MINUTES OF ADJOURNED MEETING
OF AUGUST 25, 1960
INITIATION:
1. The adjourned meeting of the City Council of the City of Temple
City was called to order by Mayor Fitzjohn who led the Pledge
2. of Allegiance to the Flag.
3. ROLL CALL:
PRESENT: Councilmen-Buchan, Dickason, Merritt, Tyrell &
Fitzjohn
ABSENT: Councilmen -None
ALSO PRESENT: Sha.tford & Woollett.
UNFINISHED BUSINESS:
4. PROPOSED CONTRACT CHAMBER OF COMMERCE (Discussion)
F. M. Jackson, 9119 E. Las Tunas Dr., spoke representing the
Chamber of Commerce, and stated since last meeting on Xmas tree
lights he had learned there were 14 strings of lights last year
and that the price had been raised $15.00 per line this year
making an additional $210.00. It was recommended that the number
of strings be increased to 18, making 4 more switches costii;ng
$500., 4 extra strings $580., 4 cable installations $80., and
approximately $200. more for electricity, together with cost
of 14 strings of $2030. making a total of $3390. for Xmas lights.
Dickason made a motion to authorize expenditures as follows:
Camellia Festival expenses not to exceed $1500.
Xmas tree lights expenses not to exceed $1500.
Buchan seconded, and there followed considerable discussion.
Tyrell was in favor of under - writing the Camellia Testival as he
felt it to be a project of the entire community, but was not in
favor of giving funds for Xmas lights. He also requested Mr.
Jackson to furnish a break -down of the budget requested for
the Information Center and the Anniversary Celebration in order
that the Council may better consider funds requested for them.
He felt the City was not obligated to support the Chamber but
felt the City should support them on specific. Mayor Fitzjohn
suggested these two donations be voted on separately. Merritt
felt somewhat the same as Tyrell regarding the Camellia Festival
and suggested about $500. toward Xmas lighting. Buchan stated
he would like to bring out some things that no one else has men-
tioned, quote: "I do not look on the sales tax as a tax in the
same nature as it would be if we had a city tax, nor is it the
same tax as a property tax which is forced upon us and which we
have no way to object to. If we look at the sales tax in a dir-
ect the sales tax is a privilege tax imposed by the State of
California for the privilege of selling personal property to the
customer. Therefore the merchant who owns the business is bur-
dened with collecting and becomes a collection agency accumulat-
ing an account and then paying it. Also this sales tax is not
collected 100% from the residents of Temple City. I would ven-
ture to say 50% of Temple City sales tax is paid by other persons
than residents of Temple City. Therefore I feel the merchants
should have some reward, some consideration for expense and
trouble he goes to to create sales which brings in these taxes.
Therefore if we were to re- invest some of this tax money in a
manner which would increase the return we would be doing a wise
thing. So I recommend the City make a contribution to the cost
of Xmas lights. I would rather have it in a way that we would
pay 50% of the cost of lights but not to exceed $1500. The
Camellia Festival I believe is a:responsibility of the City and
I would like to have $1500. appropriated." Following consider-
able discussion Dickason requested his motion be with - drawn, and
Buckan requested his second to the motion with -drawn also. Mr.
Jackson advised the Camellia Festival ordinarily made between
$1100. and $1300. over and above all expenses, the Chamber gives
them $500. and they are asking the City for approximately $1500.
Tyrell stated he felt the Festival a community project which

every one enjoyed, and that it should be a City project, and he
felt the City should under -write it in the amount of $2880.
which figure plus net revenue from the carnival should pay for
the Festival in its entirety. After further consideration Tyrell
made the motion that the City under -write the Camellia Festival
in a sum not to exceed $2880., which sum is to be specifically
used for the Camellia Festival as shown in proposed budget of
1961 plus $700. for brochure reimbursement to be made by author-
ized vouchers. Buchan seconded and discussion followed. Motion
carried by roll call vote as follows: AYES: Councilmen - Buchan,
Dickason, Merritt, Tyrell & Fitzjohn. NOES: Councilmen -None.
ABSENT: Councilmen -None.
Dickason then made a motion that the Council authorize an expen-
diture for Xmas lights through the Chamber of Commerce for an
amount not to exceed $1,000. to be paid by authorized vouchers.
