TEMPLE CITY, CALIFORNIA
MINUTES OF JUNE 27, 1960
1. A regular meeting of the City Council of the City of Temple
City was held in the City Hall, 9664 E. Las Tunas Drive, and was
called to order by Mayor Fitzjohn at 7:30 P.M.
2. The Pledge of Allegiance was led by Mayor Fitzjohn.
3. Rev. R. E. Schulz of the Lutheran Church, 9123 Broadway, gave
the invocation.
4. Roll Call: Councilmen- Buchan, Dickason, Merritt, Tyrell and
Fitzjohn.
5. Councilman Tyrell corrected the Council Minutes of June 13, 1960
under item 10, regarding three whell motorcycle in the Roll Call
Vote Councilman Tyrell voted "No ". Councilman Merritt added
to item 1 to read as follows "regarding firearms being unlawful
for anyone to fire firearms under 18 yrs. of age." Tyrell moved
the minutes of June 13, and June 20, be approved as corrected,
and further reading be waived. Buchan seconded and carried by
the following roll call vote: Councilmen- Buchan, Dickason,
Merritt, Tyrell and Fitzjohn. Noes: None. Absent: None.
6. ORDINANCE NO. 60 -3; REGULATIONS & PROCEDURE FOR PURCHASE AND
SALE. Following discussion the Council decided to have Mr.
Shatford re -draw the Ordinance to be introduced at the next
Council meeting.
7. ORDINANCE NO. 60 -4: PROHIBITING FORTUNE TELLING. (second read-
ing) Tyrell moved to introduce the title and waive further
reading, Buchan seconded, carried by roll call vote as follows:
Ayes: Councilmen- Buchan, Dickason, Merritt, Tyrell and Fitzjohn.
Tyrell moved to adopt Ordinance 60 -4 Prohibiting Fortune - telling.
Merritt seconded, roll call vote as follows: Ayes: Councilmen -
Buchan, Dickason, Merritt, Tyrell and Fitzjohn. Noes: None.
Absent: None.
8. ORDINANCE NO. AN ORDINANCE OF THE CITY OF TEMPLE CITY
AMENDING THE MUNICIPAL CODE BY PROHIBITING THE USE OF FIREARMS
WITHIN THE CITY OF TEMPLE CITY WITHOUT A PERMIT FROM THE CITY
COUNCIL. City Attorney Shatford read the title to the ,Ordinance
and presented a rough draft, amending the Municipal Code, Sec-
tions 3501, 3502, 3503, 3504, 3505, and 3506. Following con-
siderable discussion the Council recommended various changes and
the City Attorney will re -draw the Ordinance incorporating these
recommendations and present it at the next Council meeting.
9. ORDINANCE N0.10: ADOPTING LOS ANGELES COUNTY ORDINANCE #5860 -
REGULATION &LICENSING OF BUSINESSES (URGENCY). A letter was
read by Mr. Woollett from Mr. John L. Shaw of Shaw, Montpas &
Shaw regarding business licenses recommending continuation of
the Los Angeles County business license ordinance for purpose
of regulation and inspection, and that other businesses not
requiring regulation or inspection should not be required to
obtain a license. Woollett also read a letter from Temple City
Signs in favor of a city business license which would help to
keep out the cut -rate and inferior operator. Councilman Tyrell
stated he was concerned with the letter of Mr. Shaw and that he
felt the client mentioned by Mr. Shaw should have .attended
Council meeting and made the statement himself. Tyrell also
felt the business license question will have to be determined by
whatever we find to be best for the .City. Dickason asked if
no action was taken there would be no licenses in effect, which
has been true since May 25, 1960. Tyrell moved to waive.,fur-
ther reading and introduce our Ordinance No. 60 =10, Adopting
County Ordinance #5860 - Regulation & Licensing of Business,
Dickason seconded, carried by the following roll call vote:

No. 60 -10 as an emergency ordinance, Dickason seconded, carried
by the following roll call vote: Ayes: Councilmen- Buchan, Dicka-
son, Merritt, Tyrell and Fitzjohn. Noes: None. Absent: None.
Further discussion on the business license stated that licenses
currently in effect in the county should be accepted by the
city for the unexpired term. Tyrell moved to adopt -a Resolu-
tion complying with any license purchased from the County for
unexpired terms, Dickason seconded, roll call vote as follows:
AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell and Fitz-
john. NOES: None. ABSENT: None.
10. ORDINANCE NO. 60 -5: AMENDING MUNICIPAL CODE SECTION 9102 -
PLOT PLAN APPROVAL: & ORDINANCE NO. 60 -6 RE -PLOT PLAN FEES:
Ordinance No. 60 -5 was read in full by City Attorney Shatford.
which included a fee of $10.00 for filing a plot plan. Dicka-
son moved to adopt the Ordinance as an urgency ordinance.
Merritt seconded, carried by the following roll call vote:

NOES: None. ABSENT: None. ORDINANCE NO. 60 -6 calling for a
fee of $50.00 for a zone change or zone variance request was

OF A TRAFFIC COMMISSION. Attorney Shatford read title to
Resolution No. 60-46, Dickason moved to waive further reading
and to adopt Resolution No. 60 -46, Merritt seconded, roll call

13. RESOLUTION NO. 60 -47. ESTABLISHING A PETTY CASH FUND. Tyrell
moved to adopt Resolution No. 60 -47, Dickason seconded, and
carried by roll call vote as follows: AYES: Councilmen - Buchan,
Dickason, Merritt, Tyrell and Fitzjohn. NOES: None. ABSENT:
None.
14. RESOLUTION NO. 60 -48: APPOINTING MASTAFA REJAI AS AN ADMINIS-
trative.aide. Shatford read in full Resolution No. 60 -48.
Dickason moved to adopt. Resolution No. 60 -48. Tyrell suggested
maybe appointee should possibly be someone that could later
possibly become a permanent employee, however due to immediate
need and qualifications he agreed to the temporary employment.

ORDINANCE NO. 60 -7: AN ORDINANCE OF THE CITY OF TEMPLE CITY
AMENDING THE MUNICIPAL CODE BY PROVIDING FOR PRESENTING, FIL-
ING AND BRINGING SUIT UPON CLAIMS IN COMPLIANCE WITH CALIFORNIA
GOVERNMENT CODE SECTIONS 710 THROUGH 720. City Attorney Shatford
read Ordinance No. 60 -7 in full. Tyrell moved to adopt Ordin-
ance No. 60 -7 by reading title, Merritt seconded Roll call vote
as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell

ORDINANCE NO. 60 -9: AN ORDINANCE OF THE CITY OF TEMPLE CITY
AMENDING THE MUNICIPAL CODE BY REPEALING SECTIONS 3200, 3201,
3203, and 3204 OF CHAPTER 2, ARTICLE 111 RELATING TO FELONS,
Tyrell moved to adopt Ordinance No. 60 -9 by reading title,
Dickason seconded, roll call as follows: AYES: Councilmen -
Buckan, Dickason, Merritt, Tyrell & Fitzjohn. NOES: None.

ORDINANCE NO. 60..8 - AN ORDINANCE OF THE CITY OF TEMPLE CITY
AMENDING THE MUNICIPAL CODE BY PROVIDING FOR APPROVAL OF PLAN-
NING COMMISSION APPOINTMENTS BY THE CITY COUNCIL. Tyrell
moved to waive further reading and .introduce the title, Buchan
seconded, roll call as follows: AYES: Councilmen- Buchan, Dicka-
son, Merritt, Tyrell & Fitzjohn. NOES: None. ABSENT: None.
At this time Mayor Fitzjohn called for a five minute recess.
OFF- STREET PARKING & PARKING METERS: Following the recess
City Attorney Shatford gave a detailed report on the parking
lots and meters. He found a Mrs. Kettle of Monrovia owned
lots 1 & 2, and received $75.00 per month on lease and gave
option to the .County to purchase at a fixed price of about
$7500.00. The County did not exercise . the option, and Mrs.
Kettle now . feels the value to be $13,500.00 and would take
considerable negotiation if the city wishes to buy. Lot #1
has 24 parking stalls, Lot #2, 26 parking stalls. Lot #5
owned by Mr. Wells is not under lease, has 26 stalls, available
at $75.00 per month on lease. Mr. Wells will fence lot against
use until an arrangement is entered into to. lease it. Lot #3
leased at $75.00 per month by the Parking Assn., lease has
about 4 years to run, lot has 26 stalls. Lot #4 has 25 stalls,
a Parking Assn. lot leased at $75.00 per month. Lot #6 is a
proposed location which has no parking at all at present. The
County leases Lots No. 1, 2, 3 and 4 from the Assn. and private
owners, and in order to pay the .rental adopted an ordinance
for parking meters, also to pay for maintenance, collection and
enforcement of law, and at the present time there is approxi-
mately $14,000.00 held by the County which was raised by parking
meters. The Co unty of Los Angeles will transferor assign the
leases to the City of Temple City, The County will make arrange-
ments with the owners of properties getting their consent to
transfer to the .city. The County will go before the County
Board of Supervisors and a resolution adopted by them after ob-
taining consent of the property owners, then the people of
Temple City will hold these leases. The .question of financing
the lots has to be decided by the City Council. It would take
some legal procedure to get the $14,000.00 held by the County
for Temple City. The City Attorney recommended the City Coun=
cil immediately pass a Resolution setting the wheels in motion
to acquire these leases as he felt it would be a great tragedy
to lose them and that the City should retain them regardless
of what they do in the future.

