INITIATION: The regular meeting of the City Council of the City of Temple City was called to order by Mayor Dickason at 7:30 P. M., who 2. led the Pledge of Allegiance to the Flag. 3. INVOCATION: Invocation was given by Rev. Roger Hillis, of Westminster Pres byterian Church, 9642 Live Oak Ave., Temple City., 4. ROLL CALL: PRESENT: Councilmen - Buchan, Fitzjohn, Merritt, Dickason ABSENT: Councilmen- Tyrell ALSO PRESENT: City Attorney Shatford & City Manager Woollett 5. APPROVAL OF MINUTES: Councilman Buchan moved to approve the minutes of the regular meeting of November 27, 1961, as mailed, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman - Tyrell 6. UNFINISHED BUSINESS: ORDINANCE NO. 61- 57 -- -2nd reading. City Attorney Shatford read title to Ordinance No. 61 -57 AN ORD- INANCE OF THE CITY OF TEMPLE CITY CHANGING TRAFFIC REGULATIONS RELATIVE TO THE INTERSECTION AT LAS TUNAS DRIVE AND TEMPLE CITY BOULEVARD ON JANUARY 26, 1962, BETWEEN THE HOURS 0F2:00 P. M. AND 6:00 P. M. ONLY, AND GRANTING CERTAIN LIMITED STREET USE ON LAS TUNAS DRIVE FOR THE TEMPLE CITY KIWANIS CLUB MARCH OF DIMES CAMPAIGN, AND CERTAIN LIMITED SOUND CAR USE IN CONNECTION WITH THE "MOTHERS MARCH" OF THE MARCH OF DIMES CAMPAIGN IN TEMPLE CITY. Councilman Fitzjohn moved to waive further reading, Coun- cilman Buchan seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman - Tyrell Councilman Buchan moved to adopt Ordinance No. 61 -57, Councilmar Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman - Tyrell 7. ORDINANCE NO. 61 -58 re- Peddlers Business License. City Attorney Shatford reported that the Municipal Code covers what this ordi- nance was prepared to require, and unless something more proved to be necessary it can be held in abeyance. Following discussio, Councilman Fitzjbhn moved to direct the City Manager to enforce the provisions of Section 4263 of the-Municipal Code In lieu of No. 61 -58, Councilman Merritt seconded, roll call vote as follow. AYES: Councilmen -E- uchan, Fitzjohn, Merritt, Dickason ALOES: Councilmen -None ABSENT: Councilman - Tyrell 8. RESOLUTION NO. 61 -178. City' Attorney Shatford read title to Resolution No. 61 -178 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, SUPPORTING LEGISLATION TO PRO- HIBIT COMMERCIAL DRAW POKER PARLORS WITHOUT PROHIBITION OF NON- COMMERCIAL DRAW POKER AND LOWBALL GAMES. He advised this action would only affect commercial gambling places. Councilman Fitz- john moved to adopt Resolution No. 61 -178, Councilman Merritt seconded, roll call vote as Follows: 218 Council Minutes, December 11, 1961, page 2 AYES: Councilmen - Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman - Tyrell 9. NEW BUSINESS: ORDINANCE N0. 61 -59 first reading. City Attorney Shatford read title to Ordinance No. 61 -59 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, AMENDING THE MUNICIPAL CODE SECTION 3704 ( 1 ) ( c ) RELATING TO COSTUME WEAR I N PUBLIC PARKS. After reading the ordinance in full he explained this was to clarify the section in the original ordinance. Councilman Mer- ritt moved to waive further reading, Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Dickason NOES: C6 ncilmen -None ABSENT: Councilman - Tyrell As this was the first reading no further action was taken. 10. RESOLUTION NO. 61 -177- WARRANTS & DEMANDS. Councilman Fitzjohn moved to adopt Resolution No. 61 -177, war- rants and demands in the sum of $27,565.45 Nos. 965 through 1007 Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman - Tyrell 11. PROCEDURE FOR CONSTRUCTION OF CURBS, GUTTERS, SIDEWALKS, PAVEMENT & DRIVEWAYS. City Manager Woollett explained the streets & high- ways Code sections 5870 and 5895 which constitute a procedure for construction of curbs and sidewalks apart from special assess ment district construction procedure. This provides for install- ation of curbs and sidewalks by the city and assessing the cost against the property when 50% of the front footage on the block has been constructed, or a petition signed by more than 60% of the owners on the block requesting sidewalk or curb. City Attor- ney Shatford advised this is a state law and is operative here and explained the legal procedure necessary. Following consider- able discussion Councilman Fitzjohn made a motion the property owners be fully advised of the benefits of this law which is theirs if they want to utilize it, Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen-None ABSENT: counci irnan -Tyrel 1 12. INSTALLATION OF NEW TRAFFIC SIGNALS: Las Tunas & Camellia, Las Tunas & Primrose Temple City Blvd. & Olive. City Manager Woollett stated we had received plans and specifica- tions for this installation and the City ,Attorney has drawn up a Resolution which instructs the City Manager to publish notice inviting bids for installation. City. Attoeney Shatford read title to Resolution No. 61 -179 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, INSTRUCTING THE CITY MANAGER TO PUBLISH NOTICE INVITING BIDS FOR INSTALLATION OF TRAFFIC SIGNALS. City Manager Woollett advised the City Attorney would draw the contract and performance bonds would be required, Councilman Merritt moved to adopt Resolution No. 61 -179 and adding that upon opening of bids the City. Manager be authorized to award the contract to the lowest competent bidder, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman - Tyrell 13. APPOINTMENT OF PARKS & RECREATION COMMISSIONER; City Manager Woollett advised the term of Haven Andrist expires on December 26, and recommended the Council either re- appoint him or someone else for a four year term. Following discussion Councilman Fitzjohn moved Haven Andrist be re- appointed as 219 Council Minutes, December 11, 1961, page 3 Parks & Recreation Commissioner for a four year term beginning Dec. 26, 1961, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman - Tyrell PLANNING COMMISSION RECOMMENDATIONS: 1, J. W. Potter- Recommend denial. City Attorney Shatford recommend the Council deny the requesi and affirm the action of the Planning Commission as he fails, to comply with the requirements of making application for a zone variance. Councilman Buchan made a motion to accept the recommendation of the Planning Commission and deny the zone variance request of J. W, Potter without prejudice to him filing on the same property again for either a variance or zone change, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman - Tyrell 2. Donald L. Secres -Zone change request: recommend approval. Mr. Ed Holden, Planning Advisor, stated this should be set for public hearing. Also that the Planning Commission recom- mends approval with conditions easterly 12 feet be dedicated for road purposes and the entire frontage on Arden Drive have curb and gutter installed, and the southerly 6 ft.be used for a drainage easement and pedestrian walkway with the improvements on this easement to be made by the interested property owners after which the City will assume the mainten- ance. Following discussion Councilman Merritt moved that a public hearing be held on Dec. 26 at the City Hall at 7:30 P. M. and that the effected property owners be properly noticed by the staff, Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman - Tyrell 15. TRAFFIC COMMISSION RECOMMENDATIONS: le CROSSING GUARD- Cloverly & Olive: recommend removal. After considerable discussion Councilman Buchan made the motion that we accept the recommendations of the Traffic Commission and that after the traffic light has been install- ed at Olive and Temple City Blvd. that the situation be re- viewed at which time if necessary to correct this action that it can be done at that time, Councilman Fitzjohn second ed. Councilman Merritt moved to amend the motion and add that the guard be left there for 90 days after installation of the traffic signal light. The amendment died for lack of a second and the roll call vote of the original motion was as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT:'Councilman- Tyrell 2. EAST -WEST ALLEY NORTH OF LOWER AZUSA RD.- Recommend closure. Following discussion Councilman Fitzjohn made a motion the City Attorney get a title report before any action is taken, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman- Tyrell 3. LIVE OAK & CLOVERLY- additional crosswalks: recommend three yellow crosswalks at south, east and west lines. Councilman Buchan moved to accept the recommendation of the Traffic Commission, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilmen - Tyrell & Fitzjohn Councilman Fitzjohn had left the Council Chambers prior to this action. 14, 220 Council Minutes, December 11, 1961, page 4 4. LIMIT LINES AT STOP SIGNS - various locations: recommend in- stallation. Councilman Merritt moved to approve the recom mendation of the Traffic Commission, Councilman Buchan se- conded, roll calls vote as follows: AYES: Councilmen- Buchan, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilmen - Tyrell, Fitzjohn 5. COMMISSION RECOMMEND LETTER OF APPRECIATION TO CALIFORNIA HIGHWAY PATROL WITH SPECIAL REFERENCE TO CAPT. PETERS. Councilman Buchan moved that the City Manager be instructed to write the above letter, and to present to Capt. Peters an appropriate token of appreciation, Councilman Merritt seconded, and carried. 