HomeMy Public PortalAboutOrd. 1526d Y i �� �• bra � , �, , AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING CHAPTER 25 OF THE LYNWOOD MUNICIPAL CODE BY REGULATING TEMPORK Y CANOPY STRUCTURES IN RESIDENTIAL ZONES. WHEREAS, carports are not permitted in R -1 (Single - Family Residential) or R -2 (Two - Family Residential) zones; and WHEREAS, carports are permitted in R -3 (Multiple - Family Residential) zones subject to setbacks and the Uniform Building Code; and WHEREAS, the City has a rapidly growing and extreme proliferation of temporary canopy structures being used as carports in residential zones; and WHEREAS, temporary canopy structures violate setbacks requirements, accessory structure regulations, are unsightly and may decrease property values; and WHEREAS, permanent and temporary structures and other improvements are not permitted in front yard setback areas or street side yard setback areas; and WHEREAS, the Lynwood Municipal Code should be amended to directly address and regulate such temporary canopy structures in residential zones; and WHEREAS, such regulations for temporary canopy structures shall protect public health, safety, welfare, aesthetics and property values in the City of Lynwood. WHEREAS, the Lynwood City Council adopted an Urgency Ordinance as an Interim Ordinance on August 20, 2002 and directed staff to process a Zoning Ordinance Amendment to provide permanent development standards. WHEREAS, the Lynwood Planning Commission pursuant to law at a duly noticed public hearing, approved Zoning Ordinance Amendment No. 2002 -02 to regulate temporary canopy structures in residential zones. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Subsection 25 -2 of the Lynwood Municipal Code pertaining to "definitions" is hereby amended to add the following: "Temporary Canopy Structures" shall mean temporary coverings of plastic or cloth materials supported by a frame and include the prefabricated canopies available from retail outlets. Section 2. Subsection 25- 4.6(d) is hereby added to the Lynwood Municipal Code to read as follows: d. Temporary canopy structures shall comply with the following standards and procedures: 1) Temporary canopy structures shall not be allowed in front yard setback areas or side yard setback areas. H: \WORDFILE\ PLANNING\ RESOS \ordcanopies.council.clean.doc — I — i 2) Temporary canopy structures shall not exceed a height of fifteen feet (15') from grade to the highest point of such temporary structure. 3) Temporary canopy structures shall not be attached to a residence, accessory structure or other improvement. 4) Temporary canopy structures shall not be used as carports and shall not be installed over a driveway or other paved area that has vehicular access or is used for vehicle storage. Except as authorized by Subsection 25- 4.6(e). 5) No parking or storage shall be permitted in temporary canopy structures. 6) Temporary canopy structures may remain for a maximum of three (3) months. 7) Temporary canopy structures shall be open on all sides. 8) Temporary canopy structures may only be located in rear yards and shall be located a minimum of five feet (5') from the side and rear property lines. Except as authorized by Subsection 25- 4.6(e), 9) Temporary canopy structures shall be located a minimum of six feet (6') from residences, accessory structures, or other improvements. 10) Temporary canopy structures shall not be larger than three hundred (300) square feet. 11) Temporary canopy structures require a plot plan and permit. 12) Temporary canopy structures in residential zones that exist at the time of this ordinance shall be removed immediately or a permit applied for after enactment of this Ordinance. Section 3. Subsection 25- 4.6(e) is hereby added to the Lynwood Municipal Code and shall read as follows: e. Exception: A permit may be issued administratively for temporary canopy structure for special family or service events. Such exception shall not exceed seventy -two (72) hours and shall not be approved more than six (6) times per calendar year per property. Section 4. The City Clerk of the City of Lynwood is hereby directed to certify to the passage and adoption of this Ordinance and to cause it to be published or posted as required by law.
