The Agenda Meeting of the Mayor and Council of the Borough of
Carteret preceding the Regular Meeting, April 19, 2001, was held
on April 10, 2001, 7:00 P.M., Municipal Court, Police Facility,
230 Roosevelt Avenue, Carteret, New Jersey.
The following were noted present:
Mayor Failace
Councilmember Fazekas
" Quinones
" Reiman

Noted absent were Councilmembers Santoro and Sohayda and
Borough Attorney Robert Bergen.
Mailed to The Home News Tribune, The Star Ledger and posted
on the bulletin board on April 6, 2001.
TO ADDRESS GOVERNING BODY:
Mayor Failace asked if they could let Mr. Cerami speak before Mr.
Norbut, because Mr. Norbut was listed first on the Agenda.
b) Dennis Cerami - MC Public Health Dept. - He asked for a
Proclamation for tobacco and health risks.
At approximately 7:05 P.M., Borough Attorney Robert Bergen was
noted present.
Mr. Cerami then asked for an ordinance on this. He explained they
can have a locking device on vending machine and they can also
have no smoking in restaurants, etc.

Mr. Cerami. (Dnt:
Mayor Failace explained that the Board of Education has an
ordinance that you can't smoke in school buildings.
Mr. Cerami said you can in the parking lot.
Councilmember Reiman said the problem is that you are going
after the businesses and there is no repercussion for the minor.

Mr. Cerami suggested to have a smoke free park.
Mayor Failace thought that was a good idea.
Councilmember Reiman suggested to do that on an event like
Ethnic Day.

a) Borough Engineer - Don Norbut then gave his report. He
spoke on the 2001 Capital Program Budget
Recommendations, Mi1ik Street Rehabilitation, Carteret
Avenue Pedestrian Safety Improvements, Grants and
Loans,

At approximately 7:25 P.M., Councilmember Santoro was
noted present.

Mr. Norbut continued to speak on USEP A CSO Grant,
Emergency Sewer Repairs, for which Don Norbut suggested
awarding this bid to D&D Inc. to be put on a resolution for the
Council Meeting, 1C1 and III Program, Hill District Storm
Sewer System Improvements, Industrial Road, Phase II Culvert
Crossing, Turnpike Interchange 12 Studies, New Jersey
Turnpike Authority Interchange 12/12 Feasibility Study,
Monmouth County Study, Beverly Street Drainage Study.

At approximately 7:50 P.M., Councilmember Sohayda was
noted present.
Sewer Connection Review Fee, for which he said the fee
schedu1~ will be. put on for introduction for the next meeting,
and Vanous SanItary Sewer Complaints

Councilmember Santoro asked Mr. Norbut to check with
Woodbridge about an ordinance when connecting a sewer they
have to check if it is connected to the main line or if it is
separated, when a co is issued.
Councilmember Quinones asked the Engineer to check on the
Fire House door for an emergency.
Don Norbut asked if the repair for the Beverly Street Pump
Station for $1300.00 is taken out of the Emergency Sewer
Money and not the budget.
Attorney Bergen said it should be a motion and should say
pending funds available.
Mayor Failace then asked for a motion on the repair for the
Beverly Street Pump Station for $1300.00, pending funds are
available from the Emergency Sewer Money.
Upon MMS&C by Councilmembers Quinones and Santoro and
individual roll call vote Councilmembers Quinones, Reiman,
Rios, Santoro and Sohayda voted in the Affirmative.
c.) John Riggio - Mr. Riggio said the notice he got was just to
appear before the Council.
Attorney Bergen said it is his understanding it will be a general
discussion with regards to matters discussed at the last Council
Meeting and the Council wants to discuss it with him among
themselves and then he asked Mr. Riggio if he wanted it to be
Open Session or Closed Session.
Mr. Riggio said an Open Session.
Nick Goldsack explained Mr. Riggio was asked to be present
at this meeting because of last weeks Council Meeting and
what transpired after it.
C.1Uncilmember Reiman said he met with Nick Friday morning
and in reference to a voice message and time of the message,
or call, which John Riggio basically said he is a liar. He said
Nick told him he had spoken to him about the outburst at the
Council Meeting the prior evening. His intention was not to put
him on the spot. He said he made a motion to Table the UEZ
Budget because it was never reviewed with anyone and went
into an explanation about it, referring to the tape.
Mr. Riggio said that Nick did talk to him and one of the things
he thought happened was that he shared that with Mr. De

John Riggio Coot:
Blasio and said it was unprofessional to talk about him to his
pier.
Counci1member Reiman said Mr. De Blasio is not at his pier
level and the tape was simply played behind closed doors with
Patrick and the Business Administrator.
Counci1member Quinones asked Counci1member Reiman why
he would do that.

