An Agenda Meeting of the Mayor and Council of the Borough of
Carteret preceding the Regular Meeting, December 7, 2000 was held
on November 29, 2000, 7:00 P.M., Municipal CourtlPolice Facility,
230 Roosevelt Avenue, Carteret, New Jersey.
The following were noted present:

Also noted present was Business Administrator Nick Goldsack and
Borough Attorney Craig Coughlin.
Mayor Failace opened the meeting with no quorum at approximately
7:10 P.M. but stated they would wait for another member of the
Governing Body to be present before continuing. Councilmember
Quinones was noted present at approximately 7:18 P.M. making a
quorum and allowing the meeting to proceed.
At approximately 7:18 P.M. Councilmember Quinones was noted
present.
Statement of Meeting Notice was mailed to the Home News Tribune,
The Star Ledger and posted on the bulletin board on November 22,
2000.

Town Center Revitalization - Contract #99-21

Marvec Construction is almost completed with the exception of some
items and the delivery of monuments and plaques. The monument
supplier indicated that the granite monuments are scheduled to be
shipped out of Vermont on December 15 and delivered to Carteret by
Monday or Tuesday of the following week. Marvec Construction will
coordinate with Long Branch Monument for mounting of the bronze
plaques and complete any remaining items.

Business Administrator Nick Goldsack wanted to know if, with the
GIS, you could pin point the 200 feet and it can print out the 200 feet
in its entirety.
Jim Watson replied yes and it can give you a graphic picture. It can
also give you a filtered printout on all the attributes. GIS creates
different layers of information that are attached to lots and can be
fi Itered.
Business Administrator Nick Goldsack wanted to know when the
changes would take place.
John DuPont replied maybe once a year for the Borough.
Business Administrator Nick Goldsack asked if the (inaudible) had to
be replaced every year.
John DuPont replied yes. The (inaudible) is only $18.00 a sheet but it
can be bought at a lower cost.
Mayor Failace asked Mr. DuPont to clarify whether or not it was up to
date.
John DuPont replied to the end of this year. As far as what we did, we
took the key sheet and a representation of four (4) Tax Maps. When
you see the quality of the mapping (inaudible).
Councilmember Quinones asked a Mr. DuPont a question that was
inaudible.

Jim Watson stated that something is needed to attach it to. Census
information can be down loaded and attached to every lot and block,
you don't have to sit there and type it.
John DuPont's reply was inaudible.
Jim Watson stated that they were going to be amazed at how easy it is
and how useful. Use your imagination to think about what else can be
attached to this. Thank you for your time.

Mayor Failace stated that OENJ Cherokee is the project in
Woodbridge and part of the Industrial Road. The Mayor said that he
asked them to come before the Council. He said he met with them a
few times and he thought it was necessary for the Council to listen to
them as a whole.

John Giordano, Esq. stated that he was counsel for OENJ Cherokee.
The entire track consists of approximately two hundred and ninety
(290) acres located in Carteret with the balance located in
Woodbridge. One hundred and fifty (150) acres will be developed and
for Professional Engineering Services for Planning Board review/
easement acquisition phase, Design Engineering Phase, Bidding
Services phase and Construction Administration and Inspection phase
as outlined in the report. Estimated project costs including engineering
fees are $374,500. The line item was included in this year Sewer Bond
Ordinance for replacement of the Harrison A venue Pump Station.
IMPROVEMENTS TO THE DOROTHY STREET PUMP STATION
- CONTRACT # 00-05
A meeting for the Dorothy Street Pump Station was held with
representatives from the Borough, Killam and the Contractor, Maple
Construction Co. The contractor has provided the signed contracts,
insurance certificates and performance bond for the Borough review
and approval. The contractor will be providing a construction schedule
shortly. He anticipates beginning to submit shop drawings within a
few weeks dependent on weather conditions and schedules.
Construction is scheduled to begin in early 2001. The Contractor is
required to complete the project within 150 days.
INDUSTRIAL ROAD EXTENSION PROJECT - FEDERAL
GRANT
Killam's office has completed the revised conceptual alignment plan
for the Industrial Road Extension. The revised plan can be used by the
Borough in discussion with Conrail and the Federal Highway
Administration. Copies have been forwarded to the Borough and other
involved parties for review.

John DuPont spoke about re-doing the Tax Maps in digital formats.
They don't need State code or State regulations and they are not
stamped or approved by the State, which is a problem. They took the
most complex maps, scanned them in the computer and redid the maps
entirely. As a result they have maps with very clear data. They can
provide the Borough with eighty (80) tax maps on one (1) CD
(compact disk). Once they have the maps in the computer it will be
very easy to update them.

Jim Watson spoke about how difficult it is to get a good copy of the
maps. If something happens to these films they would have to start
again from the beginning. The digital maps that they are suggesting
could be made in five (5) to ten (10) minutes. The cost to generate a
disk is approximately one ($1.00) dollar. They recommend that the
street numbers should be put on the tax maps. The digital tax maps
will cost $48,000.00 to $49,000.00. If the project is okayed they could
have it in March. This could benefit many different departments, the
Fire Department, the Police Department, the First Aid Squad and the
Sewer Department. Funding for this project is available from a variety
of sources. Any department that uses this is eligible for grant money.

