MINUTES OF THE REGULAR MEETING OFF
THE CITY COUNCIL, MARCH 13, 1961
1. INITIATION:
The regular meeting of the City Council of the City of Temple
City was called to order by Mayor Fitzjohn who led the Pledge
2. of Allegiance to the Flag. Mr. Lucian Bruner, 5217 Golden West,
3. gave the invocation.•
4. ROLL CALL:
PRESENT: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn
ABSENT: Councilmen -None
ALSO PRESENT: Atty. Tom Lumsdon representing Henry Shatford,
and City Manager Woollett.
5. APPROVAL OF MINUTES:
Woollett corrected the minutes on page 5, Section 12, sub- sectio?
#3 to read as follows:" 260 property owners received notices.
99 were represented on the application representing 64 parcels.
Also objections by 59 people owning smaller lots representing
64 other parcels and who were against the change were received."
Dickason moved to adopt the minutes of February 27, 1961, as
corrected, Buchan seconded, roll call vote as follows:

6. ORDINANCE NO. 61 -37 AMENDING CODE RELATIVE TO SALE & USE OF FIRE
WORKS. Attorney Lumsdon read the title to Ordinance No. 61 -37
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMEN
ING THE TEMPLE CITY MUNICIPAL CODE RELATIVE TO THE SALE AND USE
OF FIREWORKS WITHIN THE CITY OF TEMPLE CiTY, AND REPEALING ALL
OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH.
Dickason stated at the last Council meeting he suggested this
ordinance be tabled for two weeks as he felt the public should
be given a chance to speak. Also that he had only one contact
during that time and that was a "pro" and he was interested to
know what the other members of the Council had learned.
Merritt stated he had spoken to a number of people at Live Oak
Park regarding the possibility of changing the ordinance, and
they were not aware of an ordinance against fireworks, also
that they have been buying and using them. Also he could find
noone opposed to selling fire works in the City.
Mayor Fitzjohn at this time requested anyone in the audience
against the use or sale of safe and sane fireworks in Temple
City to please step forward and speak.
Mr. Carl E. Johnson, 9204 Olive, Temple City, stated at the pre-
vious meeting he was against it, and we can get along nicely
without it. He was hoping more cities would also not allow it.
He did not feel anything was being taken away from the children
and if just one accident was eliminated it waswor.th it. He felt
the letter from the Fire Dept. and others heard at the previous
meeting opposing this ordinance was well received and he would
like to see the ordinance continued as it is.
Mrs. Martha Johnson, 9204 Olive, felt selling fire works was not
strengthening the community, and although this is not a big thin
it is a start in the wrong direction and if we continue to do
things to lower the ideals of the community she does not think
it a good thing.
Mr. Parkhurst, 5651 Olive, stated as a member of the American
Legion he had seen fireworks used a good many years. The profit
from sale of fireworks supports many Legion Posts in their com-
munity work more than any other source of income. He felt this
sale is a good clean way to make an income that will support a
veteran organization. He also advised the big firework show at
the Coliseum in Los Angeles on the 4th is put on by the County
Council of the Americal Legion, and the money'is used to main-
tain the service department of the County Council of the America