Mr. Milo Rhynsberger, 9616 Las Tunas Dr., Temple City, reported
on the parking situation regarding parking meters. In leasing
the .four lots, and free off - street -two hour parking it was im-
possible without the meter collection fund. He further stated
Mr. Byron Wells owns Lot 5 and if a lease with the city is not
submitted within .a short time that he will fence or build on the
lot. He thinks we can still get a lease with Mr. Wells for
$75.00 per month. Also Lot No. 6 the second lot south of
the Chamber of Commerce office on east side of the alley, which
is the only lot available currently. Regarding the meters gives
convenient parking for customers closer to businesses, and the
cost is minimum. Therefore the Committee respectfully recom-
mends until better means can be developed or the city can re-
place the tax - payers money that we maintain street meters and
expand our parking facilities. Figures on the financing are
available in the files of the Chamber of Commerce.
Mr. Robert Skinner, President of the Chamber of Commerce, pre-
sented a form for a survey of all merchants in the area regard-
ing the parking meters.
Mr. Don Pinzo of 9530 Las Tunas Dr. presented a list of 57
merchants on Las Tunas Drive, showing 51 against parking meters
and 3 for with three not designating preference.
Mr. Fitzjohn stated definitely he felt something must be done
about renting these lots before the ,meters .be, taken out. He
stated something should be .done to improve Temple City, and
should be done now, and that he felt strongly it would help by
removing the meters.
Mr. A. L. Nunamacher, 5757 N. Agnes, spoke for the Parking Assn.
of which he is a member. He stated the Assn. was formed and
incorporated under the State of California and financed at
$25.00 a share, the money used to buy the parking lots now
owned by the Assn. The leases to the County have approximately
4. yrs. to run, with options for 10 yrs. at the same terms.
If not taken up or assigned to Temple City the Assn. will be
free to sell.
Mr. Stewart Bingham, 9720 Las Tunas Drive stated he was in ac-
cordance with Mayor Fitzjohn in favor or removing the meters.
Mrs. Georgia Maxey, 9823 Hallwood, stated from a resident's
angle and a past business person in this community, that the
City should do something about getting the meters our as soon
as possible and get people to shop in their own home town.
Attorney Shatford outlined several ways the City could handle
the problem. Mr. Nunamacher stated 1% of sales tax revenue was
used by El Monte since removing meters to finance parking. Mr.
Shatford will check this out and also the way Montebello is
financing their parking. Mayor Fitzjohn stated he felt we
should not let the contracts go at this time. Tyrell felt we
should maintain what we have, and that there should be consid-
erable more study before any changes made. Personally he felt
it was not a great penalty to pay a penny or so for meters. in
Alhambra they have ,metered parking lots so there is no free
parking. Here there are something like 150 free parking spaces.
Leora Blessinger, 9659 E. Las Tunas Dr., stated she felt off -
street parking should be taken care of first, and she believes
the meters should be kept on .Las Tunas Dr. until the city can
provide off street parking.
Tyrell felt the merchants should be polled, and suggested we
publicize in the paper so residents can state an opinion after
reading broth sides. If we had a time zone parking we would
have to make extra runs to patrol the area. if a short time
zone it means that many more passes through to patrol. Fitz-