analyzed some of the conditions. They are hoping to construct a
combination sound barrier. It will be fifteen (15) feet high and made
out of wooden material. It would represent the necessary (inaudible) of
noise with the additional traffic on the roadway. A good portion of that
traffic is pre-existing traffic that is going down Roosevelt Avenue.
75% to 80% of the traffic is pre-existing. The other traffic will be
coming from their project. Most of the noise will be from the trucks
moving in and out.
Council member-elect Dan Reiman asked if it would be a car carrier.
Ralph Orlando replied that he didn't know but that he could find out.
What is nice about this whole design is that there is no anticipation of
any traffic on the site, it will be going onto Roosevelt Avenue. The
traffic will go either back into Woodbridge or around to Industrial
Road.
Councilmember Santoro asked what would happen when the people
come off the turnpike and they all use the same route.
Ralph Orlando replied that today they would find their way over to
Roosevelt Avenue. The intention is to get them off and get them
through Industrial Road.
Councilmember Santoro asked how close the barrier would be to the
homes in Carteret.
Ralph Orlando replied that between the property lines and the barriers
is ten (10) feet. In that ten-foot (10) section there will be landscaping
added and the wall with another stretch between the retaining wall and
the (inaudible). It's been selected based upon the noise studies that
they have undertaken. They will present all the detailed information to
the Council. In addition to that, if there is more specific information
like specific landscaping that is required that is satisfactory to Carteret.
Councilmember Santoro asked about lower Industrial Road. She asked
about the newer section because of the flooding and what height the
section is going to be?
Ralph Orlando replied that the roadway would basically be the same
grade as the homes along there now or lower. Industrial Road will stay
at a lower elevation through this section.
Council member Santoro asked if it will be raised like the other one
that caused the problem with the flooding.
Ralph Orlando stated that the rest of the area will be raised in order to
(inaudible) that particular area.
Councilmember Santoro stated then the water in our area (inaudible).

Inaudible--everyone speaking at once.
Ralph Orlando stated that they already developed an entire site plan
for this project that would be submitted to both Woodbridge and
Carteret, for review. These (inaudible) facilities, all the water is being
the balance of one hundred forty (140) acres will be consumed by
either the Industrial Road, the Industrial Road extension or Wetlands
litigation and open spaces. The property is supposed to be utilized as a
(inaudible) depot. (Inaudible) will be delivered by vessel barges and
will carry the vehicles to the site. The vehicles will be unloaded onto
an existing pier, which will be repaired and put into operational
conditions. The cars will be stored on site and then transported by
truck with approximately one fifteen-car train (inaudible). The site will
be remunerated and all the materials will be placed on the site.
Approximately three million cubit yards raising the existing grade
from ten (10) to fifteen (15) feet. The property will be subject to
remuneration in accordance with the final approval being given by the
New Jersey Department of Environmental. The channel will be
dredged so as to accommodate the large vessels, which will be utilized
in the operation bringing the vessels through the Arthur Kill to the
existing site. The site will be used as a depot and there will be storage
on the site for the vehicles and an office building. In order for them to
proceed with a site plan application in Carteret they need to fix a road
alignment for Industrial Road. They are requesting it be extended by
Carteret to the proposed property line of OENJ, which is under
contract, by OENJ from the present owners PSE&G and VISA. As
part and parcel of this project they are asking an alignment be fixed
through Carteret to their property line. Killam has proposed an
alignment acceptable to (inaudible). It is consistent with Killam and
(inaudible) and representatives from Schoor DePalma had (inaudible)
that it beats their overall concerns as it relates to the proposed location.
Their particular concern was the continued preservation of their
railroads that they utilize in part of their operations. He said he would
like Ralph Orlando to speak about some of the features of the site and
their improvement of Industrial Road

Ralph Orlando showed the Mayor and Council a rendering of the site
plans. He then discussed the map in great detail. The area in gray is the
proposed parking area for the vehicles. It will be brought in by boat
onto the site and then transported from the site to car dealerships
throughout the area. The project has a lot of amenities such as open
space and (inaudible) facilities with (inaudible) criteria. The purpose
of this evening is to focus on the line that is the extension of the
Industrial Road. The proposal is for Carteret to continue the extension
of Industrial Road and from that point onto the Stay-Flex property that
is coming into our property and terminating within the Carteret section
on their property and then for this project OENJ - (inaudible) parallel
to Edwin Street and then tie into Port Reading Avenue in Woodbridge.
This entire stretch of roadway would then meet the requirements
allowing for a regional bypass of the Carteret Center portion of town.
It's a master plan type of extension which Carteret and Woodbridge
jointly have considered. This is now the (inaudible) alignment that has
been agreed to, at this point between Killam Associates and designing
it to the point where it comes onto their side and then their
continuation of it. What he would like to do is represent a few details
that may be of some interest to the Council. They have a plan that was
given to them from Killam & Associates and working together
between the alignment of Stay-Flex and their particular site. He said he
would like to show them is a little detail about what is going to happen
on Edwin Street and the homes in that area. There are a lot of homes
on Edwin Street and they want to respect these homes. They have done
some noise testing, traffic studies, and environmental studies and

