INITIATION: The regular meeting of the City Council of the City of Temple City was called to order by Mayor Dickason at 7 :30 P. M„ who 2. led the Pledge of Allegiance to the Flag. 3, INVOCATION: Invocation was given by Father Birch of St, Lukes Catholic Church, Temple City. 4, ROLL CALL: PRESENT: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason ABSENT: Councilmen -None ALSO PRESENT: City Attorney Shatford and City Manager Woollett. 5, APPROVAL OF MINUTES: Councilman Buchan moved the minutes of the regular meeting held on September 11, 1961, be approved as mailed, Councilman Fitz- john seconded, roll call vote as follows: AYES: Councilmen — Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 6. UNFINISHED BUSINESS: RESOLUTION NO. 61- 162 - -A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, VACATING EASEMENT WITHIN TRACT #11695, City Attorney Shatford explained that Ordinance No. 61 -46 was adopted in August declaring intention to vacate this easement, a public hearing was held on Sept. 11, 1961, and this Resolution finally vacates the easement. Councilman Buchan moved to adopt Resolution No, 61 -162, Councilman Tyrell seconded; roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 7 0 ORDINANCE NO. 61-47, re- installation umbrellas on city streets. City Attorney Shatford read title to Ordinance No. 61 -47 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIF- ORNIA, AMENDING THE TEMPLE CITY MUNICIPAL CODE BY ADDING SECTIONS 3304 THROUGH 3319 RELATING TO INSTALLATION OF UMBRELLAS UPON CITY SIDEWALKS. Councilman Tyrell moved to waive further read- ing, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None As this was the second reading Councilman Tyrell moved to adopt Ordinance No. 61 -47, Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen-None 8, RESOLUTION NO, 61- 163- -A RESOLUTION OF THE CITY OF TEMPLE CITY AUTHORIZING EXECUTION OF A CONTRACT BETWEEN THE STATE OF CALIF- ORNIA AND THE CITY OF TEMPLE CITY PURSUANT TO CHAPTER 1641, STATUTES OF 1959. City Manager':.!oollett stated the City Attorney had approved the contract and approved as to form of context, and that as soon as executed Mr. Elton Andrews would take it to the state, Councilman Fitzjohn moved to adopt Resolution No. 61 -163, Councilman Buchan seconded. City Manager Woollett stated the $9000.00 mentioned is the amount which we will deposit in cash which will make up the cash payment due from the City with the balance of the City's share being paid in services and mat- erials furnished. Mr, Ed Holden, City Planning Advisor, explained the processes of subdividing and that all required provisions had been made and approved by the various departments of the County and the sub- divider has met all requirements imposed by the City including posting of various bonds guaranteeing completion of streets, sewers, surveying, etc., and the final tract map is now submitted to the Council. When City requirements were completed the City agreed to vacate the easement within the tract, and to grant change of zone from A -1-1 acre to R -1. He recommended the change of zone be completed prior to recording. The subdivider is com- mitted by final map and bonds for commitment pending only upon acceptance of the tract for recording and acceptance of these streets as public streets. First he recommended vacation of the easement. Councilman Tyrell moved to adopt Resolution No 61® 165 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF. TEMPLE CITY CALIFORNIA VACATING EASEMENT WITHIN TRACT 26522 PURSUANT TO ORDINANCE NO, 61 -43 AND PUBLIC SERVICE EASEMENTS VACATION LAW, Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn,-Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen-None City Attorney Shatford read in full Ordinance No 611.9 titled AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, GRANTING A ZONE CHANGE OF TRACT NO, 26522 FROM A-1 -1 to R-1 ZONING which he recommended should be adopted as an urgency ordinance at this time. Councilman Tyrell moved to adopt Ordinance No, 61 -49, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None Mr. Holden read a letter from the County Engineer recommending approval of the map and acceptance of dedications of streets and approval and acceptance of the work agreements and bonds covering installation of sanitary sewers, setting of survey monuments, tie points and furnishing tie notes, and agreement to construct a masonry wall. Council Buchan moved that the Tract Map No. 26522 be approved, that the bonds be accepted, and letters of agreement be approved, and there be accepted on behalf of the public the street and avenue shown thereon for highway purposes, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen-None ABSENT: Councilmen -None 10. ORDINANCE NO, 61- 43- Relating to discharge of firearms and use of bow and arrows: City Attorney Shatford read title to Ordinance No, 61-48 AN ORD i NANCE OF THE CITY COUNC I L OF THE CITY OF TEMPLE CITY, CALIFORNIA, RELATING TO THE DISCHARGE OF FIREARMS AND USE OF BOWS AND ARROWS, Councilman Buchan moved to waive further reading of Ordinance No. 61 -48, Councilman Fitzjohn seconded. City Attorney Shatford stated this had been added to the County Ordinance. After discussion the roll call vote was as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen-None. As this was the 1st reading no further action was taken. Chernikoff City Manager Woollett acknowledge receipt of the appeal but it cannot be heard until the next meeting when the recommendations of the Planning Commission will be presented to the Council. Councilman Tyrell moved to table, Councilman Merritt seconded, and carried. 13. REGULAR COUNCIL MEETING OF OCTOBER 23, 1961- Discussion, This meeting will come during the conference of the League of California Cities held in San Francisco and as the Council mem- bers are attending another date was considered with a decision to be determined at the next Council meeting. 