SUBJECT: Proposed Addition to the Fremont Older Open Space
Preserve
Introduction : On May 14 , 1975 the Board of Directors decided
to exercise an option to purchase the 266 acre Fremont Older
Open Space Preserve in the Cupertino and Saratoga foothills.
Since then, planning procedures for the long range use and
management of the Preserve have progressed. Through this
process the District has become more aware of the site ' s com-
plex nature in terms of its future use and management. It
now appears necessary to acquire additional parcels of land
to provide a functional park site.
Site Description : The proposed acquisition consists of four
parcels of land which are adjacent to the Fremont Older Open
Space Preserve and are each an integral part of a large geo-
graphic unit containing the park site (see attached map) .
Size, Location and Boundaries : The proposed acquisition,
comprising approximately 68 acres , is located on the northwest
boundary of the Fremont Older Open Space Preserve. A large
portion of the site is within the city boundary of Cupertino
and located one half mile south of the heavily urbanized area.
The addition is roughly L-shaped and is bounded by the MRPD
Preserve to the south and east, by Regnart Road and Regnart
Creek on the west and by small private parcels to the north
and northwest.
Topography, Geology and Soils : The proposed acquisition
includes a portion of ridgetop which extends in a northeasterly
direction through the Fremont Older Open Space Preserve. Par-
cel A (see map) consists of hilltops with moderate to steep
slopes . The remaining parcels are largely comprised of east
and northeast facing slopes which are all relatively steep.
Soils are of the Los Gatos-Gaviota association and are charac-
terized by fine to medium texture, occurring on 30% - 70%
slopes. These soils are highly erodable and must be protected

by maintaining the vegetative cover. Studies indicate that
fault zones exist in the area and are associated with land-
slides and slippage.
Vegetation and Wildlife : The vegetative types present
are woodland (primarily oak and bay) , chaparral and grassland.
Boundaries between chaparral and grassland are distinct due to
previous clearing for orchard crops. Fruit trees are still
apparent in some places , although they are no longer produc-
tive. A riparian vegetative community is located on the west
boundary of parcels B and D along Regnart Creek. Previous
studie of Regnart Canyon and the Fremont Older site indicate
a large variety of flora and fauna are present in this region.
A species list was previously included in the pre-acquisition
report for the Fremont Older Open Space Preserve (R-74-18 , dated
September 2 , 1974) .
Current Use and Development: Developed use of these sites
has been limited by steep slopes and poor access. The primary
development consists of a transmitting tower constructed on
parcel B. One acre of this parcel is leased by a cable tele-
vision franchise for its facility, consisting of a number of
power poles and antennas , and enclosed by a 6 foot fence. There
are three old structures on parcel A, including a barn, house
and storage shed, but all are vacant and appear irreparable.
The property surrounding the structures is fenced for horse
grazing and currently appears to be overgrazed.
A few unpaved roads have been developed on these proper-
ties. Parcel A has an access road from Regnart Road and has
a right of way through a small adjacent private parcel. This
road crosses the site in an easterly direction, climbs to the
ridge and then adjoins a road running along the ridgetop pro-
viding access to the Fremont Older Open Space Preserve. Another
private road enters off Regnart Road, dividing parcels B and
C from parcel D. Near the ridge it splits in three directions
allowing access to the cable television facility, parcels C
and D and the upper meadow of the Preserve. Recently, a road
has been graded directly up the steep slopes of parcel D, and
a portion of the ridge has been cleared and leveled.
Electrical utilities consist of a major P.G.& E. high
tension line crossing a small portion of the northeast corner
of parcel A, and a low voltage power line on parcel B associated
with the transmitting facility. Water is available on the
west side of parcel A and is supplied by a piping system from
Regnart Creek. On the east side an existing spring provides
water to a stock pond.

