SUBJECT: Status of Interim Site Use and Management Recommendations
Discussion: At its September 10 , 1975 meeting the Board con-
sidered interim site use and management recommendations for
Permanente Creek Park and Black Mountain Open Space Preserve
as set forth in a memorandum (M-75-132) from the Land Manager
to me dated September 4 , 1975 . As the result of discussion
at the meeting, the Board directed staff to return in two weeks
with a plan for the use of the ridgetop area of Black Mountain
Open Space Preserve with respect to equestrians and hikers.
Staff was also directed to meet with horsepeople to determine
the historic use of Permanente Creek Park. Residents in the
area of the Fremont Older Open Space Preserve were encouraged
to work with the District' s staff in the development of long
term planning for that site.
Attached is a memorandum (M-75-141) dated September 18 , 1975
from the Land Manager to me addressing the matters contained
in the Board's directive.
Recommendation: It is recommended that the Board of Directors
adopt the recommendations contained in the Land Manager' s memo-
randum (M-75-141) dated September 18 , 1975 .

SUBJECT: Status of Interim Site Use and Management Recommendations
Background: At the September 10, 1975 Board meeting, staff was
directed to restudy the adopted interim use and management recom-
mendations for Fremont Older Open Space Preserve and the proposed
recommendations for Permanente Creek Park and Black Mountain Open
Space Preserve. Staff was further directed to meet with interested
equestrian groups and return with a revised recommendation for the
Monte Bello Ridge area on Black Mountain Open Space Preserve for
the September 24 Board meeting, as well as revised recommendations
for Permanente Creek Park and Fremont Older Open Space Preserve at
a later date if deemed necessary.
BLACK MOUNTAIN OPEN SPACE PRESERVE
Discussion: The specific aspect of the Black Mountain Open Space
Preserve recommendations to be restudied dealt with exploring the
feasibility of having a permit exemption for the Monte Bello Ridge
portion of the Preserve and determining if the District' s permit
requirements on the remainder of the site interfered with previously
established use patterns. After discussions with equestrians
familiar with the area, it was agreed that the ridge portion of
the site was the primary concern in terms of possible interference
with established use patterns, and that the remainder of the site
had not been regularly use by equestrians, at least in the last
few years. As a practical matter, District rangers have never
interfered with use of Monte Bello Road either by adjacent property
owners, equestrians, hikers or bicyclists.
This procedure has been followed because it is likely that the
public already has rights associated with Monte Bello Road and
that activity along the road does not significantly impact the
Preserve. In effect, then, the District's past procedures affect-
ing Monte Bello Road seem eminently compatible with those of the
interested user groups. The only additional issue regarding the
ridgetop is the desirability of providing water for recreational
users of Monte Bello Road. There is currently a developed spring

which feeds Gold Mine Creek and is almost on the ridgetop. In
the past, staff has never interfered with any recreational user
of the site obtaining water. The previously submitted recom-
mendations have been altered to clarify this situation.
INTERIM USE AND MANAGEMENT RECOMMENDATIONS:
BLACK MOUNTAIN OPEN SPACE PRESERVE
Past and Current Agricultural Use : While in private ownership,

this property has been used primarily for grazing cattle, with
cattle remaining on the property on a year-round basis. Due to
the relatively steep slopes and moderate to highly erodable soils ,
this year-round grazing results in relatively high soil erosion
during the winter and spring months, with resultant loss of top-
soil.
Recommendation: It is recommended that the current year-round
grazing be phased out and that grazing be limited to summer and
fall months, and that no more than thirty animals occupy the area
at any one time. Also, no bulls should be allowed as part of
the grazing herd due to potential danger to users of the area.
Past and Current Educational Use : The area has been used by

Sunnyvale s Peterson High School as a supplement to their alter-
native education program operated on the adjacent Stanford
property. The San Jose State Biological Sciences Department
is using this and other property on Monte Bello Ridge for an
extensive bird banding program. Naturalist hikes have been
given by organized groups.
Recommendation: It is recommended, due to the rich diversity
of natural resources, that use of the area be encouraged for
nature study hikes, environmental education classes and work-
shops, and that the San Jose State bird banding program be con-
tinued.
Past and Current Recreational Use : In the past, organized
groups have used the area for hiking, and limited equestrian use
has occurred primarily on Monte Bello Road.
Recommendation: It is recommended that Monte Bello Road and the
spring which feeds Gold Mine Creek be exempted from entry permit
requirements. It is further recommended that such group hiking
as has previously occurred be encouraged and continued and that
staff develop trail routes which use existing roads during this
interim period. Maps showing these trails would be provided to
hiking groups.
Equestrian use should be held off on the lower portion of the site
at least until a trail system is developed for the site and the
use and management plan adopted. Access points will be from the
north and south on Monte Bello Road.

