M., who 2, led the Pledge of Allegiance to the Flag. 3. INVOCATION: Invocation was given by Elder Harold Calkins, 7th Day Adventist Church, 9664 Broadway. 4, ROLL CALL: PRESENT: Councilmen - Fitzjohn, Merritt, Tyrell, Dickason ABSENT: Councilman - Buchan ALSO PRESENT: City Attorney Shatford and City Manager Woo1lett4 APPROVAL OF MINUTES: Councilman Merritt moved to approve the minutes of the regular Council Meeting of October 20, 1961, as mailed, Councilman Fitz- john seconded, roll call vote as follows: AYES: Councilmen-Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilman-Buchan ORDINANCE NO, 61-52: City Attorney Shatford read title to Ordi- nance No, 61-52 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, REGULATING THE PLANTING AND MAINTENANCE OF STREET TREES: REQUIRING PERMITS FOR THE PLANTING, PRESERVA- TION AND REMOVAL IN PUBLIC PLACES. There followed considerable discussion regarding various changes suggested, City Attorney Shatford will re -do the ordinance incorporating various changes and submit it for re- introduction at the next regular meeting, 7. ORDINANCE NO, 61 -53: City Attorney Shatford read title to Ordi- nance No, 71 -53 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, REGULATING STREETS AND SIDEWALKS IN THE CITY OF TEMPLE CITY, He stated this was basically aimed at sign:. on the sidewalks which are increasing daily, The question of draining swimming pools into the street and placement of bicycle stands on the sidewalk were discussed. The City Attorney will rewrite the ordinance including these two items. 8, ORDINANCE NO, 61 -51: AN ORDINANCE OF THE CITY COUNCIL OF THE C17' OF TEMPLE CITY, CALIFORNIA, ESTABLISHING A PERSONNEL SYSTEM, Councilman Tyrell recommended this for further study. City Attorney Shatford stated the staff has done a lot of work but felt the Council would want to study it over at some length, it was agreed that this be held over for more study before intro- duction. ORDINANCE NO. 61 -5k City Attorney Shatford read title to Ordinance No, 61 -54 AN ORDINANCE TO AMEND THE UNIFORM LOCAL SALES AND USE TAX ORDINANCE. He explained this was drafted by the League of Calif, Cities in connection with the Board of Equ- alization to correct the law relating to where there would be a double tax, and actually all this does is to clarify the law of the State of California, Councilman Tyrell moved to waive fur- ther reading of Ordinance No. 61 -54, Councilman Fitzjohn second- ed, roll call vote as follows: AYES: Councilmen- Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: councilmen - Buchan As this was the first reading no further action was taken. 208 Council Minutes, November 13, 1961, page 2 10. RESOLUTION NO, 61 -174: AUTHORIZING EXECUTION OF AGREEMENT FOR JAIL SERVICES. The City Attorney explained this agreement and resolution as clarifying the present arrangements regarding medical, surgical and hospital treatment of prisoners. He then read title to Resolution No. 61 -174 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT ;WITH THE COUNTY OF LOS ANGELES FOR THE HOSPITALIZATION OF CITY JAIL PRISONERS IN THE JAIL WARD OF THE COUNTY GENERAL HOSPITAL. Councilman Tyrell moved to adopt Resolution No. 61 -174, Councilman Merritt second- ed, roll call vote as follows: AYES: Councilmen - Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen- Buchan 11. RESOLUTION NO, 61 -175: 4ARRANTS & DEMANDS IN THE SUM OF $21,059,02 DEMAND NOS. Councilman Tyrell moved to adopt Resolu- tion No, 61 -175, Councilman Fitzjohn seconded, roll call as fol- lows: AYES: Councilmen - Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen- Buchan l2. RECOMMENDATIONS FROM PARKS & RECREATION COMMISSION. Councilman Tyrell requested these recommendations be held over for further study to which the Council agreed. 13. ORDINANCE NO. 61 -56: Amending the Municipal Code to establish the City Manager in charge of Plot Plan Approval. City Manager Woollett explained this was to expedite plot plan approval and to relieve the Chairman of the Planning Commission by having the approval given by the City Manager or such members of the staff he may designate. City Attorney Shatford read title to Ordin- ance No, 61 -56 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, AMENDING THE MUNICIPAL CODE OF THE CITY OF TEMPLE CITY TO ESTABLISH THE CITY MANAGER IN CHARGE OF PLOT PLAN APPROVAL, Councilman Tyrell moved to waive further reading of Ordinance No, 61 -56, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen- Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT Councilmen- Buchan As this was the first reading no further action was taken 14. RECOMMENDATIONS FROM TRAFFIC COMMISSION: 1. Cloverly & Olive - removal of temporary crossing guard recommend ed. City Manager Woollett read letters from Mrs. Thomas Niemeyer; Safety Chairman, Cloverly P. To A., Mayne Utterson Principal of Oak Ave. School, Wilbur Hawkins, Principal of Cloverly School, and H. B. Beckner, Supt. of Schools, requesting the continuation of the crossing guard services at Cloverly and Olive,. Following discussion Councilman Tyrell moved to refer this back to the Traffic Commission for further study, Councilman Fitzjohn second- ed, and carried. 2. Additional Traffic Control devices: Live Oak to Lower Azusa, & El Monte Ave, to Double Drive. 3„ Olive Street to Lower Azusa, & Temple City Blvd, to Baldwin Ave,: Additional Traffic Control devices. 