INITIATION: The regular meeting of the city council of the city of .Temple 2. City was called to order by Mayor Fitzjohn who led the Pledge of Allegiance to the Flag. 3. Invocation was given by Rev. R. E. Schulz of the Lutheran Church, 9123 Broadway, Temple City. 4. ROLL CALL: PRESENT: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohi ABSENT: Councilmen-None ALSO PRESENT: Shatford & Wool lett 5. APPROVAL OF MINUTES OF DECEMBER 12, 1960. Mr. Woollett referred to page 8 item 16, first paragraph which read Danner seconded, which should have read "Dickason" second- ed. Mr. Dickason corrected page 8 item 16 paragraph 3 line 5 ,"Mr. Beckner" which was incorrectly typed "Bechner ". Merritt moved to approve the minutes as corrected, Buchan seconded, roll call vote as follows: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None UNFINISHED BUSINESS: 6. Parking Meters: Shatford read in full Ordinance No. 60 -26 "AN ORDINANCE OF THE CITY OF TEMPLE CITY, CALIFORNIA, REMOVING PARKING METERS FROM TEMPLE CITY STREETS, CURBS AND SIDEWALKS ", and he.also explained that as it stands the City Manager would have to re- install the meters on January 3, 1961, and if the Council desires to have them out indefinitely it requires immediate action as an urgency ordinance. Mayor Fitzjohn made a motion that Ordinance No. 60- 26 be adopted as an urgency ordinance, Dickason seconded. Tyrell asked the City Attorney as a point or order if it is appropriate for the Mayor to so do, and was advised under the Government Code the Mayor can so move. Dickason asked the City Attorney about use of the word in the ordinance "permanently" and was advised it did not mean forever but could be changed by ordinance at such time as the Council so desired. Mayor Fitzjohn then asked if anyone wished to speak in favor of continued removal for an indefinite period. Mr. Stewart Bingham of the Fuller Paint Store, 9720 Las Tunas Dr. Temple City, presented signatures of 1867 customers of the busi- nessmen of Temple City gathered in past two weeks who would like to have the parking meters kept out. Mr. Carl Clark, 9711 Olive St., stated before removing the meters the Chamber of Commerce ran _a survey•of businessmen asking what . they thought of parking meters in front of their locations, and of 61 replies 43 wanted them out, and only 18 to leave them in, which report he submitted to the Council. Harry Teitelbaum of the Band Box, 9600 Las Tunas Dr., stated there were many favorable comments from customers since the meter were out. Also that he was not entirely sold on them being taken out, that he has been in town ten years and his business increase this year in November and December which he cannot definitely sal was because meters were out but he would hate to have them put in again. Las Tunas, since taken out the customers say' for the first time they can shop with ease and no worry about 98 Council Minutes December 27, 1960, page '2 parking and his business has improved considerably. Councilman Tyrell said as he understood it when taken out about three months ago a survey was to be made and see whether bene- ficial to the businessmen and also during this three months the City has lost approximately $1500. revenue which could be used toward additional off street parkin lots. He also felt they should extend the study period to find out what the story is, and felt the Council was breaking faith with itself by not showing statistically that it will be beneficial to remove them perman -i ently. He advised he had heard comments on both sides and he did not know whether removal was assisting business or not, and was not impressed by the number of signatures presented as he felt people will sign anything these days, and those aware were sign.. ing without knowing the facts as the revenue received could be used for leasing other free lots.. Regarding the Ordinance the parking lots do not have meters. Also the motion on the part of the Mayor, that is rushing something through and he could see no reason why this ordinance has any urgency and entirely inappropri, ate to have it adopted at this time. City attorney Shatford advised the reason for doint it in this -' manner that under the provisions the meters would have to be .in» stalled forth -with and if adopted will fore -stall it which would incur considerable expense to re- install and then if adopted to take them off again. Due to traffic type ordinance it does fall into urgency classification. Tyrell felt that the time could be extended two or three months in order to determine the facts rather than an emotional type of basis. Dickason asked Shatford why removal was a Resolution and now indefinite removal was by Ordinance and he advised you are chang- ing a present law and to change it requires an ordinance. Mayor Fitzjohn stated that being that he is in