Buchan stated he would like to amend this motion to read: "The
City of Temple City would pay 50% of the cost of Xmas lights
not to exceed $1,000. reimbursement to be made upon authenti-
cated vouchers." Dickason seconded the amendment. B. L. Meek
6004 N. Rosemead Blvd., stated he felt it strictly a merchants
enterprise. Dickason felt all citizens benefit from the Xmas
lights and I feel strongly that we as residents have much to
gain and I did not connect the lights with the merchants. I am
in favor of helping the Chamber put the lights up. Tyrell stated
unless the lights were for all business areas of the City that
the Council could allocate funds for them. Also by under - writing
the Camellia Festival for the full amount budgeted, the Chamber
could divert their monies allocated in the budget for the Cam-
ellia Festival to the Xmas lights and they could assume full
responsibility there. Art Stoppel, 962.1 Las Tunas Dr., referred
to results in San Gabriel when they did not install Xmas lights,
and that the following year they got money from the City to help
with lights because their business was so poor. Leora Blessinger
9659 Las Tunas Dr., stated the Xmas lights did not just benefit
the merchants but the entire community. If the City is attrac-
tive you will bring in more people and this City will have more
sales tax money. S. I. Belk, 5034 Rio Hondo, with insurance
office on Rosemead Blvd. stated there was no need for Xmas lights
on Rosemead Blvd. Connie Condell, 9548 Las Tunas Dr. stated
people outside of area do not Want to contribute, and downtown
was in favor of lights and felt the City should help in financ-
ing. Herbert Hawkins, 5730 N. Rosemead, the Chamber performs a
function in the City, and the lights are a promotion for the
City, the Community and the children. The Xmas lights also per-
form a commercial function of increasing sales tax, and the
business area is the appropriate place to put up the lights.
Mayor Fitzjohn called for the vote on the amended motion.
AYES: Councilmen - Buckan, Dickason, Tyrell & Fitzjohn
NOES: Councilmen - Merritt. ABSENT: Councilmen -None. The Mayor
then called for the vote on the original motion. AYES: Council -
men-Buckan, Dickason, Tyrell & Fitzjohn. NOES: Councilmen: Mer-
ritt. ABSENT: Councilmen -None. Leora Blessinger stated as
a City now the people wanted to know what the City was going to
do, and she felt the people are going to appreciate anything the
City is going to do. Mr. Jackson was requested to break down
the budget figures for the other promotions and bring them in
a plan that will be acceptable to the residents of this City and
the Council can then act on them.
5. PROPOSED TEMPORARY REMOVAL OF PARKING METERS: Woollett stated
there are 276 meters on the streets, and the cost of removal
and capping the open appurture could be $100. and to replace
$100. If covered with a plastic bag cost of material would be
$25. and labor to put them on. These would cause certain pro-
blems being attractive . to children, and bags are put over meters
when they are being repaired. Also the present law enforcement

guarantees our contract with the Sheriffs Dept. for four hours
a day six days a week with parking meters. In event the meters
were removed would have the same service by time limit and mark-
ing, and with hours staggered between 9 A.M. and 6 P.M. the
Sheriff's Dept. felt it would be effective. The parking lot
leases would continue to be paid by the County from the parking
meter fund, in which there is ample money to pay the off street
parking leases during this period, in fact enough to pay until
the leases run out. However the cost of removing and replacing
the meters would have to be borne by the City. Woollett advised
the present cost of servicing the meters is $1.50 per mo. per
meter. All of the area is already posted for time limit parking.
Also 1 hr. was scheduled to circumvent all posted areas. Tyrell
Stated "It is not my feeling that removal of meters is going to
Improve business in Temple City. If one hour time zone it will
end opportunity to get a parking place in front of business.
A long parking period is adverse to business. Our meters are
providing us with lots of free parking and in the future will
provide more lots and allow us the right to park in front of
fhe business where we wish to shop. People desiring more time
can park in the lots and take all the time they want. Will re-
quire an '8 hr. man and maybe more. We will lose revenue which
could go into fund for additional lots. I do not think this
quarter will be of benefit as due to raise of prices tax will be
higher, and without any change we should have greater volume
of sales. If you take the meters out it will appear that they
have created an inducement to your sales program and I think
it will be a false picture. I think you are going to have to
provide additional enforcement so that you will have a turn over.
I think it a poor move but maybe right to try it, but I think you
are driving shoppers out of Temple City." Fitzjohn stated the
meters were put in not by merchants and people but by a small
group and the County, and if put up to a vote of the people now
they would be pulled out. Speaking to Tyrell he said "You spend
most of your time in Alhambra during the day, I wish you could
spend a few days in Temple City and see the number of cars on
the street. Except at Xmas time the streets are very very empty.
I am against meters. I could be wrong but I believe in this test
we can see the biggest sales period in Temple City history.
Tyrell questioned if put to vote of people if all facts and fig -
ures were made public that the people would reject the meter
system. Dickason stated his position somewhere between Tyrell
and Fitzjohn, and if enough merchants feel, and their customers
think this is a problem I am for a trial period. As County funds
pay for the parking lots we stand to lose around $500. per month
but the only way to look at that is it will be put back into the
pockets of the people who would have had to put it in the meters.
