HomeMy Public PortalAbout2000/10/26 The Agenda Meeting of the Mayor and Council of the Borough of Carteret preceding the Regular Meeting November 2, 2000 was held on October 26, 2000, 7:00 P.M., Municipal Court, Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. The following were noted present: Mayor James Failace Councilmember Crilley " O'Brien " Quinones " Santoro " Sohayda Noted absent was Councilmember. Jack Fazekas, Business Administrator Nicholas Goldsack and Borough Attorney Craig Coughlin. Mailed to the Home News Tribune, The Star Ledger and posted on the bulletin board on October 20, 2000. a. Borough Engineer - MUNICIPAL PROJECTS: 1.Albert Beninato from Killam and Associates gave his report. He spoke on the Town Center Revitalization -Contract No. 99- 21. Marvec Constructions should be substantially complete with the site improvements, curbing, sidewalks, and paver brick Town Center area by the end of next week. Pavement Improvements were undertaken today and irrigation and landscaping are scheduled for next week. The contractor is awaiting fabrication and delivery of the granite monuments and plaques that are scheduled to arrive in early December. Mayor James Failace asked if there was going to be a problem with the 1andscaping and the facade. Borough Engineer Al Beninato stated that the façade should not be a problem. They are fully responsible for the façade and the planting so if there is a problem with that in the spring under maintenance we will be coming back to do whatever remedies are necessary. Mayor James Failace asked if the grant was the only reason things were being held up until December. Borough Engineer Al Beninato stated they just received design drawings early this week for the irrigation system. They are proceeding with ordering the irrigation equipment and getting that in, the sidewalks and the landscaping can be done. That is expected in about a week or two. Councilmember Santoro asked if the problems they were having this morning were going to be corrected for tomorrow. OCTOBER 26, 2000 AGENDA MEETING OCTOBER 26, 2000 PRESENT STATEMENT OF MEETING NOTICE BOROUGH ENGINEER MUNICIPAL PROJECTS TOWN CENTER I OCTOBER 26, 2000 MUNICIPAL PROJECTS CONTINUED TOWN CENTER VETERANS FEILD LIGHTING POLlCE GAS HEAT CONVERSION NOTED PRESENT Borough Engineer Al Beninato stated that, as he understood it everything has been corrected. There has been a lot of communication regarding the complications that took place. When they left the job sight last night they communicated with the contractor that had, everything in order to partially close the road down for the pavement today. He did what he had to do with regards to notifications to the police department. Councilmember Santoro stated that they were not only to notify the Police but other departments as well at least 24 hours before closing the road down, and they did not do any of that. Borough Engineer Al Beninato stated that everything was pretty much in order. He mobilized very early this morning to get things going. With in an hour because of complications, Sergeant McFadden had to get out there. He said that was about the same time the inspector arri ved on sight. Councilmember Santoro stated that the roadblock caused problems with Holy Family, and Bethlen Hall had to cancel their Atlantic City trip because of it. Borough hall, all the employees could not get into the parking lot. At least now for tomorrow they know that they can not get into that area. Borough Engineer Al Beninato stated that he is on Cooke A venue right now completing that. Pershing is paved and that will be opened up for access tomorrow. Councilmember Santoro stated, as a reminder if any more work like this had to be done these buildings must be notified. 2. Veterans Field Lighting Project- Contract No. 00-08- Al Beninato reported that Killam presented the site plan to the Carteret Planning Board last evening and received preliminary and final site plan approval for the Veterans Field Lighting Project. Killam is progressing with the final lighting design and preparation of bid documents and is scheduled to advertise the project by the week of November 6th. The project consists of the installation of four support poles and twenty-six fixtures to provide illumination meeting the National Little League lighting standards. 3. Police Headquarters Gas Heat Conversion - Contract No. 00- 10 _ Al Beninato stated that J.c. Morris Associates, the mechanical design consultant, is nearing the completion of technical specifications and contract drawing for the gas heat conversion. Upon receipt of the technical specifications, our offices will complete the bid package and coordinate project advertisement, bidding and project implementation. The project consists of removal and disposal of the existing oil fired heating unit and replacement with a new gas fired unit to serve the Police Headquarters and Municipal Court Building. A temporary heating oil storage tank has been installed on-site to serve the building during the interim Borough Attorney Craig Coughlin is noted present at 7:05 p.m. 2 4. Municipal Court Room- Emergency Exit Door / Handicap Ramp - Al Beninato stated that their office solicited proposals from fourteen (14) masonry contractors over a period of two months, with two separate deadlines and the Borough did not receIve any quotations for the proposed improvements. Accordingly, since efforts were made by the Borough in compliance with the Local Public Contracts Law, and no responses were received, the Borough may wish to select a contractor to perform the work and negotiate a price which was estimated to be between $12,000 and $14,000 and below the Public Bid threshold of $17,500. Three copies of the designs drawing and specifications for the project, which were prepared by Lauro Architects, have been provided to the Borough Administrator for coordination of the work through the Purchasing Agent and Construction Code Office. 