INITIATION: The regular meeting of the City Council of the City of Temple City was called to order by Mayor Dickason at 7:30 P. M., who 2. led the Pledge of Allegiance to the Flag. 3. INVOCATION: Invocation was given by Pastor Merrill Byington of the Re- Organ- ized Church of Jesus Christ of Latter Day Saints, 9458 Broadway. 4. ROLL CALL: Councilmen PRESENT: Councilmen - Fitzjohn, Merritt, Tyrell, Dickason ABSENT: Councilman- Buchan ALSO PRESENT: City Manager Woollett, & City Attorney Shatford, 5. APPROVAL OF MINUTES: 1. Minutes of Nov. 13, 1961. Item 6, Ordinance No. 61 -52 page 4, section 3806, sub. 1, Method of Service. Councilman Tyrell objected to publication as being one method. Councilman Fitzjohn moved to leave this method in the ordinance, Council- man Merritt seconded, roll call vote as follows: AYES: Councilmen - Fitzjohn and Dickason NOES: Councilmen- Merritt and Tyrell ABSENT: Councilman- Buchan Councilman Fitzjohn moved to approve the minutes of November 13, 1961, as mailed with above addition. Councilman Buchan arrived at this time. 2. Minutes of November 14, 1961, adjourned meeting. ORDINANCE NO. 61 -52. City Attorney Shatford read title to Ordi- nance No. 61 -52 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, REGULATING THE PLANTING AND MAINTENANCE OF STREET TREES: REQUIRING PERMITS FOR THE PLANTING, PRESERVATION AND REMOVAL IN PUBLIC PLACES. ORDINANCE NO. 61 -53. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, REGULATING STREETS AND SIDEWALKS IN THE CITY OF TEMPLE CITY. ORDINANCE NO. 61 -51. City Attorney Shatford read title to Ordinance No. 61 -51 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, ESTABLISHING A PERSONNEL SYSTEM. Councilman Tyrell moved to waive further reading, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None Councilman Tyrell commented on Section 21, page 11, that he felt a right of termination clause should be included when after a certain length of time an employee does not return to work. Also Section 34 regarding jury duty that an- employee be relieved of jury duty if the City feels his work time necessary in the best interests of the City. The City Attorney will incorporate these changes in an ordinance amending these sections. City Attorney Shatford read title to Ordinance No. 61 -55 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, REGULATING THE CONDUCT IN PUBLIC PARKS: PROVIDING FOR ENFORCEMENT THEREOF: AND PRESCRIBING PENAL TIES FOR THE VIOLATION OF ITS PROVISIONS. Councilman Tyrell moved to waive further reading of Ordinance No, 61 -55, Council- man Buchtm seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None Councilman Tyrell requested clarification of part c of Section 3704 regarding costume, and also page 6, section 3705 part 3 regarding dogs in the park. The City Attorney will so do. City Attorney Shatford read title to Ordi- nance No, 61 -56 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, AMENDING THE MUNICIPAL CODE OF THE CITY OF TEMPLE CITY TO ESTABLISH THE CITY MANAGER IN CHARGE OF PLOT PLAN APPROVAL. PRESENTATION OF AWARD CERTIFICATE: Mr. Hinckley of the State Compensation Insurance Fund, and also representing the League of California Cities, thanked the City for participating in the Safety Contest completed June 30, 1961, with no disabling injuries, and presented an award certificate to the City, which was accepted by Mayor Dickason on behalf of the City. 13. \'!ARRANTS & DEMANDS: Resolution No. 61 -176, in the sum of $3277.17 nos, 342 through 964. Councilman Tyrell moved to adopt Resolu- tion No. 61 -176, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 14. ORDINANCE NO. 61 -57. City Attorney Shatford read title to Ordi- nance No. 61 -57 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY CHANGING TRAFFIC REGULATIONS RELATIVE TO THE INTER- SECTION AT LAS TUNAS DRIVE AND TEMPLE CITY BOULEVARD ON JANUARY 26, 1962, BETWEEN THE HOURS OF 2 :00 P. M. AND 6:00 P. M. ONLY, AND GRANTING CERTAIN LIMITED STREET USE ON LAS TUNAS DRIVE FOR THE TEMPLE CITY KIWANIS CLUB MARCH OF DIMES CAMPAIGN, AND CERTAIN LIMITED SOUND CAR USE IN CONNECTION WITH THE "MOTHERS MARCH" OF THE MARCH OF DIMES CAMPAIGN IN TEMPLE CITY. Councilman Tyrell moved to waive further reading, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None. As this was a first reading no further action was taken. Mayor Dickason read a complaint entered