I would certainly go along to give this thing a try. I think
there are other things involved, as shopping centers around are
a big attraction and I think Temple City can afford something
along this line. To look at the 4th quarter of sales tax re-
ceipts would be unfair unless we look also to increase of mer-
chants and average of previous three quarters of year. If only
increased 10% or 20% we have gained nothing, but if up 30% or
40% I would be very pleased. We have population here to support
it and I would go along and support the trial for the very few
dollars it will cost.
Mr. Mackay, 9660 La Rosa, says take out meters, neighbors (75%
of them) shop elsewhere rather than put money in meters.
Ande Tambe, 9816 La Rosa, stated he felt the 4th quarter an un-
fair test and it should be made in the ht quarter of next year.
Also that taping was not good and the meters should be capped
if we have the trial period. Wm. Harker, 9956 E. Broadway, stat-
ed he did not feel parking meters were driving business out of
Temple City. Larry Cude, 9923 E. Live Oak, stated more than
50% revenue the City receives is from sales tax, and to increase
revenue must increase sales which also required parking, and un-

less we give it a try will not know if meters are a problem.
Meek stated removal involved taking off revenue at best time of
year.
Shatford then discussed terms, when effective, how long effective,
whether to remove, or cover heads, what time zone will be, all
of which should be included in the Resolution. I can then pre -
pare the Resolution and get them to you so you can study it be-
fore the Council meeting. Buchan moved date of removal be Oct.
1, 1960, Merritt seconded, roll call vote as follows: AYES::
Councilmen - Buchan, Dickason, Merritt, Fitzjohn. NOES: Councilman
Tyrell. ABSENT: Councilmen: None. Buchan moved to re- install on
Jan. 3, 1961, Dickason seconded and carried. It was stated the
streets are already posted 9 AM to 6 PM. Merritt made a motion
the over- parking fine be $3.00, Dickason seconded, roll call as
follows: AYES: Councilmen- Buchan, Dickason, Merritt, Fitzjohn.
NOES: Councilmen - Tyrell. ABSENT: Councilmen -None. Shatford
read title to Resolution No. 60 -73 RESOLUTION REMOVING PARKING
METERS FOR INDETERMINATE PERIOD, and also read a rough draft
including the above determinations, Merritt made a motion Reso-
lution No. 60 -73 be adopted as read, Buchan seconded, roll call
vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt.
Fitzjohn abstained from voting. NOES: Councilmen-Tyrell. ABSENT:
Councilmen -None. Shatford read Resolution No. 60 -74 authorizing
expenditure of $100. by City Manager for removal of heads of
meters, and $100. to have heads restored on January 3, 1961.
Buchan moved to adopt Resolution No. 60-74, Merritt seconded,
roll call vote as follows: AYES: Councilmen - Buchan, Dickason,
Merritt, Fitzjohn. NOES: Councilmen - Tyrell. ABSENT. Councilmen -
None. Tyrell moved to enter into supplemental contract with the
Sheriffs Dept. for three- wheel enforcement of this legislation.
Woollett stated by varying hours three - wheeler makes rounds we
can do this with same amount of time as people do not know when
he is coming and Woollett stated this was discussed with the
Sheriffs Dept. and they both felt it could be enforced with same
amount of time as before. Motion made by Tyrell died for lack
of a second.
6. NEW BUSINESS: RESOLUTION NO. 60 -67 WITH - DRAWING TEMPLE CITY RE-
SIDENTS FROM PARK RECREATION & PARKWAY DISTRICT #8 (Rosemead)
Shatford read in full Resolution No. 60 -67 RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING DETACHMENT OF AREA
FROM PARK RECREATION & PARKWAY DISTRICT #8 (Rosemead) WITHIN
TEMPLE CITY. Dickason moved to adopt Resolution No. 60 -67 as
read, Buchan seconded, roll call vote as follows: AYES: Council-
men- Buchan, Dickason, Merritt, Tyrell & Fitzjohn. NOES: Council-
men -None. ABSENT: Councilmen -None.
7. ORDINANCE NO. 60 -17 ESTABLISHMENT OF SPECIAL GAS TAX IMPROVEMENT
FUND: (first reading) Ordinance No. 60 -17 was read by Shatford
and recommended to be adopted next meeting. No further action.
RESOLUTION NO. 60 -71 CONSENTING TO CIRCULATION OF PETITIONS
TEMPLE CITY ANNEXATION 2 A, EAST TEMPLE CITY INHABITED.