14, APPOINTMENT OF PERMANENT MEMBER TO LIBRARY COUNCIL. Mayor Dickason appointed Councilman Lou Merritt as a permanent member to the Library Council from the City which he accepted, 15. RESOLUTION NO, 61 -164 Temple City Improvement Dist. #1-institu- tion of proceedings for construction of Sanitary Sewers; Mr. Bravender, Regional Engineer for the County Engineers office, stated last June the City Engineer prepared this petition which was circulated for signatures and 65% of the property owners have signed up. Resolution No, 61-164 provides for initiation of pro- ceedings, City Manager Woollett read title to Resolution No. 61-164 A RESOLUTION INSTITUTING PROCEEDINGS ACKNOWLEDGING WAIVER OF DEBT LIMIT INVESTIGATION PROCEEDINGS AND DIRECTING PREPARAu TION OF PLANS AND SPECIFICATIONS. He explained if passed the Engineer will be instructed to prepare plans and specifications, the cost for which including inspection would be charged to the improvement district and when final costs are completed assess- ment will be made by the engineer and the entire cost will be against the people who have requested the improvement. If not paid after 30 day period assessment will go to bonds for 10 yrs. at 6% which will be a lien against the property. Councilman Fitzjohn moved to adopt Resolution Nov 6i -i64, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen—None ABSENT: Councilmen -None l6, RESOLUTION N0. 6i- 161 - Warrants & Demands Nos, 798 through 822 in the sum of $20,097,71 Councilman Fitzjohn moved to adopt Resolution No, 61-161, Coun- cilman Buchan seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyreli, Dickason NOES: Councilmen- -None ABSENT: Councilmen -None 17. COMMUNICATIONS: A. Boundary Commission, County of Los Angeles, proposed annexa- tion #26, El Monte, Councilman Tyreli moved to receive and file Councilman Buchan seconded and carried. B. City Manager Woollett read a letter from the Metropolitan Transportation Engineering Board requesting re-affirmation of primary objective of expedition of construction of freeway system. Councilman Tyrell moved to receive and file, Council- man Buchan seconded and carried. C. City of La Mirada: City Manager Woollett read a letter from the City of La Mirada urging consideration of their Resolu- tion No, 6-150 .urging tax relief as to fall out shelters, City Attorney Shatford was instructed to draw a similar res- olution for the City of Temple City and present it at the 197 Council Minutes, September 25, 1961, page 4 next Council meeting. D. City Manager Woollett read a letter from the City of Arcadia regarding supplemental water supply. He recommended the Council receive and file the report and to ask the staff for a recommendation on it. Councilman Merritt so moved, Councilman Tyrell seconded, and carried. E. City Manager Woollett read a letter from the Circle of Hope Auxiliary requesting the Mayor proclaim Nov. 6 to 13 as "City of Hope" week for their fund raising campaign. Mayor Dickason with the consent of the Council so proclaimed. F. City Manager ,Woollett stated he had two letters of thanks to the Fire Dept. Councilman Tyrell moved to refer them to the Fire Dept., Councilman Buchan seconded and carried. G. Mayor Dickason presented a letter for Mr. Woollett to read from Governor Brown pertaining to Civil Defense. Councilman Buchan moved to refer to the Civil Defense Committee, Coun- cilman Fitzjohn seconded, and carried. H, Mayor Dickason also read a letter from Mrs. John Weller, Pres, of the P. T. A. stating the week of Oct. 2 was Pa T. A. membership week and requesting cooperation of the City. 1. The Mayor also presented a letter from the Duarte Chamber of Commerce regarding the gambling situation and asking for a letter of support from Temple City. As this had been con - sidered previously it was referred to Mr. Woollett to check. J. Mayor Dickason also read a letter from the Temple City Busi- nessi& Professional Womens Club, Mrs. Violet Lewis, Presi- dent, requesting that the week of October 1 - 7 be proclaim- ed National Business Womens ;Week. Councilman Buchan moved to so proclaim, Councilman Merritt seconded and carried. K, The Mayor read a letter from the San Gabriel Committee for the Physically Handicapped requesting Oct, 1 - 7 be pro - claimed. Physically Handicap Week. Councilman Tyrell moved to file, Councilman Buchan seconded and carried. 18. TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO ADDRESS THE COUNCIL:, Mr. A. L. Nunamaker, 9549 Las Tunas, Stated he felt if the Coun- cil had taken no action regarding the gambling threat in Duarte he felt some positive action should be taken as it affectsthe whole San Gabriel valley. Councilman Fitzjohn stated City Mana- ger Woollett would check and this could be acted on at the next meeting. Rev, Lyman Ellis of St. Pauls Methodist Church, expressed appre- ciation to the Council for the services and capabilities of our City Manager at a recent meeting at their church, 19. MATTERS FROM CITY OFFICIALS: The benefits derived from memberships in the League of Calif. Cities and Contract Cities of Calif. was discussed. Councilman Fitzjohn reminded the Council members of Masonic Orders in the area sponsorship of a program on Citizenship to be held at the Monrovia - Duarte High School on October 16 and urged all to attend. City Attorney Shatford presented Resolution No, 61-166 which he read in full titled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, APPOINTING THOMAS G, LUMSDON AS ASSISTANT CITY ATTORNEY. Councilman Tyrell moved to adopt Re- solution No. 61 -166, Councilman Buchan seconded, roll call vote as follows: AYES, Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None City Manager Woollett read a letter from the Purchasing it Stores Dept. of the County of Los Angeles regarding a joint purchasing program which he recommended the Council participate in as the program, is voluntary and we are not binding ourselves, and that the Council authorize the purchasing agent to participate in such a program as an additional option. 198 Council Minutes, September 25, 1961, page 5 Councilman Buchan so moved, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES; Councilmen -None ABSENT: Councilmen -None 20, ADJOURNMENT: Councilman Fitzjohn moved moved to adjourn, Councilman Buchan seconded and carried, with the meeting adjourned at 9:30 P.
