AT THE COMMUNITY CENTER PUBLIC HEARING: AMENDMENT TO R-T ZONE TO ALLOW PATIO HOMES PRESENT: Chairman Dan Garren; members Roy Hobbs, Mike Taylor, Rob Geray, Bette Lovinus, and Clerk Robyn Keyes. VISITORS: Dan Gubler, Greg Hansen. PZ member Garren welcomed everyone, and PZ member Hobbs led the Pledge of Allegiance. Minutes. PZ member Geray made a motion to approve the minutes. PZ member Hobbs seconded the motion. Minutes approved Impact Area Letter. PZ chairman Garren said he was waiting on a land description so he could write the proposed Impact Area revision letter. Clerk Keyes said she would send PZ Chair Garren the information he needed. Council member Gubler said he agreed with the recommended impact area expansion and said the impact agreement needed to be updated anyway. Council member Gubler spoke of the issues and stipulations of the impact agreement. Title 11 Review. PZ member Geray said he noted several inconsistencies with the verbiage in the Title as well as contradictions with some of the requirements between zones. The Commission members agreed there was too much to go through and decided upon a work meeting to go over the issues. The work meeting was scheduled for March 23, at 6:30 p.m. at the Community Center. Council member Gubler left the room for the public hearing at 7: O5 p.m. Public Hearing Amendment to R-T Zone. A public hearing was held to consider amending the R-T zone to allow patio/rambler type dwellings. After holding the hearing the Commission recommended to the Council to amend the R-T zone to allow patio/rambler type dwellings provided that appropriate adjustments were made to existing set backs. See appendix A for hearing minutes. Council member Gubler returned after the hearing at 7: S5 p.m. Council member Gubler spoke more about the need for the Title 11 review and how the zones could be condensed or revised. PZ member Taylor made a motion to adjourn. PZ member Hobbs seconded the motion. All were in favor. Adjourned 8:10 p.m. 1 114 APPENDIX A PUBLIC HEARING 7:05 P.M. R-T ZONE AMENDMENT TO ALLOW PATIO HOMES PRESENT: Chairman Dan Garren, Members; Roy Hobbs, Robert Geray, Mike Taylor, Bette Lovinus, and Clerk Robyn Keyes. VISITORS: Greg Hansen Chairman Garren welcomed everyone, went over the procedure for the public hearing and turned the time over to Greg Hansen from Rockwell Development. Mr. Hansen handed out maps of the R-T zone showing where existing town homes were and proposed sites for patio homes instead of town homes. Mr. Hansen explained that the patio homes Rockwell wanted to build were essentially a rambler home. Mr. Hansen said he had spoken to each local city regarding the same proposal and the other Cities had decided to make a change to their ordinance as opposed to issuing conditional use permits to allow the patio homes. Mr. Hansen explained that a town home had not been built for quite awhile because people were no longer interested in purchasing the town homes; the patio homes were more appealing to their customers. Mr. Hansen said in the Old Mill Subdivision, about 1 %2 miles from Iona, had sold all of its patio homes and Rockwell could not build them fast enough to keep up with the demand. Mr. Hansen said the patio homes were an affordable choice for many people. He showed the PZ members several pictures of patio homes and town homes and said most people liked the separation of the homes. PZ member Lovinus asked how the driveways would be arranged in the cul-de-sac so people were not backing into each other. Mr. Hansen said the driveways were separated instead of two connected, which was safer. Mr. Hansen handed out a paper with suggestions for changes in the language of the R-T ordinance to allow patio homes. The suggestions were as follows: The area requirements would be- an area of not less than 6,000 square feet (or what ever area the Council decided) shall be provided and maintained for each one -family dwelling. Width requirements- the minimum width of any building site for a dwelling shall be 50 feet (or what ever the Council decided) for each one -family dwelling and 100 feet (or what ever the Council decided) for each two-family dwelling. Front and rear set backs would remain as they currently were, side set backs for buildings shall be not less than 6 feet. Size of building- either no requirement, or no smaller than 900 square feet (or what ever the Council decided). Lot coverage and landscaping -the maximum lot coverage of single-family attached dwelling units shall be 65% for the interior lots and 50% for the corner lots. Mr. Hansen said those were only suggestions and the PZ and Council would need to decide what was best for the City. 2 PZ member Geray said he did not see a problem with `separating the homes instead of having connected town homes. Geray said he was curious why the Council added "no patio homes" to the R-T amendment to allow single family dwellings. PZ member