john.stated a number of people were coming in and discussing
the parking meter problem. He thought maybe they could be.dis-
continued on a trial basis for 6 months and if business increased
as in El Monte fine, and if not they can always be put back in
operation. Tyrell felt we should retain what we have and study
what can be done in the future, and that we should authorize the
sheriff . to maintain their patrol area now after the lst .of July.
Alfred R. Sale, 9427 E. Olive, stated he has been a resident of
Temple City for six years and he felt the reason residents were
buying outside of Temple City was because they cannot find what
they want here, and speaking as a resident :he.did not mind put-
ting money into the meters. Buchan felt the big problem in pro-
viding parking was to find the financial means to do so. One
solution would be to purchase these lots on a time basis con-
tract and proceeds on revenue used to make payments could be
through a business license .tax, and wondered .what reaction the
tax would be on the merchants. Daniel Pinzo, 9530 Las Tunas Dr.
stated he received gripes every day and comments about parking
in West Arcadia without cost. He suggested the City Council
condemn 100 parking spaces on Las Tunas Dr. and have them paid
for partly by the property owner, partly by the businessmen and
partly by the tenant.
Dickason said re.. a 6 months moratorium would cost approxi-
mately 7 months in lost revenue and there were quite a few mer-
chants against it. Might consider a temporary moratorium and
if sales did spurt 40% or 50% would then know the problem was
the meters.
Shatford said it might take quite .a while to get this $14,000
from the County, anywhere from 90 days to 6 months. Woollett
stated the leases will be paid from monies in the parking meter
fund. There is money enough in the fund to pay for off - street
parking lots until leases run out. Shatford said all the Coun-
cil had to do is adopt a Resolution and then go through.pro-
ceedings to get this money from the County. Merritt moved a L0-D
Resolution be .drawn requesting additional law enforcement ser-
vices from Los Angeles County Sheriff's Department in the .form
of a 3 wheel motorcycle service. Buchan seconded, roll call
vote as follows: AYES: Councilmen - Buchan, Dickason, Merritt,
Tyrell and Fitzjohn. Tyrell moved to adopt a resolution re-
taining meters for a period of 6 months during which time we
can study the problem further, Merritt seconded, roll call vote
as follows: AYES: Councilmen- Buchan, Merritt, Tyrell. NOES:
Councilmen- Dickason .& Fitzjohn. ABSENT: None.
Merritt made a motion a Resolution be drawn to the Board of
Supervisors from the City of Temple City requesting them to
assign all interest of. Los Angeles County in all leases in re-
spect to parking facilities in the City of Temple City. Shat-
ford stated the County will pay all rental payments due on the
leases until completion of assignment. They will collect money
from meters until the Board of. Supervisors adopt a Resolution
then we will get it. Buchan seconded, roll call as follows:
AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn.
NOES: None. Absent: None. Tyrell suggested that the City
Manager investigate. Lot 5 and see if the City can get it.
BUDGET
Woollett submitted the proposed City budget for 1960 -61, show-
ing a balanced budget without city property tax. City will re-
ceive approximately $529,340. in revenue, a budget of $379,072,
estimated surplus at end of fiscal year $321,167. He recom-
mended the Council hold a meeting Thursday night, June 30th to
pay the bills for the fiscal year ending on June 30 as we will

receive approximately $177,000. before that date.
Mr. Woollett presented a petition signed by 29 property owners
in area surrounding 5306 Rosemead Blvd. protesting the opera-
tion of a small animal hospital and kennels at this address.
Mr. Roy Burger, 9081 Rancho Rio Rd. spoke for the petitioners
stating they just want him to clean up the property and do
something to stop the noise. Tyrell stated we can have the
City Manager take care of the sanitation. problem. Mr. Woollett
will investigate and report back at the next Council meeting.
Mr. Burger also complained regarding the alley which was paved
by the property owners which is being taken over by parked e-
quipment. Mr. Woollett will check out if dedicated and if so
can have the Sheriff's Dept. open it up.
Robert Skinner, representing the Chamber of Commerce, requested
in the budget to be presented on June .30 that some funds be set
up to be used by the Chamber of Commerce for promotional ser-
vices of the City of. Temple City. Tyrell moved to table the
request until we consider the budget itself. Mr. Skinner
stated the Chamber of Commerce wants to get some assistance
from the City to advertise Temple City and attract new and
better businesses but not to perform functions for the -mer-
chants. It was suggested that they should bring in.a program
to present to the Council. Tabled for the present.
Mike Hinshaw, 9492 E. Pentland, with W. P. Boatright & Assoc.
then spoke regarding the equipment, furniture, etc. purchased
by the City. The Council gave him all desired information.