Planning Considerations : On June 11, 1975 an Interim Master
Plan map was adopted by the District. It indicates that the
proposed acquisitions score well in acquisition priorities.
Parcel A is located in the unincorporated area of Santa
Clara County and is zoned RHS (Residential Hillside) , requiring
2? - 10 acres per dwelling unit. Parcel A is also in the Sphere
of Influence of the City of Cupertino. The other parcels in-
cluded in this proposal (B, C and D) are within Cupertino' s
city boundaries and are zoned Al-43.
Acquisition of the unincorporated portion of the proposed
addition for park and open space purposes has been found to
be in conformity with the Open Space Element of the General
Plan of Santa Clara County. Acquisition of the total proposed
addition (incorporated and unincorporated area within the
Sphere of Influence of Cupertino) has been found by the Cup-
ertino Planning Director to be in conformity with the General
Plan of the City of Cupertino, subject to confirmation by the
Cupertino Planning Commission.
Access : Access to the proposed acquisition is via Regnart Road,
which is a public road. These parcels also provide a link
between the existing Fremont Older Open Space Preserve and
Regnart Road, which dramatically increases community access
to the Preserve. There are approximately fifty horses cur-
rently stabled in the Regnart Canyon area. The proposed
acquisition will provide access to the Fremont Older Open
Space Preserve for equestrian users from Regnart Canyon. Reg-
nart Road also provides the most direct access to that portion
of the Preserve which has in the past been used for environ-
mental education purposes. It is likely that these two types
of uses and their associated access will be continued, but
Regnart Road should not be the primary access to the site due
to its minimal width and conflict with the existing residential
development along Regnart Road.
Adjacent Land Use : Currently, subdivision development has
encroached into the lower portion of Regnart Canyon, but the
rest of the Canyon remains developed at a relatively low
density (approximately 13 homes) . This pattern of urbaniza-
tion is similar to that which has occurred over much of the
Santa Clara Valley. Remnants of past agricultural use, i.e. ,
orchards and grazing, are still evident on some of the adjacent
properties but are no longer economically viable.
Boundary: The acquisition of these parcels will round out the
adjacent northwest viewshed of the Fremont Older Open Space
Preserve. All of these parcels comprise portions of the major
northeast/southwest ridgeline which is the scenic backdrop for

the existing Preserve. Acquisition of these parcels effectively
protects the visual and environmental integrity of the existing
Preserve.
Cultural History and Past Use : The first European expedition
into the area was the second Anza Expedition which passed
within one mile of the site on March 25 , 1776. The site was
not part of a Spanish or Mexican land grant, although it is
likely that cattle from neighboring ranchos grazed on portions
of the site until the decline of the Spanish and Mexican presence
in the 1840 's. During the 1850 ' s, what is now the City of Cup-
ertino began to develop as an agricultural area. The first
known permanent settlement in the Canyon occurred in the 1870 's
when William Regnart planted orchards on portions of the par-
cels currently being proposed for acquisition. The Regnart
family cultivated the orchards until the 1950 's when they were
abandoned, as were many other orchards in the area, due to
increasing urbanization.
Potential Use and Management:
Natural Resources : The proposed acquisition contains a
wide diversity of vegetation and wildlife habitats. These range
from the riparian plant communities which border Regnart Creek
to the brush on portions of the steep slopes above the Creek
and upper grassland and former orchards which predominate on
the ridgetop. This environmental variety and convenient access
of Regnart Road provides an outstanding combination of resources
for environmental education purposes. In the past, thousands
of Cupertino school children have taken tours and nature hikes
of the area as part of a program developed under the leadership
of Mrs. Jo Ann Gholson.
In addition, staff of the Cupertino Park and Recreation
Department and the MRPD have been discussing implementation of
an environmental education program operated by the City of Cup-
ertino.
In the past, dumping of debris and abandoned cars into
Regnart Creek has seriously detracted from this valuable re-
source. In order to protect the creekside it would be neces-
sary to patrol the area regularly to prevent such dumping and
to monitor the water quality of Regnart Creek.
The upper portions and the ridgetop are primarily grass-
land and former orchard. The management of these areas would
be carefully studied while developing the long range use and
management plan for the entire Fremont Older Open Space Pre-
serve.

