AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD APPROVING ZONE CHANGE NO. 2002 -03,
APPROVING AN ORDINANCE CHANGING THE ZONING
FROM R -3 (MULTIPLE FAMILY RESIDENTIAL) TO C -2
(LIGHT COMMERCIAL), ON PROPERTY LOCATED AT
11007 LINDEN STREET ON THE SOUTHWEST CORNER
OF IMPERIAL HIGHWAY AND LINDEN STREET,
WINCHELL'S DONUT HOUSE PROJECT, SUBJECT
PROPERTIES FURTHER DESCRIBED AS ASSESSOR
PARCEL NUMBER 6193 - 005 -009, TRACT 9337, LOTS 1
AND 2, CITY OF LYNWOOD, CALIFORNIA.
WHEREAS, the Planning Commission of the City of Lynwood, pursuant to law, on
July 2, 2002, approved Zone Change No. 2002 -03 at a public hearing; and
WHEREAS, the Lynwood City Council, pursuant to law, on August 6, 2002, held a
public hearing on Zone Change No. 2002 -03; and
WHEREAS, the Lynwood City Council has carefully considered all pertinent
testimony offered at the public hearing; and
WHEREAS, the Lynwood City Council has determined that commercial zoning and
a commercial land use on this property would be consistent with the goals, policies and of
the General Plan; and
WHEREAS, the Community Development Department has determined that the
proposal is categorically exempt from the California Environmental Quality Act; (CEQA)
as amended; and
Section 1' The City Council of the City of Lynwood hereby finds and determines
as follows:
A. A C -2 (Light Commercial) zoning of this property would be compatible with
surrounding land uses and development in the vicinity.
B. The project plans demonstrate that the development will satisfy all required
development standards.
C. The proposed C -2 zoning will be consistent with goals and policies set forth
in the Lynwood General Plan.
D. The C -2 zoning designation will not be detrimental to the properties
surrounding the site and would not negatively impact the public health,
safety, or general welfare.
Section 2. The City Council of the City of Lynwood, based upon the
aforementioned findings and determinations, hereby approves Zone Change No. 2002 -03
changing the zoning designation for this property from R -3 (Multiple Family Residential) to
C -2 (Light Commercial) for development of a Winchell's Donut House.
Section 3. The City Clerk is hereby directed to certify to the passage and
adoption of this Ordinance and to cause it to be published or posted as required by law.