business here he felt he could make this statement, that removing the meters is only a beginning to what can be done to improve business in Temple City, and that since October 1 many people have expressed approval of removal of meters from all over the area including West Covina, Arcadia, Baldwin Park, Temple City, San Gabriel etc., and we have created good -will and money cannot buy that, and if necessary to raise some revenue he would be in favor of some sort of business tax in order to compete with these different shopping centers and he sincerely hopes Temple City never replaces the meters to raise revenue for parking lots. Buchan stated some apparently are being criticised for action they are about to take tonight, and he would like to state that he had personally observed during the three months period the affect of- removing the parking meters, and had discussed it with the merch., ants who are vitally concerned with it and in his opinion is fully convinced that removing the parking meters was a wise move and to delay this action any longer would just keep this in a state of flux and prevent anything permanent being done. It will take 90 to 100 days to get statistics records from the state and he felt sure they will show the Council was right in taking this action therefore he does not feel it is rushing anything but it is the thing to do. Merritt stated as far as he was concerned the happy attitude of customers he had talked to since they were out was acceptable coal, pensation for taking them out and also for leaving them out. Tyrell wished to make his position clear, that he did not know whether better or not. The purpose of making a survey was to de- termine whether beneficial or not to keep them out. He believed it appropriate to wait until we have the results of that survey. He did not believe it proper to permanently take them out until we had the survey results. 99 Council Minutes, December 27, 1961, page 3 Dickason stated this merely takes them out until they want them in again which can be done by ordinance if desired. Woollett stated the Road Dept.already had made a study regarding parking use. Also when sales tax figures are available from Sacramento the staff will do a study of the amount of business, in the 4th quarter last year and the 4th quarter this year. Un- fortunately as incorporation was not in effect then it will take considerable research which will be done. Roll Call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt & Fitzjohn NOES: Councilmen-Tyrell ABSENT: Councilmen -None 7. ZONE CHANGE CASE No. 60 -7 Frederick N. Free. Woollett advised Mr. Holden was out of state and could not attend the meeting but had indicated the light & air easement could be taken care of. Mayor Fitzjohn asked if anyone in the audience wished to speak regarding this zone change. Al Kiefer, Herbert Hawkins Realty, stated it is the wish of the property owners in area in question that it be re -zoned to R -1 that the request before the Council is for the zone change and the subdivision maps etc. would have to meet state and county requirements.. Shatford advised him the Council is concerned in the development of the property and for that reason would not . want to just grant the change without having some control of the type of development to go in there. Woollett suggested it could be granted contingent upon approval of the final tract map for the final re -zone approval. Kiefer advised the property concerned were tots 16 through 30. Also that there were 13 property owners who were waiting the de- cision of the Council. Also that they have good builders, and that the homes would be in the $20,000. catagory, and that there will be certain deed restrictions which will keep them in the better homes bracket. Buchan felt the Council should indicate that they would change the zone, and as he understood it he had to meet subdivision re- quirements regarding the lay -out. Kiefer advised he would be agreeable to geting a zone change subject to approval of the City Council of the final tract map. Buchan make the motion that the Council approve the zone change subject to approval of the City Council of final tract map. ORDINANCE NO. 60 -24: (Urgency) Request of Kiwanis Club for March of Dimes. Shatford read in full Ordinance No. 60 -24 AN ORDINANCE OF THE CITY OF TEMPLE CITY CHANGING TRAFFIC REGULATIONS, RELATIVE TO THE INTERSECTION AT LAS TUNAS DRIVE AND TEMPLE CITY BOULEVARD ON JANUARY 20, 1961, BETWEEN THE HOURS OF 2 :00 P. M. AND 6 :00 P.M, ONLY, AND GRANTING CERTAIN LIMITED STREET USE ON LAS TUNAS DRIVE FOR THE TEMPLE CITY KIWANIS CLUB MARCH OF DIMES CAMPAIGN, AND CER TAIN LIMITED SOUND CAR USE IN CONNECTION WITH THE "MOTHERS MARCH" OF THE MARCH OF DIMES CAMPAIGN IN TEMPLE CITY. Dickason moved to adopt as an urgency ordanance, Merritt seconded, Tyrell felt no