4„ Removal of one hour parking restrictions Trelawney St, south of Lemon, 5. Installation "No Parking" zone Temple City Blvd, on bridge south to railroad right of way. 6. Installation of single skip center line Olive St. & Rosemead Blvd. to El Monte Ave. 7, Installation of Pedestrian Crosswalks north and south line of Las Tunas Dr, in Baldwin District. Following discussion Councilman Fitzjohn moved to approve items 2 through 7 listed above, Councilman Merritt seconded, roll call vote as follows: 209 Council Meeting, November 13, 1961, page 3 15. AWARD PRESENTATION® CALIFORNIA CITIES EMPLOYEE SAFETY CONTEST- League of Calif, Cities and. State Compensation Insurance Fund, The City Manager announced that he had been requested to hold this over until the next Council meeting. i6. COMMUNICATIONS: L. A. County Boundary Commission, City of So, E1 Monte, proposed Annexations Nos. 13, 19, 22, 23 & 2L.. Councilman Tyrell moved to receive and File, Councilman Merritt seconded; and carried. 17, City of Hermosa Beach: Resolution #2388 Condemning Soviet Union for Resumption of Nuclear Testing. Councilman Fitzjohn moved to receive and file; Councilman Merritt seconded and carried, 18, American Cancer Society: City Manager 'Woollett read a letter from the American Cancer Society requesting April, 1962, be de- sisnated as Cancer Control Month, and also for a charitable solicitation permit for that month. Councilman Tyrell moved to grant the request, Councilman Fitzjohn seconded, and carried, 19. Junior Women's Club of Temple City: City Manager Woollett read a letter from the Junior Women's Club requesting a charitable solicitation permit for the campaign against Muscular Dystrophy„ and that a Proclamation be made for the week of November 26 to December as Muscular Dystrophy Week in Temple Cith, Councilman Fitzjohn moved to approve the proclamation and request for soli- citation, Councilman Merritt seconded and carried, 20, City Manager Woollett read a letter from Mr, Waiter B. Powell 772 Mirada P1., Altadena, who was concerned in respect to our Ordinance No. 61 ®48 restricting archery and requesting the Coun- cil to reconsider it, Mr. Powell was in the audience and spoke in support of his requests Following considerable discussion and as non of the complaints were from citizens of Temple City the Council decided the ordinance should stand as is 21, City Manager Woollett read a letter from Ray G. Fortner regard - ing the pigeon problem in Temple City, Councilman Merritt moved the staff come up with recommendations to alleviate this problem, Councilman Fitzjohn seconded, and carried. 22, Lloyd A. Walters: Non- Military War. City M..nagerWoolle't read a letter from Lloyd A. Walters, 4211 Rio Hondo Ave., Rosemead, regarding the Cold War against Communism. Councilman Tyrell moved to file, Councilman Fitzjohn seconded, and carried. TIME RESERVED FOR THOSE I N THE AUDIENCE WHO °:fl SH TO ADDRESS THE COUNCIL: No one came forward to address the Council. 24, MATTERS FROM CITY OFFICIALS: Councilman Tyrell requested all mail addressed to the City Coun- cil or Mayor be kept in a circulating file in the City Hall available to all Councilmen so they may be informed prior to the Council meetings and thus eliminate time consumed at meetings for letters not to be considered. This was agreed to and copies of any letters addressed to the Mayor and Council letters will be handled in this manner. The Councilmen each gave a short report on the meetings attend- ed at the League of California Cities Conference in San Francis- co City Manager Woollett read a letter from the Board of Supervise, ors requesting an expression of views as to whether or not an election should be called regarding the question of fall -out shelters. Following discussion it was decided to refer this to the Civil Defense Committee for a recommendation to be returned at the first meeting in December. 210 1 1 Council Meeting, November 13, 1961, page 4 Councilman Tyrell reported on the progress of the Civil Defense Committee and that they were trying to develop a .good plan for our City and it would protect our City. City Manager Woollett stated they hoped to make a comprehensive report to the Council the first meeting in December. City Manager Woollett reported from the Camellia Festival Com- mittee a request to modify our ordinance to control vendors from outside of the City. Youth groups, etc., of the City could sell these things and help raise funds for their own benefit. City Attorney Shatford stated we can restrict vendors to members of service organizations or youth groups which have been in the City three to five years. Councilman Fitzjohn made a motion that the City Attorney draw up an ordinance to this effect to restrict vendors to Temple City organizations, Councilman Merritt seconded and carried. Mayor Dickason read a letter from the Boy Scouts of America requesting December 2, be proclaimed as GOOD TURN DAY„ With agreement of the Council the Mayor so proclaimed. City Manager Woollett requested authorization to purchase the legal file for the Councilmen a Councilman Merritt so moved, Councilman Tyrell seconded, roll call vote as follows: AYES: Councilmen - Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen-None ABSENT: Councilman- Buchan 25. ADJOURNMENT: Councilman Tyrell moved to adjourn at 10 :30 P. M. until Tuesday November 14, 1961, at 7 :30, in the City Haifa Councilman Merritt seconded, and carried, ATTEST: 211