5. Middlesex Water Company - Renew 2000 Project - Al Beninato stated that their office has been in contact with representatives from Middlesex Water Co. with regard to the work progressing throughout the Borough under the Renew 2000 Project. The Water Company has indicated that work under the Renew 2000 program should be completed by the end of this month, which is slightly longer than the origina1 schedule had indicated. This includes final pavement restoration of trenches and excavations in accordance with the Borough restoration details provided by their office during the Preconstruction Meeting. However, since many utilities other then the Water Co. are performing improvements with Washington Avenue, the County has scheduled the resurfacing of Washington A venue for the spring of 200 I. Councilmember Santoro asked if they were going to leave Washington Avenue like it is right now. Borough Engineer Al Beninato stated that the Water Co. has indicated that they will be bringing their restorations to the counties requirements, which is resurfacing the roadway. I can not speak for the other utilities right now; I am not sure what the status of their work IS. There has been a series of utility work done on Washington A venue. Mayor Failace stated that the Borough Engineer, Construction Official Anthony Neibert, or Streets and Roads Official Theodore Surick has to go around and see everything that is there, and everything that has been done. There are some terrible problems and we have to make sure that they are fixed and restored back to the way that they were. It is really a mess. Who cleans up the streets? Borough Engineer stated that the Water Co. should be doing that. They informed me today to advise Mayor and Council that they will address any area that they have effected to the satisfaction of the Borough and the Borough can be assured of that. Councilmember Santoro wanted to know who would be determining that the areas have been repaired to the Borough Satisfaction. She felt that it should be someone who is for the Boroughs best interest not theirs. She feels that this needs to be down while they are still here. OCTOBER 26, 2000 MUNICIPAL PROJECTS CONTINUED MUNICIPAL COURT ROOM MIDDLESEX WATER COMPANY 3 OCTOBER 26, 2000 MUNICIPAL PROJECTS CONTINUED MIDDLESEX WATER COMPANY SEWER FACILITIES NJDEP ADMINISTRATIVE HEARING SABO STREET PUMP STATION REPLACEMENT AND SANITARY SEWER SYSTEM IMPROVEMENTS SANITARY SEWER MANHOLE REHABILITATION PHASE 1 SUSPECT AREAS SEWER CLEANING AND INTERNAL INSPECTION Mayor Failace stated this was his point. He said he felt that every road that that they have worked on should be inspected very closely. Unidentified voice stated that Mr. Williams over at the Water Co. said that they are wilJing to come back and fix any road that they have worked on, they would just like to be notified of what we would like them to work on. b. Al Beninato then spoke on Sewer Facilities: 1. NJDEP Administrative Hearing - Al reported that the administrative hearing that was scheduled for October 24, 2000 (NJDEP v Borough of Carteret) was placed on the inactive list by the Attorney General's Office since the State recognizes the Borough's diligent efforts to investigate and address the matters identified in the Administrative Order and Notice of Civil Administrative Penalty Assessment. Councilmember Santoro asked were we getting fined. Mayor James Failace stated that at this point things are on hold, and as long as we continue to do what we are doing, it will stay on hold. Borough Attorney stated that the negotiation is something they should talk about in Closed Session. Borough Engineer Al stated that the underlined issue is that the state is satisfied. 2. Sabo Street Pump Station Replacement and Sanitary Sewer System Improvements - Contract No. 99-13 - Borough Engineer Al Beninato stated that the contractor, Ace Manzo, Inc. & D. Manzo & Son, Inc. are progressing on schedule with the work under Contract No. 99-13. The contractor has completed the brickwork and internal painting on the generator control building. Also, some site grading, electrical and plumbing has been completed. The contractor intends to begin installation of pumps and piping in the pump station wet well during the first week of November. The contractor has submitted several requests for change orders for unexpected delays or for work that was beyond the original scope of work. Upon review of the requests, our office recommends authorization of change Order No. I in the amount of $12,562.34. A copy of the change order and of the Contractor's request is attached to this report for Borough's review. Upon approval, the contract value of $840,960.00 will be increased. 