INITIATION: The regular meeting of the City Council of the City of Temple City was called to order by Mayor Dickason at 7:35 P.M., who 2. led the Pledge of Allegiance to the Flag. 3. INVOCATION: Invocation was given by Father Michael Lenihan, St. Lukes Catholic Church, Temple City, 1 1 4. ROLL CALL: PRESENT: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason ABSENT: Councilmen a None ALSO PRESENT: City Attorney Shatford & CitY Manager Woollett 5. APPROVAL OF MINUTES: Councilman Merritt stated that on Item 15 he voted against removal of the crossing guard at Cloverly and Olive. Councilman Fitzjohn made a motion to approve the minutes as corrected, seconded by Councilman Buchan,..roll call vote as follows: AYES: Councilmen - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen - None ABSENT: Councilmen - None 6. UNFINISHED BUSINESS: ORDINANCE NO. 61 -59 -- 2nd reading. City Attorney Shatford read title to Ordinance No. 61 -59 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, AMENDING MUNICIPAL CODE SECTION 3704(1)(c) RELATING TO COSTUME WEAR IN PUBLIC PARKS. Councilman Tyrell moved to waive further reading, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen: - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen: - None ABSENT: Councilmen: - None Councilman Tyrell moved to adopt Ordinance No. 61 -59, Council- man Merritt seconded, roll call vote as follows: AYES: Councilmen: - Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen: - None ABSENT: Councilmen: - None 7. PUBLIC HEARING: Zone Change Case No. 61 -23, Donald L. Secres. The public hearing was declared open and Mr. Ed Holden, City Planning Advisor gave the facts in the case, explaining that this was an irregularly shaped lot facing on Arden Drive between Olive and Green Streets, having an area of 1.2 acres. The Planning Commission recommended that the requested zone change from A -1 Acre to A -1 5,000 be granted to Mr. Secres with the provision that the easterly 12 ft. of said property be dedicated for road purposes and that the southerly 6 ft. be granted to the City for a drainage easement and pedestrian walkway, such ease- ment to be improved by property owners and the City to assume responsibility for maintenance. Mr. Donald Secres, 102k9 Green Street, owner of the property, spoke on his behalf at this time, stating that he would like very much to be able to do something with this property to de- velop it along the lines of surrounding property, as both the ones on the east and south are developed. 223 Council Minutes, December 26, 1961 Page 2 Since there were no others who wished to speak in favor of the zone change, the following people spoke against such a change: Mr. and Mrs. Dave White, 5327 Arden Drive Mr. Griff Williams, 10250 Olive Mrs. Teresa Stein, 5125 Arden Drive The main objection voiced by each of these people was that they felt 5,000 sq. ft. was entirely too small a lot for the area and would decrease the value of the surrounding properties. It was also felt that by allowing a house to be built on each 5,000 sq. ft. there was a strong possibility of houses being built in back of houses, thereby crowding the area and perhaps causing a hazardous condition. In view of the fact that the master plan will not be completed for at least another year, these people felt that it would be a dangerous situation to continually allow large areas to be chopped up into such small parcels, thereby eliminating the possibility of a good master plan, involving all those concerned. There being no further objections, Councilman Tyrell moved to close the public hearing, seconded by Councilman Buchan and carried unanimously. Councilman Tyrell stated that he agreed with Mrs. Stein about cutting down lots before the master plan was completed, and therefore moved that this matter be denied, seconded by Councilman Buchan. Each of the Councilmen stated their opinion and generally concurred. Mayor Dickason said he felt it would be nice to develop it in 6,500 sq. ft. lots but it can't be done under the present ordinance. A five minute recess was called, and at it's conclusion Councilman Fitzjohn made an amendment to Councilman Tyrell's motion stating that this matter be referred back to the Planning Commission for further planning for the entire area with respect to getting away from putting in little streets and small homes. City Attorney Shatford informed the Council that if larger lots were desired, a new ordinance would have to be drawn so stipulating these requirements. Councilman Fitzjohn withdrew his amendment. Roll call vote as follows: AYES: Councilmen: Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen: None ABSENT: Councilmen: None Councilman Tyrell made a motion directing the Planning Commission to rezone according to a formal resolution to be drawn up by the City Attorney. Seconded by Councilman Buchan and roll call vote as follows: AYES: Councilman: Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen: None ABSENT: Councilmen: None 8. TITLE REPORT 4 East-west alley North of Lower Azusa between Pal Mal and El Monte Avenues. Mr. Shatford stated that this has not been received as yet and this item was tabled. 