Councilmember Santoro asked if we can have Ralph Orlando contact
Woodbridge and confirm everything and report back because
(inaudible) Industrial Road (inaudible) portion of Carteret because this
never took place (inaudible).
Mayor Failace stated that they wouldn't continue and could not
continue with the Industrial Road unless they had a commitment from
Woodbridge or the developer.
Ralph Orlando replied that most of the (inaudible) is in Woodbridge.
They are prepared; we are making a public statement tonight, to
confirm that. When they get all the approvals, and when they proceed
with the project at (inaudible) and Carteret's commitment there is no
point in Carteret doing a extension if its going nowhere.
Councilmember Quinones (inaudible)
Borough Attorney Craig Coughlin asked if they currently own all that
property.
Ralph Orlando replied that they have it under contract.
Council member Santoro asked if there was a meeting coming up.
Ralph Orlando replied that the meeting has been deferred.
Councilmember Santoro wanted to know until when.
Ralph Orlando replied that he didn't have the dates. It has to do with
the Water (inaudible). It's been deferred pending the resolved
(inaudible).
Janet Santoro stated that what she is concerned about is what
(inaudible) because ours seems minimal compared to what there is.
Mayor Failace stated that the benefit is great. He said he is not sure of
the final position with Woodbridge and their governing body. He said
he spoke to them about it and they have said that they are looking for a
commitment from Carteret. If in fact we agree we think it is okay to do
this and it helps us extend Industrial Road through Port Reading and
take the traffic off lower Roosevelt Avenue. Our commitment
depends on everything that Woodbridge is going to do and it is tied
into that. The Mayor said that he did not think that we put ourselves in
harms way or do anything to Carteret if we agree that the Industrial
Road and this extension, if it is agreeable to the governing body and
Carteret, to do what we'd like to do and sit and wait. Our commitment
doesn't commit us to anything if Woodbridge doesn't do the project in
that fashion. He then asked if he was correct. We are committed to
extending the Industrial Road.

Janet Santoro stated that they have to extend it some place. We need to
know where we are extending it out.
Business Administrator Nick Goldsack stated that they also want a
monetary commitment from Carteret.

Councilmember Santoro stated that she had a question with the
acreage and if it's basically going to be the borderline of the road.
Ralph Orlando stated that they may ultimately be going before the
planning board but maybe some of the parking area will be in Carteret
but primarily it's mostly road area. A lot of it will remain
undeveloped.
Council member Santoro asked if the remammg two hundred and
seventy (270) acres and all the facilities are in Woodbridge. Is all that
area in Woodbridge?
Ralph Orlando replied that it is correct.
Councilmember Santoro asked if they had approval from Woodbridge.
Ralph Orlando replied no. First, we are hopeful to get (inaudible) to
agree on the proposed road alignment and make a site plan application.
Secondly, they are here to secure a commitment from Carteret and he
believes we have some other funds (inaudible) which will defray the
cost of construction of that portion of the roadway in Carteret. We
need that commitment (inaudible) in some form of Resolution and the
reason for that is Woodbridge has indicated that in addition to a
commitment which would be the subject matter of any approval that
we should secure from the Woodbridge Planning Board as it would
relate to the completion of the Industrial Road. They want assurances
that Carteret be permitted (inaudible) the balance of the Industrial
Road Extension to the property line so to ensure that the entire
Industrial Road will be (inaudible).
Councilmember Santoro asked if Woodbridge is concerned about
where this Industrial Road is coming out onto?
Ralph Orlando replied that he thought that was where Woodbridge is
at the moment. They want to get to the comfort level and Carteret is
committed to this project. That is one of the reasons (inaudible). They
will continue to refuse to consider the application until such time that
we come to them.
Councilmember Quinones asked if they would refuse to consider the
application until they get a commitment from us.
Ralph Orlando replied that you are going to undertake your portion of
(inaudible).

Ralph Orlando stated that in discussions with the Mayor there were
some funds available.

(inaudible) like Woodbridge isn't waiting for us to say that we would
agree to it. The other problem is that we need to work out with them
that they were just waiting to hear from us. She said that she would
like to hear from them that they were waiting for us and that would be
fine.
John Giordano replied that will confirm what they are saying.
Mayor Failace replied that they even put it in the newspaper for Mayor
McGreevey. In the last article they were waiting for a commitment
from us. OENJ Cherokee told them that he had told them that he
would support, with the Council, this project and if in fact we can do
that he would urge the Council to support this so that we can extend
the Industrial Road. The Mayor said that he didn't see whether
Woodbridge or whatever they have with the Army Corps of Engineers
or whatever it is that they have to do on that property but he didn't
know that a commitment from us will extend the Industrial Road, if in
fact they do everything that they are supposed to do, he does not see a
problem with that. It fits right into our project, the revitalization of
lower Roosevelt Avenue. Maybe somewhere along the line after this is
done there can be a swap, we can get lower Roosevelt Avenue, the
county can take that. We can make that completely light traffic; no
truck traffic goes there.
Councilmember Santoro stated that the whole key IS whether
Woodbridge agrees with it.
Mayor Failace replied yes. But, if they choose not to agree (inaudible).
Councilmember Santoro stated that it does fit but the problem is that it
isn't the Borough's decision.
Mayor Failace stated that it is the Borough's decision on what they are
asking us for, on this side. Whatever Woodbridge chooses to do. If
anything changes then the Borough's commitment changes. If
anything changes on the Woodbridge side beside what we are seeing
here then it is not valid.
Borough Attorney Craig Coughlin asked if they did some traffic
studies. Can you tell us what the impact is going to be both on lower
Roosevelt Avenue as well as the up end portion where Roosevelt
Avenue intersects near the Turnpike?
John Giordano replied that he is not prepared to go into great detail
about the traffic tonight but what he can tell us is that they have
studied all the traffic for the site and they have studied the diversion of
the traffic that would be coming through this area. We do know that all
of our traffic will go onto Industrial Road and we will not use
Roosevelt A venue, there would be no purpose to it. As indicated, the
small amount of trips that would be coming in and out of the area
which would be approximately 600 trips total a day. Approximately
100 trucks a day.

