INITIATION: The regular meeting of the City Council of the City of Temple City was called to order by Mayor Dickason, who led the Pledge 2. of Allegiance to the Flag. 3. The invocation was given by Rev. Geo. Gripe, Temple City Brethren Church, 5537 Temple City Blvd. 4. ROLL CALL: PRESENT: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell & Dickason ABSENT: Councilmen -None ALSO PRESENT: Atty. Tom Lumsdon representing City Attorney Shat- ford, & City Manager Woollett. 5. APPROVAL OF MINUTES: Councilman Buchan added the following to his statement in the last paragraph on page 1, ':Councilman Buchan also stated that he thought the residents should have some say as to how the neigh- borhood should be developed." Councilman Merritt added the follow, ing to his statement on page 2 immediately following Councilman Dickason's statement: "I visited the property in question and felt that any improvement would be a great one. From statements made tonight the problem seems to be something of this nature, commercial or residential. As regards the wall it does not nec- essarily blend with the area, and with the parking area and no garden tends to be more of an asphalt jungle. If it were closer to Live Oak it would not be so much in residential." Councilman Tyrell moved to approve as corrected, Councilman Buch- an seconded and carried by the following roll call vote: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell & Dickason NOES: Councilmen -None ABSENT: Councilmen -None 6. PUBLIC HEARING: PROPOSED VACATION OF LIGHT & AIR EASEMENT, Tract 10553, Zadell & Glickman City M.nager Woollett explained that this is the easement on the subdivision which has submitted its final map for approval. Mayor Dickason declared the Public Hearing open and asked if any - one in the audience wished to speak. Mr. Dick Lucas, 5301 aadeil, stated he did not object to this easement but would object if similar action was taken on the easement on properties across the street where his property is located. As no one else wished to speak Mayor Dickason declared the Public Hearing closed. Following discussion Councilman Tyrell moved no action be taken at the present time and that this item be restored to the agenda at such time as the Tract map is reported to the Council, Councilman Merritt seconded, roll call vote as fol lows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None ORDINANCE NO. 61- 44, INTENT TO ANNEX TO CONSOLIDATED COUNTY FIRE DISTRICT. Atty. Lumsdon read title to Ordinance No. 61 -44 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLAR- ING ITS INTENTION AND DESIRE TO HAVE CERTAIN TERRITORY WITHIN ITS BOUNDARIES ANNEXED TO THE CONSOLIDATED COUNTY FIRE PROTECTION DISTRICT. Councilman Tyrell moved to waive further reading, - Counciiman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None As this was the first reading of Ordinance No. 61 -44 no further action was taken. 169 Council Minutes, June 12, 1961, page 2 REQUEST FOR DANCE & ENTERTAINMENT LICENSE: HAL J. BROADHEAD 9151 LAS TUNAS DR., TEMPLE CITY City Manager Woollett stated pursuant to the request of the Coun- cil at their last meeting= this was re- submitted to the Sheriffs Department for their investigation. At this time he read a lette from the Sheriffs Dept. stating Mr. Broadhead had operated Cov- entry Inn in Arcadia which was not a police problem and he had no record. Councilman Tyrell moved to grant the request for dance and entertainment license to Hal J. Broadhead, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 9. RESOLUTION NO. 61 -133 GEO. E. RUST & GRACE L. RUST SPECIAL USE PERMIT. Atty. Lumsdon read title to Resolution No. 61 -13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DENYING A SPECIAL USE PERMIT TO GEORGE E. AND GRACE L. RUST TO EXPAND THE EXISTING REST HOME FACILITIES AT 5610 MCCULLOCH ST., TEMPLE CITY, FROM 9 BEDS TO 20 BEDS. Councilman Fitzjohn stated he would like to make a motion that this be tabled until the August lath Council Meeting for further study, and that the City Attorney be instructed to re -draw this Resolution. It was noted in Section 1 that denial was based on development of the Master Plan. Councilman Fitziohn stated a variance was issued some time ago establishing the Rest Home and it is not up to the Master Plan whether they should increase. Councilman Buchan seconded. Following considerable discussion the 'roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen - Tyrell ABSENT: Councilmen -None 10. ESTABLISHMENT OF CIVIL DEFENSE ORGANI1ATIOiN: Mayor Dickason stated the City Manager is Director of Civil De- fense by law and during the first year we have not done a lot of organizational work. He thinks we should give this some atten• tion in our second year, and would like to appoint a Deputy Di- rector, and suggested Dick Sale of the Traffic Commission who has been through the County Defense Program and has quite a know- ledge of this organization. Mayor Dickason felt there should be three members, possibly one from the Council and asked Coun- cilman Tyrell if he would serve. He accepted temporarily. Coun- cilman Tyrell moved to appoint Dick Sale as Deputy Director and himself as a volunteer on a temporary basis, Councilman Merritt seconded and carried. Mr. G. Stinstrom of Pacific Telephone stated that the Telephone Co. would appreciate consideration as they progressed. He also suggested having a representative from the various utilities on the committee. Mayor Dickason preferred only three individuals at present to start the organization. Councilman Fitzjohn ad- vised Mr. MacKay would like to volunteer his services at such time as they might be helpful. 