INITIATION: The regular meeting of the City Council of the City of Temple 2. City was called to order by Mayor Fitzjohn who led the Pledge of Allegiance to the Flag. 3. The invocation was given by Elder Harold Calkins, 7th Day Ad- ventist Church, 9664 Broadway, Temple City. 4. ROLL CALL: PRESENT: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn ABSENT: Councilmen -None ALSO PRESENT; Shatford & Woollett 5. APPROVAL OF MINUTES OF October 24, 1960. Councilman Buchan corrected item 13 of the minutes of the regu- lar meeting of October 24 to pay the Chamber of Commerce $850.00 for the budgeted amount for the Los Angeles County Fair booth and brochures and not $750.00 as shown. Dickason corrected line 3 page 2 of item 7 to read "smacks of a police state ". Dickason moved to approve the minutes as corrected, Buchan se- conded, with roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None UNFINISHED BUSINESS: 6. REQUESTED ABATEMENT OF LIGHT & AIR EASEMENT — DEPT. OF REAL ESTATE MANAGEMENT: PLANNING COMMISSION Woollett recommended this be held over until the next meeting. Merritt felt also it should be held over and stated he had taken pictures over this area and did not have them back yet. Shatford advised it be continued until the next regular meeting. Tyrell so moved, buchan seconded and carried. 7. ORDINANCE NO. 60 -20: AMENDING MUNICIPAL CODE - FIRST READING Shatford stated this Ordinance was drawn to consolidate Ordin- ance #1, the basic change was necessary language regarding zone change, which would enable Woollett to establish price and also when the Master Plan is adopted may be better way of filing. I recommend the fee be left where it is for the time being, and as fair with publication and posting costs. He also stated he was having Ordinance No. 1 re -typed and re- organizing sections. Shatford read title to Ordinance No. 60 -20 "AN ORDINANCE OF THE. CITY OF TEMPLE CITY, CALIFORNIA AMENDING SECTIONS OF ORDINANCE NO. 1494 OF THE COUNTY OF LOS ANGELES (AS AMENDED) AS ADOPTED BY THE CITY OF TEMPLE CITY BY SECTION 9100 OF THE MUNICIPAL CODE AND AMENDED BY SECTION 9103 OF SAID CODE." Dickason moved to waive further reading of Ordinance No.. 60 -20, Merritt secondr ed, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen- None ABSENT: Councilmen - None As this was the first reading no further action was taken. 9. APPOINTMENT OF TRAFFIC COMMISSIONER: Mayor Fitzjohn recommended Mr_. Lucian Bruner and stated he felt personally that he was one of the finest men in Temple City, he works for Edison Co. and very active in civic affairs, and his knowledge will be an asset to the Commission. Dickason stated there was no question about his ability, and made the motion that Mr. Lucian Bruner be appointed to the Traffic Commission to fill the vacancy created by the resignation of Mr. R. Null. Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None 76 Council Minutes, November 14, 1960 10. ORDINANCE NO. 60 -22 PARKS & RECREATION COMMISSION & APPOINTMENTS Tyrell thinks there should be nine members on the Commission rather than five to get broader coverage, and to get as many groups as possible represented to get a composite picture, and there should be a greater membership due to the type of condi- tion. Dickason felt too large a number loses its effectiveness, and that the Commission would have to make decisions right away and that five members to start with would be advisable. Buchan duggested it might be better for five commissioners, and desig- nate each one head a•committee covering the different phases. With too many members it is too hard to get them together at one time, and this way five would be responsible, and each one would eo�e�r� b,epresent their group. Merritt stated there were 15 on the '4411',--Y Youth Center Board and it was difficult to operate at . that time. a a"t Fitzjohn served also and it was always the same few that came out every time. Dickason did not feel we should have a large Commission but should have various facets represented by having advisory groups., and right now we need a working group to act. Dickason moved that we initiate a Parks & Recreation Commission with a membership of five Commissioners to get it started, Buchan seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Fitzjohn NOES: Councilmen- Merritt, Tyrell ABSENT: Councilmen -None Discussion followed regarding appointments and the following were recommended for consideration: Dickason recommended Chas. Ristow, 5751 Rio Hondo Dr. Buchan recommended Mrs. Bob Turner Fitzjohn recommended the following - Haven Andrest, 5817 Primrose John Clemson, 9854 Val St. Jacob Gunst, 4929 Hello Al J. Lindberg, 9932 E. Nadine John Franklin, 5025 Kauffman Tyrell recommended Mrs. Bertha Rains Merritt felt these names be held as recommendations until the next meeting. Dickason made a motion to continue discussion of the Parks & Recreation Commission at the next meeting, Buchan seconded and carried. 