CITY OF TEMPLE CITY TEMPLE CITY, CALIFORNIA MINUTES OF REGULAR MEETING OCTOBER 9, 1961 INITIATION: The regular meeting of the City Council of the City of Temple City was called to order by Mayor Dickason at 7:30 P. M., who led the Pledge of Allegiance to the Flag. INVOCATION: Invocation was given by Rev,, Lyman B. Ellis of St. Paul Metho- dist Church, Temple City, ROLL CALL: PRESENT: Councilmen-Buchan, Fitz_iohn, Merritt, Dickason ABSENT: Councilmen-Tyrell ALSO PRESENT: City Attorney Shatford and City Manager Woollett, 5, APPROVAL OF MINUTES: Councilman Buchan moved the minutes of the regular meeting of September 25, 1961, be approved as mailed, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen-None ABSENT: Councilman-Tyrell 6. UNFINISHED BUSINESS: ORDINANCE NO. 61-48: Discharge of firearms and bows and arrows: City Attorney Shatford read in full Ordinance No. 61-48 titled AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, RELATING TO THE DISCHARGE OF FIREARMS AND USE OF BOWS AND ARROWS, 2nd reading, Following discussion Councilman Fitzjohn moved to adopt Ordinance No. 61-48, Councilman Merritt seconded. City Manager Woollett read a letter from R, A, Brisco of 5817 N. Oak stating his objections to bows and arrows; air rifles and b-b ®guns being permitted under any circumstances, Roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman'Tyre11 7, DUARTE CHAMBER OF COMMERCE: Request for support vs. establish- ment of legalized gambling in Duarte. City Manager Woollett stated research into prior action showed on June 12 the Council received a communication from the Duarte City Council with their Resolution No. 61 ®44 declaring its opposition to gambling in said City. He also advised Councilman Fitzjohn moved to support the City's action, seconded by Councilman Merritt and supported by four out of five Councilmen present. Following discussion City Attorney Shatford advised many cities on motion have author- ized the Mayor to write the Chamber of Commerce expressing the City's opposition to legalized gambling as long as it will ef- fect the whole valley. Councilman Tyrell arrived at this time. Councilman Fitzjohn moved that a letter be drafted and signed by the Mayor that we are definitely against legalized gambling, Councilman Buchan seconded. Councilman Tyrell was opposed as� he felt Duarte should resolve this on their own behalf, Roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen-None 8, ZONE VARIANCE CASE NO. 6121: Alex E. Chernikoff, 1. Planning Commission recommend denial. 2. Letter of appeal to Council from Mr. Chernikoff, The City Attorney explained what legal consideration could be given to appeal and Mr. Holden from Regional Planning Commission explained the reasons for the request, reasons in favor and also 200 Council Minutes, October 9, 1961, page 2 conditions he felt the Council should consider. After consid- erable discussion Councilman Tyrell moved that the variance be granted subject to conditions as follows: 1, that they have a 5 ft, set back from property lines 2, that property be retained in one parcel 3. that he have a one unit garage or carport 4, that he will execute an agreement with the City that he will dedicate the necessary footage for a public street, and that he will be counted in favor of a public street 5,, and that the property will be developed according to the plot plan with one exception being 5 ft. set -back. Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen-Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None Mr, Chernikoff asked to speak at this time and gave a resume of his request to date, Also Mr. Woollett prior to the voting read Mr. Chernikoff's letter of appeal to the Council and pre -' sented a petition signed by 32 individuals requesting the Counc. cil grant this permission to build to the Chernikoffs. 9, SAN GABRIIEL VALLEY SYMPHONY ASSN. Request for support by Mr. Bowlby, 6455 N. Loma, Temple City. Mr. Bowlby presented a request for financial support by the City of Temple City. Following considerable discussion Mr. Bowlby was advised to present his request about next April at which time study sessions begin pertaining to the new budget. Coun- cilman Merritt moved to offer a token amount of $100,00 at this time and consideration be given at budget time for next year, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Dickason NOES: Councilman-Tyrell ABSENT: Councilmen -None 1 1 , NEW BUSINESS: ORDINANCE NO, 61-50: Amending Ordinance 60.23 re automobile parking. .Introduction. City Attorney Shatford explained some of the zoning was not included in original ordinance and this also clarifies parking, Councilman Tyrell moved to waive further reading, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None As this was the first reading no further action was taken, 12. RESOLUTION NO, 61 -168: Warrants and Demands. Following discussion Councilman Tyrell moved to adopt Resolution Nom 61 -1668, warrants and demands in the sum of $13,951.99, and