INITIATION: The regular meeting of the City Council of the City of Temple 2. City was called to order by Mayor Fitzjohn who led the Pledge of Allegiance tm.the'F1ag. 3. Invocation was given by Rev, Ralph Walker of the Temple City Baptist Church, Corner of Baldwin & Woodruff, Temple City. 4. ROLL CALL: PRESENT: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn ABSENT: Councilmen -None ALSO PRESENT: Shatford & Woollett 5 APPROVAL OF MINUTES OF DECEMBER 27, 1960. Buchan moved to ap- prove the minutes of December 27, 1960, of the regular meeting of the Council, Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None UNFINISHED BUSINESS: 6. ORDINANCE NO. 60 -25 (2nd reading) EQUALIZING PARKING FINES AT $1.00. RESOLUTION NO. 61 -109 SETTING PUBLIC HEARING ZONE CASE NO. 60 -9 ROBERT VOEGELI for January 23, 1961. Shatford read title to Resolution No. 61 -109 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY SETTING APPEAL HEARING IN ZONE CASE NO. 60 -9 (Robert Voegeli). Dickason moved to adopt Resolution No. 61-109, Merritt seconded, r311 call vote as follows: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None 8. INCREASE SPEED LIMIT ON DOUBLE DRIVE FROM 25 MPH TO 35 MPH. Woollett stated the recommendation of the Traffic Commission in, order to assist in alleviation of the traffic condition on Double Drive to raise the speed limit from 25 mph to 35 mph, and request Mr. Geo. Envall, our traffic engineer, to make the presentation to the Council. Mr. Envall advised in regard to recommendation for increase of speed on Double Drive that speed checks were taken to determine what the speeds were at the present time, at morning, mid -day and evening, 85 percentile was from 37 to 40 mph in 10 mile range. When 25 mph placed it was only speed other than 35 that could be placed and it was primarily a residential area with no outlets, and since has become a major street through the city and that was reason for recommendation. Tyrell stated with due respect to Mr. Envall he still did not see why it is going to be more'safe by increasing to 35 mph hnd 103 Council Minutes, January 9,. 1961, page 2 because the majority violate the law does not justify increasing speed and felt this solution to dangerous on this street but felt more effective enforcement of regulations would be better. In a recent accident the motorist could not stop in time and if at proper speed perhaps could have stopped and until adequate traffic control is installed he felt the speed limit at 25 should be enforced. Merritt stated he attended the Traffic Commission meeting the night the accident was discussed and Capt. Peters of the High- way Patrol gave the information that the pedestrian struck was not near a cross walk but stepped off the curb in front of the car, and even if going 25 mph it would have been impossible not to hit him. Also that with modern cars such as they are and people do not travel 25 mph it is hard to enforce speed on a street of this type. Dickson felt he joined Tyrell in questioning the logic of'this proposal but having heard Mr. Envall's explanation there is lots of truth in what he says, and yesterday he drove this distance at 25 mph and it can be as much a hazard in traffic as going 40 or 50 down this street so he would agree with the engineer that it is a hazard to go 25 mph on that street. Mayor Fitzjohn advised when slowing down to 25 it seemed like crawling and he thought the 35 mph would be the right speed. Buchan said he was under the impression that the area prior to approaching this area is 35 mph, and as you leave it you are back to 35 mph zone again. He is also of the opinion that a pedestrian has some responsibility when he wants to cross the street. They should look before stepping out on to the street. He felt to maintain a speed through the area common to both sides would be a lot safer because a slow person in traffic is more a hazard than advantage and the speed limit should be uni- form in the area. Dickason moved to adopt the recommendation of the Traffic $ Safety Commission to increase the speed from 25 mph to 35 mph on Double Drive between the south City limits of Arcadia to the north City limits of El Monte, Buchan seconded. Tyrell stated above Live Oak it is a divided highway, and below Temple City much open land and neither are comparable to the area between: Woollett stated he had additional information as he had attended a meeting with persons living in the neighborhood and they are now in the process of submitting a petition for widening the street and for signal traffic control, which they understood was slated to be done. Tyrell said this is