Recreation: The primary recreational value of the proposed
acquisition is its potential for hiking and riding trails along
the ridgetop which links these properties and the adjacent
Fremont Older Preserve. Staff is presently working with Castle
Rock Horsemen's Association and other interested user groups
to develop a trail system for the existing Preserve. Planning
of trails for the subject parcels would be incorporated into
the larger trail planning effort.
Patrol : Currently the area is patrolled by the Santa Clara
County Sheriff' s Department. Interviews with representatives
of the Department indicate that there are no significant police
or fire patrol problems associated with the site.
Relationship to Regional Trails Plan: The Trails Task Force
of the Midpeninsula Regional Park District is currently develop-
ing a plan of regional trail corridors throughout the District.
The preliminary version of this plan shows a link from Fremont
Older Open Space Preserve to the lower Stevens Creek County
Park.
Land Tours: On September 19, 1975 a public Board of Directors
meeting was held in order to conduct a tour of the existing
Fremont Older Open Space Preserve. At that time the Board,
staff and members of the public were able to observe the rela-
tionship of the proposed acquisition to the existing Preserve.
Community Attitudes : On September 15 , 1975 the staff of the
City of Cupertino submitted to the City Council a survey analy-
sis entitled "City of Cupertino, Parks and Recreation Needs
Assessment Survey. " Findings indicate that 76% of the people
favor preservation of open space. Although there is wide sup-
port for both valley floor and hillside acquisitions, hillside
open space was favored. About 54% identify undeveloped orchards
or agricultural land as open space.
Interim Use and Management Recommendations : This proposed
acquisition would become a part of the existing Fremont Older
Open Space Preserve, for which adopted interim use and manage-
ment recommendations are in effect and attached at the end of
this report. It is recommended that these adopted recommenda-
tionsthe proposed acquisition as individual par-
cels be applied to

The long range planning for these additions would be incorpor-
ated into planning for the Fremont Older Open Space Preserve.
Costs: The four parcels are currently being appraised by ex-
pert appraisers in order to determine their current fair market
value.
According to the Santa Clara County assessment rolls, the
four parcels have a combined total full cash value of $89 ,390.
Current research, however, indicates that there have been some
recent minor subdivisions of properties in the area which could
possibly affect land values.
Recommendation: It is recommended that the Board of Directors
adopt the attached Resolution of the Board of Directors of the
Midpeninsula Regional Park District, Finding and Determining
That the Public Interest and Necessity Require the Acquisition
of Certain Properties for Public Use, to Wit, for Public Park,
Recreation and Open Space Purposes , Describing the Properties
Necessary Therefor and Authorizing and Directing its Retained
Legal Counsel to do Everything Necessary to Acquire All Inter-
ests Therein (Fremont Older Open Space Preserve Addition) .
It is further recommended that the Board of Directors adopt the
interim use and management recommendations contained in this
report.

INTERIM USE AND MANAGEMENT RECOMMENDATIONS
Adopted August 13 , 1975
Background: On May 14, 1975 the Board of Directors
adopted a resolution (No. 75-6) authorizing exercise of
an option to purchase the Fremont Older Open Space Pre-
serve. Under the option terms, escrow will close in early
August and the District will take title prior to September
1, 1975.
The following recommendation is in concurrence with the
recently adopted site planning format and constitutes the
initial procedure of the post-acquisition phase. It
consists of an interim recommendation which will be ef-
fective upon acquisition and continue until the site
specific plan is developed.
Discussion: This recommendation is based primarily on
information generated by research prior to exercising the
option. After recently re-examining the site and adjacent
land use, it has been determined that, in general , the
existing types of uses at Fremont Older are compatible
with District goals and appropriate uses to be continued.
Land Use: In the past, portions of this property were
used for agriculture, environmental education and recrea-
tion.
Agricultural Uses : The upper meadow presently produces
a viable spring hay crop (see map) . In the summer, meadows
are disced for planting which in turn provides a partial
firebreak.
Apricot farming on the site has been discontinued and will
not be resumed because the orchard is not economically
viable. These orchards are potential grazing areas . If
the trees were removed and fences constructed, a grazing
tenant could likely be established.
Agricultural Recommendation: It is recommended that staff
be directed to negotiate a contract for the continuance
of the haying operation.
Environmental Education: Environmental education programs
have been successfully conducted on the Fremont Older
Ranch over the past few years.
Environmental Education Recommendation: It is recommended
that the District should allow environmental education use
on a group basis and by permit only. Groups will be limited
a.
to a maximum of thirty people (no more than eight vehicles)
and must be authorized by a school district, scout group,
4-H or other responsible organization. Access for these
groups should be only from Prospect and vehicles should be
parked at areas shown on the attached map as "A" .
Recreational Use: At a recently held public meeting, the
District became aware of the trespassing problem which
existed prior to the fencing of Fremont Older. Because
Prospect Road is the only access to the property, hikers
and equestrians have in the past been inclined to trespass
through individually owned properties around the site' s
perimeter. In order to provide any kind of a looping trail
in the area both Regnart and Prospect Roads would have to
incur a significant increase in equestrian traffic. It is
possible that some adjacent property owners would permit
public access but if this occurred, it would encourage
hikers and equestrians to establish their own trails hap-
hazardly through the site.
Safety is also an important factor in considering recrea-
tional access. There are a number of potentially hazardous
structures on the site, including underground water shafts,
an unfilled swimming pool and the Fremont Older home.
Recommendation: Recreational uses have been restricted in
the past and should continue until further planning and
management schemes are developed. This closed policy is
suggested by the following five factors:
(1) Trespassers on adjacent lands
(2) Limited access to and from the site
(3) Traffic congestion on nearby public roads
(4) No developed trail system
(5) Unsafe structures on the site
Additional Interim Recommendation:
(1) Analyze all physical improvements on site, as to condi-
tion, safety and rehabilitation cost
(2) Issue group hiking permits or other permits as deemed
appropriate by the General Manager, after mitigation of
any safety hazards found in (1)
(3) Develop, with other legal users of the Prospect Road
extension, a common policy for maintenance of this road
(4) Establish regular patrol of area
(5) Establish job description and responsibilities for
resident caretaker (s)
(6) Erect 10 feet of additional fencing (see B on map)
(7) Install an unlocked self-closing gate at the entrance
to the site on Prospect Road
(8) Staff is directed to complete the draft Site Specific
Plan within six months