Hobbs said he thought there was a need to separation between homes instead of having connecting homes. Hobbs remembered the visitor from the last Council meeting who was having lending issues because his home was connected to another home. PZ member Taylor asked Mr. Hansen if Rockwell had considered building only single family residence in the R-T zone since people weren't buying town homes. Mr. Hansen said they considered two single family homes next to the existing R-1 homes, but they didn't like to mix types of homes too much. Mr. Hansen said his proposal was to keep building town homes on Quaky Aspen where there were existing town homes, then add the patio homes on the lots along Denning and in the cul-de-sac on Sagebrush, that way the types of homes were grouped together. Mr. Hansen said the infrastructure had already been installed for two homes on each lot, so it would not be cost effective if they put in all single family homes. PZ member Garren said the density of people living in the R-T zone wouldn't change if patio homes were built instead of town homes, but because of the separation of the homes, it would have less open space and would be a higher housing density than current zoning permitted. Clerk Keyes said a home owner living on Quaky Aspen said she would rather see anything in the area than dirt and weeds. Clerk Keyes said if the town homes weren't selling, then it seemed that having lots sit for years would not be a good situation. Clerk Keyes said many people were reconsidering the size house they needed and looking for smaller homes. Mr. Hansen said that was the trend they were seeing at Rockwell, people were looking for more affordable housing, and many people were so busy they didn't want a lot of open space to care for. PZ member Geray made a motion to allow patio homes in the R-T zone with the provisions that appropriate adjustments were made for the set backs. PZ member Hobbs seconded the motion. PZ Chair Garren asked if there were any further discussion. PZ member Geray said he thought the patio homes were a good alternative to the town homes. PZ member Hobbs said he thought the reason for the 10 foot side set back was for fire code. 3 Mr. Hansen said there had been a change to side set back regulations, and the current fire code allows for six foot side set backs. There was no further discussion. PZ member called for a vote. AYE: PZ member Lovinus, PZ member Hobbs, PZ member Garren, PZ member Taylor, PZ member Geray. NAY: None. All were in favor. Motion carried. Public hearing closed 7:50 p.m. 4 Suggestions for Changes or Additions to the Current Language Area Requirements. An area of not less than six thousand (6,000) square feet shall be provided and maintained for each one -family dwelling. Width Requirements. The minimum width of any building site for a dwelling shall be fifty (50) feet for each one -family dwelling and one hundred (100) feet for each two-family dwelling. Location of Buildings and Structures. A. Setback would remain as they are currently B. Side Yards For main buildings there shall be a side yard of not less than six (6) feet. EXCEPTION: Single-family attached dwellings shall have no side yard setback requirement at the property line separating the attached or party wall or walls; however, all accessory buildings shall comply with the setback requirements set forth above. C. Rear Yards For main buildings would remain as they currently are. Size of Buildings. No requirement. Or no smaller than 900 square feet. Lot Coverage and Landscaping. The maximum lot coverage of single-family attached dwelling units shall be sixty-five (65) percent for interior lots and fifty (50) percent for corner lots. The Planning and Zoning commission reviewed Title 11 Chapter 4 in the City Code Book looking for necessary updates to the code. The yellow highlighted sections are suggestion for the section and items to be removed have a line through them. All buildings, shelters, or enclosures for farm animals shall be located no closer than fifty (50) feet from any property line. 4. (Ord. 96, 5-24-05) 11-4-3: CONDITIONAL USES: The City may, after notice and public hearing, permit the following uses where such uses are deemed essential or desirable to the public convenience or welfare. The City may require an impact statement to assess 3 the impact of any conditional use upon surrounding properties and upon city services and infrastructure. The City may impose such conditions and safeguards, as it deems necessary to protect the best interests of the surrounding property or neighborhood and city services or infrastructure from damage, hazard, nuisance or other detriment: (B) Home Occupations, subject to the provisions of 11-11-12 and 11-11-13 of this Title. (C) Public facilities such as schools, parks and playgrounds, utility facilities and other municipal uses. (D) Temporary buildings for construction purposes for a period not to exceed one (1) year. (E) Boarding and rooming houses. (F) Manufactured homes or rccrc\otional vehicle parks. (G) Nursery school or Day Care facilities. (H) Cemeteries. 