3. Sanitary Sewer Manhole Rehabilitation Phase I - Contract No. 99-19 - Al Beninato stated that the contractor, Vangelis Construction, is progressing with the rehabilitative measures on approximately 240 of the Borough's deteriorated sanitary manholes. Based upon the schedule, the work under this contract should be completed by early December. 4. Suspect Areas Sewer Cleaning and Internal Inspection - Contract No. 00-06 - Al stated that the work under the contract has been completed. The original contract is valued at $70,211.00 4 and the value of completed works equals $63,731.25. Upon review of the internal inspection reports and videotapes, it is recommended that the Borough consider authorizing some additional internal inspection work under the contract. Based upon our findings we recommend adding work valued at approximately $9,889.50. Since the current contract value is $6,479.75, which is less than the original contract value, the additional work would require a change order in the amount of $3,409.75, which equa1s the value of work exceeding the original contract amount. Since the information obtained from the additional sewer inspections would assist in identifying system deficiencies, we recommend authorization of this not to exceed amount of $3,409.75 under Change Order No. I, which would result in a revised contract value of $73,620.75. Councilmember Santoro asked how much did they budget for that, and if it came out of a bond. The total reply to Council member Santoro's question is inaudible. c. Road Projects: 1. Industrial Road Extension Project - Federal Grant - Al Beninato stated that at a meeting last week with representatives from the Borough, C.P. Hall (Staflex Products), the developer (OENJ Cherokee), and their consultant (Schoor DePalma), to discuss the proposed alignment, property and site constraints (i.e.: railroad crossings, etc.) and other project concerns. Since Federal Aid is involved, and the Borough must comply with the National Environmental Policy Act (NEPA) for project implementation which involves a consultant selection phase (6-8 months) and a rigorous environmental study and approval phase (18-24 months) prior to road design and construction phase which may take between 3 to 5 years prior to completion. This schedule would be prohibitive to the developer and may adversely impact the proposed development. In an effort to meet the developer's needs, it may be possible to have the portion of the Industrial Road Extension within Carteret constructed by the developer. The Federal Grant monies then may be transferable to complete the remaining portion of the roadway from the border of Carteret and Woodbridge to Port Reading Avenue in Woodbridge. We will continue to coordinate with the Borough, Woodbridge and the other involved parties to progress with this project. Councilmember Santoro asked if they were going to construct the road in Carteret. Borough Engineer Al Beninato answered that they will be constructing a portion of the road in Carteret so that they will have access to the Industrial Road... (inaudible). Councilmember Santoro asked what would happen if there was a problem. The Federal dollars require that it be completed to .. . (inaudible).. .Port Reading Ave. Council member Santoro asked if they would be passed all that before they would start construction. Borough Engineer Al Beninato stated that the developer would like to move very quickly, but there are a lot of issues here that need to be addressed very carefully, and Woodbridge Township has to be on board with this 100%. Councilmember Santoro asked the Borough Engineer if he had met with them. Borough Engineer Al Beninato stated that he has spoken with .. . (inaudible) several times this week relative to this concept. What he has indicated is that the Borough is in general agreement with this concept of swapping the responsibility of the roadway to allow OENJ Cherokee to proceed, so that they access Industrial Road and not access Roosevelt A venue down to the Turnpike. Mayor Failace stated that in his meeting with ...(inaudible)... OENJ Cherokee and Woodbridge myself. Councilmember Santoro asked whom. Mayor Failace stated he spoke with Simsack and they certainly would like to see this done, as long as everything was in place. Everything must be in place before it is started and constructed. We will have our end of the Industrial Road completed almost immediately if the project went through which would be a good thing. Secondly if we transferred that money to Woodbridge while that was being done it would cut a bunch of time off of what we have to do. Council member Quinones asked realistically what time frame are they looking at. Borough Engineer Al Beninato stated that they are very anxious to get the shovel in the ground. They have not given us what there deadline is to satisfy...