Councilmember Quinones wanted to know who would be able to
supply them with those studies.
Councilmember Quinones asked Ralph Giordano if he said that they
had to dredge along the Arthur Kill.
Ralph Giordano replied that they would be dredging along the pier.
Councilmember Quinones asked if there was an allocated section that
they would be dredging to the Carteret borderline.
Ralph Orlando replied that the dredging would only be on in
Woodbridge.
Councilmember Quinones then asked what the cost would be.
Ralph Orlando replied (inaudible).
Councilmember Quinones stated that she was curious.
Mayor Failace stated that quite honestly we could go back to three (3)
or (4) four years ago when he met with Woodbridge. Some of the
Councilmembers and Mayor Sica said this is the exact alignment that
we were looking at except the possibility of going to (inaudible) when
is not amendable to OENJ Cherokee. He said he understood why
because it divides the property and takes so much away. But, this is the
exact alignment that we looked at from Carteret through Woodbridge
to Port Reading Avenue. We had originally discussed it with them,
and basically they said they would not do it unless they have a
developer that will pay for (inaudible) on their side.
Ralph Orlando stated that they are willing to throw in the noise
(inaudible) wall and the landscaping. Beyond that they need some help
from the Mayor to gain some credibility with Woodbridge. They have
some concerns about the commitment of Carteret to the (inaudible)
and the expenditures of the time, effort and money as it would relate to
the (inaudible) Industrial Road. They want to be sure before they
undertake the consideration of a major project, which has one hundred
fifty (150) acres that are being developed in Woodbridge Township.
They will feel comfortable if they could get the commitment from us
because it is a practical matter and any approval they give us will be
subject to construction completion before the project becomes
operational. (Inaudible) build a road in Woodbridge including the
retaining "noise" wall up to the Carteret boundary line and then to find
that Carteret has not extended the road (inaudible).
Councilmember Quinones asked to the extent that you are able to
disclose it, what is the basis of your concern?

John Giordano replied that he thought that they were being careful.
They have a major project that is being considered and when it comes
up in Woodbridge they want to be able to say to the public that the
planning board, himself and Mr. Orlando want answers to what
assurances they have and what assurances do you have to (inaudible)
to be built that which is necessary in Carteret.
Councilmember Santoro stated that she had many questions. She said
that it is her understanding that (inaudible) Woodbridge was having
letters and things drafted that was against that. So there is many
questions on whether (inaudible) water section. Her concern is

going to evaluate timing and how it's going to go forward in
relationship to whether or not this is going to be a contentious
application for him but he could not speak for Mayor McGreevey. We
are all sufficiently familiar about what happened here and (inaudible).
Mayor Failace stated that he thinks that once the Borough Attorney
speaks with Woodbridge and we will contact them ASAP (as soon as
possible) and move forward. You will know exactly what will happen
in a few days.
John Giordano asked if the Mayor wanted copies of the traffic study.
Mayor Failace replied yes. Please make extra copies for the Council
and a few more because we have Council-elect who would like copies
too.

ORDINANCES: Public Hearing
1. #00-51 Amending Salary Ordinance #71-9, Re: Clerk Typist with
Transcribing Duties.
2. #00-53 Amending Chapter 38-5 of the Code, Re: Repealing
Residency Requirements.
Council member Santoro stated that she had a question about
Ordinance #00-53. She said she knew it was amended at a meeting, for
a year. Would there be a chance about discussing (inaudible) and we
don't have anyone here to discuss it.
Councilmember Quinones asked what the difference would be.
Council member Santoro replied that a year residency isn't secure
enough. Somebody can move into town for a year (inaudible).
Mayor Failace stated that we should do that with the police too.
Councilmember Santoro stated that they have no control with that.
That is State and this is something we can control and have for the
residents of Carteret.
Councilmember Quinones asked if it was fair to put the burden on
them to have to be here ten (10) years.
Councilmember Santoro replied that she said five (5) or ten (10) and
right now they are mandated to live in Carteret. Most of them are
people who were born and raised here, have worked here and she
doesn't" . see (inaudible). They probably have been living here so it's
not going to effect those people anyway. The ones it is going to effect
are the ones who think it's a quick fix to get ajob after living here for
a year.

Councilmember Quinones stated that she didn't understand why
Councilmember Santoro thinks this will hurt the people that live in
Carteret. As a potential employer, can we look at an application from
five (5) people from Carteret and three (3) people from outside of

they would want. All the noise levels and all the traffic studies that
they would need. Any type of development that would go on here.
Two thousand (2000) could easily come in and out of this
development.
Borough Attorney Craig Coughlin asked if they had any numbers on
how many of those (inaudible).
John Giordano replied yes. They would probably be diverting about
six hundred (600) to eight hundred (800) (inaudible) per peak hour.
Councilmember Sohayda asked if they were willing to leave the truck
traffic on lower Roosevelt Avenue. Because if you are going to tell
him to take the traffic off lower Roosevelt Avenue in this study and
then you are going to tell him (inaudible) on that particular project
(inaudible).
Mayor .Failace stated that they did not say that. The proposal is to take
the traffic off of Roosevelt A venue. Cars will still be going through.
Councilmember Sohayda stated that he is talking about the (inaudible).
Mayor Failace stated that the key to that project is taking all the traffic
off (inaudible).
Councilmember Sohayda stated that since the Mayor ran all the
meetings, the people had major concerns about the truck traffic and
that it is going to stay on the road.
Mayor Failace replied no it is going to take the traffic off the road.
Councilmember Sohayda stated that there would be no reason for a
truck to find its way through lower Roosevelt A venue.
Mayor Failace said he would certainly go to the county and ask them
to give us a swap. Ask the county to give us Washington and
Roosevelt and we will give them Industrial Road. Or ask them to make
it a light traffic area. He said he thinks that they would be more
amendable to do that.
Councilmember Quinones stated that she did not think that anyone
wants to put more trucks on lower Roosevelt A venue.
Mayor Failace stated to John Giordano that the Council is amendable
to doing something but we are asking the Borough Attorney to speak
to Woodbridge. If everything goes well, we will do it very quickly, If
we can get the information quickly enough we can do it at the next
Council meeting.
11. John Giordano stated that they should feel free to confirm to the
representatives that he has made it to where Woodridge is (inaudible)
application and he represents to them (inaudible). His deep-seated
suspicions, not facts, is when this road problem is solved the
(inaudible). As he understands we don't want to do anything until such
time (inaudible). He can't speak until such time that they Mayor of
Woodbridge, who has political aspirations, and they are sure he is