through the Chamber of Commerce opposing the collection at the intersection considering it a safety hazard and poor public relations for the City, and also considering the heavy race track traffic at this time of the year. The following were complainants: Joe Crelago of Vernons Mr. Rhyasberger of \\Ioodruffs Mr. Stoppel of Stoppels Store Mr. Braeger of Braegers Store Mr. Teitelbaum of the Band Box Asst. Mgr. of Leibergs Discussion followed regarding the intersection and City Attorney Shatford will amend closing left turn out lanes and prohibit left hand turns for the east -west flow. Councilman Fitzjohn moved to waive further reading as amended, Councilman Tyrell seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None II15. ORDINANCE NO. 61 -58. City Attorney Shatford read title to Ordi- nance No. 61 -58 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, _CALIFORNIA, AMENDING THE TEMPLE CITY MUNICIPAL CODE BY ADDING TO ARTICLE IV, CHAPTER 4, SECTIONS 4450 THROUGH 4467 RELATING TO DEFINING, REGULATING AND LICENSING PEDDLERS AND PRO- VIDING PENALTIES FOR THE VIOLATION THEREOF. The City Attorney explained he believed this ordinance to be a proper one and that it is best to provide an Ordinance as a permanent one as the code prohibits any peddlers except with consent of the City Council. This ordinance defines what a peddler is, sets forth in more de- tail what application must contain, states organizations eligible and who else can qublify for a' peddler °s license. Would also 216 1 Council Minutes, November 27, 1961, page 4 make provision in event license was misused so there could be a hearing to determine whether it should be revoked. There followed considerable discussion regarding people with reoular routes such as milk men, Helms man, Fuller Brush man, Good Humor man, etc. and it was decided that the City Attorney will make amendments and present for the first reading at the next Council meeting. 16. COMMUNICATIONS: 1. Mayor Dickason read a letter from the 7th Day Adventist Church signed by Elder H. Calkins requesting permission to sing Xmas carols and solicit gifts for their welfare and mission work in the City of Temple City between Dec. 2 and Dec, 25. Councilman Fitzjohn moved to approve, Councilman Tyrell seconded and carried. 2. The Mayor also read a letter from the Cudahy Improvement Assn. requesting the City by resolution to support efforts requesting Governor Brown to approve and include in the special budget session starting in February, the outlawing of draw poker and low ball draw poker in California. Following discussion Councilman Fitzjohn moved that the City Attorney be instructed to draw us such a resolution, Council. man Merritt seconded and carried by the roll call vote as follows: AYES: Councilmen-Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen -None ABSENT: Councilmen -None 3. Mayor Dickason read a letter from Aleene Herchman, Ch. of PROJECT ALERT, School of Anti - Communism, presented by the Navy League and the Marine Corps League Dec. 11 thru Dec. '5. She requested that this week be proclaimed as PROJECT ALERT WEEK. Councilman Merritt moved the Mayor make the proclamation, Councilman Tyrell seconded and carried. 17. TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO ADDRESS THE COUNCIL: At this time Rev. Walker addressed the Council expressing his deep appreciation of the plaque presented him by the City. Mayor Dirk re=plied and wished him God Speed in behalf of the Council. Mr, Warren Bohnke, 10037 Bogue St. addressed the Council in regard to installation of lights and type of poles that were being used, stating the homeowners in the area were opposed to the poles being used and were interested in some means of having metal poles of some type. Mayor Dickason explain- ed the City had budgeted money for the lights but did not feel the City could install the metal poles which cost in the vicinity of $125. each, and also when the budget meetings were held there was no expression from the citizens in the area regarding the improvement. Work on the project is stopped and before anything further is done City Manager A'oollett will contact the people in the area and go from there. 18. ADJOURNMENT: Councilman Tyrell moved to adjourn, Councilman Fitzjohn seconded, and carried. Council adjourned at 9:30 P. M. until the next regular meeting on December 11, 1961, at the City Hall.