a hazar- dous situation and has become increasingly worse since it became a main artery through El Monte . After signalization it would make it safer for crossing and then he could see it but until then no. Mrs. Georgia Maxey, Chairman of the Traffic Commission,stated there were signals at Live Oak and Double Drive, and also at Lower Azusa and Double Drive, and 25 mph slows it down so both directions of traffic pile up in the middle and the feeling of the Commission and people in the area was an average of speed of 35 mph. NEW BUSINESS: 10. ORDINANCE NO. 61 -28 -- AMENDING ORDINANCE NO. 60 -11 RELATING TO DISSEMINATION OF ADVERTISING MATTER (first reading) Shatford read title to Ordinance No. 61 -28 AN ORDINANCE OF THE CITY OF TEMPLE CITY, CALIFORNIA, AMENDING CITY ORDINANCE NO. 60 -11 RELATING TO THE DISSEMINATION OF ADVERTISING MATTER. This is to clarify and tie up Ordinance No. 60 -11. ORDINANCE NO, 61-29 -- FIXING TIME PERIOD FOR USE OF APPROVED PLOT PLANS. (first reading). Shatford read title to Ordinance No. 61 -29 AN ORDINANCE OF THE CITY OF TEMPLE CITY FIXING TIME PERIOD FOR USE OF APPROVED PLOT PLANS AFTER ADOPTION OF ORDIN- ANCES CHANGING DEVELOPMENT STANDARDS AND LIMITING PERIOD OF VALIDITY OF PLOT PLAN APPROVAL. Shatford advised it would be legal to void any previously approved plot plans from the date Ordinance No. 60 -23 is legal but it would be unfair to people that have gone through the procedure and people should be allow- ed a period of time to proceed with their construction, and he had arrived at a time of six months for construction to start and four month abandonment prior to completion, violation of either to make plot plan approval null and void. Tyrell felt a period of three months before beginning construction was ample time, and if after started abandoned before completion for a period of one month was adequate time limit. Tyrell moved to amend Ordinance No. 61 -29 to a limit of three months time to commence development, and one month time of abandonment before completion as time limits. Buchan seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None Tyrell moved to waive further reading of Ordinance No. 61-29 Merritt seconded, following roll call vote: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None Woollett suggested they place a stipulation in the Ordinance for length of time that owner should have to exercise his right as some of the earliest plot plans approved have not been used, and suggested four months after approval or they become void. Shatford will re -frame the title and add Section 7 providing for a four month period from date of approval after Ordinance in effect. ORDINANCE NO. 61.30 -- AMENDING SECTION 9103 OF MUNICIPAL CODE to P,ROffIWI RECtr =L USE PERMIT'f''RQCECUWE. (;15e RE/ Dtl!G) Shatford read title to Ordinance No. 61 -30 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 9103 OF THE TEMPLE CITY MUNICIPAL ODE TO PROVIDE FOR SPECIAL USE PERMIT PROCEDURE. He advised the City did not adopt the County procedure for a Planning Com- mission but have our own, and there is some question regarding special use permit. This Ordinance provides a special use sec- tion to the Municipal Code. ORDINANCE NO. 61 -31 URGENCY ORDINANCE -- AMENDING MUNICIPAL CODE BY ADDING ORDINANCE NO. 60 -12 TO THE MUNICIPAL CODE AS CHAPTER 5 OF ARTICLE VI11 & ADDING REGULATIONS. Shatford read title to Ordinance No. 61 -31 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMEND- ING THE TEMPLE CITY MUNICIPAL CODE BY ADDING ORDINANCE NO. 60 -12 TO THE TEMPLE CITY MUNICIPAL CODE AS CHAPTER 5 OF ARTICLE VIII AND ADDING REGULATIONS RESPECTING REMOVAL OF CONTAINERS AFTER COLLECTION. Shatford advised he was attempting to place all ordinances in the Municipal Code so individually you will each have a Municipal Code and it will contain all ordinances in it. Nothing is changed in original ordinance except removal of cans after collection setting time as 12 noon of following day. Follow- ing discussion Tyrell moved to amend Ordinance No. 61 -31 changing time for removal to 9 A. M. the following day, Merritt seconded and carried. Tyrell moved to waive further reading of Ordinance No. 61 -31, Merritt seconded, roll call vote as follows: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None As this is an urgency ordinance Merritt moved to adopt Ordinance No. 61 -31, Buchan seconded. Tyrell was concerned re pick -up hour,- which are from 6 AM to 6 PM as in the wintertime it is dark some of those hours and this equipment should not be on the street in the dark, second people sweep leaves and hose them out into the streets andon page 7 we