(inaudible). They are trying to put pressure on the procedure. What I am responding to them on is that before the Borough extends any significant effort they need to get the Woodbridge Township to fully agree to the access point on Port Reading Avenue and to fully agree to this plot. This needs to be done in writing as well as verbally. Councilmember Santoro asked if there was a problem with Woodbridge as to where the road would come out. Borough Engineer Al Beninato stated that Woodbridge, from his discussions with Bob Simsack, the Mayor is still under the understanding that there are three options as to where the road would access Port Reading A venue. One is still Key Court. Mayor Failace stated that quite honestly Key Court is the Number one option. It is Woodbridge and the developer who has a problem with Key Court not us. 6 Borough Engineer Al Beninato stated that Woodbridge would prefer Key Court but the deve10per stated that it dissects to much of the property and. ..(inaudible). The Developer would prefer to see the roadway as close to the Borough border as possible. This would bring the roadway up just south of the abattoir. This also creates a complication because it brings it in close proximity to the narrow section of Roosevelt A venue, and close proximity to Edwin Street. There would have to be some consideration to still move it still further south. The responsibility to try and address this to the satisfaction of Woodbridge is on the developer. They have to go back and satisfy Woodbridge Township as to where it is going to come out, and how it is going to come out, before we exercise any effort on the part of the Borough. Mayor Failace stated that we absolutely wou1d not enter into any agreement with anybody unless it is for the benefit and the betterment of Carteret and that is the bottom line. 2. New Jersey Turnpike Authority -Interchange 12/ l2A Study - Borough Engineer stated representatives from office, EKA Associates will represent the Borough at a meeting with the NJT A, and County scheduled for tomorrow. The meeting was scheduled by NJTA to discuss the technical memorandum, dated August 8th, which was issued by the NJTA's consultant, Wilbur Smith Associates, concerning the Interchange improvements and regional needs. As indicated in our response to the NJTA dated September 19th. It was evident upon review of the memorandum that the Borough's development and/or redevelopment potential and needs were not accurate1y reflected or considered as part of the study. The Middlesex County Planning Department agreed with our findings and recommendations. We intend to discuss the Borough's concerns and will recommend that the NJTA revise the study accordingly. Mayor Failace stated that what the Turnpike basically said was that Carteret pretty much as no development, no plans, no nothing, and their not doing anything and Linden is doing a lot. I called Al and asked him to address this and he did a great job with this. Borough Engineer stated that he was provided with a sewer study from Woodbridge Township. He said he did not have an opportunity to take a look at it yet. It is a sewer study regarding conditions in Woodbridge Township. The report identifies that the sewer system downstream of which Carteret discharges is deteriorated prematurely and there is going to be a need to do some upgrading, repairs, replacements, lining and etc...(inaudible)... He does not know if it is a Borough responsibility yet. He said he would have to look at the report and the Borough's agreement with Woodbridge as well as the monies that the Borough as been paying for the last seventeen years, to see if any of that money has gone towards either maintenance repairs and upgrades. Mayor Failace stated that he guesses we have to fix our sewers and Woodbridge sewers as well. OCTOBER 26, 2000 ROAD PROJCTS CONTINUED INDUSTRIAL ROAD EXTENSION PROJECTS NEW JERSEY TURNPIKE AUTHORITY SEIiIER - STUDY FROM WOODBRIDGE TOWNSHIP 7 OCTOBER 26, 2000 SEWER STUDY FROM WOODBRIDGE TOWNSHIP CONTINUED ORDINANCES, PUBLIC HEARING RESOLUTIONS COMMUNICATIONS Borough Engineer said that he would take a look at it and report his findings at the next Agenda Meeting. I. Public Hearing - #00-48 Amending Salary Ordinance #71-9, Re: Construction Official. 2. #00-49 Amending Code, Chapter 132, Re: Flood Damage Prevention. I. Directing the Issuance of Various Raffle Licenses. 2. Refund of Tax and/or Sewer Fee Overpayments. 3. Authorizing Contractors to Perform Rehabilitation of Homes Pursuant to COAH Regulations. 4. Providing for the Transfer of Surplus Funds. 5. Adopting LOSAP Plan provided by Lincoln National Life Insurance Company. 6. Budget Insertion - $15,992.00, Re: Local Law Enforcement Grant. Councilmember Santoro asked if they were going to get a list of surplus funds that were being transferred before the meeting. Borough Clerk Kathleen Barney stated that they would have to get that information from Patrick. Mayor Failace stated that they usually get them before the meeting. Mayor Failace stated that he would be putting the benefits question on the Agenda next week. Councilmember Crilley stated he would like to add the resolution that puts the Business Administrator as the person who hears the grievances back on. He said he did not believe it got the vote of the full Council. Councilmember Santoro asked Borough Attorney Craig Coughlin if there was a time limit after a resolution goes down that it could be put back on. Borough Attorney Craig stated no, it could be reintroduced. 1. NJ Transit - Public Notice of Fiscal Year 2001 Request for Federal Financial Assistance Under the Transportation Equity Act for the 21st Century. Comments invited. 