HomeMy Public PortalAboutOrd. 1537ORDINANCE NO. 1537 AN INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING TO SECTION 7 -28 TO THE LYNWOOD MUNICIPAL CODE WHEREAS, vehicles left parked on public streets for long periods of time create an inconvenience for shoppers by monopolizing available parking spaces; and WHEREAS, the City by imposing a nominal charge for the privilege of parking vehicles on certain streets and commercial areas may recover in part revenues required for the maintenance of such streets; and, WHEREAS, the City finds and declares that the volume of traffic in certain sections of the City has the effect of congesting the streets and impeding the movement of traffic; that numerous operators, absent any restrictions and regulations for regulating traffic, do park for unreasonably periods of time on the congested parts of the City's business streets; that such practice impedes and prohibits the rights held in common by other members of the public to use the streets of the City of Lynwood in the congested portions of the City; and that the employment of parking meters and the enforcement of parking restrictions will reduce the number of employees required to regulate traffic and parking in congested areas. The City Council therefore declares the necessity and public policy of establishing restricted parking districts, designating individual parking spaces in said area, restricting parking in said areas to reasonable intervals of time. It is reasonable that operators of vehicles who enjoy the use of parking spaces so designated shall be required to pay a portion of the costs of establishing, maintaining and regulating the use of such parking spaces. WHEREAS, the City under the authority granted to it by the California Constitution, Article XVi, Section XV, Vehicle Code section 22508 and other applicable laws, has determined that the creation of parking meter zones will be of benefit to the community, NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD HEREBY DOES ORDAIN AS FOLLOW: 7 -28.1 DEFINITIONS As Used in this Section Highway shall mean a way or place of whatever nature, publicly maintained and open to use of the public for purposes of vehicular travel. Operator shall mean an individual who operates a vehicle or is the registered owner, including a business entity. Parking Meter shall mean an installed device adjacent to delineated parking space that receives and retains specified coins and displays hours of required operation, time charges, and expiring time periods. Park or Parking shall mean the stopping of a vehicle, whether occupied or not, other that momentarily for the purpose of and while actively engaged in loading or unloading property or individuals. Parking Meter Zone shall mean any highway within the restricted parking district upon which parking meters are installed and in operation. Parking Meter Space shall mean any space within a parking meter zone adjacent to a parking meter and which is duly designated for the parking of a single vehicle by lines painted or otherwise durably marked on the curb or on the surface of the street adjacent to or adjoining a parking meter. Parking Meter Zone Permit shall mean a permit issued under this section which, when displayed upon a motor vehicle, shall exempt said motor vehicle from parking meter violations and time restricted parking violations of a reasonable nature established pursuant to this section. Vehicle shall mean a device by which any person or property may be propelled, moved, or drawn upon a highway, except a device moved by human power or used exclusively upon stationary rails or tracks. 7 -28.2 METER ZONES The following are existing zones within the restricted parking district and shall be designated as: a. City Park / Hospital Zone 1A— area bounded by and also included to the north west Imperial Highway, west to Birch Street, south to Platt Avenue, east to Bullis Road, north to Le Sage Street, first alley north of Martin Luther King Jr. Boulevard and Martin Luther King Jr. Boulevard. b. North Long Beach Boulevard Zone 213— Long Beach Boulevard bonded to the north by Tweedy Boulevard and to the south by Martin Luther King Jr. Boulevard. 7 -28.3 PARKING SPACES All highways within a Parking Meter Zone shall be marked with white lines designating parking spaces, within which are required to park. 7 -28.4 PARKING METERS Parking meters shall be installed in Parking Meter Zones and may from time to time be adjusted by ordinance. a. The operator of a vehicle shall upon parking immediately deposit in the adjacent meter, proper coin and set in operation the timing mechanism on such meter in accordance with all directions appearing thereon. b. Any person parking a vehicle in a space adjacent to a meter, which indicates unused time, shall not be required to deposit a coin so long as occupancy of the space does not exceed the indicated unused parking time. c. No vehicle shall remain in a parking space beyond the parking time limits set for such parking space, or if the meter time shall have expired, then in either event, the vehicle shall be considered as parking overtime. Overtime parking shall be deemed a violation of this Section and subject to penalty. Parking meters shall be operated in said parking meter zones on the days and between the hours as prescribed by the City Manager so long as the same are duly posted. 7 -28.5 PARKING FEES The City Council may by ordinance from time to time may provide for the installation, alteration, or removal of parking meters and the type of meters to be installed, fix, or change the rates of fees, penalties and fines for any of the foregoing adopted zones, which to the extent possible shall be standardized with similar fees recovered within Los Angeles County for the same offenses. The following charges are hereby authorized and maybe amended from time to time: Meters Charges 1 hour 12 minutes $. 05 24 minutes $. 10 1 hour $.25 1 hour 6 minutes $.05 12 minutes $. 10 30 minutes $. 25 1 hour $ .50 2 hours 3 minutes $.05 6 minutes $ .10 15 minutes $ .25 30 minutes $. 