are preventing this and wondered if this is necessary. Shatford advised this prevents the streets from . being cluttered and other cities have similar provisions. Also Mr. Woollett advised it also interferes with the street sweeper._ Roll call vote as follows: AYES: Councilmen•Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None 14. RESOLUTION NO. 61 -110 WARRANTS & DEMANDS NOS. 345 THROUGH 365 IN SUM OF $5519.20. Following discussion Merritt moved to approve Resolution No. 61 -110 warrants and demands nos. 345 through 365 in the amount of $5519.20, Tyrell seconded, roll call vote as follows: AYES: Councilmen - Buchan, Dickason, Merritt, Tyrell & Fitzjohn NOES: Councilmen -None ABSENT: Councilmen -None 15. PLANNING COMMISSION RECOMMENDATION: Retention of Gordon & Brysis Whitnall as planning consultants. Woollett advised this was simply a recommendation from the Planning Commission to indicate to the Whitnalls that the Council is taking under study their proposal. He explained the $36,000. proposal, that through the Federal and State governments there is a 50% aid grant to cities under 50,000 population, and to qualify there are some presenta- tions that must be made, and Mr. Whitnall has assisted in drawing up the proposal which we will submit to the Council. The proposal of $36,000. for a Consultant for a Master Plan involves about 12 years work. The 701 government program if accepted would leave a cost to the City of $18,000. Dickason asked why on the agenda tonight and Woollett advised only because the Planning Commission felt the Council should make some indication to the Whitnalls as they gave assistance to him in formulating the proposal and the Commission felt to clarify the situation we should indicate to the Whitnalls that we want them to be consultants for our Master Plan, Dickason thinks the indication is apparent in fact we havE listened to them,sees no reason to indicate formally. Tyrell askec if trying to get the Council to commit itself on this thing, and that he felt there may be parts we want and parts we do not want,_ 106 Council Minutes, January 9, .1961, page 5 Buchan said he is in accord with both Dickason and Tyrell but he was on the other side of the table a good deal in same sort of situation and he would like to have some idea that when giving out information valuable to the party receiving it that he is going to be reimbursed some time in the future. He °felt we are accepting advice and possible services of Mr. Whitnall at the present time, and it is to his advantage to give this service but he would like to know that we are appreciating what he is giving us and I think that is all we are be'i:hg asked to do. Dickason felt it still on sales expense at present time and if he gets it back fine and if not charge it to sales promotion. Buchan asked if necessary to designate who is going to do work in submitting 701 program. Woollett advised it was in order to make application complete as it would be an application form which says we plan the program will cost this much and contract with named consultant will be so much. The contract is signed between the State and Consultant and not the City. Also the City$18,000. is not cash as half may be in services, such as aerial survey, etc. Will require a Resolution which will indi- cate that the City Council wants to do this program and will support it and want Whitnalls to do this. The program was chang- ed just last week and it is being redone at this time. Hope to get to the Planning Commission at their next meeting and the following Council meeting, and if approved to the State Planning Board which meets monthly, and Mr. Whitnall will be there and probably will also. Mayor Fitzjohn stated he did not think Mr. Whitnall was asking too much as if in his place he would feel like going of the job altogether, and we should let him know that we are going to try and work with him. Dickason said if he wants the job he can stay with it until it has been decided and if the Council takes action we are giving him a contract. Also that there should be discussions before a decision is made. Buchan suggested the possibility that the consultant might be dickering with some other City which if they accepted him prior to us we would be left high and dry. What we are requested to do here is give him some assurance that we are considering him seriously for the job so as to reserve the time for us. Tyrell asked assuming we are considering him for the job how much of a job are we considering and are they qualified. Woollett stated we indicate we want him to continue to assist in arranging the 701 program, and