11. RENEWAL OF HEALTH SERVICES AGREEMENT: City Manager Woollett stated this is an agreement with Los Angel- es County pertaining to the local health ordinance, and he is re- questing the City Council to renew this agreement for a period of five years which can be done by minute order. Councilman Tyrell so moved, Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 12. APPOINTMENT SANITATION DISTRICT REPRESENTATIVES. City Manager Woollett advised the Mayor is automatically Direct- or and requested the City Council to appoint Howard Dickason as Director, and another Councilman as Alternate. Councilman Tyrell rppved to appoint Howard Dickason as Director, and Vice -Mayor T. Donald Buchan as Alternate. Lumsdon read title to Resolution No. 61 -140 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING TWO PLANNING COMMISSIONERS, naming C. Ray Johnston, 6470 Livia Ave., and Russell G. Ludwig, 6�. -2B Livia Ave. Councilman Tyrell moved to adopt Resolution No. 61 -1 +0, Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 14,. RESOLUTION NO. 61 -139 WARRANTS & DEMANDS. Councilman Tyrell moved to adopt Resolution No. 61- 139,,.A RESO- LUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS & DEMANDS IN THE SUM OF $13,860.`y1, DEMAND NOS. 560 THROUGH 622, Councilman Buchan, seconded, carried by the following roll call vote: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 15. RECOMMENDATIONS OF THE PLANNING COMMISSION PLANNING COMMISSION RESOLUTION NO. 61 -4PC -- RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY RECOMMENDING TO THE CITY COUNCIL GRANTING OF A ZONE.VARtANCE TO ORIN C. AND IRENE M. BERGE TO CONSTRUCT TWO HOUSES TO BE USED AS MODEL HOMES ON THE EAST SIDE OF ZADELL AVENUE APPROXIMATELY 120' SOUTH OF OLIVE. STREET, SUBJECT TO CERTAIN CONDITIONS. Councilman Tyrell moved to adopt Resolution No. 61 -4PC, Councilman Buchan seconded. Following discussion Councilman Tyrell amended his motion to change part b of Section 3 to be 90 days or Jan. 1, 1962, which- ever first occurs, Councilman Buchan seconded the amendment to the-motion. Mr. Dick Lucas, 5301 Zadell, spoke opposing curbs and gutters required in the Resolution. Mr. W. R. Baran, 5311 Zadell stated he had submitted a request for a petition for curbs & gutters and to set up an assessment district, and prior to to submitting this request to the City Manager it was determined by contacting the vast majority of people in that area that they would sign the petition, and only concern was that noone knows the cost. Roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 16.. RECOMMENDATIONS OF TRAFFIC COMMISSION: 1.. Traffic Engineer Envall's report re -Arden Drive, Councilman Tyrell moved to adopt the recommendations, Council- man Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 2. Recommend one -way alleys east and west bound. Following consi- derable discussion Councilman Tyrell moved to table so it will come up next meeting, and have the City M,Jnager advise the Merchants Committee and if they have any objections they can be here. Councilman Fitzjohn seconded, roll call vote as fol lows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 3. Recommend 5 min. parking at School for Little Children, 9914 E. Las Tunas Dr. Following considerable discussion pro and con Councilman Merritt moved that the Council pass recommendation No. 3 of the Traffic Commission, Councilman Fitzjohn seconded roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen-None ABSENT: Councilmen -None 171 Council Minutes, June 12, 1961, page 4 9 Recommend no change in Traffic Enforcement. Councilman Tyrell moved to receive and file, Councilman Merrit seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 17. COMMUNICATIONS: 1. City Manager Woollett read a letter from Frank G. Bonelli, Supervisor First District, requesting support of Senate Bill 1294. He explained if passed it would make possible at the option of local governments of raising part of the car license fee from $2. to $3. which would revert back to local govern- ment for street improvement if adopted. Also if the County does not adopt this measure the City cannot, but if the County does adopt the City has the option to do so or not. Councilman Merritt moved to go on record to support Senate Bill 1294, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 2. City Manager Woollett presented a letter from the Los Angeles County Boundary Commission re- proposed annexation #257, City of El Monte. Councilman Tyrell moved to receive and file, Councilman Fitzjohn seconded and carried. 3. City of Duarte, request for support of Anti - Gambling Resolu- tion. Following discussion Councilman Fitzjohn moved to sup. port this Resolution, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen - Tyrell ABSENT: Councilmen -None Under #1 City Manager Woollett will write letters to our State Representatives, and State Senator indicating that the City has gone on record as supporting Senate Bill 1294. 18. TIME RESERVED FOR THOSE IN THE AUDIENCE WHO DESIRE TO ADDRESS THE COUNCIL: No one wished to speak at this time. 19. MATTERS FROM CITY OFFICIALS: Mayor Dickason requested the City Manager to discuss re- appor- tionment in respect to Mr. Bonelli. Mr. AJoollett advised the Governor is establishing a Commission to study senate reappor- tionment, and suggests the Governor appoint to this Commission Hon. Frank G. Bonelli. If you so desire you may instruct him to write the Governor requesting the appointment of Mr. Bonelli. Councilman Tyrell so moved, Councilman Buchan seconded & carried. Mayor Dickason read messages of congratulations to the City from John Rousselot and H. Allen Smith. City Manager Woollett discussed the budget meetings of the 13th and l5th, and inasmuch as two Councilmen will be out of town on June 26 when budget would normally be adopted, he recommended the public budget meetings for Tuesday the 13th, and the next one Wednesday night instead of Thursday night. Wednesday night the Parks & Recreation Commission are hording a special meeting' regarding the budget, which figures can be added to budget and the Council meeting could follow and adopt the budget. Follow- ing discussion Councilman Tyrell moved to adjourn until Tuesday 20. night at 7:30 P. M., Councilman Buchan seconded, and carried, adjourned at 10:00 P. M. ATTEST: 172
