Mr. Hansen gave everyone a map showing where the R-T zone was within Mountain
Ridge Estates. Mr. Hansen explained that the economy had caused building to slow down
in Mountain Ridge Estates while building had increased in other Rockwell developments
in the area. Mr. Hansen said the sales of attached twin town homes had nearly ceased.
Mr. Hansen said he had two solutions that would help increase the sales of the empty lots
in the R-T zone. The first solution was to allow single family homes within the R-T zone,
since they were in more of a demand. The second solution was to allow twin patio homes
to be built in the R-T zone as well. Mr. Hansen said Rockwell had a development in the
Pocatello area that was set up like town homes, but instead of building two homes that
were attached with a common wall; they were separating the homes with a six foot side
easement for each home, which would give a total separation between homes of 12 feet.
Mr. Hansen said the lot size was the same as that for a town home and the cost was the
same as a town home, but much lower than a single family home, which made it
affordable for many more people. Mr. Hansen said Rockwell had already approached
other cities in the area regarding the idea of two patio homes on a lot instead of a two
town homes, and the other cities were in favor of the idea. Mr. Hansen said some of the
other cities were making amendments to the R-T, or R-2 zones to allow two patio homes.
Mr. Hansen said the R-T zone in Mountain Ridge already had the infrastructure in place
for each lot to have two homes. Mr. Hansen said for the sake of selling the remaining lots
Rockwell was proposing to allow two single family dwellings on the two lots adjacent to
the R-1 zone on Sagebrush, build two patio homes per lot instead of two town homes in
the cul-de-sac lots on Sagebrush, and leave the remaining lots on Quaky Aspen as town
homes. Mr. Hansen said town homes were appealing to single people and older people
who's children were grown and not living at home, where as patio homes were appealing
to young couples with children who were looking for an affordable first home. Mr.
Hansen said the sale of twin patio homes was going very well in their other
developments.
PZ member Hobbs asked what the square footage was for the patio homes. Mr. Hansen
said they were generally 1,100 to 1,400 square feet, and because of the floor plan they
were very appealing to many people.
PZ member Taylor asked why the patio homes were so a popular. Mr. Hansen said the
patio homes were more popular because they were less expensive than single family
homes, and they were separated and didn't have a common wall like the town homes.

PZ Chairman Garren asked if the lots were sold separately. Mr. Hansen said they would
be and the existing R-T lots in Mountain Ridge would need to be re -staked.
PZ member Geray asked if it would be faster and easier to just rezone the two lots in the
R-T zone where Rockwell wanted to build single family homes.
PZ member Taylor said rezoning the property would take another month along with
another public hearing, amending the zone would be faster and easier.
PZ member Geray said he was worried that by amending the R-T zone to allow single
family homes that would open the door for all sorts of mixing and matching within zones.
PZ member Taylor said that probably wouldn't happen if the single family dwelling was
built to the specifications of the R-T zone.
Clerk Keyes said most developers would not allow mixing and matching within their
developments and they were fairly strict and uniform with the structure requirements.
Clerk Keyes said an alternative might be to issue a variance for the two lots that
Rockwell wanted to put single family homes on.
Mr. Kirkpatrick said he lived in a town home within the R-T zone and he was in favor of
allowing the patio home idea because he was already having lending problems because
he lived in a town home with a common wall. Mr. Kirkpatrick also said he was in favor
of allowing the two single family homes in the R-T zone because they were contiguous to
the R-1 zone anyway.
Mr. Kirkpatrick asked if the City had a master plan and if having various housing options
was part of the master plan.
Clerk Keyes said the City did have a Comprehensive Plan and varied, affordable, housing
was part of the plan.
Clerk Keyes also said that Connie Roberts called and was in favor of allowing single
family dwellings because she wanted to see the area developed and not left in fields of
dried weeds. Ms. Roberts lives in the R-T zone in Mountain Ridge Estates.
Chairman Garren asked how this would effect the 1/3 acre lot requirement.
Mr. Hansen said the two lots that they want to put the single family homes on met the
requirements.
PZ member Taylor said regarding the patio homes, the City had already allowed patio
homes on smaller size lots, so there was already a precedence set.

Mr. Hansen said the twin patio home proposal was really not much different than a twin
town home, except the side set back requirements would need to be changed to allow for
the separation space. The town homes were already sold as separate lots.
PZ member Taylor said he was in favor of allowing the amendment to the R-T zone and
in favor of the twin patio home proposal.
PZ member Hobbs said he was also in favor of the amendment.
PZ member Geray said he was in favor of allowing the single family homes as long as
they followed the R-T requirements, which would discourage typical single family
dwellings within the zone, but he wanted to think more about the twin patio home
proposal.
Chairman Garren agreed.
PZ member Geray made a motion to recommend to the Council to amend the R-T zone to
allow single family dwellings provided they follow the R-T zone requirements.
PZ member Hobbs seconded the motion.

Garren.
NAY: None.