Legion. This is a group of service officers who are well versed
in the laws where vets may obtain rights to which they are en-
titled.
Mr. Fred Brukins representing the Latter Day Saints Church, said
they are concerned and have come to the conclusion these are ab-
solutely safe and sane, and they wish to convey to the Council
that youth groups of the church would like to enter into the sale
Mr. Jack Dalismer, Pres. of Temple City Rotary Club, stated they
were all for it, and they could use the money for various service
projects and as long as they are sold in surrounding communities
Temple City might as well have the benefit of sales tax and pro,
fit.
Councilman Buchan stated he felt holidays were created for spec!-
fic purposes and the 4th is recognized by fireworks. He also
felt the kids today are losing the spirit, and he can see nothing
wrong in allowing safe and sane fireworks to be sold and used
here in Temple City.
Dickason said on hearing both sides of the argument he felt the
people opposed were thinking in terms of old fashined fireworks
where there is danger to life and limb but in his opinion he did
not think this true today, and at this time he favored pro argu-
ments, but would be willing to postpone another couple of weeks
taking any action to see if there is any more reaction from the
people of Temple City.
Merritt stated he spoke to a friend and he was opposed, but all
the people he spoke to at Live Oak Park had children there and
they were all heartily in favor of using fireworks, and had
bought there's in the surrounding areas in the past.
Tyrell stated his position had ..not changed any since the last
meeting. He said it is not necessary for any club to make money
in this manner when jeopardizing the safety of our children. It
is the duty of the Council to provide for the City what we deem
is in the best interest of our citizens and the mere fact that
there are four or five here for it, it still is not representing
the people as a whole. Many people are law abiding and if they
cannot afford it can use the law as an excuse and use their money
for necessities. He is wholeheartedly against it and in support
of the Fire Dept. and the L. A. Fire Dept. he can see no dissim-
ilarity between this and the show type. We do not have a safe
and sane firework any more than we have a safe and sane match
and he considers fireworks are the same idea.
Mayor Fitzjohn stated logically speaking he felt it unfair when
all surrounding communities have the right to sell and use fire-
works, that the average family is intelligent and the right
place 10 use them would be in the front or backyard of their
home and fire damage would be negligible. He believes that all
on the Council believe in protecting our childredn. He stated
he is heartily in favor of abolishing the ordinance we took over
and adopted when we became a city, and he would be in favor of
adopting this ordinance for the sale of safe and sane fire works.
It is not right that we forbid the people in Temple City to use
them when they can purchase them in surrounding towns and use
them here which they have been doing many years.
Woollett gave a report on fireworks in the surrounding cities.
He also stated he would like to propose a couple of changes in
the Ordinance as follows:
Section 3113. The Council shall require a cash deposit with thr
City Clerk in the sum of $100.00 for each 20 feet ln length or
ce�,��ted portion thereof. Woollett recommends this be changed to 24 feet.
l''�"a1-1'' Section 3118. Sub- section d. There shall be at least one super -
yisor, twenty one years of age or older, on duty at all times.
_. Woollett recommends this be changed to .18 years of age. Also
in sub - section k footage be changed from 20 ft. to 24 ft.
Section 3115, sub- section 3, Woollett recommends fee be changed
from $10. to $25. to cover cost of inspections.
Buchan moved to waive further reading of Ordinance No. 61 -37 as
changed by the City Manager. Dickason seconded. Roll Call Vote

Dickason stated he was in favor oP a higher fee for regulation
rather than income to the City.
Tyrell stated it was a source of some disappointment to him that
the Council could not follow the lead of the County.
7. ORDINANCE NO. 61 -36, 2nd reading.
Attorney Lumsdon read title to Ordinance No. 61 -36 AN ORDINANCE

ING THE TEMPLE CITY MUNICIPAL CODE BY ADDING SECTIONS 4250:2,
4250.3, 4250.4, and 4250.5 RELATING TO DISTRIBUTION OF TIP SHEETS
AND COMMERCIAL ADVERTISING MATTER ON PUBLIC STREETS IN THE CITY
OF TEMPLE CITY. Merritt moved to waive further reading and to
adopt Ordinance No. 61 -36, Buchan seconded, roll call vote as
follows.:

8, CURRENT USE OF COUNTY PARKING LOTS
Woollett stated that on Febr. 20 the time limit was removed on