Additional Interim Recommendations :
(1) Issue permits for group use general limited to not more
than thirty people, and other permits as deemed appropriate
by the General Manager.
(2) Repair fence line adjacent to Monte Bello Road (A on map) .
(3) Install new gates at B and C on map.
(4) Grade existing roads where necessary to minimize erosion.
(5) Maintain regular patrol.
Overall Recommendations : It is recommended that the Board adopt
the recommendations contained within this report, direct staff
to develop a draft use and management plan by March 1976 , and
adopt the attached Resolution of the Board of Directors of the
Midpeninsula Regional Park District Amending Permit Standards
(Resolution No. 75-13) to Exempt Certain Portions of Black
Mountain Open Space Preserve.
PERMANENTE CREEK PARK
Discussion: At the September 10 , 1975 meeting, several members
of the audience stated that they had been using the Perham Ranch
on a regular basis for hoseback riding. Staff has discussed
this issue with the Perham family, who state that they have
never given permission for any regular use of the site and
that they have vigorously patrolled the property to prevent
trespassing.
Staff has been working with Mr. Gordon Jennings , who has acted
as liaison between members of the Castle Rock and Los Altos
Hills Horsemen 's Associations and District staff, to clarify
which particular trails audience members were referring to when
they stated they had been riding on the Perham Ranch. It
appears that these particular trails are in fact on adjacent
property and not on the Perham Ranch. A field trip is scheduled
for Saturday, September 20 to inspect the trails being used to
determine which property they are on. If in fact these trails
are on adjacent property, then the previously presented staff
recommendation would not interfere with established equestrian
use of the general vicinity. If the above is the case, Mr.
Jennings concurs with the previously presented staff recommenda-
tion for interim use and management of Permanente Creek Park
and the active participation of equestrians in the long range
planning for the site. Pending the outcome of the field trip
and discussion with other local equestrians, staff will present
a recommendation at the September 24, 1975 Board meeting.
The only change in the previously submitted recommendations for
the interim use and management of Permanente Creek Park is the
consolidation of the recommendations regarding the potential
caretaker 's residence.

INTERIM USE AND MANAGEMENT RECOMMENDATIONS:
PERMANENTE CREEK PARK
Past and Current Recreational and Educational Use : In the
past, this area has been subject to limited-use for hiking and
for environmental education programs. The Environmental Volun-
teers are currently developing a program for the site.
Recommendation: It is recommended that group hiking be contin-
ued and expanded and that a trail system be identified which
uses existing roads. Maps of these trails would be provided
to users. Due to the proximity of the site to the urbanized
area and the diverse and outstanding quality of its natural
resources , it is recommended that the District actively solicit
use for environmental education programs .
Past and Current Range Management and Agricultural Use: The
site has supported a variety of agricultural uses, including
cattle grazing, hay fields and orchards. Currently, the cattle
grazing and hay crop operations of the Perham family are being
phased out. In accordance with the acquisition agreement, the
target date for this phasing out is November 30, 1975, and the
final date is May 30 , 1976.
Range Management Recommendation: It is recommended that staff
take no action until a comprehensive range management program
is developed. This program will be a part of the long range
use and management plan for the site.
Additional Interim Recommendations:
(1) Issue permits for group use generally limited to not more
than thirty people, and other permits as deemed appropriate
by the General Manager.
(2) Maintain regular patrol.
.(3) Depending upon intensity of use and other management con-
siderations, it may be necessary to engage a resident
caretaker on the site. In order to do this , it will be
necessary to determine the condition and suitability of
the small house located on the north site of the main access
road approximately 1/8 mile west of the Permanente Creek
bridge. If this house is found to be unsuitable, it will
be necessary to wait until another house is available on
the site for the establishment of a resident caretaker. if
it is deemed feasible, staff will establish a resident care-
taker on the site.
Overall Recommendations ; It is recommended that the Board adopt
the recommendations contained within this report and direct
staff to develop a draft use and management plan by April 1976.

FREMONT OLDER OPEN SPACE PRESERVE
Discussion: Due :to the complex nature of the various factors
which influence use and management recommendations for Fremont
Older Open Space Preserve, we will not be able to return with a
recommendation at the September 24 , 1975 Board meeting. The
primary issue regarding this site is the extent of recent
equestrian use of the area and the involvement of the Castle
Rock Horsemen's Association in planning trails associated with
the site. Staff will meet with area residents in an attempt
to determine recent past use and any significant hardships
associated with the adopted interim use and management recommen-
dations. With respect to participation of the Castle Rock Horse-
ments Association in planning for the area, staff had invited
this participation in mid-August through one of the members of
the Association. Apparently this invitation was not conveyed
to other key Association members. The letter delivered to the
District at the September 10, 1975 meeting is in accord with
the previous staff position of wishing to work with past and
potential users, and staff looks forward to working with the
Association neighborsand others in planning the implementation
of a trails system related to the Fremont Older Open Space
Preserve.

