HomeMy Public PortalAboutOrd. 1554ORDINANCE NO. 1554 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING SECTION 7 -28 OF THE LYNWOOD MUNICIPAL CODE RELATING TO THE SETTING OF FINES /CIVIL PENALTIES FOR PARKING METER VIOLATIONS WHEREAS, California Vehicle Code section 40203.5 authorizes a City to establish as civil penalties the fine amounts for parking violation citations issued within its jurisdiction; and WHEREAS, the City of Lynwood, under the authority granted to it by section 15, Article 16 of the California Constitution and Vehicle Code section 22508, has created parking meter zones and established fines for parking violations which occur -in such zones; and WHEREAS, the City Council hereby finds and determines that the currently - established fines and penalties for parking meter violations should be amended to reflect the increased costs of enforcement and to deter violations of the parking meter laws; and WHEREAS, the City Council further finds that incorporating the fines for parking meter violations into the Lynwood Parking Civil Penalty Schedule would be of benefit to the community; and WHEREAS, the City Council desires to facilitate the manner in which future adjustments to the penalties associated with parking meter violations are made. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Subsection 7 -28.7 of the Lynwood Municipal Code shall be amended in its entirety to read as follows: "7 -28.7 Violations: It shall be unlawful and a violation of the provisions of this section for any person: a. To stop, stand, or park any vehicle in any parking space within a parking meter zone, beyond the parking time limits set for such parking space or if the meter shall indicate such illegal parking, then, and in either event, such vehicle shall be considered as parking overtime which is beyond the period of legal parking time and such parking shall be deemed a violation of this section. b. To cause, allow, permit or suffer any vehicle operated by such person to be parked overtime, or beyond the period of legal parking time established for any parking meter or parking meter zone as herein described. C. To deposit additional coins, tokens or debit cards in a parking meter for the purpose of displaying time remaining on said meter beyond that which the vehicle in the parking meter space is lawfully allowed. d. To park any vehicle across any line or marking of a parking meter space or in such position that the vehicle shall not be entirely within the area designated by, such lines or markings. The fines for the violations specified in paragraphs a through d of this subsection shall be as set forth below, and upon the effective date of this ordinance, such fines shall be incorporated into the Lynwood Civil Penalty Schedule. 'Thereafter, such parking meter violation fines shall be subject to change from time to time by resolution of the City Council amending the Lynwood Civil Penalty Schedule. Code Violation Description Fine Amount Expired meter (subsection 7- 28.7a) $30.00 Extended parking prohibited - meter (subsection 7- 28.7b) 40.00 Replugging meter (subsection 7- 28.7c) 30.00 Nondesignated space (subsection 7- 28.7d) 30.00 If any vehicle is found stopped, standing or parked in any manner violating the provisions of this section and the identity of the operator cannot be determined, the owner or person or corporation in whose name said vehicle is registered or the named lessee in a lease or rental agreement of said vehicle shall be held prima facie responsible for said violation." Section 2. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance or any part thereof is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase be declared invalid or unconstitutional. Section 3. This ordinance shall take effect thirty (30) days after its final passage by the City Council. Section 4. The City Clerk of the City of Lynwood is hereby directed to certify to the passage and adoption of this Ordinance and to cause it to be published or posted as required by law.