Lorr NC'{'ep doing a survey. He recommended to the Council to leave restric-
tions off until the next Council meeting when he w i l l have a full
report. Buchan moved to table until the next meeting, Merritt
seconded and carried.
PROPOSED PURCHASE OF RECORDING EQUIPMENT.
Woollett presented Karl Koski, Administrative Assistant, v -o re,
pared the two page report submitted to the Council. Mr. Koski
discussed his report and answered various questions by the Counci
and following considerable discussion Buchan made the motion that

e tiez pone any further discussion until that time. Dickason seconded
and carried.
10. NEW BUSINESS:
ORDINANCE NO. 61 -38. 1st reading.
Attorney Lumsdon read title to Ordinance No. 61 -38 AN ORDINANCE
OF THE CITY OF TEMPLE CITY, CALIFORNIA, AMENDING THE TEMPLE CITY
MUNICIPAL CODE BY ADDING SECTION 1200.1 THROUGH 1200.10 RELATING
TO ARRESTS AND PENALTIES FOR VIOLATIONS OF CITY ORDINANCES.'
Tyrell moved to waive further reading of Ordinance No. 61 -38,
Merritt seconded, roll call vote as follows:
AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn
NOES: Councilmen -None
ABSENT: Councilmen -None
As this was the first reading of the Ordinance no further action
was taken.
11. RESOLUTION NO. 61 -125 WARRANTS & DEMANDS.
Attorney Lumsdon read title to Resolution No. 61 -125 A RESOLUTI''0
OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS & DEMANDS IN THE SUM
OF $16,627.59 NOS. 422 THROUGH 442. Woollett stated as this
Resolution included the first bill from the Road Dept. in the
amount of $11,677.28; he had prepared a breakdown of the .
charges we are being billed for which was available to them.
Tyrell moved to adopt Resolution No. 61 -125, demands nos. 422
through 442 in the sum of $16,627.59. Merritt seconded, roll
call vote as follows:
AYES: Councilmen- Buchan, Dickason, Merritt, Tyrell & Fitzjohn
NOES: Councilmen -None
ABSENT: Councilmen -None
12. RECOMMENDATIONS OF TRAFFIC COMMISSION:
1. Additional "NO PARKING" zone Lemon Ave.- Temple City Blvd.
west. Tyrell moved to accept the recommendation of the Traf-
fic Commission, Buchan seconded, and carried.
2. Traffic Channelization- Encinata & Broadway. Tyrell stated
he felt this raised area in this intersection a traffic haz-
ard. Mr. Bruner, 5217 Golden West, of the Traffic Commission,
said he personally thought it a monstrosity but it is some-

thing the County put in on the basis of traffic accident record.
Dickason made the motion to refer this back to the Traffic Com-
mission for further study, Buchan seconded and carried.
3. Proposed "NO PARKING" zone Sultana south of Las Tunas.
This was recommended as it is a narrow street with a fair amount
of traffic. Tyrell moved to accept the recommendation of the
Traffic Commission. Dickason seconded and carried.
4. Baldwin Ave. & Daines Dr. west approach -- constricted roadway'
Recommendation was for placing arrow markings and reflectors.
Tyrell moved to accept the recommendations of the Traffic Com-
mission, Merritt seconded, and carried.
5. Temple City Blvd. West Side, south of Woodruff Ave. .
Parallel parking stalls.
Tyrell moved to adopt recommendation of the Traffic Commission
Buchan seconded and carried.
13. COMMUNICATIONS:
1. County of Los Angeles Boundary Commission - proposed annexa-
tion City of El Monte #255. As this in no way affects Tempi,
City Tyrell moved to receive and file, Buchan seconded and
carried.
2. L. A. County Medical Assn. - Request March 19 -25 proclaimed.
as Community Health Week and March 19 as Polio- Tetanus Ino-
culation Day. Buchan so moved,Dickason seconded and carried.
14. Time reserved for anyone in the audience wishing to address the
Council. No one stepped forward at this time.
15.. MATTERS FROM CITY OFFICIALS:
�l. Woollett reported on the special meeting of the Traffic Com-
mission held on March 9, 1961, regarding proposed widening of
Double Drive and signalization at Double Drive & Freer. The
storm drain will not be completed until 1962 which means 12 or
2 years before the storm drain work will be completed and con-
tinual traffic problems would be in existence for some time.
For this reason the Commission asked the staff to come up with
something regarding temporary installation at this corner. The
F,xe4i- Commission feels a 1 ,green on Double Drive except when people
wish to cross, installed at Freer should be considered. The es-
timated cost would be $3340. which includes all labor to dis •
mantle and for the permanent installation. Because of the ur-

