AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF LYNWOOD EXTENDING THE EXISTING
TIME LIMITS FOR THE EFFECTIVENESS OF AND
THE RECEIPT OF TAX INCREMENT FOR THE
REDEVELOPMENT PROJECT AREA A
REDEVELOPMENT PLAN
WHEREAS, the City Council of the City of Lynwood (the "City of Council "), adopted
Ordinance No. 945 on July 10, 1973, approving and adopting the Redevelopment Plan for
Project Area A (the "Redevelopment Plan "), which Redevelopment Plan was subsequently
amended on eight separate occasions; and
WHEREAS, Project Area A ( "Project Area ") as originally adopted (the "Original Area ")
has separate time limits for the effectiveness of the plan and receipt of tax increment resulting
from the amendment to add territory effectuated by Ordinance No. 1111 adopted on December
16, 1980 (the "81 Annex "), and the amendment to add territory effectuated by Ordinance No.
1308 adopted on July 19, 1988 (the "89 Annex "); and
WHEREAS, the Redevelopment Agency of the City of Lynwood (the "Agency "), has
been given the authority to carry out the functions and requirements of the California
Community Redevelopment Law, Health and Safety Code Section 33000 et seq. (the "Law ") and
to implement the Redevelopment Plan; and
WHEREAS, Section 33333.6 of the Law as amended by SB 1045 (effective on
September 2, 2003), now authorizes redevelopment agencies, which are required to make a
payment pursuant to Section 33681.9 of the Law, to amend the redevelopment plan to extend by
one year the time limits for the effectiveness of the plan and the receipt of tax increment; and
WHEREAS, the Agency is required to make a payment to the Los Angeles County
Auditor Controller for deposit in the Educational Revenue Augmentation Fund, pursuant to
Section 33681.9 of the Law.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY
ORDAIN AS FOLLOWS:
Section 1. The foregoing recitals are all true and correct.
Section 2. The Redevelopment Plan is amended to extend the time limit by one year
for the effectiveness of the Redevelopment Plan for the Original Area to July 10, 2014, for the 81
Annex to December 16, 2021, and for the 89 Annex to July 19, 2029.
Section 3. The Redevelopment Plan is further amended to extend the time limit by
one year for the receipt of tax increment for the Redevelopment Plan for the Original Area to
July 10, 2024, for the 81 Annex to December 16, 2031, and for the 89 Annex to July 19, 2039.
Section 4. All previous Redevelopment Plan amendments are continued in full force
and effect, except as amended by this Ordinance.
Section 5. The City Clerk is hereby directed to send a certified copy of this
Ordinance to the Agency.
Section 6. Severability. If any part of this Ordinance is held to be invalid for any
reason, such decision shall not affect the validity of the remaining portion of this Ordinance, and
this City Council hereby declares that it would have passed the remainder of this Ordinance if
such invalid portion thereof had been deleted.
First read at a regular meeting of the Lynwood City Council held on the 18th day of
November, 2003 and adopted and published -at a regular meeting of said Council held on the
3rd day of December 2003