8 PUBLIC HEARING 8 P. M. RE- REQUESTED VARIANCE: 4913 N. FIESTA, OWNER BERNARD GOLDSTEIN. Mayor Fitzjohn declared this appeal hearing now open. Mr. Ed Holden, of the Regional Planning Commission employed by the City of Temple City, stated Mr. Goldstein applied for a Variance to place three houses on property of approximately 11,400 sq. ft. which is 3600 sq. ft. short of number required for three houses in A -1 5000 sq. ft. area as property is zoned. A hearing was held before the Planning Commission and the re- quest refused, and then applicant appealed to the Council. He advised a zone variance is basically not a means of changing zoning, but set up so that relief may be granted to specific property where completely impossible to use the property for . which it is zoned. Specific findings are required before grant- ing as to whether he is being deprived of property right. Use would not be detrimental in this case of two houses on property. There are none in the vicinity that have three. Mr. Goldstein is using it for which it is zoned and cannot see that property variance should be granted. Mr. Bernard Goldstein, 4913 Fiesta, stated he did not agree with Mr. Holden that he is short 3600 sq. ft. as the lot is 80 x 160, or 12,800 sq. ft. but he agreed that he did not have the necess- ary 5000 sq. ft. He made the appeal as he feels he has space enough for another house which would provide for another family to live in Temple City. 77 Council Minutes, November 14, 1960, page 3 Mrs. Wm. Herbert, 4826 N. Fiesta, stated she was a welfare work- er and that rental properties bring in more undesirable people, that there is too much traffic on the street as is, and also presented a petition with 15 names of other property owners who oppose it. George G. Massey, 4847 N. Cloverly Ave. stated, building a house in such a small space does not provide a proper place for child- ren, and in this area they want privacy, and that two houses takes up enough room. The house is too small and not enough ground and he is very much opposed to it. Ralph Spellman, 4900 N. Cloverly, protested at last hearing and also at this time. Two houses on these lots is enough. James Carr, 5027 N. Fiesta, is very much against it for the same: reasons. Mrs. Jessie Plummer, 4839 N. Fiesta, stated it was for two houses only, and she opposed the variance also. Merritt asked if there was a deed restriction limitation for only two houses, but Mrs. Plummer did not know. Dickason moved that the recommendation of the Planning Commissior be approved, and that the petition for variance of Bernard Gold- stein on property at 4913 N. Fiesta, be denied, Merritt seconded and carried by the following vote: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None Shatford stated with the appeal denied there would be no further action. 11. RESOLUTION NO. 60 -92 re- CONVEYANCE LIVE OAK & TEMPLE CITY PARKS Woollett advised it is the policy of the County of Los Angeles to convey parks when incorporated, and we must request January 1, 1961. To give them time and facilitate this matter it is advisable to do this at this time. In the case of Temple City Park if desirous of not having this conveyed on January 1, we may write them a letter and indicate to them when we wish it, providing however we pay for maintenance after January 1, 1961. Tyrell asked what if we did not agree to maintain it, and was advised the County would give it to the City any way. RESOLUTION NO. 60 -93 REQUESTING COUNTY PARKS & RECREATION SERVICE Shatford read in full title of Resolution No. 60 -93 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, REQUESTING COUNTY PARKS & RECREATION DEPARTMENT TO FURNISH VARIOUS SERVICES AT FACILITIES WITHIN THE CITY OF TEMPLE CITY. Dickason stated he did not feel we are in a position to act on this, and we must decide what services we want, and the Parks & Recreation Commission of the City should work on this. Woollett stated the Resolution as drawn would authorize the County to perform only what was requested by the City. At the present time ser- vices on Live Oak Park and