numbers 823 through 859, Councilman Fitzjohn seconded, roll: call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 100 RESOLUTION NO. 61 -167: Urging tax relief as to fallout shelters, City Attorney Shatford read title to Resolution No. 61 -167, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY URGING TAX RELIEF AS TO FALLOUT SHELTERS. Councilman Tyrell moved to waive further reading and to adopt, Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason. NOES: Councilmen -None ABSENT: Councilmen -None 13e RECOMMENDATIONS OF TRAFFIC COMMISSION. I. Requested stop sign at Cloverly & Gidley, Planning Commis- sion recommend denial of stop sign and to recommend to City Council placement of a couble stripe center line for a dis- tance of 125 ft. on Cloverly. 201 Council Minutes, October 9, 1961, page 3 3. Requested crossing guard, stop sign: Temple City Blvd, & La Rosa. Recommend advanced pavement markings to indicate speed limit be placed on Temple City Blvd, and La Rosa. Councilman Tyrell moved to adopt the recommendations #1 and #3 of the Traffic Commission, Councilman Fitzjohn seconded, and carried by the following roll call vote: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 2. Deployment of Crossing Guards: Recommend removal of cross- ing guard at Live Oak and Cloverly, and that temporary cross - ing guard at Cloverly and Olive remain until additional study is made at this intersection. Following discussion Councilman Merritt moved recommendation #2 of the Traffic Commission be approved, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 4. Requested tuthill panel: Kauffman south of .Sparklett St. Recommend installation of a tuthill panel at end of non- dedicated portion of Kauffman, and installation of sign reading "End of Dedicated Roadway" Following discussion Councilman Buchan moved that the City Attorney be instructed to investigate the possibilities of this request and report back at the next meeting, Councilman Tyrell seconded and carried, 14. COMMUNICATIONS: A. .City Manager Woollett read a letter from the State Control - ler requesting title of officer responsible for signing the state report to the state controller. Councilman Tyrell moved to designate the City Manager as the official responsible for signing and filing the state report to the State Controller, Councilman Buchan seconded, and carried. B. A letter of commendation re the Fire Dept. was read from Mrs, Lucille Oldenburg, Councilman Tyrell moved to refer to the Fire Dept., Councilman Buchan seconded and carried. 15. TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO ADDRESS THE COUNCIL: Mr. John Hackney, 5210 !Wilmonte, Temple City, spoke against the ordinance as originally drawn re archery. He was given a copy of the Ordinance as passed and amended. 16. MATTERS FROM CITY OFFICIALS: Mayor Dickason read a letter of request that Oct, 16 -23 be pro- claimed as Community Chest Week. Councilman Fitzjohn moved to allow the Mayor to so proclaim, Councilman Buchan seconded, and carried. City Manager Woollett reported he was meeting on Tues, with mem- bers of Santa Anita Race Track re provisions for race track traffic. Also reported on the conference with Mr. Whitnall re Master Plan. In addition to land use survey will be a marketing survey and recreational desires. They expect to have this done by Nov. 1. City Manager Woollett read a letter from Swenson, Clark & Co. advising Mr. James S. File is no longer associated with the Co, and also a letter from Mr. File so stating. He recommended that the City retain Mr. File to do the monthly work and then contact other firms and select a firm for the annual audit: Following discussion Councilman Tyrell so moved, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 202 Council Meeting, October c, 1961, page 4 City Manager Woollett reported back to the Council re telephone services at the City Park and, City Hall. Following considerable discussion re installation and comparative costs Councilman Tyre11 moved a switchboard be installed, and also two public telephone booths, one at Live Oak Park, and one in the vicinity of the Library and Fire Station, Councilman Merritt seconded, roll call vote as follows AYtS: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None Also as the Council will be attending the Conference of the League of Calif. Cities in San Francisco on the date of the next regular meeting it was decided to adjourn this meeting until the 20th of October, Friday, in the City Hall. Mayor Dickason asked regarding the Community Center and was ad- vised by Mr, Woollett that Supervisor Bonelli was asked for .a recommendation on it. The City Manager also reported on the street lighting that Edison Co, had asked for an extension due to difficulty in getting some of the necessary equipment but that the City will be notified 10 days in advance re installation, 17. ADJOURNMENT: Councilmen Buchan moved to adjourn until Friday, October 20, 1961, at 7 :30 P. M, at the City Hall, 9664 E.