Mayor Failace replied no. How it works is that we set up this
Redevelopment Agency, when we go to the local finance board in
December it is set up as to what we have right now in lower Roosevelt
A venue, the revitalization district. In the future, if this
Councilor the next Council says that they should expand this and add
ten (10) more blocks or take this piece of property and throw this in;
you don't have to go to the
Local Finance Board anymore.
Councilmember Santoro replied then they don't need anymore
approvals. She said that she knew there was an attorney appointed for
redevelopment and the planning board.
Borough Attorney Craig Coughlin stated that they need the Local
Finance Board too.
Borough Administrator Nick Goldsack stated that they need the Local
Finance Board's approval in December to establish the (inaudible).
Councilmember Santoro stated if they wanted to add (inaudible).
Mayor Failace rèplied that you don't have to go back anymore.
Councilmember Santoro stated (inaudible) because she is in the
process of getting them from other towns.
Borough Attorney Craig Coughlin asked if she meant other areas of
the community.
Mayor Failace replied no, Councilmember Santoro is referring to the
Ordinance.
Councilmember Santoro stated to create a Redevelopment Agency.
We have a (inaudible), Perth Amboy, Rahway, Woodbridge, Hoboken,
Bayonne and South Amboy. She said she asked them to fax the
information to her because she assumes it is going to be a three (3)
page (inaudible). They have booklets. She wants to know if they can
add or change it.

Hoboken the Ordinance establishes the redevelopment plan within the
Ordinance being part of the whole scenario.
Councilmember Santoro replied that if you are reading it and then you
need to know what goes along with that.

Hoboken did is that the Housing Authority is the Redevelopment
Agency. They brought it over to the council and they reestablished it
as the Mayor and Council redevelopment agency. What you see is the
document outlining the redevelopment plan.

Councilmember Santoro replied that they were very specific.
Mayor Failace stated that was the redevelopment plan.
Carteret? If it happens that three (3) people or one person who lives
outside of Carteret that is qualified, (inaudible) have the option to
(inaudible) but you don't have to discount anyone else because they
live here.
Councilmember Santoro replied no, you don't have to but she would
hope that everyone who sits here will give the preference to us. There
is no guarantee that would happen. This has been in existence for so
long and it is going to be changed. She just thinks that they didn't even
have what they were voting on until that meeting when we walked in
there. From that meeting we went directly to an amendment and this is
an agenda where we can discuss it.
Councilmember Quinones replied that (inaudible) made it fairly
consistence with what the (inaudible) wants to do.
Councilmember Santoro replied that it wasn't, because that is not
something that we can control. The Police and the Fire are controlled
by the State. If we could control it, it might not be that.
Councilmember Quinones stated that she just doesn't see a valid
argument for not having it or making it five (5) or ten (10) years as
opposed to one (1) year. The one- (1) year just makes it consistent with
what other employees in the town are required to do. If you can come
up with an argument that makes her think that it is fairer to impose five
(5) or ten (10) years then she will consider it. At this point she does not
think they are hurting the residents of Carteret by doing this because
there is always the option of hiring them.
Councilmember Santoro replied that when we did go back to that
problem it overlooked Carteret residence and she will go back to that
to make it easy for someone to move in, gain a job in Carteret over
people who lived here and worked here, and had their children here
and their homes here, just because they can build a residency for a year
is unfair.
Mayor Failace stated that it doesn't change anything, in the hiring. The
point in fact is this Councilor whoever is hiring can hire as they
choose and take a preference to someone living in Carteret. They can
do that. You can certainly bring that up to amend it and it will be voted
on.
3. #00-54 Creating a Carteret Redevelopment Agency.
Councilmember Santoro wanted to know where this came from.
Borough Attorney Craig Coughlin replied that he drafted it.
Councilmember Santoro wanted to know if it was from the statute.

very closely. He thinks the only difference is that he included the
obligation to (inaudible).
Councilmember Santoro asked if this redevelopment is just for lower
Roosevelt Avenue. Because the redevelopment agency in other towns
sometimes targets just one (1) area. Is this just a blanket?

2. John DuPont, PE - Planning Board/Zoning Board Salary
Mayor Failace stated that he thought that they did this twenty (20)
months ago.
Councilmember Santoro stated that it should come through the Boards.
Every other salary came from them. It came through for Tony, the
attorney etc.
Borough Administrator Nick Goldsack stated that the Board passed a
Resolution when this first issue came up. The Resolution requested
that he be paid a salary.
Councilmember Santoro asked if they could see that.
Municipal Clerk Kathleen Barney replied that she would get it from
Gloria Goodrich.
Mayor Failace stated that he thought they did this in the beginning of
the year.