Counci1member Reiman said no discipline was discussed at
that meeting.
Mr. Riggio questioned if playing that tape was proper.
Attorney Bergen said if Mr. Riggio leaves a tape message on
someones recorder and he knows he is being taped you can
take that message out on the street and play it.
Mr. Riggio said that Councilmember Reiman had made a false
statement about him at a meeting. He told him he did not like
being lied to and on several occasions he lied to him and they
cannot have a working relationship if he lies to him.
Councilmember Santoro told Mr. Riggio that it went both
ways.
Mr. Riggio agreed.
Mayor Failace said the issue here is that Councilmember
Reiman played the tape for Patrick and Nick, where John said
Mr. Reiman lied and the fact ofthe matter is that he lied.

John Riggio said if he hadn't come to the meeting the Budget
would have been Tabled and and in the course of events we
wouldn't have a UEZ Budget and we would have to pay
$60,000.00 for not having UEZ.
Counci1member Santoro said it is unfortunate that it has got to
be tied to a time on both sides.
John Riggio said he did take offense on how Counci1member
Reiman insinuated to him that he is not telling the truth.
Councilmember Reiman asked Nick Goldsack what he thought
about the tape.

Nick Goldsack said his concern was the way John responded
tonight about what that $47,000.00 was in his opinion the way
he should have responded when the question was asked.
Mr. Riggio said he did or say nothing disrespectful. When you
are sitting in the audience it is hard to give an answer.
Coucilmember Quinones said that is a different situation.
Mayor Failace played the tape from the last Council Meeting,
which he felt put John in an adversarial position.
Councilmember Reiman told Mr. Riggio that his intent was not
to embarrass him and he apologizes if he did commenting they
had a good working relationship over the years and that his
problem was the message on the tape. He feels it was
disrespectful and insubordinate.
Councilmember Santoro asked for clarification from the
attorney on what the Business Administrator's position is over
jobs.
Attorney Bergen said it would be like the Chief of Police over
the Police Department. He would be in charge of everyone.
Councilmember Santoro then asked the attorney if Nick
Goldsack is the authority over Mr. Riggio.
Attorney Bergen answered yes.
Councilmember Santoro asked Mr. Goldsack if when this came
up it was under his direction and he called the meeting.
Mr. Goldsack said he was asked to call the meeting after a
meeting on Monday with the Mayor and Mr. Riggio.
At approximately 8:45 P.M., Councilmember Fazekas was
noted Absent.
Councilmember Reiman said he should have been invited to
the meeting in the mayor's office.

At approximately 8:47 P.M., Counci1member Fazekas was
noted Present.
Mayor Failace questioned what they would like to do.

Councilmember Quinones told Counci1member Reiman that he
tends to use antagonizing, strong language.
Councilmember Reiman said he directed the Business
Administrator to talk to John and find out where they were at
with the RCA money and then he spoke about the RCA
monies.
Borough Attorney Bergen asked Mr. Riggio ifhe had anything
to say.
Mr. Riggio said he was not vulgar and did not yell or scream
and said he does not agree with the Business Administrator. He
was not prepared at the meeting to make a presentation and his
intention is to solve the problem.
Attorney Bergen asked Mr. Riggio if his problem lS that
Counci1member Reiman was not being truthful to him.
Mr. Riggo said it was.

Councilmember Quinones asked Mr. Riggio if Councilmember
Reiman's (inaudible) was antagnostic to him.
Mr. Riggio said it was.
Councilmember Rios asked Mr. Riggio if he thought his
statement to Councilmember Reiman was antagonistic to him.
Mr. Riggio said no, because he lied.
Nick Goldsack suggested that he the Mayor, Councilmember
Reiman and Mr. Riggio should sit down and have a meeting
and talk everything out.

Councilmember Reiman asked who is the parliamentary for the
Council.
Attorney Bergen said according to the Rules of Council he is.

MATTERS FOR DISCUSSION:
Director of Social Services-Requesting resolution supporting
A-1006 and S-768, Re: End discrimination by State against
local administration of Work First/General Assistance
program.

The Clerk said Attorney Bergen will review the resolution.
Lebduska & Associates - Request for additional appropriation,
$562.80. This is okay.
Schoor DePalma-Request for additional appropriation. Nick
Go1dsack will review this.
Personnel Matter - Appeal. This will be discussed in Closed
Session.
Carteret Community Action Council - Requesting question be
placed on ballot on November election to establish a ward
system. Mayor Failace said this was voted on once at a Special
Election on February 3, 1993 and the vote was about 2,600 No
to 2,300 Yes.. He said he will have Nick Goldsack get
information on all the forms of government.