`�`V "' °'r County regarding their willingness to pay for their half. The
etreerck Road Dept. felt it not a good thing because existing traffic
lrtA,`4 . ` pattern does not meet with their warrants establishing a basis
for installation of signalization. They would not be willing
to participate in the fixed timing type. They did say if the
City wanted to go ahead and pay the full cost the County would
give them permission to do so but at this time do not wish to
participate.
Mrs. Frank Stunden, 5355 N. Double Drive, stated it is costing
$2000. to maintain crossing guards which she assumed would be
removed at the time the signal was installed. Mr. Bruner of the
Traffic Commission quoted the traffic engineer that in a large
number of instances the need for crossing guards was relieved.
Tyrell stated he is heartily in favor of installing a signal.
He moved that we install the temporary signal at a cost of
$3340. even if the City has to pay in full, and we should have
it as soon as possible. Merritt seconded.
Buchan asked if this cannot be installed by June 30, if it then
comes in the future budget. Woollett advised if the contract
was let prior to June 30 it would be in this years budget. Roll
call vote as follows:

2. Woollett stated the City signed an agreement with the State
for a Master Agreement. Recently the State designed a new agree-
ment which is the same as far as the City is concerned. Through
some oversight they wanted this executed by March 1 and we have
just received it. He would appreciate the Council authorizing
the City Clerk and the Mayor to sign and return this Agreement.

Buchan asked if there was any change in the distribution as yet
and was advised there was not. Tyrell moved to delegate the
Mayor and the City Clerk to execute the Master Agreement, Buchan
seconded and carried.
Woollett advised of a meeting of the Metropolitan Transit Author
ity relative to offering reduced fares to senior citizens. Ty-
rell moved Administrative Assistant Karl Koski attend and
represent the City of Temple City, Buchan seconded, and carried.
3. Woollett read a letter from Palos Verdes Estates together
with a Resolution opposing extension of the Brown Act, which re-
quires any consultations of any type be held in a public meeting.
Tyrell felt we should go on record as opposing it. Woollett
read in full E 1 -7-. and Resolution #345 of Palos. Verdes
(}1lFrdial -Gr Estates opposing AB 127 as an unwarranted extension of the
Brown Act. Tyrell made a motion to adopt the same Resolution
and to forward a copy to each of the names listed thereon.
Merritt seconded, roll call vote as follows:

ABSENT: Councilmen -None
4. Woollett advised regarding the problem of deficit in build
ing permit fees and costs. He suggested that we do nothing
to the fee schedule at this time as he believes we will break
even by the end of the year, and prefers not to raise the fee
until after this quarter as he feels we can make it up. Dickason
felt we should study it for a few more months, Buchan seconded,
and carried.
5. Woollett stated March 1926 is the 50th anniversary of the
Campfire Girls, and they request March 19 -26 be proclaimed as
Golden Jubilee Week for the Campfire Girls. Mrs. Ambrose Mazola
of 9933 Nadine, presented the request. Tyrell so moved, Buchan
seconded and carried.
Buchan stated he would be unable to attend the League of Calif.
Cities meeting in Southgate on March 16 and asked if someone
could attend in his place. It was agreed that City Manager
Woollett would represent Temple City at this meeting.
Dickason stated he was appointed to the Library Advisory Council
to represent the City Council. The meetings have been held in
the evening but recently have been changed to afternoon meeting
which makes it difficult for him to attend. The Mayor suggestec
possibly Mrs. Rains could give the Council a report on these
meetings. Woollett stated he felt it of such importance that
someone should attend,and requested permission of the Council
to attend and report back to them)which was granted.
16. ADJOURNMENT:
Dickason moved to adjourn at 9:30 P. M.) Buchan seconded, and
carried to adjourn to the next regular meeting on March 27, 1961