Woollett stated a group living in the area requested to annex
to Temple City. The area involved is bounded on the west side
by the existing boundary of Temple City, bounded on the north
side by the existing boundary of the City of Arcadia, bounded
on the East side by the existing boundary of the City of Arcadia,
and on the south side by existing boundary of the City of El
Monte, encompasses about one half a square mile with approximate-
ly 5000 people. The petition signed by people in this area ask -
ing to annex has been received, publication made as required by
law, and proposed intention to circulate petition filed. The
Planning Commission recommended annexation to the City and filed
a Certificate of Publication of this petition, did acknowledge
receipt of the petition and did consent to circulation of peti-
tions. If the Council passes this. Resolution Temple City will

have exclusive 50 day rights. If passed the City Manager will
transmit to the Boundary Commission maps, petitions, boundaries,
etc. and after 2.1 days they come back and remainder of time may
be used to secure names on petitions. It will be necessary for
25% of voters to sign petitions requesting annexation. If found
to be sufficient by City Clerk and County the Council is in a
position to act. If not proponents may have an additional ten
days to secure additional signatures. By Resolution receipt
of petitions can be acknowledged, date of protest hearing can be
set and election follow, with a form for those indicating they
do not desire to be included. If protests not over 50% of assessed
valuation of land only, Council will be able to proceed with the
election which will determine final result. An Ordinance can
be effective 45 days after introduced. This procedure is de-
signed by the State Legislature to give everyone in the area a
chance to decide which way they wish to go. For 50 days no
other City nor anyone in the area may circulate petitions sug-
gesting incorporation. Buchan asked if allowing all required
time this could be completed before June 1, 1961, and was ad-
vised by Woollett it could be done.
Woollett also stated regarding the financial condition of the
area that currently the Sheriffs Dept. has 1/3 of a car working
the area. If annexed law enforcement would become city's re-
sponsibility. 1/3 car more would cost $26,133. a year, the
election cost approximately $500. City would also assume road
improvement responsibility. Revenue if annexed from in lieu
tax would be approximately $25,250. a year, gas tax approximate-
ly $14,450. plus sales tax.. From these figures possible $40,000.
revenue with expenditure of $26,700.
Dickason moved to adopt Resolution No. 60 -71 CONSENTING TO CIR-
CULATION OF PETITIONS TEMPLE CITY ANNEXATION 2 A, EAST TEMPLE
CITY INHABITED, Merritt seconded, roll call vote as follows:
AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn.
RESOLUTION NO. 60 -72 RE -FIRST LUTHERAN CHURCH; Shatford read
title RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
APPROVING RECOMMENDATIONS OF THE PLANNING COMMISSION OF THE. CITY
OF TEMPLE CITY AND GRANTING THE ZONE VARIANCE OF THE FIRST LUTH-
ERAN CHURCH, SUBJECT TO CERTAIN CONDITIONS: Buchan moved to
waive further reading, Dickason seconded, roll call vote as fol-
lows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitz-
john. NOES: Councilmen - None. ABSENT: Councilmen -None. Merritt
moved to adopt Resolution No. 60 -72, Buchan seconded, roll call
vote as follows: AYES: COuncilmen - Buchan, Dickason, Merritt,

RESOLUTION NO. 60 -75: COMMENDATION SUPERVISOR BONELLI: Shatford
read resolution No. 60 -75, Dickason moved to adopt Resolution
No. 60 -75 as read, Merritt seconded, roll call vote as follows:
AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn.
NOES: Councilmen -None. ABSENT: Councilmen -None.
10. MATTERS FROM CITY OFFICIALS: Tyrell asked about the contemplat-
ed hospital. Woollett advised revised plot plans have been sub-
mitted for 85 bed hospital and he believed they had been approv-
ed. Shatford stated it was legal for Chairman Pursley of the
Planning Commission to make sure conditions were complied with.
Woollett stated they had secured approval from the City of Arcad-
ia on small part in Arcadia, and he had discussed with Mr. Schone
re- annexing this small part from Arcadia and whole hospital area
would be in Temple C:i.ity. They wish to increase to 110 beds and
have submitted request for increase in occupancy, and also to
use land he bought for access to Double Drive, and for permiss-
ion for access. They are in good shape to go ahead with 85 bed

but is getting set up for 'a larger number of beds.
Tyrell asked about the insurance. Woollett stated we are cover-
ed but have had certain problems and have contacted many compan-
ies. The problem has been a small clause in our contracts
containing the words "hold harmless" in the General Services
and Road Maintenance agreement contracts. Our estimate is $2500.
and the nearest to it is $4,000. on lower limits of liability
of $250,000. & $500,000. We are covered and not in an exposed
position at this time. Will get you more information in next
couple of days.
Tyrell asked about Temple City residents getting mail in other
cities, and Woollett advised the Postal Dept. ruling is that
they have to circulate and find out what people in area wish.
The City cannot do this nor can the Postal Dept. do it.
There followed discussion about microphones and existing pro-
blems.