without any promise of compen- sation from the City. Dickason moved the City Manager be in- structed to write a letter with the City Attorney's approval including that this letter does not constitute any binding con- tract with the City nor to expect reimbursement from the City. ORDINANCE NO. 60- 21- OBSTRUCTION ABATEMENT ORDINANCE: This ordinance was referred back to the Traffic Commission from the Council and has been modified and simplified and is now returned for your approval. Geo. Envall, Traffic Engineer, drew a chart showing proposed requirements with only 40" obstruc- tion allowable within triangle of corner, also could not have branches lower than 6'. Tyrell moved to amend Section 6 by in- serting "mailing of" before Traffic Commission's decision on last line of Section. Merritt seconded and carried. ADDITIONAL TRAFFIC CHANNELIZATION LAS TUNAS DR. WEST OF SULTANA ST. Mr. Envall explained this recommendation involved additional warning by arrows on approximately 50' centers would give advance warning of merging which was a normal practice. Dickason moved to adopt the Traffic t Savety Commission recom- mendation as described by Mr. Envall, Merritt seconded and carrie< 3. ADDITIONAL TRAFFIC CHANNELIZATION: LAS TUNAS DR. EAST OF HART ST. Mr. Envalt explained the change of channelization would notify for left turns and that this will go along with the plan we have now. Tyrell moved to adopt, Buchan seconded, and carried. 4. NEW TRAFFIC CHANNELIZATION: TEMPLE CITY BLVD. & GARIBALDI ST. Mr. Envall explained it was a blind corner on one part and recommendation of Commission was trying to help solve problem. Dickason moved to adopt, Merritt seconded and carried. 5. POSTED SPEED ZONE LONGDON AVE. WEST OF TEMPLE CITY BLVD. Mr. Envall stated the recommendation was for an extension of 30 mph zone on Longdon between Rosemead and Temple City•Blvd. and posting to encompass this additional area. Tyrell moved to adopt, Buchan seconded, and carried. 6. BUS LOADING ZONE REMOVAL: SOUTHWEST CORNER TEMPLE CITY BLVD. AND LAS TUNAS DR. Mr. Envall stated the bus stop was no longer in operation and would furnish additional parking spaces. Tyrell moved to adopt, Dickson seconded and carried. 17. COMMUNICATIONS: A. B. & C. Woollett advised these were proposed annexations to El Monte and South El Monte and did not affect Temple City. Tyrell moved to receive and file, Merritt seconded and carried. 2. Salvation Army request for renewal of charitable solicita- tion permit, was'read by Woollett. Dickason moved to grant re- quest, Buchan seconded and carried. 3. Woollett read a letter of appreciationfor services of the Fire Rescue Unit from Mr. & Mrs. G. D. Holmes, 5023 Sultana. Tyrell moved to refer to the Fire Dept., Dickason seconded and carried. 18. TIME RESERVED FOR AUDIENCE; No one wished to speak at this time 19. MATTERS FROM CITY OFFICIALS: Tyrell asked about the Hospital and Woollett advised that at present they were having finance problems. Merritt brought up several things as follows: 1. Asked if some of the minor things of the Planai.iig „& Traffic Commissions might not be deleted from the Council agenda and have them make the decisions/He felt they should be able to do this without Council approval. Shatford advised ac- cording to the laws of the City they cannot do that, but an amendment could be made. Tyrell did not think at this time it is appropriate. 2. Suggested the City get a postal weighing machine and was ad- vised we presently have one. 3. Also suggested that the City get some recording device that the staff could use. Dickason thought it very appropriate for the City to have for Commissions and Council. Tyrell thinks we should consider a stenorette. Merritt moved the City Manager check into securing for the staff a recording device such as a stenorette, Dickason seconded, roll call vote as follows: AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & r. Fitzjohn NOES: Councilmen -None ABSENT: Councilmen-one 108 1 Council Minutes, January 9, 1961, page 7. The question was brought up regarding hiring an Administrative Assistant and Clerk - Stenographer. Woollett advised the appoint- ments will have to be made by Resolution but first the Council will have to decide the salary range. He also cited the scale of salaries paid by various cities in the area. Woollett stated the man he was considering for Assistant was well qualified by experience as well as education. Merritt suggested the City Manager get a resume.) of the qualifications of this individual for the next meeting. 20. ADJOURNMENT: Dickason moved to adjourn at 9:30 P, M. Buchan seconded and carried.