RESOLUTION OF THE BOARD OF DIRECTORS OF THE
MIDPENINSULA REGIONAL PARK DISTRICT, FINDING
AND DETERMINING THAT THE PUBLIC INTEREST AND
NECESSITY REQUIRE THE ACQUISITION OF CERTAIN
PROPERTIES FOR PUBLIC USE , TO WIT, FOR PUBLIC
PARK, RECREATION AND OPEN SPACE PURPOSES , DE-
SCRIBING THE PROPERTIES NECESSARY THEREFOR AND
AUTHORIZING AND DIRECTING ITS RETAINED LEGAL
COUNSEL TO DO EVERYTHING NECESSARY TO ACQUIRE
ALL INTERESTS THEREIN (FREMONT OLDER OPEN SPACE
PRESERVE ADDITION)
WHEREAS , the Board of Directors of the Midpeninsula
Regional Park District is authorized to acquire property for
public purposes, pursuant to Division 5 , Chapter 3 , Section
5542 , of the Public Resources Code, State of California, and
WHEREAS , the property, rights , and interests de-
scribed in Exhibit A attached to this resolution and incorporated
herein by reference (the "property") are necessary for public
park, recreation, and open space purposes , said purposes consti-
tuting a public purpose,
NOW, THEREFORE, BE IT RESOLVED that the Board of
Directors of the Midpeninsula Regional Park District does hereby
find and determine that the public interest and necessity require
the acquisition of the property for public park, recreation and
open space purposes;
BE IT FURTHER RESOLVED that acquisition of the fee
(unless a lesser estate is described in Exhibit A) is necessary
therefor; and
BE IT FURTHER RESOLVED that the Board of Directors
of the Midpeninsula Regional Park District does hereby find and
determine that said property is located so as to be most com-
patible with the greatest public good and cause the least private
injury; and
BE IT FURTHER RESOLVED that the General Manager be
and is hereby authorized and directed to cause to be negotiated
and/or prepared all appropriate applications to governmental
agencies for grants of funds or property, legal documents and
related instruments for acquisition of title to the property by
gift and/or purchase, all upon terms and conditions discussed
by or presented to this Board at its meeting this date or custom-
ary to this District in like transactions; provided , however,
that each such application, document and instrument shall be
subject to approval as to form and content by this Board prior
to its execution or delivery on behalf of the Midpeninsula
Regional Park District; and
BE IT FURTHER RESOLVED that the General Manager be
and is hereby authorized to hire all appraisers , engineers and
other experts necessary or appropriate to the acquisition of
said property up to an amount not to exceed $15 ,000. 00 for said
services; and
BE IT FURTHER RESOLVED that the law firm of Rogers ,
Vizzard and Tallett be and the same is hereby retained, in-
structed and directed to do everything necessary to acquire all
interests in the property described in Exhibit "A" , and they are
further authorized to prepare and prosecute such condemnation
proceedings in the proper court having jurisdiction thereof as
are necessary for such acquisition.