8 2. Woodbridge Township - Land Use & Development Ordinance Providing Home/Office Occupation Uses in Residential Zones. 3. Township of Edison - Resolution supporting legislation designed to regulate the Transportation of waste materials by rail cars. 4. Swidler Berlin Shereff Friedmsn, LLP - Notice to Intent to Estab1ish and Open Video System, Re: RCN Telecom Services, Inc. 5. Township of South Brunswick - Resolution urging legislation to amend the Municipal Land Use Law to allow municipalities the right to deny applications of irresponsible developers or at least comment on applications submitted by Developers. Councilmember Crilley asked if the communication received from South Brunswick was already on file. Borough Attorney said it was done a couple of years ago. Mayor Failace said let's check it out and see if we did that. I. 2. 3. Clerks Office - October 2000 Sewage Collection - September 2000 Treasurer - October 2000 I. NJ Department of Personnel - Certification of Eligibles for Appointment, RE: Truck Driver. One (I) on list, S. Lugo. Date of Disposition: 12/29/00. Borough Clerk asked if this could be explained in Closed Session because there was more to it. Mayor Failace stated yes this could be discussed in Closed Session. 2. John Riggio - Requesting that Ordinance #00-27 be amended, Re: Zoning and Building Fees. Mayor Failace stated that he spoke with Construction Official Tony Neibert and what we will be doing is the zoning fees. He said Tony has to give us the information. By zoning fees, he was under the impression that meant going to the zoning board for variances and so forth. Instead, he found out that it meant there was various fees under zoning for example: sidewalks, a fence. He said he thought that was all a part of the fees in the building. What we need to do is amend that ordinance so that the seniors do not have to pay for those fees either. 3. Helmer, Kassel & Stowell Esqs. - Police Ordinance. Mayor Failace stated that there was a law that came down that we have to make some adjustments. Every body should have a copy of the letter from Mr. Stowell. He asked Craig to read it and to give Gary a call, and discuss this with him and see which is in the best interest of the Borough and what we have to do. OCTOBER 26, 2000 COMMUNICATIONS CONTINUED REPORTS MATTERS FOR DISCUSSION 9 OCTOBER 26, 2000 MATTERS FOR DISCUSSION BUSINESS TO BE ADDED Councilmember Santoro stated to Mayor Failace that evidently he paid to have it changed and now it will not hold up in court so it should be changed again. Mayor Failace answered that the ordinance would hold up in court. There are some things that need to be changed, but if the Council chooses not to change it then that is fine. It has nothing to do with what happened two years ago. Councilmember Crilley stated Borough Attorney Craig should take a look at it. Mayor Failace answered correct he wants Craig to take a look at it. Councilmember Quinones asked was that in light of a subsequent decision. Mayor Failace answered yes; it is a subsequent decision about something that happened two years ago. It was done in accordance with state law two years ago. 4. Coregis - Requesting payment of claim, Re: L. McDermott Borough Clerk Kathleen Barney stated that this was a fall in a park. Borough Attorney Craig stated it is the deductible, the self-insured portion. Borough Clerk Kathleen Barney stated that she had one more thing to put under matter of discussion. A resolution for Ottavia Kurdyla, in the building department, needed to be put in making her permanent. We have increased her hours from part-time to full-time. A resolution was never done making her permanent, she was only a temp Clerk Typist. Council member Santoro stated she would like to look at a resolution. As everybody knows there was no kitchen put into the Community Center and after meeting with the Meals on Wheels, The County, and the Program Director she was able to find out what needs to be put in there before they transfer over. Only to find out, along with the Board of Health we have to submit plans. This would mean we need an architect's plan and he is not sure whether there would be a Mechanical Engineering possibly along with that. So, if possible she would like to put it on for next weeks meeting. She said she spoke with him today and asked him not to exceed and to have a figure thrown of no more then $5000.00. He said he would firm it up before the meeting. Mayor Failace requested that they receive the figures before the next Agenda Meeting, for the Architect and the Engineering. 