50 1 hour $ 1.00 1 1/2 hour $ 1.50 2 hours $ 2.00 Notwithstanding the foregoing parking meter charges, the City Manager may direct the usage of the following types of meters and charges at locations deemed appropriate: Meters Charges 5 minutes $.05 15 minutes $.20 30 minutes $.25 1 hour $.25 1 hour $.50 2 hours $ 1.00 7 -28.6 PARKING CITATIONS The Notice of Parking Citation shall be accompanied by written notice of the amount of the parking penalty due for that violation, the address of the agency authorized to receive payment of the parking penalty, statement in bold print that payments of the parking penalty for the parking violation may be sent through the mail, and instructions on obtaining information on appealing procedures. 7 -28.7 VIOLATIONS It shall be unlawful and a violation of the provisions of the Section for any person: a. To stop, stand, or park any vehicle in any parking space within a Parking Meter Zone, beyond the parking time limits set for such parking space or if the meter shall indicate such illegal parking, then, and in either event, such vehicle shall be considered as parking overtime. Which is beyond the period of legal parking time and such parking shall be deemed a violation of this Section. G b. To cause, allow, permit or suffer any vehicle operated by such person to be parked overtime, or beyond the period of legal parking time established for any parking meter or Parking Meter Zone as herein described. c. To deposit additional coins, tokens or debit cards in a parking meter for the purpose of displaying time remaining on said meter beyond that which the vehicle in the parking meter space is lawfully allowed. d. To park any vehicle across any line or marking of a parking meter space or in such position that the vehicle shall not be entirely within the area designated by such lines or markings. CITY CODE VIOLATION DESCRIPTION FINE AMOUNT Expired Meter (a) $30.00 Extended Parking Prohibited — Meter (b) $40.00 Replugging Meter (c) $25.00 Non - Designated Space (d) $25.00 If any vehicle is found stopped, standing or parked in any manner violating the provisions of this Section and the identity of the operator cannot be determined, the owner or person or corporation in whose name said vehicle is registered or the named lessee in a lease or rental agreement of said vehicle shall be held prima facie responsible for said violation. 7 -28.8 LAWFUL MONEY It shall be unlawful to deposit in any meter, any objects, devices, or coins as substitutes of the United States currency. Any person violating this Section shall be deemed guilty of a misdemeanor. 7 -28.9 TAMPERING AND DESTRUCTION It shall be unlawful to deface, injure, tamper with, open, conceal, represent as inoperable, or willfully break, destroy, or otherwise impair the usefulness of any parking meter. Any person violating this Section shall be deemed guilty of a misdemeanor. 7 -28.10 PARKING METER ZONE PERMITS Parking meter zone permits shall be made available for business establishments within a particular designated parking meter zone for an annual fee of one hundred dollars ($100.00) per permit. a. Parking meter zone permits shall be issued by the Parking Enforcement Division in accordance with requirements set forth in this section. Each such permit shall be designed to state or reflect thereon the identification of the particular parking meter zone as well as the license number of the motor vehicle for which it is issued. No more than one permit shall be issued to each vehicle owned or leased for which an application has been completed. b. A parking meter zone permit may, in addition, be issued for any vehicle owned, leased, or under the continuing custody of a person who owns or leases commercial property and engages in business activity within a particular parking meter zone. The owner and /or employees of a business located in a parking meter zone will be allowed to obtain one permit for each vehicle they own, lease, or have under their continuing custody. However, in no case shall more than two parking permits be issued per business establishment or vehicles registered to or under the control of the owner and /or employees of such an establishment. c. A vehicle on which is displayed a valid permit, as provided for herein, shall be permitted to stand or be parked in the designated parking meter zone for which the permit has been issued without being limited by time restrictions established pursuant to this section. Any vehicle, which does not display such permit, shall be subject to the parking meter zone regulations and consequent penalties in effect for such zone. d. A permit shall not guarantee or reserve to the permit holder thereof an on- street parking space within the designated parking meter zone, or exempt the permit holder from other traffic controls and regulations existing in the designated permit parking district. e. Renewal of permits shall be made on an annual basis and subject to the same conditions imposed on new permits. Any person to whom a parking permit has been issued pursuant to this section shall be deemed a parking permit holder. 7 -28.11 PERMIT VIOLATIONS It is unlawful and shall constitute a violation of this section for any person to stand or park a motor vehicle, without a current parking permit properly displayed, at a curb within a parking meter zone for a period of time exceeding the time limitation established by the City Council for such zone. Vehicles identified as used by disabled persons meeting the requirements of Section 22511.5 of the California Vehicle Code shall be exempt from this subsection. a. The following acts shall be punishable by a fine not exceeding five hundred dollars ($500.00) and revocation of any permit currently held: 1. For any person to falsely represent himself or herself as eligible for a parking permit or to furnish false information in an application therefore; 2. For any person holding a valid permit issued pursuant hereto to permit use or display of or to use or display such permit on a vehicle other than that for which the permit was issued; 3. For any person to copy, reproduce or otherwise bring into existence a facsimile or counterfeit permit or permits without written authorization from the City Manager; 4. For any person to knowingly use or display a facsimile or counterfeit parking permit in order to evade time limitations on parking applicable in a parking permit area; 5. For any person holding a valid parking permit issued pursuant hereto to sell, give or exchange said permit to any other person-, 6. For any person to knowingly commit any act, which is prohibited by the terms of this section, or any ordinance enacted by authority granted by this section.
