MINUTES OF REGULAR MEETING
AUGUST 28, 1961
1. INITIATION:
The regular meeting of the City Council of the City of Temple
City was called to order by Mayor Pro Tem Buchan at 7 :30 P. M.,
2. who led the pledge of Allegiance to the Flag,
INVOCATION:
invocation was given by Rev. Lyman B. Ellis, St. Paul Methodist
Church, El Monte at Freer.
4. ROLL CALL:
PRESENT: Councilmen - Fitzjohn, Merritt, Buchan
ABSENT: Councilmen - Dickason, Tyrell
ALSO PRESENT: City Attorney Shatford and City Manager Woollett.
S. APPROVAL OF MINUTES:
City Manager Woollett corrected the minutes on page 2, section
10, of the minutes of ,august 14, 1961, re setting the public
hearing from December 11, 161, to September 11, 1961. Council-
man Fitzjohn moved to approve the minutes as corrected, Council-
man Merritt seconded, roll call vote as follows:

6. UNFINISHED BUSINESS:
ORDINANCE NO. 6.1-46 =• 2nd reading.
City Attorney Shatford read title in full to Ordinence No.
61-46 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY, CALIFORNIA, OF INTENTION TO PROCEED UNDER STREETS AND
HIGHWAYS CODE, SECTIONS 8320 THROUGH 8324, TO VACATE EASEMENT
WITHIN TRACT NO, 11695 C ouncilman Fitzjohn moved to waive
further reading, Councilman Merritt seconded, roll call vote
as follows:

CULLOCH STREET, TEMPLE CITY, CALIFORNIA, FROM 9 BEDS TO 20 BEDS.
Councilman Tyrell moved to adopt Resolution No. 61 -143, Council -
Merritt seconded, roll call vote as Follows:

NOES: Councilman - Fitzjohn

8. INSTALLATIONS OF UMBRELLAS ON CITY SIDEWALKS:
Following discussion the City Attorney will draft a Resolution
covering insurance and all other angles to present at the next
Council meeting, in order to not hold up the merchants Council-
man Fitzjohn moved as follows: That umbrellas be permitted to
be placed upon the sidewalks in the City of Temple City in the
parking poles subject to approval of the exact location and um-
brella installation of the City Manager, and also subject to
their acquiring an insurance policy of public liability not less
than $250,000. and $500,000, any one accident, and $25,000, for

any accident to the City of Temple City. in addition thereto
both property owner and owner of store execute an agreement with
the City of Temple City which will hold the City of Temple City
completely harmless in the event of any accident. That upon the
installation of each umbrella owner shall pay a fee to the City
of Temple City of $5,00 for one year, and that the City of Temple
City may at any time revoke the permission to erect and maintain
or to continue the use of the umbrellas, and that this motion be
only an emergency motion and effective only until the City Attor-
ney can draft a Resolution more concise in its terms, and also
that the city license required shall coincide With fees on all
other City license fees for same term, Councilman Tyrell second-

9. TRAFFIC COVERAGE SUPPLED BY CALIFORNIA HIGHWAY PATROL:
City Manager Woollett advised the Highway Patrol will remain for
traffic enforcement until January 1, 1962, as a result of sever-
al communications from this City to the Highway Patrol as well
as Senator Richards and the Governor's efforts on our part. He
also recommended that he be authorized to continue proceedings
with the Sheriffs Dept. to provide for this service on Jan. 1,
1962. Councilman Tyrell made the motion to instruct the City
Manager to continue negotiations with the Sheriffs Dept. and
establish a meeting with the Sheriffs Dept. and the Council some
time in September for further discussion, Councilman Merritt se-
conded, roll call vote as follows:

NOES: Councilmen -None

PLANNING COMMISSION:
Councilman Merritt recommended Paul W, Beckley, 5602: •C:amio,:xy as
Commissioner on the Planning Commission. Councilman Tyrell mov _

PARKS & RECREATION COMMISSION:
Councilman Fitzjohn recommended B. Arley Gorham, 5039 Encinata,
as Commissioner on the Parks & Recreation Commission, Councilman
Tyrell moved recommendations be closed and this gentleman be ap-
pointed as Commissioner on the Parks & Recreation Commission:

TRAFFIC COMMISSION:
Councilman Merritt recommended Henry R, Stegnam, 9303 Biackley,
for the unexpired term of Lucian G. Bruner as Commissioner on
the Traffic Commission, Councilman Fitzjohn moved to close and
that this gentleman be appointed, Councilman Tyrell seconded,
roll call vote as follows:

Councilman Tyrell moved to adopt Resolution No. 61-154 A RESOLU-

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE
CITY RECOMMENDING TO THE CITY COUNCIL DENIAL OF A ZONE VARIANCE
TO PAUL F. AND VIRGINIA L, UHL TO BUILD A FOURTH RESIDENCE WITH
LESS THAN REQUIRED AREA AND HAVING AN UNDERWIDTH DRIVEWAY AT
5050 NORTH SERENO DRIVE, TEMPLE CITY. Councilman Tyrell moved
to adopt the recommendation of the Planning Commission, Council-
man Merritt seconded, roll call vote as follows:
AYES: Councilmen-Fitzjohn, Merritt, Tyrell, Buchan
NOES: Councilmen-None
ABSENT: Councilman- Dickason
12. RESOLUTION N0, 61-156, ESTABLISHING ZERO TAX RATE
City Manager Woollett read in full Resolution No. 61 -156 titled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY IN-
DICATING NO CITY TAX RATE FOR THE FISCAL YEAR 1961-1962. Council -
man Fitzjohn moved to adopt Resolution No. 61 -156, Councilman
Merritt seconded and commented that as stated in some of the
papers and pointed out by Councilmen in other cities Temple City
enjoys a zero tax rate not because of a free ride on Highway
Patrol which is not free but is paid for by fines and forfeitures

13. RESOLUTION NO. 616155, WARRANTS & DEMANDS
Councilman Merritt moved to adopt Resolution No, 6!;155
Warrants & Demands No, 741 through 768 in the amount of
$35,831.58, Councilman Fitzjohn seconded, roll call vote as
Follows:
AYES: Councilmen-Fitzjohn, Merritt, Tyrell, Buchan
NOES: Counc i lmen-None

COMMUNICATIONS;
14. City Manager Woollett read a letter from Mrs. C, V. Dalton,
4817 N. Camellia Ave., in appreciation of the Fire and °SheH ffs
Depts. Councilman Tyrell moved to refer to these Depts. Counc;lo.
man Fitzjohn seconded, and carried.
City Manager read a letter from Temple City Republican Womens
Club requesting permission to hold monthly meetings in Live Oak
Park. Councilman Fitzjohn moved to grant permission, Councilman
Merritt seconded and carried.
City Manager read a request to place three signs across Las Tun-
as Dr. advertising the L,A.County Fair, Councilman Merritt
moved permission be granted, Councilman Fitzjohn seconded, and
carried.
15, TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK
Margie Calamia, Sec. of the Camellia Festival, introduced Mr,
W. P. Bowlby, a resident of Temple City and Director of the San
Gabriel Valley Symphony Assn., who presented a request for fin-
ancial assistance to the Council. Councilman Merritt moved to
take Mr. Bowlby's presentation under consideration and let him
know at a future date what the Council decision is. Councilman
Tyrell seconded, and carried.
Mr, James A, Montpas, Attorney for Charles Rust, addressed the
Council in protest of the denial of the Special Use Permit to
Mr. Rust to increase his rest home to 20 beds. City Attorney
Shatford advised the Council action was final unless his client
wishes to pursue court action.
Mr., Ed. Hawser, 5927 Kauffman, representing the Lions Club stated
the Club was willing to share the cost of 12 refuse cans to be
placed at various spots in the city, and that the club would
paint and maintain them, the cost to the City to be $219.00 and

to the Lions Club $180.00, Councilman Fitzjohn made the motion
that the City pay $215, toward purchase of these 12 trash cans,
the Lions Club to paint and maintain them and pay the balance of
$180,00, locations to be determined by the Club and City Manager.

ABSENT: Councilmen - Dickason
Mrs, Georgia Maxey presented the Council members with some anti-
Communist literature in keeping with Anti - Communist Week,
Mrs. Richard Berry asked regarding the Rust Case if this can be
appealed and was advised by the City Attorney that as far as the
City is concerned the Resolution has been adopted, but the
applicant has the right to appeal to the Court,

Councilman Fitzjohn stated City Manager Woollett should be com-
mended for his efforts in getting the extension of service of
the California Highway Patrol,