the schools are provided by the Count, but by virtue of incorporation the County will discontinue this service on January 1 unless something is done. Emperor school is physically outside of the City limits and the County will continue to serve. Clemson school in the El Monte school district but in City limits the County will not serve. The Parks & Re- creation Dept. have estimated costs of funding for all within the City at $26,532. which is less than budgeted and would con- tinue the existing program until June 30, 1961. This Resolution simply gives the County Parks & Recreation Dept. legal authority to provide these services when requested. He suggested to adopt the Resolution and send a letter to Parks & Recreation Dept. and indicate to them we are going to have a Commission of our own. This puts the Dept. in a legal position to act for us to provide services when asked for by us. RECOMMENDATIONS: ADOPTION RESIDENTIAL DEVELOPMENT STANDARDS Mr. Ed Holden, Regional Planning Commission and advisor to City Planning Commission, advised the Planning Commission has considered several changes regarding increase of lot sizes. A number of recommendations have been made by them and now referr- ed to the Council for consideration. 1. Concerns number of parking spaces Suggest for residence 1.1 spaces, garage or car port 1 2 spaces for each lot This has been adopted and used by a number of out -lying communities and is increase from present and does provide higher standard for off - street parking. The Commission re- commends this. 2. Parking Spaces: require 9 x 20 ft. minimum. This increased standard has been adopted around the County. 3. Width of Access to Lots: R 1 and A 1 have a 9 ft. minimum for one or two units per land. Recommendation is 16 ft. for three dwellings, and 20 ft. for four dwelling units. This makes it definite and establishes standards. 4. Area Requirements in A 1 and R 1 Zone. The general purpose is to increase size of parcel on which unit is located when behind house located on the front. 5000 sq. ft for the 1st dwelling and 5500 sq. ft for each additional dwelling on the same. 3000 sq. ft. of lot area for each dwelling unit on a lot or parcel of land which has less than 25 ft. frontage on a dedicated street. I think this is a mistage and it probably should have read 5500 sq. ft. It is the Commissions feeling this should be corrected to 5500 sq. ft. so they can use it in their plot plan acceptance. Buchan asked if this would follow along with the possible plan of a Master Plan, and Mr. Holden advised these are within the scope of Mr. Whitnall's plans. These are not higher than uni- form zone ordinance but does increase standards and very reason- ably so, and makes them more definite for administration. Merritt felt they will up -grade the community and that it was a step forward, and he made a motion the City Attorney prepare an Ordinance for Council consideration in conformity with these recommendations, Buchan seconded, roll call vote as follows: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None 17. RECOMMENDATIONS: TRAFFIC COMMISSION (a) Adoption of Truck Routes. The Traffic Commission recommends truck routes as follows: Las Tunas Dr. through City east to west El Monte Ave. between Las Tunas Dr. and Lower Azusa Rd. Lower Azusa commencing east City limits to west City limits Also recommended that rather than posting "Truck Routes!' that the other streets be posted with load limits. There being a number of people present interested in the routes Shatford advised that this was not a public hearing. R. Sale, 9427 E. Olive, suggested other things to consider as adequate thickness of pavement, to not cut off other truck routes, and that the total truck traffic through the City was between 4.5 and 6.8 % of total traffic, with Lower Azusa carry- ing the heaviest load. Mayor Fitzjohn stated he backed up the Commission, and if taken off Las Tunas as we would like to see it would double traffic on Lower Azusa which would not be doing these people justice. Edw. J. Hunt, 5830 N. Hart, strongly urges adoption of Commiss- ion recommendations as Las Tunas is wide enough and pavement thick enough and with the lanes painted it is more safe than ever. Lower Azusa is just no adequate if taken off Las Tunas, and he strongly urged the Council to leave Las Tunas open throug! Temple City. H. R. Stoke, 1215 Oak Lawn Rd., Arcadia, associated with Redi- Mix and Rock & Sand Assn. of So. Calif., stated when considering any route the Council must take into