AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING
CHAPTER 25 OF THE LYNWOOD MUNICIPAL CODE BY PERMITTING MINISTERIAL
APPROVAL OF SECOND UNITS SUBJECT TO SPECIFIC CRITERIA; AND AMENDING
RESIDENTIAL DEVELOPMENT STANDARDS.
WHEREAS, State Government Code Section 65851.1 has permitted second units
since 1982; and
WHEREAS, State Government Code Section 65851.1 allowed such accessory
apartments and granny units to increase housing options and provide for senior citizens
and other affordable housing; and
WHEREAS, the Lynwood Municipal Code currently requires a Conditional Use
Permit for second units in R -2 and R -3 zones and does not permit second units in R -1
zones; and
WHEREAS, this ordinance will comply with Assembly Bill AB 1866 to permit
second units with ministerial approval; and
WHEREAS, Assembly Bill AB 1866 allows local government to implement
reasonable development standards pertaining to parking, setbacks, lot coverage; and
WHEREAS, such regulations for second residential units shall protect the public
health, safety, welfare, aesthetics and property values in the City of Lynwood.
WHEREAS, the Lynwood City Council, pursuant to law, conducted a public
hearing on Zoning Ordinance Amendment No. 2003 -01; and
WHEREAS, the Lynwood City Council considered all public oral and written
testimony offered at the public hearing.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY
ORDAIN AS FOLLOWS:
Section 1. Subsection 25- 4.2(d) of the Lynwood Municipal Code
pertaining to "Existing Uses" is hereby renumbered to Subsection 25- 4.2(e).
Section 2. Subsection 25- 4.2(d) is hereby added to the Lynwood
Municipal Code to read as follows:
d. Second residential unit in R -1 (Single - Family Residential) zones:
Second residential unit in R -1 zones may be approved ministerially
through the Site Plan Review process provided they comply with all of the
following:
1) Second residential unit shall not exceed the allowable
density for the lot upon which the second unit is located, and that second
unit is consistent with the existing general plan and zoning designation for
the lot. A lot shall provide a minimum of 6,223 square feet of gross lot
area (seven (7) dwelling units per acre).
2) There shall be no more than one (1) second residential
dwelling unit allowed per lot.
3) A two -car garage shall be provided for both the primary
residence and the second residence. Such garage shall measure 20' x 20'
(400 square feet) and shall remain clear and accessible for vehicle parking
at all times. Tandem parking shall not be permitted and no parking in
setbacks shall be permitted except pursuant to Section 25- 4.6(b)
4) The lot shall contain an existing single - family dwelling.
5) The increased floor area of an attached second residential
unit shall not exceed thirty percent (30 %) of the existing living area.
6) The total floor area of a detached second residential unit
shall not exceed 1,200 square feet.
7) Second residential unit shall be constructed in such a
manner as to be compatible with the existing primary residence in terms
of form, material and architectural design.
8) Second residential unit shall comply with all development
standards set forth in Lynwood Municipal Code Section 25- 4.5(a).
9) Second residential unit shall comply with all provisions of the
California Building Code.
10) The sanitary sewer main line servicing the property shall not
be at or exceeding capacity.
11) The water line servicing the property shall not be at or
exceeding capacity.
12) Second units shall comply with the Site Plan Review process
and procedure set forth in Lynwood Municipal Code Section 25 -32.
Section 3. Section 25- 4.2(a) of the Lynwood Municipal Code is hereby
amended to read as follows in part.
a. Residential Uses
Zones
R -1 R -2 R -3
Single- family dwellings, including State approved SPR CUP CUP
manufacturing housing.
Multiple dwellings containing not more than two SPR CUP CUP
(2) residential units, including duplex, detached
residences, and approved manufacturing housing.
Section 4. Section 25- 4.5(a)(11) of the Lynwood Municipal Code is
hereby amended to read as follows:

11. Minimum floor area in square feet.
No dwelling unit shall have less total floor area than is specified in this
section. The total floor area shall be determined by the outside dimensions of
the structure, excluding porches, garages, and similar non - habitable accessory
areas.
Minimum area in square feet:
Efficiency (bachelor) 500
One (1) bedroom 600
Two (2) bedroom 750
Three (3) bedroom 900
Section 5. The City Clerk is hereby directed to certify to the passage and
adoption of this Ordinance and cause it to be published or posted as required by
law.
First read at a regular meeting of the City Council held on the 3 d day of
.dune , 2003 and adopted and ordered published at a regular meeting of said City
Council on the 17th day of June _'2003.