10 Council member Santoro stated that if he does not need it then he will come back but we need to do that. Councilmember Crilley asked what was the estimated cost of the Kitchen. Councilmember Santoro stated that we would find out once he puts it together. She said she knows they need a stove, two refrigerators, cabinets, and counter top work area. Just for the meals on wheels we can not switch until we get this done. Borough Attorney asked who was going to be the Engineer. Councilmember Santoro said she did not have a name for that yet. She said she would have all of that tomorrow. Councilmember Sohayda stated that he received a memo from Mayor Failace asking him to check the lights on the bridge. Last year we paid $1500.00 to have them fixed. This year there is a requisition over here again to pay $1500.00 to have them fixed again. We do not own the lights we are fixing someone else's lights. Mayor Failace stated to Councilmember Sohayda that he has to understand something. Jimmy Mancuso went through this last year with the Turnpike and, Councilmember Sohayda interrupted and stated that this has nothing to do with the turnpike, PSE&G owns the lights. A gentleman from PSE&G, Mr. Griffith, in the lighting division said that he would put it on the repair schedule. He said he did not have a date at the moment but he is expecting a phone can every day to get put on the schedule. Unless you want to spend the $1500.00 and get the lights fixed. Mayor Failace answered no. Have Borough Attorney Craig Coughlin call if it is going to take us a year. Councilmember Sohayda answered it will not take us a year, but it is going to take us...(inaudible)... to put on their schedule for repair. He said that if Mayor Failace wants to pay $1500.00 again to get them done quickly it is the Council's decision. Mayor Failace told Councilmember Sohayda to give Borough Attorney Craig Coughlin whomever he spoke with and then he told Craig to give them a can and find out how long it is going to take. He felt that if it was going to take more then six months to fix the lights then they should not wait. Councilmember Sohayda stated that he does not think that is one of the options. Councilmember Crilley stated that he would like to apologies to the Council because he forgot the proposal at home for Shorecrest Park. He met with the gentleman as he had previously stated. He said the price came in for the exact same equipment that we have in West Carteret, including the over hang...(inaudible)... protector for $2000.00 less. He said he asked him to see what he could do, to shop with his pencil and it takes $41,000.00 to do. We are right at the edge of 11 OCTOBER 26, 2000 BUSINESS TO BE ADDED CONTINUED OCTOBER 26, 2000 BUSINESS TO BE ADDED CONTINUED having enough funds to pay for this, this year he said he was going to wait for the bids to come in for the light which Borough Engineer, Al mentioned was approved by the Planning Board last night. As a formality, the reason why we did that was to give the residents a chance to express any concerns. No residence showed up and as a result, it was approved accordingly. The price with the lights had to go up a little bit because we did have to go in front of the Planning Board so we had to pay a little more Engineering fees then we wanted to. He said he might ask the Tax Assessor, Patrick DeBlasio to do a surplus transfer for recreation. He said he did not know if that was done separately or if he could include that on his list that he has. Mayor Failace said no not for now it has to be done for November next meeting. Councilmember Crilley said that it would probably be a transfer of funds of a couple thousand dollars. Councilmember Santoro stated what they will be facing with the kitchen is that we have no money for it. Councilmember Crilley stated that this money was budgeted in the account to be used by the recreation. If we have $40,000.00 and it takes a couple thousand dollars to get this done then he is going to do it. He said he is going to ask the Council to approve the transfer and we may not need it. He does not know. We are right on the cut. He said there should be $118,000.00 in that fund, and the estimate for the lights is about $70-75,000.00 and the estimate here is $41,000.00 that comes out to about $116,000.00, so again we are right there we may need it we may not need it. So after we get the bids he will ask the Mayor to sign it, this is a state contract as he did the last time and go for it if we are within budget to do. He said he asked at the Council Meeting if the Mayor would consider appointing a First Aid Committee, he is reiterating that to involve citizens as well as different branches that are affected. He said he feels it is a good idea, some citizens have brought it to my attention. He felt this was something that needed to be addressed as soon as possible. It is an easy solution to throw money at it but he feels there are other solutions that may not be as costly yet being as effective. He asked Borough Clerk Kathleen M. Barney if she could remember to write Business Administrator, Nicholas Goldsack a memo. He said he had asked him at the last Agenda Meeting to get proposals with figures for TV coverage of the meetings. He said he knows he is away so if she could just send him a memo. This way he can have it at our next Agenda Meeting and the Council can review the information and see if we can afford to do such a thing. Borough Attorney Craig Coughlin stated that he spoke with Jim McGovern, we need a resolution to approve for more funds. The Teribeski & Hunderman appeal is still kicking around. There is some work to be done on that and there is a chance that the matter may have to be orally argued. He has been handling that matter and there is likely to be arbitration because we denied their grievance. The estimated cost given to continue is about $15,000.00 Mayor Failace stated that this is a shame but we have to continue. 12 Mayor Failace asked for a motion to go into Closed Session to discuss Personnel Matters and Litigation.