consideration when elimin- ating a route, an alternate route must be provided. He is con. cerned only with Las Tunas. Going El Monte, Lower Azusa, and 80 Council Minutes, November 14, 1960, page 6 and back up Rosemead and then will not be a way through to the west, and would be inducing traffic on residential streets main- ly El Monte. It would cause trucks 12 times as much over -city streets as they now do and this is a maintenance problem. Also Las Tunas Dr. is built for trucks. If use denied it increases cost of building. He stated they have an excellent safety re- cord. Tonight their principal concern is to keep Las Tunas Dr. open as a truck route. John C. Payne, 4939 N. Fratus, a member of the Dump Truck Assn., stated if closed it would be detrimental for industry and every- one especially west of here. Loyal Riley, 9545 La Rosa Dr., stated he operated a dump truck, that he did all his trading in Temple City, and if forced to use Lower Azusa he thought it would be against the people who live west and also against the people of Temple City. E. 0. Blackman, West Covina, General Manager of Calif. Dump Truck Owners Assn., stated rates are established by the Public Utilities Commission. Any time a route is changed by City Ord - inanceon routes which traverse that particular segment rates are increased to a point beyond that segment. Access to and egress from points of delivery within your city must be permitted so there would be some traffic. We ask that you consider cities behind you regarding cost problems. Ray Guntly, 5454 Sultana, felt it a good route going over Las Tunas and as far as Lower Azusa is concerned the street is not as good to handle traffic. There are a lot of truckers living in Temple City, and do business here, and in order to get home we would have to violate some law, which I do not believe is a violation even if posted as he has a right to go home but not keep his truck there. I think Las Tunas the proper street. Buchan asked if in business for himself, and Mr. Guntley stated he was, and Buchan asked what address he used on his Sales Tax Permit, and when he said his home, Buchan stated that is alright then the City will get the Sales Tax. Mrs. Millesan Drews, 9382 Lower Azusa Rd., advised she lived in the triangle below Lower Azusa Rd. at the western boundary, and the area is entirely residential and there are lots of children. The residents were happy when the freeway opened as it took lots of the traffic away. They are now concerned about trucks coming back again. The soil is pure sand and vibrations shake the houses when trucks go by, they are hoping truck traffic will not be encouraged to go down Lower Azusa Rd. R. Sale, 9427 E. Olive, stated the routes are being used now. The fact we are going to post in the opinion of Geo. Envall, Traffic Engineer, is not going to increase traffic over what we have. Baldwin is not proposed as a major street at the pre- sent time, and coming from Arcadia will have to turn on Las Tunas west or out Lbs Tunas to Live Oak until Baldwin is widened and surfaced thicker. Dickason moved to approve the Traffic Commission recommendations and ask our City Attorney to draw up the necessary documents and present at the next Council meeting, Buchan seconded, roll call as follows: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None (b) Additional Painting of MTA bus loading zones. Lack of length of loading zones necessary for buses to pull out into the second lane which is a definite hazard. MTA has author• ity over these zones. They have made a study and have indicated bus loading zones of 80 ft. After review the Traffic Commission recommended re- location of the loading zones at Las Tunas Dr. 81 Council Minutes, November 14, 1960, page 7 and Temple City Blvd. from the near -side to the far -side. There is additional striping incurred. Tyrell thought all loading zones should be on the far side of the street. Woollett stated there would be considerable objection by the property owners. Merritt also felt the zones sbould be on the far side. Woollett stated from the nearside the bus can pull into the intersection without getting into center land to leave curb. He also re- commended the Traffic Commission hold a public hearing on it. Dickason moved to refer this item back to the Traffic Commission for further study, Merritt seconded, and carried. (c) Center line striping on Cloverly Ave. The Traffic Commission recommend painting 50 Ft. single center line on south part of Cloverly where there is a considerable jog 50 or 75 ft., which would encourage people not to cut the corner. Tyrell moved to approve, Dickason seconded, roll call votes as follows: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None (d) Installation of "NOT THRU STREET" signs at Heleo St. Tyrell moved to approve this installation, Merritt seconded and carried. 