minors should be used in the streets and also asked about type of tape used. Shatford advised that anyone in any other lanes would be in violation and that he would so advise the Kiwanis Club as to where to stand to not be in violation, and as to the adhesive tape the city is covered by a rather substantial liabil- ity policy now but questioned the city being held. RESOLUTION NO. 60 -107. At this time Mayor Fitzjohn read in Full Resolution No. 60 -107 proclaiming the month of January, 1961, as the "NEW MARCH OF DIMES MONTH ". Dickason moved to approve Resolution No. 60 -107, Buchan seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None 9. RESOLUTION NO. 60 -103, Terminating Annexation 3 -A West Temple City. Shatford read title to Resolution No. 60 -103 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY TERMINATING PRO- POSED ANNEXATION NO. 3 -A WEST TEMPLE CITY. ORDINANCE NO. 60 -25: Equalizing parking fines. First Reading. Shatford read in full Ordinance No. 60 -25 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, EQUALIZING ALL PARKING FINES AT ONE DOLLAR ($1.00). As this was the first reading no action was taken. 11. RESOLUTION NO. 60-105: Granting Zone Variance -J. W. Potter. Shatford read title to Resolution No. 60 -105 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING RECOMMENDATION. OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY AND GRANT- ING THE ZONE VARIANCE OF J. W. RESOLUTION NO. 60 -104: Granting Zone Variance- Mathews. Shatford read title to Resolution No. 60 -104 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING RECOMMENDATION: OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY AND GRANT- ING THE ZONE VARIANCE OF MATTHEWS AT 5661 NORTH ROSEMEAD, ZONE CASE NO. 60 -10. RESOLUTION NO. 60-106: Denying Zone Variance - Voegeli. Shatford advised the Council an appeal had been filed by Mr. R. Voegeli in allowable time so a hearing will be held before the Council. Buchan made a motion that a Hearing on the R. Voegeli Zone Variance Case No. 60 -9 be set for Jan. 23, 1961, Dickason seconded, roll call vote as follows: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None 101 Council Minutes December 27, 1960, page 5 14. INCREASE IN SPEED LIMIT ON DOUBLE DRIVE FROM 25 to 35 MPH. As Mr. Geo, Envall, the Traffic Engineer, was unable to get to the meeting this was held over until the next meeting of the Council. 15. NEW BUSINESS: ACCEPTANCE SANITARY SEWERS: Baldwin Ave. east between Daines Dr. and Olive. Woollett stated the sanitary sewer had been complete in compliance with the requirements of the County Engineer and . he recommends approval and acceptance for public use sewers on the attached mop offered for dedication. Buchan moved that the City Council approve the work and accept for public use the sanitary sewers indicated on index map PC5579 and covered in private contract #5579 as offered for dedication by Billy L. Murray, Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: .Councilmen -None ABSENT: Councilmen ..None 16. RESOLUTION NO. 60 -108, Warrants & Demands No. 330 through No. 344 in amount of $625.17. Merritt moved Resolution No. 60 -108 in the Sum of $625.17, warrants & demands No. 330 through No. 344, Buchan seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: CouriC I inen.Nohe ABSENT: Councilmen -None 17. COMMUNICATIONS: 1. Woollett read a letter from Mr. & Mrs. John Clemson express- ing appreciation to the fire and police departments for very fine work and service to them on Nov. 26. Buchan moved to pass on to appropriate departments, Merritt seconded, carried 2. Woollett read a letter from Louis Emme, Jr. re increasing lot sizes from 5000 to 6000. Buchan moved to have the City Manager write Mr. Emme and also send him a copy of Ordinance No. 60 -23, Dickason seconded, and carried. 3, Woollett read a letter from James R. Lawyer, 9645 Olive St. protesting changing lot size requirements. Buchan moved to file, Dickason seconded and carried. 18. Time Reserved for those in Audience wishing to Speak. Ray Cromley, 5615 Rosemead, stated he was against changing lot size and was advised the 5000 ft. minimum still remained. 19. Mayor Fitzjohn stated an executive session was very necessary regarding office personnel and set the date for the meeting as January 9, at 5:30 P, M. Woollett read two letters re proposed annexations to southeast El Monte, No. 247 and No. 251. Buchan moved to receive and file. Merritt seconded, and carried. Woollett read a letter from Mrs. Harry H. Utterson, 5733 N. Row- land Ave., expressing appreciation for the manner the fire dept. rendered them service for a fire in the back part of their home. Buchan moved to pass on to Fire Dept., Tyrell seconded and carried. 20. Buchan moved to adjourn, Dickason seconded, and carried, adjourn- ed at 9:15 P. M. ATTEST: city clerk Mayor/ 102
