A regular meeting of the City Council of the City of Temple City was held in the City Hall, 9664 E. Las Tunas Drive, and was called to order by Mayor Fitzjohn, at 7:30 P.M. 2. The Pledge of Allegiance to the Flag was led by Mayor Fitzjohn. 3. Elder Harold Calkins of the 7th Day Adventist Church, of 9664 E. Broadway, gave the invocation. II 4. Roll Call: Present: Councilmen - Buckan, Dickason, Merritt, Tyrell, & Fitzjohn. Absent: None. Also present: Shatford & Woollett. 5. After deleting . action shown on Ordinance No. 60 -11 as it was the first reading, in the minutes of June.27, Section,11, also the minutes of June 30, bottom of page 1 salary of Mrs. Lavina Nixon should read $355.00 per month ", Merritt moved to approve the minutes of June 27 and June 30 as corrected, Tyrell se- conded and carried. 6. ORDINANCE NO. 60 -3: AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE MUNICIPAL CODE BY PROVIDING REGULATIONS AND PROCEDURES FOR THE PURCHASE AND SALE OF SUPPLIES, SERVICES, &EQUIPMENT. (Second reading). Tyrell moved to waive further reading of Ordinance No. 60 -3 regulating purchase and sale, Merritt seconded, carried by the following roll call vote: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell and Fitz- john. NOES: None. ABSENT: None. Tyrell moved to adopt or- dinance No. 60 -3, Merritt seconded, and carried by the follow- ing roll call vote: AYES: Councilmen - Buckan, Dickason, Mer- ritt, Tyrell &Fitzjohn. NOES: None. ABSENT: None. 7. ORDINANCE NO. 60 -11; AN ORDINANCE OF THE CITY OF TEMPLE CITY CALIFORNIA, REGULATING THE DISSEMINATION OF ADVERTISING MATTER. (Second reading). Tyrell moved to waive further reading of Ordinance No. 60 -11 regulating dissemination of advertising matter, Merritt seconded, roll call vote as follows: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn. NOES: None. ABSENT: None. Mr. Raymond Burger, 9018 Rancho Rio, was given a copy of the Ordinance to read. Tyrell moved to adopt Ordinance No. 60 -11, Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn. NOES: None. ABSENT: None. 8. RESOLUTION NO. 60 -53: APPOINTING A STENOGRAPHER- SECRETARY. Buchan moved to adopt Resolution No. 60 -53, Tyrell seconded, roll call vote as follows: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn. NOES: None. ABSENT: None. 9. RESOLUTION NO. 60 -54: APPOINTING A DEPUTY CITY TREASURER, Dickason moved to adopt Resolution. No. 60 -54 appointing God - frey Lumsdon Deputy City Treasurer, Buchan seconded, roll call vote as follows: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell &.Fitzjohn. NOES: None. ABSENT: None. 10. RESOLUTION NO. 60 -55: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING AND DIRECTING THE SECURITY FIRST NATIONAL BANK OF TEMPLE CITY TO HONOR ALL CHECKS, DRAFTS AND WARRANTS WHEN BEARING SIGNATURE OF GODFREY LUMSDON, DEPUTY CITY TREASURER, WHEN SUCH SIGNATURE IS IN LIEU OF THE CITY TREASURER. Merritt moved to waive further reading, Buchan seconded, roll call as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell &Fitzjohn. NOES: None. ABSENT: None© Merritt moved Resolution No. 60 -55 be adopted as a- mended by adding "when such signature is in lieu of the City Treasurer" at the end of Section 1 in Resolution. COUNTY OF LOS ANGELES BOUNDARY COMMISSION: a. A letter was read from the Board of Supervisors re- Notice of intention to petition for incorporation of new city of Nor- wood, originally filed as Norwood Village. b. Also a letter and map showing the proposed annexation #60 -4 of the City of. San Gabriel. c. Re- County Library Council meets once a month, the next meeting to be July 18. Woollett recommended the Council ap- point one of the Council to attend this meeting which would give the city a xhance to have something to say regarding the district we are in. Buchan moved Dickason be appointed to the library board, Merritt seconded, and carried. At this time Mrs. Bertha L. Rains read a letter from the Holly- wood Bowl Volunteers Committee who are sponsoring Temple City Community Night on Saturday, August 13th. The Committee re- quested the Mayor to declare Saturday, August 13, "Temple City Community Night at the Hollywood Bowl ", signed by Mrs. Bertha L. Rains, of 6438 Golden West, Temple City. So declared by the Mayor. 