16. COMMUNICATIONS: 1. City Manager Woollett read a letter regarding posting of restricted parking signs on Baldwin Ave. from La Rosa to Lower Azusa during the racing season From the Calif. High- way Patrol. After discussion Councilman Buchan made the motion to give the Calif. Highway Patrol permission to post these signs but to make the area From Daines Drive south to Lower Azusa, Councilman Merritt seconded, and carried. 2. City Manager Woollett read a letter From the Temple City Y's Mens Club requesting permission to sell official programs at the Camellia Festival parade. Councilman Merritt moved the Temple City Y's Mens Club be authorized to sell official programs of the Camellia Festival and that a permit be grant- ed so t� do under Section 42630 of the Municipal Code. Coun- cilman Buchan seconded, roll call vote as follows: AYES: Councilmen - Buchan, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilmen- Tyrell & Fitzjohn 3. City Manager Woollett read a letter from the Goodwill Indus- tries of So. Calif. requesting a permit for charitable soli- citation for 1962. Councilman Merritt moved to grant the request, Councilman Buchan seconded. Councilman Fitzjohn returned at this time. Roll call vote as follows: AYES: Councilmen- Buchan, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman- Tyrell ABSTAINING: Councilman- Fitzjohn 17. TIME RESERVED FOR THOSE IN THE AUDIENCE WHO WISH TO ADDRESS THE COUNCIL: At this time Mr. Donald Secres stated it seemed to him that his requested zone change seemed to hinge en the 6 ft. drain across the end of this property. The City Attorney. advised this was not the case and this was only mentioned as an additional fact in the case, and that the public hearing on Dec. 26 will give opportunity for Mr. Secres as well as anyone else interested to be heard. 18. ORDINANCE NO. 61 -60: Re- Garbage containers. City Attorney Shatford read Ordinance No. 61 -60 in full titled AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 8502 OF THE TEMPLE CITY MUNICIPAL CODE, ADDING THERETO A PROVISION REGARDING PLACEMENT OF GARBAGE AND REFUSE CONTAINERS BEFORE COLLECTION THEREOF. He explained this was to set a time limit as to when refuse and garbage containers can be set out prior to collection and that this should be adopted as an urgency or- dinance. Councilman Fitzjohn moved to adopt Ordinance No. 61 -60 as an urgency ordinance, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman- Tyrell PARKS & RECREATION COMMISSION RECOMMENDATIONS: Recommendations of fees, rentals & policy. Councilman Buchan stated he felt ample study has been made 221 Council Minutes, December 11, 1961, page 5 and he moved to adopt the recommendation of the Recreation Com- mission with reference to rules and fees and running of facili- ties, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen- Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman - Tyrell City Manager Woollett read a letter from the telephone company about the installation of a booth at the northwest corner of the County ENgineer's office and the charge would be $150. He advised there are funds available for this although not speci- fically allocated for it. Councilman Merritt moved the City Manager be authorized to spend $150, for installation of a tele- phone booth at the northwest corner of the Engineers Bldg. Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Dickason NOES: Councilmen -None ABSENT: Councilman - Tyrell The City Manager stated he had received a number of letters re- garding proposed annexations none of which affected Temple City. Councilman Fitzjohn moved to receive and file, Councilman Buchan seconded and carried. City Manager Woollett also read a letter from the National Safe- ty Council who recommended the Council pass a resolution urging organizations having parties and celebrations to abstain from th use of intoxicants for the Christmas season. Councilman Buchan moved such a resolution be adopted, Councilman Merritt seconded and carried. Mayor Dickason stated he had letter asking for a proclamation of Bill of Rights week, and if the will of the Council he will so proclaim. Councilman Fitzjohn so moved, Councilman Merritt seconded and carried. 19. ADJOURNMENT: Councilman Fitzjohn moved to adjourn, Councilman Buchan second- ed and carried, Council adjourned at 9:30 P.