(RESOLUTION NO. 75-13) TO EXEMPT
CERTAIN PORTIONS OF BLACK MOUNTAIN
OPEN SPACE PRESERVE
The Board of Directors of the Midpeninsula Regional
Park District does resolve that subsection "d" is hereby
added to section 30.0 of "Permit Standards , Midpeninsula
Regional Park District, June 25 , 1975" (Resolution No. 75-13)
to read as follows:
"d. The following portions of Black Mountain Open
Space Preserve:
(1) all of Monte Bello Road within the site
(2) the developed spring which feeds Gold
Mine Creek together with reasonable direct
access thereto from Monte Bello Road. "

Subject : Proposed San Mateo Santa Clara County Boundary Changes
Dear Colleagues
A study by the San Mateo County Local Agency Formation Commission
has come to my attention which recommends boundary changes between San
Mateo and Santa Clara Counties in the vicinity of Page Mill Road and Skyline
Blvd.
Because action is expected to be taken in the near future by Santa
Clara County and the City of Palo Alto, I want to share with you the informa-
tion I have obtained on the implications of such a jurisdictional land switch.
The study recommends that the boundary between the two counties
continue to follow the existing one of Los Trancos Creek to Page Mill Road
and then a new alignment to follow the northern right-of-way of Page Mill
Road to Skyline, and the western right-of-way of Skyline Blvd. to the San
Mateo County boundary with Santa Cruz County. Present boundaries cross
Page Mill and Skyline at aboutAt nineteen different locations.
Since both the legal language of the established District ( MRPD
and that of the annexation petition now in circulation in San Mateo County
refers to County boundaries rather than a metes-and -bounds description
of the territory included, the questions arose whether or not adjustments
between the two counties could be made without affecting the description
of the District and whether or not the actual boundaries might change. Bill
Spangle, who prepared the District's legal descriptions advised me that
both existing and proposed MRPD boundaries would be unaffected because
of references to county boundaries as of November, 1972 ( and August, 1975
in describing the territory proposed to be annexed to the District
Implications of the changes recommended by the study are as follows
Aproximately 236 acres are involved immediately along Page Mill Road and
Skyline Blvd ( both of which are designated as scenic corridors by Palo Alto
Building setbacks are 100' along Skyline in both counties. However,
the setback is 200' in Palo Alto. There is no building setback established by
either county for Page Mill Road. Palo Alto , however , has established a
setback of 200'.

Aproximately 120 acres would be transferred from Santa Clara
County to San Mateo County
Lands under the jurisdiction of Palo Alto are zoned for 10 acre
lot sizes Lands under the jurisdiction of Santa Clara County are zoned
Exclusive "A" which also permits one dwelling per ten acres However,
the Santa Clara County zoning permits permanent mobile trailer instal-
lations as a permitted use
Current zoning in San Mateo County of lands westerly of Skyline
permits 5-40 acre lot sizes depending on steepness of slope Lands
northerly of Page Mill Road are zoned to permit 1-5 acre lot sizes under
a slope density formula The latter 1-5 acre lot size would probably
have the most noticeable impact on the City's zone standards along Page
Mill Road along with the mobile trailer permitted use under the Santa Clara
County zoning
It would be my concern that the high standards established by Palo
Alto be retained as a condition of any boundary changes , and furthermore,
that an agreement be reached among the jurisdictions to retain the 200'
building setback which has been established by the City of Palo Alto for
both sides of Page Mill Road and Skyline Blvd
After review of the San Mateo County LAFCo study, it was my opin-
ion that the recommended boundary changes are reasonable from the stand-
point of providing a more logical boundary than the present one, provided
that the concerns mentioned above are adequately addressed by the City
and Santa Clara County
I wish to recommend that we send a letter expressing these concerns
to the City of Palo Alto , Santa Clara County, and Santa Clara County Local
Agency Formation Commission

will present the Cupertino Hillside General Plan/Draft EIR
at the Board meeting of September 24 , 1975 .
Previously you received a copy of a letter dated September 3 ,
1975 from Mr. Sisk asking that any comments or a request for
a time extension be received by Cupertino by October 2, 1975 .
Attached is a letter which I have sent to Mr. Sisk regarding
this matter.

Dear Jim:
As we discussed on the phone recently, the Midpeninsula
Regional Park District has received your letter of September 3,
1975 and accompanying documents regarding the Cupertino Hillside
General Plan/Draft EIR. The letter was considered by my Board 4
of Directors at its meeting of September 10. We appreciate your
acceptance of our invitation to present the information at our
next meeting on September 24.
Following that meeting the District may well want to
study the topic and then perhaps to make comment on the plan
itself or the EIR. Since the District's planning and acquisition
program relates so directly with Cupertino' s hillside planning,
District comments could be quite important to you. For this
reason the Cupertino Planning Commission may wish to continue the
matter beyond the September 22 date mentioned in your letter and
take any MRPD comments into consideration before passing a recom-
mendation on to the City Council. I recognize that the matter
has been under study for quite some time by the Commission and
would do whatever I could to insure timely response by the MRPD.
Incidentally, the District's draft Master Plan will be
ready for review by Cupertino and others in about two months.