Killam Associates - Request for payments of Change Orders
for P&H Construction Change Order #4-$6321.89, Change
Order #5-$4537.50. This was okay to be put on.
At approximately 9:30 P.M., Councilmember Sohayda was
noted Absent.
BUSINESS TO BE ADDED:
Mayor Failace then spoke about Mr. Mancuso being able to get
free paint for the Skate Park.
Mr. Mancuso explained what they wanted to do.
Councilmember Santoro said they will be putting Drug Testing
on one of the Agendas. Then she spoke about the lines on the
road that they are done by Streets and Roads and the ones by
the schools and different areas have not been done for a few
years.
Councilmember Quinones asked about getting microphones for
the building.
Councilmember Fazkeas said they would then go onto CD's
and they would be getting prices.
Councilmember Reiman said he would like to ban smoking at
the park on public events or just ban smoking at Carteret Park.
He suggested tohave the Borough Attorney and Business
Administrator look into it.
Mayor Failace said they should reinforce what the School
Board did.
Attorney Bergen said they should have the Board of Health
enforce it.
Councilmember Reiman said he was over at Pershing Ave. and
Essex Street and there is illegal dumping.
Councilmember Rios said they had a Bond Ordinance last year
to purchase a fire truck. There is money left over and the Fire
Chief could use a new vehicle.

Nick Goldsack said it would have to be a vehicle with a life of
five (5) years or more.
Flower Pot
Councilmember Rios then mentioned a flower pot on the end
of Roosevelt Avenue and Washington Avenue. He said they
should dress that up to help improve that area.
Nick Goldsack said he would look into it.
NeighbOl:bool Town
Meeting
Councilmember Rios proposed a Neighborhood Town
Meeting, at different parts of the town, to listen to people's
complaints.
Mayor Fai1ace said they can try it.
Councilmember Santoro suggested having the Mayor and two
(2) Councilmembers present and then alternating the
Councilmembers for different meetings.
Redevelo¡:ment
Meeting
Councilmember Rios said they cancelled the Redevelopment
Meeting. The next date is April 23, 2001. Attorney Bergen will
check if all the Council and Mayor can attend.
Worker's Memorial
Day
Councilmember Rios said he wanted a proclamation for
Worker's Memorial Day honoring workers that have been
killed on the job. Attorney Bergen will do it.
Borough owned Properties
& Vehicles
Councilmember Reiman said he has directed Nick Go1dsack
and Patrick DeBlasio to put together a list of Borough owned
properties or vehicles. These they could potentially auction off.
He said they have about fifty junk cars at the dump.

Menendez Honey
Counci1member Santoro said Arlene Friscia's Office contacted
her after the report of Menendez's money. He is going to try
to apply for us and it would be in our best interest if we faxed
over the people on the Appropriations Committee for the
Assembly for the Bill for the Borough Hall and for us to start
contacting and lobbying to them. She asked all the Governing
Body to start helping with phone calls.
Killiam Transition

Attorney Bergen spoke about the Killam (Engineer) Transition
Budget that was omitted from that last Resolution. He then said
they should get outside Counsel for the Redevelopment and he
said he is not quite sure and questioned whether the Planning
Board been done and are they ready to move ahead on the
(inaudible).

Mayor Failace said they still have one (1) more meeting on the
Planning Board and said the Redevelopment Agency has to be
added on to the Master Plan.

Councilmember Reiman said they cannot amend the Master
Plan until we look at it and adopt those boundaries and then we
amend the Master Plan. He said they have to start reviewing
the Re-Development Plan. Right now they have only
recommended the adoption of the Redevelopment boundaries
and suggested that the Council move forward with that for
now.
Nick Goldsack said he thinks they have to adopt by ordinance
the plan itself.
Attorney Bergen said he would have to check and that the map
had to be adopted by resolution.
Councilmember Santoro asked if they could use Attorney
Coscia because he would be the best with the Redevelopment,
saying we appointed him last year.
Mayor Fai1ace said he would contact him.
RESOLUTION #01-116 was introduced by the Mayor and
referred to the Council for action.
Upon MMS&C by Councilmembers Reiman and Rios
RESOLUTION #01-116
"RESOLUTION TO GO INTO CLOSED SESSION"
was Adopted. Upon individual roll call vote Counclmembers
Quinones, Reiman Rios and Santoro voted in the Affirmative.
Councilmember Sohayda was noted Absent.
At approximately 10:00 P.M., a Closed Session was held to discuss
Personnel Matters and Litigation.