18. RESOLUTION NO. 60 -94: Warrabts & Demands No. 269 -293. Inasmuch as the Bldg. Dept. fees did not cover the cost of their services Mr. Woollett advised he would check and if continuing could come up with a better set of fees. Tyrell moved to adopt. Resolution No. 60 -94, warrants & Demands No. 269 through 293 in the amount of $6445.83, Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None 19. COMMUNICATIONS: a. County Boundary Commission 1. Woollett stated proposed annexation #1960.5, City`of San Gabriel was dropped because Rosemead has jurisdic- tion. 2. Woollett brought to the attention of the Council propos -. ed Annexation #246 City of El Monte (Southwest inhabited, 3. Proposed Annexation 1960 -5A City of San Gabriel: Woollett advised Rosemead has jurisdiction here also. Tyrell moved to receive and file, Buchan seconded and carried. 4. Temple City Community Youth Center. Woollett read a letter from the Board of Directoks of the Temple City Youth Center offering their services to the City Council to assist in establishing an organized youth plan. Buchan moved to answer the letter stating the City is appointing a Parks & Recreation Committee and their letter will be referred to them. Merritt seconded and carried. 6. A letter from the American Cancer Society was read re- questing a permit to conduct their annual appeal during April. Woollett was authorized to answer the letter giving necessary information. 5. Salvation Army. Woollett read a letter from the Salvatior Army requesting permission to solicit in the City. Tyrell moved to grant permission, Buchan seconded and carried. 7. Byron E. Wells. re parkin? lot 642. Mr. Wells has fenc- this lot allbwing.no parking. Daniel Pinzo, 9544 Las Tunas Dr. representing the merchants asked if something could not be worked between the Council and Mr. Wells with the Council collecting from the property owners. Shatford advised the City would be in the position of a Collection Agency which it could not do and that the property owners are going to have to work this out. 82 Council Minutes, November 14, 1960, page 8 Shatford said they could get together and form an Association and deal with Mr. Wells, or possibly the existing Parking Assn... might work it out with them. Tyrell moved to file, Buchan se- conded and carried. 8. A letter from Mrs. Louise Wheeler thanking the Temple City Fire Dept rescue unit for efficient services rendered Henry Saenz of 4992 Cloverly Ave. Tyrell moved to forward to the Fire Dept., Buchan seconded, and carried. 9. L etter from Marjorie Finch approving the removal of parking meters. Tyrell moved to file, Merritt seconded and carried. 20. TIME RESERVED FOR THOSE iN AUDIENCE WISHING TO SPEAK: B. L. Meek, 6004 Rosemead Blvd., presented a petition with 128 signatures satisfied with present daytime parking and re- questing the Council to not approve 2 hr. parking on cross streets. Mayor Fitzjohn stated the Council had not discussed having two hour parking on side streets. Meek stated the people do not like to have employees parking in front of their homes all day, and that two hour time limit would force commercial into this area which is R 1. Buchan asked what would be peoples reaction if we were not able to provide sufficient parking so we could not raise sufficient Sales Tax, and would therefore have to put in a City Tax? Buchan asked if any one else was circulating a petition and Mr. Meek said he was doing it as he had six rentals involved in this area, and also that the people felt the Council was letting them down. To this Mayor Fitzjohn took exception stating, "1 am not perfect, but do not like the inference from you that residents feel we are letting them down.' Dickason suggested haveing the Manager take the Petition and when and if it comes up it would be taken, into consideration on further studies. Dickason made the motion to refer this to the City Manager to be a part of his study when he makes his recommendations, Merritt seconded and carried. Georgia Maxey, 9823 Hallwood Dr., read a letter to the Council requesting use of part of Temple City Park for the Carnival dur- ing the Camellia Festival, and the removal of several trees to