9. NEW BUSINESS: CHARITABLE SOLICITATION PERMITS: a. Boys Christian League b. Cub Scout Pack #156 Mr. Woollett informed the Council that in the case of the Boys Christian League he was contacted by an individual requesting permission to publicise a game to be played against a team from the East which was to take place during the Christmas holidays. In the case of the Cub Scouts, permission was requested to sell mistletoe during the week preceding Christmas, as has been the custom with this organization for many years. Since the permit would not help either organization after Christmas, Mr. Woollett granted permission and was now requesting Council to verify his actions. Councilman. RESOLUTION NO 61 -181 - WARRANTS AND DEMANDS, Councilman Fitzjohn moved to adopt Resolution No. 61-181, war- rants and demands in the sum of $17,532.26 Nos. 1009 thru 1033. Councilman Buchan seconded, roll call vote as follows: AYES: Councilmen: Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen: None ABSENT: Councilmen: None ORDINANCE NO. 61-58 & RESOLUTION 61 -182. City Attorney Shatford read title to Ordinance No. 61 -58 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA AMENDING SECTION 9100 OF THE TEMPLE CITY MUNICIPAL CODE BY AMENDING CERTAIN SECTIONS OF ORDINANCE NO. 1494 OF THE COUNTY OF LOS ANGELES ADOPTED BY SECTION 9100 OF THE MUNICIPAL CODE, SAID AMENDMENTS RELATING TO MINIMUM SQUARE FOOT REQUIRE- MENTS IN ZONES R -3 AND R -4 AND YARD SET BACK REQUIREMENTS, Councilman Merritt moved to waive further reading, Councilman Tyrell seconded. Mr. Shatford stated that he should have men- tioned before reading title to the ordinance that the Planning Commission at its last meeting adopted Resolution 61 -182 from which this ordinance was drawn. Mr. Holden said that he would like to go over the ordinance and will make a report at the next meeting. COMMUNICATIONS: Mr. Woollett stated that a notice of a Proposed Annexation #21 to the City of Rosemead was received, which does not concern this City. Councilman Merritt moved to receive and file, seconded by Councilman Buchan and carried unanimously. A letter was also received from a Mr. Bonnerto, 10420 Olive St. requesting the City reimburse him 50 per lineal foot for the installation of curb and gutter. Since only Mr. Bonnerto's property was completed, which comprises about 4,0% of the entire street, he does not qualify for the reimbursement. Mr. Woollett stated that it would be difficult to change the policy for this specific case as it could lead to all sorts of complications and feels that the policy is good the way it is. City Attorney Shatford read title to Ordinance No. 61 -63 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA AMENDING THE MUNICIPAL CODE TO CORRECT DUPLICATION OF CODE NUMBERS. Mr. Shatford ex- plained that this was just to correct the numbering. City Attorney Shatford read full title to Ordinance No. 61-61 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY CHANGING PARKING REGULATIONS RELATIVE TO PRIMROSE STREET BETWEEN LAS TUNAS DRIVE AND WOODRUFF AVE., TEMPLE CITY, CALIFORNIA, ON FEBRUARY 23, 1962, BETWEEN THE HOURS OF 4 :00 P.M. AND 1962, BETWEEN THE HOURS OF 4:00 P.M. AND 6:30 P.M. ONLY. Mr. Woollett explained that this restriction is for the Camellia Festival, Councilman Fitzjohn moved to waive further reading, seconded by Councilman Buchan, roll call vote as follows: AYES: Councilmen: Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen: None ABSENT: Councilmen: None ORDINANCE NO. 61 -62 first reading„ City Attorney Shatford r ad full title to Ordinance No. 61-62 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, AMENDING SECTIONS OF THE MUNICIPAL CODE TO EXEMPT PERMIT FEES FOR EMERGENCY FALL OUT SHELTERS AND DECLARING THE URGENCY THEREOF: AND THAT THIS ORDINANCE SHALL TAKE IMMEDIATE EFFECT; Councilman Tyrell moved to waive further reading, seconded by Councilman Merritt, roll call vote as follows: AYES: Councilmen: Buchan, Fitzjohn, Merritt, Tyrell, Dickason NOES: Councilmen: None ABSENT: Councilmen: None Mr, Woollett stated that complaints have been received regarding the route the busses take which haul people to and from the race track during the racing season; They do not follow a regular bus route and are presently using Temple City Blvd., which is neither a bus orr truck route. It was suggested that Mr. Woollett contact the race track association and approach them with the thought that Rosemead Boulevard would be a good route to use. 15. ADJOURNMENT: Councilman Fitzjohn moved to adjourn, Councilman Buchan seconded and carried, Council adjourned at 9:25 P.M. until January 8, 1962 at 7:30 P.M. at the City Hall. ATTEST: City Clerk 226