Municipal Clerk Kathleen Barney stated that the violation was for
a liquor sale to a minor. She said the officers told her that they
already corrected it. They have someone standing by the door
proofing people before they come in. They also have their list
there. He said that he would turn it over to Mayor and Council.
Mayor Failace stated that they've been there awhile and it's a first
offence. Should we have a hearing?
Borough Attorney Craig Coughlin replied that it was the Council's
prerogative

the file. When it came to the renewal, the Council might want to
consider something then.
Councilmember Quinones stated that she did not think they had

before we issued any more money it was requested (inaudible).
Mayor Failace replied it was because we had so much on the last
agenda meeting. We had four (4) and five (5) things on and he said to
Nick that they were not going to give anymore money until they come.

Borough Attorney Craig Coughlin stated he was contacted by the
lawyer for Sprint. They want to locate somebody else called FX Radio.
Under the agreement they are required to obtain the Borough's
consent. He did not know if the Council wanted them to come in and
make a presentation or submit more documents.
Mayor Failace wanted to know if they were going to give us more
money.
Councilmember Santoro asked if (inaudible) with them?

if they are current. We have an agreement in place where we get a
percentage of the fee that Sprint gets.

Mayor Failace stated that he went to the Solid Waste Advisory
Commission meeting in Union County. There are twenty-one (21)
members and five (5) showed from the representatives for each mayor
in Union County. There was no vote taken but they are supposed to
advise the Freeholders before tomorrow as to whether they think we
should include the transfer station. We all had a chance to speak but
quite honestly it was a waste of time. We have a number of cars going
down tomorrow and he urges anyone who can get to Birch Street in
Elizabeth should go to that meeting for the Freeholders tomorrow.
Secondly, we made the adjustments on the hospitalization benefits that
were taken away from the Mayor and Council. He said he knows that
there was talk as to why we kept on the Borough Attorney and Public
Defender. He said he would like to do away with that Ordinance
completely. He thinks there is no need to do that since we took it away
from the Council. The Council suggested that they were picking and
choosing.
Resolution # 00-389 was introduced by the Mayor and referred to the
Council for action.

Veterans Ball Field Lighting - Contract #00-08
The project design and the preparation of documents are complete.
The contract was advertised this week. The bids should be received on
December 15th, they will prepare the bid report. The project consists of
the installation of four (4) support poles and twenty-six (26) fixtures to
provide illumination of Veteran Ball Field and meeting the
requirements of the National Little League lighting standards.
Boiler Replacement Carteret police Station - Contract # 00-10
Bid documents have been completed by Killam & Associates and J.C.
Morris Associates. The project was advertised for public bid this week.
The bids are scheduled to be received by December 15th. Killam will
prepare the bid report for the Borough's review and consideration. The
project consists of removal and disposal of the existing oil fired
heating unit and replacement with a new gas fired unit to serve the
Police Headquarters and the Municipal Court. A heating oil storage
tank continues to serve during the interim.
CARTERET HEALTH
Access Ramp -
DEPARTMENT
Handicap
Lauro Architects is preparing the design documents for the installation
of the handicap access ramp for the Carteret Health Department. It
should be completed by the end of the year and quotes for the work
early next year.
SEWER FACILITIES:
Sabo Street Pump Station Replacement and Sanitary Sewer System
Improvements - Contract # 99-13
Contractors Ace Manzo, Inc. & D. Manzo & Son Inc., are progressing
on schedule with the work under Contract #99-13. The contractor has
completed the generator building, electrical and plumbing work. The
Contractor has received the new pumps but he is waiting for the
delivery of the generator and control panels prior to re-mobilization.
SANITARY SEWER MANHOLE REHABILITATION PHASE I -
contract #99-19
Vangelis Construction is progressing with the rehabilitative measures
on approximately 240 of the deteriorated sanitary manholes. Based
upon contractor's progress the work should be completed by the end of
December.

HARRISON A VENUE PUMP STATION EVALUATION
Killam has completed the preliminary evaluation of the pump station
and has prepared the attached evaluation report of November 27th for
the Borough. The Harrison Avenue Pump Station has to be replaced
and the sewer improvements. The estimated cost of construction is
$310,000. Killam requested authorization of the budget for

going to evaluate timing and how it's going to go forward in
relationship to whether or not this is going to be a contentious
application for him but he could not speak for Mayor McGreevey. We
are all sufficiently familiar about what happened here and (inaudible).
Mayor Failace stated that he thinks that once the Borough Attorney
speaks with Woodbridge and we will contact them ASAP (as soon as
possible) and move forward. You will know exactly what will happen
in a few days.
John Giordano asked if the Mayor wanted copies of the traffic study.
Mayor Failace replied yes. Please make extra copies for the Council
and a few more because we have Council-elect who would like copies
too.