make the area useable. The trees are in the rear area of the park and their removal would be an improvement. Woollett stated the row of trees is in northmost part just before play area. This would give an area 75 ft. x 290 ft. and this in conjunction with the area back of the Fire Station and Womens Club would give access from Woodruff and Golden West. The figure of $600. for removal was received from Mr. Ostergaard who is in charge of trees. Shatford advised this matter be held over until later as we do not have the parks yet. Mr. Sale said removal of the trees would make a permanent improvement worth while. Merritt moved to receive this letter of recommendations for consideration with no action as of tonight and discuss and check into it further. Dickason seconded and carried. Mrs. Millesan Drews, 9382 Lower Azusa Rd., asked what steps had to be taken to request the name of Lower Azusa Road be changed. Woollett advised the first step would be to draw up petitions requesting this from the Council and get as many people as you', can to sign. R. Sale, 9427 E. Olive, speaking in behalf of Civil Defense rec. quested December 7 be proclaimed "National Civil Defense Day "'. He stated there is no program but this might be a good beginning Tyrell moved in favor of the proclamation, Merritt seconded and carried. Woollett read a letter from James R. Lawler re- vivisection and presented a petition signed by 300 people requesting rescinding the contract with the County Pound Dept. Woollett stated on Sept. 12 the City Council denied the right to the Pound to turn over any animals picked up in our City for vivisection. Althouc picked up in our City they cannot and are not used for this pur- pose. Tyrell moved to file, Merritt seconded, and carried. Woollett presented a request from the Secretary of the Chamber 83 Council Minutes, November 14, 1960, page 9 of Commerce requesting permission from the City to decorate the standards that were used for parking meters for Xmas. Merritt moved to deny, Tyrell seconded, and carried. Woollett advised the Council that an Alcoholic Beverage License had been applied for across the street from the City Hall at 9671 E. Las Tunas. He stated necessary procedure for granting or refusal, this application was made November 4, and the de- partment takes 30 days to process. If individuals are desirous of protesting this license I have the necessary form here. If e protest is submitted the Dept. will hold a hearing downtown. If the City Council takes a stand and protests the Board will hold a hearing here in the City Hall, and people would be given an opportunity to testify before the Hearing Officer of the Dept. Valid reasons for protest were proximity to schools, churches, playgrounds, parks and residential areas, and police protection. The granting lies squarely with the Stated December 4 is the end of the 30 day period. Buchan stated if the Council takes any action they would be setting a precedent.• Tyrell felt it might be the cleanest one in town, and just because selling beer is it less bad than selling hard liquor. Woollett stated he did not think the City Council would want to get into this. Tyrell felt if the people in town want to protest let them do so. Merritt said some of the people have spoken to him and he felt the Council should get into it, to which Fitzjohn agreed. Shatford advised most cities do not take a stand on this since the state determines granting or not. Buchan stated the building would be posted 45 days and anyone going by would be given notice Anyone who wants to object to it can start a petition requesting denial of application. We can advise the Board that if a protect is lodged that we lhave facilities here for holding a Hearing and offer it to them for any Hearings in our boundaries. Shatforc recommended the City avoid getting into this kind of argument, the State has sole right and the City might oppose but the State still might grant. Buchan moved to table, Dickason secondec and carried. Woollett advised the Council that Paul Rejai, Administrative Aide, was notified today that he had been granted a Graduate Scholar- ship with Syracuse University for full tuition and books, and a Research Assistant -ship. In order to take this up he will have to be in Syracuse by February 6. It is a tribute to an individual and to his credit that he has been selected. Merritt moved to have the City Attorney draw a Resolution commending him for his work for the City of Temple City. Buchan seconded and carried. 22.
