HomeMy Public PortalAboutOrd. 1482OgOIN~j~i j1~Q, 1482 AN ORDINANCE OF THE CITY C0~1CIL OF THE CITY OF LYNWOOD, CALIFORNIA, AN~ENI)ING CHAPTE~L Y2, ~ SECT'I:ON 12-Z.~, RELATING TO THE PREREQUISITES TO ISSUE A LICENSE TO SELL FIREWORKS IN THE CITY WHEREAS during the past Fourth of July festivities there were numerous incidents of unsupervised discharge of fireworks in the City that endangered persons and propcrt}'; and WHEREAS the City desires to protect the safety and welfare of its inhabitants by lirniang the sale and thereby limiting the discharge of"safe and sane" fireworks in the Cir~• by eliminating the current requirement that a "drawing" be held if the number of arrlications exceeds the number of licenses to be issued sad replacing it with a vote by the Cit}• Council.. NOS', THEREFORE, the City Council of the City of Lynwood does hereby ordain as follows: S s ^ui~..i, Section 12-2.5 (d) Preregnlsite to Issuance otLleense is hereby amended as follows: (d) Applications for licenses to sell fireworks shall be brought before the City Council for their review and approval. Licenses to sell fireworks may only be awarded pursuant to a majority vote of the City Council. If the City Council determines that it is in the best interests of the City to reject an application, it shall state its reasons therefor on the record. Any rejected applicant shall be given the opportunity to appeal the City Council's rejection by addressing the City Council (for not more than three (3) minutes), and/or submitting a written statement setting forth the basis for their appeal.