ORDINANCES: Public Hearing
1. #00-51 Amending Salary Ordinance #71-9, Re: Clerk Typist with
Transcribing Duties.
2. #00-53 Amending Chapter 38-5 of the Code, Re: Repealing
Residency Requirements.
Councilmember Santoro stated that she had a question about
Ordinance #00-53. She said she knew it was amended at a meeting, for
a year. Would there be a chance about discussing (inaudible) and we
don't have anyone here to discuss it.
Council member Quinones asked what the difference would be.
Councilmember Santoro replied that a year residency isn't secure
enough. Somebody can move into town for a year (inaudible).
Mayor Failace stated that we should do that with the police too.
Councilmember Santoro stated that they have no control with that.
That is State and this is something we can control and have for the
residents of Carteret.
Councilmember Quinones asked if it was fair to put the burden on
them to have to be here ten (10) years.
Council member Santoro replied that she said five (5) or ten (10) and
right now they are mandated to live in Carteret. Most of them are
people who were born and raised here, have worked here and she
doesn't . see (inaudible). They probably have been living here so it's
not going to effect those people anyway. The ones it is going to effect
are the ones who think it's a quick fix to get ajob after living here for
a year.

Councilmember Quinones stated that she didn't understand why
Councilmember Santoro thinks this will hurt the people that live in
Carteret. As a potential employer, can we look at an application from
five (5) people from Carteret and three (3) people from outside of

(inaudible) like Woodbridge isn't waiting for us to say that we would
agree to it. The other problem is that we need to work out with them
that they were just waiting to hear from us. She said that she would
like to hear from them that they were waiting for us and that would be
fine.
John Giordano replied that will confirm what they are saying.
Mayor Failace replied that they even put it in the newspaper for Mayor
McGreevey. In the last article they were waiting for a commitment
from us. OENJ Cherokee told them that he had told them that he
would support, with the Council, this project and if in fact we can do
that he would urge the Council to support this so that we can extend
the Industrial Road. The Mayor said that he didn't see whether
Woodbridge or whatever they have with the Army Corps of Engineers
or whatever it is that they have to do on that property but he didn't
know that a commitment from us will extend the Industrial Road, if in
fact they do everything that they are supposed to do, he does not see a
problem with that. It fits right into our project, the revitalization of
lower Roosevelt A venue. Maybe somewhere along the line after this is
done there can be a swap, we can get lower Roosevelt Avenue, the
county can take that. We can make that completely light traffic; no
truck traffic goes there.
Councilmember Santoro stated that the whole key IS whether
Woodbridge agrees with it.
Mayor Failace replied yes. But, if they choose not to agree (inaudible).
Councilmember Santoro stated that it does fit but the problem is that it
isn't the Borough's decision.
Mayor Failace stated that it is the Borough's decision on what they are
asking us for, on this side. Whatever Woodbridge chooses to do. If
anything changes then the Borough's commitment changes. If
anything changes on the Woodbridge side beside what we are seeing
here then it is not valid.
Borough Attorney Craig Coughlin asked if they did some traffic
studies. Can you tell us what the impact is going to be both on lower
Roosevelt Avenue as well as the up end portion where Roosevelt
A venue intersects near the Turnpike?
John Giordano replied that he is not prepared to go into great detail
about the traffic tonight but what he can tell us is that they have
studied all the traffic for the site and they have studied the diversion of
the traffic that would be coming through this area. We do know that all
of our traffic will go onto Industrial Road and we will not use
Roosevelt Avenue, there would be no purpose to it. As indicated, the
small amount of trips that would be coming in and out of the area
which would be approximately 600 trips total a day. Approximately
100 trucks a day.

supply them with those studies.

Councilmember Santoro asked if we can have Ralph Orlando contact
Woodbridge and confirm everything and report back because
(inaudible) Industrial Road (inaudible) portion of Carteret because this
never took place (inaudible).
Mayor Failace stated that they wouldn't continue and could not
continue with the Industrial Road unless they had a commitment from
Woodbridge or the developer.
Ralph Orlando replied that most of the (inaudible) is in Woodbridge.
They are prepared; we are making a public statement tonight, to
confirm that. When they get all the approvals, and when they proceed
with the project at (inaudible) and Carteret's commitment there is no
point in Carteret doing a extension if its going nowhere.
Councilmember Quinones (inaudible)
Borough Attorney Craig Coughlin asked if they currently own all that
property.
Ralph Orlando replied that they have it under contract.
Councilmember Santoro asked if there was a meeting coming up.
Ralph Orlando replied that the meeting has been deferred.
Councilmember Santoro wanted to know until when.
Ralph Orlando replied that he didn't have the dates. It has to do with
the Water (inaudible). It's been deferred pending the resolved
(inaudible).
Janet Santoro stated that what she is concerned about is what
(inaudible) because ours seems minimal compared to what there is.
Mayor Failace stated that the benefit is great. He said he is not sure of
the final position with Woodbridge and their governing body. He said
he spoke to them about it and they have said that they are looking for a
commitment from Carteret. If in fact we agree we think it is okay to do
this and it helps us extend Industrial Road through Port Reading and
take the traffic off lower Roosevelt Avenue. Our commitment
depends on everything that Woodbridge is going to do and it is tied
into that. The Mayor said that he did not think that we put ourselves in
harms way or do anything to Carteret if we agree that the Industrial
Road and this extension, if it is agreeable to the governing body and
Carteret, to do what we'd like to do and sit and wait. Our commitment
doesn't commit us to anything if Woodbridge doesn't do the project in
that fashion. He then asked if he was correct. We are committed to
extending the Industrial Road.