4 (I) Greenhouses. (J) Patio Homcs, subject to the restrictions set forth in section 11-1-11 of this chapter. (D) Clear view of intersecting streets and ways. For the purpose of ensuring reasonable visibility and safety in the residential districts and in the business districts which require buildings to be set back from the right-of-way line, the triangle of land formed on any corner lot by drawing a line between the points on the two lot lines, which points are each thirty (30) feet from the intersection of said lot lines, shall be free from structure or other obstructions, except as otherwise permitted in this section. Any triangle of land formed along any street by drawing a line between a point on the lot line parallel to the street (which point is fifteen (15) feet from an alley or driveway which abuts the street) and a point on the near side of the alley or driveway (which point is fifteen (15) feet from the lot line) shall be free from structures or other obstructions, except as otherwise permitted in this section. Trees are allowed in such triangles provided they are trimmed from the ground level to at least seven (7) feet above the curb. Shrubs, fences and 6 walls are likewise allowed in such triangles provided they do not exceed three (3) feet in height. (E) Protection of Waterways. Any development near any irrigation canal or ditch shall protect the canal or ditch right-of-way from encroachment and meet all standards required by the owner of the canal. 11-4-7: AREA REQUIREMENTS: The following area requirements shall apply in the R-1 zone: (A) Lots within this zone shall be not less than fourteen thousand five hundred twenty (14,520) square feet in total area and shall be of a width at the front lot line of not less than eighty-five (85) feet (B) Lot coverage. No more than fifty percent (50%) of the lot area may be covered by buildings or structures. 11-4-8: WATER AND SEWER SERVICES: (A) Sewer. All residential structures within this zone shall be connected to a public sewer facility, if located within three hundred (300) feet of the terminus of any existing sewer line. If such sewer facilities are not available, then the use shall meet the requirements of the District Seven Health Department. 7 (B) Water. (B) All other uses shall comply with the provisions of Chapter 12 of this Title. 11-4-11 PATIO HOMES (A) For the purposes of this section, a "patio home" shall mean a residential structure which occupies a substantially greater portion of the lot in. comparison to other residential structures allowed within the zone. (Ord. 96, 5/21/05) 11-4-12: KEEPING OF DOMESTIC HENS: (A) The keeping of domestic hens is hereby permitted within the R-1 zone subject to the provisions of this section. For the purposes of this section, the term "domestic hen" shall mean a common domestic hen (domesticus gallus gallus) for the purpose of domestic egg production or as a domestic pet. The keeping of such hens for breeding or for slaughter as a source of food is not permitted. (B) Only one (1) animal unit per one-third (1/3) acre or greater shall be allowed. One (1) animal unit shall represent ten (10) domestic hens. (C) All buildings, shelters or enclosures used for the purpose of housing or sheltering domestic hens shall be located no less than twenty (20) feet {-2-01-) from the primary residence located upon the lot or parcel for such uses permitted and no closer than fifty (50) feet {50') from the foundation wall of any building or structure used for human occupation and located upon any adjoining lot or lots. In no event shall domestic hens be kept within a front yard or a side yard, as defined by section 11-1-5 of this Grade aiV. (D) Domestic hens shall at all times be kept within a secure enclosure having a total area of not less than two (2) square feet per domestic hen. Domestic hens shall not be kept within any building or structure designed for human occupancy. (E) The area within which domestic hens are kept shall be cleaned and maintained in a manner that does not unreasonably attract flies, emit 10 foul or objectionable odors or create a public health hazard nor shall the keeping of domestic hens disturb the peace of the adjoining properties or otherwise constitute a public nuisance. The purpose of the hearing is to consider an amendment to the Residential Town home (R-T) zone to allow patio homes. A second public hearing is scheduled for the evening of March 15, 2011 at 7:30 P.M. at the Community Center with the City Council for final review. If you have any comments concerning this amendment, they will be considered at the public hearing. Comments may be made in writing, but must be received by the City Clerk seven (7) days before the public hearing.