12. Similar letters from Lawndale and Lakewood re - a resolution for a new formula for apportionment of Gas Tax were read by Woollett. Council has already acted on this so Buchan ma0e a motion to file the letters, Tyrell seconded and carried. 13. There was considerable discussion regarding annexations. Mr. Rejai has completed map as relating to area surrounding our city boundaries, and at present time is determining property owners, registered voters, and valuations in these areas. Woollett stated he is expecting to meet with the Annexation. Committee and attempt to map out some sort of program. A. L. Nunamacher of 5757 N. Agnes of the Planning Commission stated the Commission recommended to the Council to invite any sur- rounding area to consider annexation to the City of Temple City. Due to 50 day waiting period in certain areas nothing can be done by the City to invite annexation of these specified areas. Considerable discussion followed regarding county ter- ritory adjacent to Temple City. Mr. Skinner, Pres. of the Chamber of Commerce suggested a survey be made. Dickason thought any survey should have the approval of the Council be- fore printing. Mr. Don Wheeler, Postmaster of Temple City, spoke with reference to residents within the boundaries of Temple City still being in a different postal district and having mailing addresses of Rosemead, Arcadia, etc. The Postmaster does not have author- ity to make the change. The people if they so desire can come in to this district. The Postal Department can do it if a ,petition is presented from the area or by talking to the people in the area. Tyrell moved the Mayor be directed to write a letter to the Postmaster requesting the Postmaster to canvas the citizens of Temple City in other postal districts ascer- taining the postal district they wish to be in. Seconded by Merritt, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn. NOES: None. ABSENT: None. Some discussion followed regarding what influence this would have on the man -power as far as the postal district was concerned, and Mr. Wheeler advised practically none. Tyrell felt anyone living within the City of Temple City should have a Temple City mailing address. 14. MATTERS FROM CITY OFFICIALS: Woollett referred to petitiin signed by 29 residents and prop- erty owners in .area surrounding 5306 Rosemead Blvd. protesting the operation of a small animal hospital and kennels at this address. As requested by the Council Woollett investigated the hospital with the following to report: Dr. Jobe, is owner and operator of the hospital, and the existing zoning does permit this use. Inspected hospital, the hospital was clean and could see no sanitation problem. The Health Dept. had been called out at one time and had inspected the hospital 25 Council minutes of July 11, 1960 page 3. and it was up to standard at that time and all bodies were kept under refrigeration. Talked to Dr. Jobe and assistant and in addition to hospital they also board small animals, primarily on holidays, vacations, etc. For their health it is advisable they be let outside in runways which he provides. Woollett suggested the Council hear both from Dr. Jobe and Mr. Burger, first signer and who presented the petition. Dr. Jobe, 5406 N. Rosemead, stated he thought he operated the hospital in a good manner. The building is sound - proof. The only time the .dogs are in the runways was during daylight hours. Mr. Burger, 9018 Rancho Rio Rd., stated any real estate man will verify the depreciation in surrounding property due to hospital and reiterated the complaint of noise, sanitation, and undesirability of the hospital in that area. Stated he would bring in reports from different departments in this re- spect. Tyrell stated their were two problems, and zoning was one and it has been ascertained the hospital was permitted, the other would be an extreme condition such as a nuisance in the eyes of the law. Suggested getting proper people to give written reports, and the Council should not hear further but get definite information and written reports from the State Depts. etc. Mayor Fitzjohn told Mr. Burger to submit written reports as requested and submit them to the Council. Tyrell moved to table petition until reports were turned in, Merritt seconded and carried. Mr. Richard .Little of the Sterling Press, who lives at 9648 Nadine, Temple City, submitted design for proposed stationary for the City of Temple City for the Mayor and Council to con - sider. Woollett submitted a communication from the Los Angeles County Division of the League of Calif. Cities meeting on Thursday, July 21, at 7 P.M. at Hollywood Park Turf Club. Merritt and Buchan unable to attend, reservations for rest will be made by Mr. Woollett. The Council, City Attorney and City Manager invited to a Lions Club meeting at the Santa Anita Bowl, Wednesday evening at 7 P.M. July 13. A letter from the Dept. of Finance of the State advises they are holding a conference on Monday, July 18, at 9:30 A.M. in Room 100 of the County Engineers Building, 108 W. Second St., Los Angeles, at which time the 701 program will be discussed and how it relates to incorporated cities. Planning Commis- sion will be contacted regarding attendance. A Communication from the Los Angeles Chamber of Commerce, Governmental Affairs Dept. will have .a luncheon session on August 4 at Chamber of Commerce Bldg., from c1:2 noon to 4 P.M. the program to consist of a Sales Tax Clinic. Buchan and Woollett will attend. Woollett stated that according to the .request of the Council he had made arrangements that the Council members could visit the Fire Dept., Sheriff's Dept., County Engineers, etc. for a tour of their facilities on .a Saturday morning if they so desire. If at the City Hall at 9 A.M. could complete the tour by noon. Buchan suggested Saturday morning, at 9 A.M. July 23. RESOLUTION NO. 60 -56: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY IN RE AUTHORITY TO ACCEPT DEEDS OR GRANTS TO THE CITY OF TEMPLE CITY AS REQUIRED BY SECTION 27281 OF THE GOVERNMENT CODE AND DESIGNATING CERTAIN. OFFICIALS OF THE CITY OF TEMPLE CITY AS AGENTS OF THE CITY TO EXECUTE CER- TIFICATES OF ACCEPTANCE OF DEEDS OR GRANTS. Shatford read title to Resolution No. 60 -56 which states when street or sewer is to be constructed and it is necessary for an easement be given to the City to give them permission to go in for maintenance, etc., under the government Code must have some kind of Certificate of Acceptance and must be recorded in the County. He recommended the Resolution be adopted. Tyrell moved to adopt Resolution No. 60 -56, Buchan seconded, roll call vote as follows: AYES:. Councilmen: Buchan, Dickason, Merritt, Tyrell & Fitzjohn. NOES: None. ABSENT: None. RESOLUTION NO. 60 -57: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY PROVIDING FOR CREDIT AGAINST CITY LICENSE WHERE COUNTY LICENSE HAS BEEN. PREVIOUSLY PAID. Shatford read title to Resolution No. 60 -57. Tyrell moved to waive further reading, Buchan seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn. NOES: None. ABSENT: None. Merritt moved to adopt Resolution No. 60 -57, Dickason seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell &Fitzjohn. NOES: None. ABSENT: None. Fitzjohn asked when the traffic commission will be in force and Woollett stated as yet the Council had appointed only three members and the Commission was to be five. Dickason.recom- mended John Benedict, and Fitzjohn suggested Mrs. Georgia Maxey, thus completing the necessary five. Woollett will contact them and if they will accept the appointment will get them to- get'ier with the City Attorney and make.a Resolution appointing them and establish meetings, etc. Buchan asked if. the Resolution to be presented to the Board of Supervisors for changing over leases on parking lots, and also if we had communicated with the County to obtain reserve funds they had in parking fund. Woollett stated he had talked to the Property Management and Chief Administrative Offices, and they will be happy to assign them to us, and will not even discuss the fund until assignments are made. Dickason then asked regarding the sheep ranch in Temple City. Woollett stated this afternoon he received a report from the County that they have given no special use permit to these people. Mayor Fitzjohn directed the .City Attorney to write a letter to the owners of the sheep ranch to this effect. Regarding the alley problem Mr. Burger brought before the Council Mr. Woollett will report at the next meeting if the alley is dedicated or not. Tyrell asked about insurance bids. Woollett stated we have a 90 day binder, and specifications are now being drawn up. Tyrell asked about the podium, Woollett stated a price of $130. from the cabinetmaker who made the table, and because of price he had not placed the order. 15.