Janet Santoro stated that they have to extend it some place. We need to
know where we are extending it out.
Business Administrator Nick Goldsack stated that they also want a
monetary commitment from Carteret.

analyzed some of the conditions. They are hoping to construct a
combination sound barrier. It will be fifteen (15) feet high and made
out of wooden material. It would represent the necessary (inaudible) of
noise with the additional traffic on the roadway. A good portion of that
traffic is pre-existing traffic that is going down Roosevelt A venue.
75% to 80% of the traffic is pre-existing. The other traffic will be
coming from their project. Most of the noise will be from the trucks
moving in and out.
Councilmember-elect Dan Reiman asked if it would be a car carrier.
Ralph Orlando replied that he didn't know but that he could find out.
What is nice about this whole design is that there is no anticipation of
any traffic on the site, it will be going onto Roosevelt A venue. The
traffic will go either back into Woodbridge or around to Industrial
Road.
Councilmember Santoro asked what would happen when the people
come off the turnpike and they all use the same route.
Ralph Orlando replied that today they would find their way over to
Roosevelt Avenue. The intention is to get them off and get them
through Industrial Road.
Councilmember Santoro asked how close the barrier would be to the
homes in Carteret.
Ralph Orlando replied that between the property lines and the barriers
is ten (10) feet. In that ten-foot (10) section there will be landscaping
added and the wall with another stretch between the retaining wall and
the (inaudible). It's been selected based upon the noise studies that
they have undertaken. They will present all the detailed information to
the Council. In addition to that, if there is more specific information
like specific landscaping that is required that is satisfactory to Carteret.
Councilmember Santoro asked about lower Industrial Road. She asked
about the newer section because of the flooding and what height the
section is going to be?
Ralph Orlando replied that the roadway would basically be the same
grade as the homes along there now or lower. Industrial Road will stay
at a lower elevation through this section.
Councilmember Santoro asked if it will be raised like the other one
that caused the problem with the flooding.
Ralph Orlando stated that the rest of the area will be raised in order to
(inaudible) that particular area.
Councilmember Santoro stated then the water in our area (inaudible).

Ralph Orlando stated that they already developed an entire site plan
for this project that would be submitted to both Woodbridge and
Carteret, for review. These (inaudible) facilities, all the water is being

Business Administrator Nick Goldsack wanted to know if, with the
GIS, you could pin point the 200 feet and it can print out the 200 feet
in its entirety.
Jim Watson replied yes and it can give you a graphic picture. It can
also give you a filtered printout on all the attributes. GIS creates
different layers of information that are attached to lots and can be
fi Itered.
Business Administrator Nick Goldsack wanted to know when the
changes would take place.
John DuPont replied maybe once a year for the Borough.

be replaced every year.
John DuPont replied yes. The (inaudible) is only $18.00 a sheet but it
can be bought at a lower cost.
Mayor Failace asked Mr. DuPont to clarify whether or not it was up to
date.
John DuPont replied to the end of this year. As far as what we did, we
took the key sheet and a representation of four (4) Tax Maps. When
you see the quality of the mapping (inaudible).
Councilmember Quinones asked a Mr. DuPont a question that was
inaudible.

Jim Watson stated that something is needed to attach it to. Census
information can be down loaded and attached to every lot and block,
you don't have to sit there and type it.
John DuPont's reply was inaudible.
Jim Watson stated that they were going to be amazed at how easy it is
and how useful. Use your imagination to think about what else can be

Mayor Failace stated that OENJ Cherokee is the project in
Woodbridge and part of the Industrial Road. The Mayor said that he
asked them to come before the Council. He said he met with them a
few times and he thought it was necessary for the Council to listen to
them as a whole.

John Giordano, Esq. stated that he was counsel for OENJ Cherokee.
The entire track consists of approximately two hundred and ninety
(290) acres located in Carteret with the balance located in
Woodbridge. One hundred and fifty (150) acres will be developed and

Veterans Ball Field Lighting - Contract #00-08
The project design and the preparation of documents are complete.
The contract was advertised this week. The bids should be received on
December 15th, they will prepare the bid report. The project consists of
the installation of four (4) support poles and twenty-six (26) fixtures to
provide illumination of Veteran Ball Field and meeting the
requirements of the National Little League lighting standards.
Boiler Replacement Carteret Police Station - Contract # 00-10
Bid documents have been completed by Killam & Associates and J.C.
Morris Associates. The project was advertised for public bid this week.
The bids are scheduled to be received by December 15th. Killam will
prepare the bid report for the Borough's review and consideration. The
project consists of removal and disposal of the existing oil fired
heating unit and replacement with a new gas fired unit to serve the
Police Headquarters and the Municipal Court. A heating oil storage
tank continues to serve during the interim.
CARTERET HEALTH
Access Ramp -

Handicap
Lauro Architects is preparing the design documents for the installation
of the handicap access ramp for the Carteret Health Department. It
should be completed by the end of the year and quotes for the work
earl y next year.
SEWER FACILITIES:
Sabo Street Pump Station Replacement and Sanitary Sewer System
Improvements - Contract # 99-13
Contractors Ace Manzo, Inc. & D. Manzo & Son Inc., are progressing
on schedule with the work under Contract #99-13. The contractor has
completed the generator building, electrical and plumbing work. The
Contractor has received the new pumps but he is waiting for the
delivery of the generator and control panels prior to re-mobilization.
SANITARY SEWER MANHOLE REHABILITATION PHASE I -
contract #99-19
Vangelis Construction is progressing with the rehabilitative measures
on approximately 240 of the deteriorated sanitary manholes. Based
upon contractor's progress the work should be completed by the end of
December.

HARRISON A VENUE PUMP STATION EVALUATION
Killam has completed the preliminary evaluation of the pump station
and has prepared the attached evaluation report of November 27th for
the Borough. The Harrison A venue Pump Station has to be replaced
and the sewer improvements. The estimated cost of construction is
$310,000. Killam requested authorization of the budget for
