HomeMy Public PortalAbout2001/09/27 The Agenda Meeting of the Mayor and Council of the Borough of Carteret preceding the Regular Meeting, October 4,2001, was held on Thursday, September 27, 2001, 7:00 P.M., Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. The following were noted present: Mayor James Failace " Fazekas " Quinones " Reiman " Santoro Noted absent was Councilmember Sohayda. Also noted absent were Borough Attorney Bergen and Business Administrator Goldsack. Statement of meeting Notice was mailed to the Home News Tribune, The Star Ledger and posted on the bulletin board on September 21, 2001. TO ADDRESS THE GOVERNING BODY: 1. John Riggio 2. Borough Engineer John Riggio addressed the Governing Body. Mr. Riggio said he would like to speak with the Council regarding two items, the first being H.S.I. for the housing rehabilitation. He said at the last Council Meeting a resolution was passed to ok monies to cover houses that were ... (inaudible)... but the regular resolution to continue doing the homes was not passed. He just needs to know if he should tell Housing Services to continue the program or to stop it. Councilmember Santoro said she thought Business Administrator Goldsack was going to speak with them. Councilmember Reiman said Business Administrator Goldsack was supposed to handle this. He said he was also under the impression that COAH was coming. Mr. Riggio stated that he looked at three different firms and was able to negotiate 18% instead of the standard 20%. Business Administrator Goldsack was noted present at approximately 7:08 P.M. Mr. Riggio stated COAH was concerned because H.S.I. told them about the interruption in service. I SEPTEMBER 27, 2001 AGENDA MEETING NOTED PRESENT STATEMENT OF MEETING NOTICE TO ADDRESS THE GOVERNING BODY JOHN RIGGIO NOTED PRESENT SEPTEMBER 27, 2001 AGENDA MEETING TO ADDRESS THE GOVERNING BODY CONT' JOHN RIGGIO Mr. Reiman stated he still would like to see if money can be saved and ... (inaudible) ... NOTED PRESENT Borough Attorney Bergen was noted present at approximately 7:12 P.M. NOTED ABSENT Councilmember Santoro was noted absent at approximately 7:12 P.M. Mayor Failace said the Council needs to make a decision soon so the funding is not jeopardized. NOTED PRESENT Borough Attorney and Councilmember Santoro were both noted preset at approximately 7:15 P.M. Business Administrator Goldsack stated that he is more comfortable with the outside service now then he was before. NOTED PRESENT At approximately 7:20 P.M. Councilmember Sohayda was noted present. Mr. Riggio asked for a Resolution for H.S.I. Councilmember Reiman asked if H.S.I. could give the Council a status report. Mayor Failace suggested having the Borough Attorney work along with Mr. Riggio on this. Mr. Riggio said that he also put in a Resolution for UEZ funding for the Streetscape project. He said he sent the Mayor and Council a memo in regards to this. He said the memo was to satisfy a request for more information concerning a possible UEZ Project. He said the project would cost approximately $150,000.00. Councilmember Santoro said why or where was it decided Shop Rite and not Plaza Twelve which really is the first thing seen when coming off of the turnpike. Councilmember Rios suggested doing West Carteret. Mayor Reiman said the area must be in a UEZ area and at this point funds are being applied for to do the West Carteret Area. He said personally he supports both projects. Councilmember Santoro asked about the Head Start program, she wanted to know if there is something that UEZ can do to help them out with there building. Mr. Riggio stated that he does not think this is a business. 2 Mayor Reiman said they are looking for funding and he does not think the Borough should spend any of its money on this; they can search on their own. Borough Engineer Donald Norbut addressed the Governing Body. 1. Carteret Avenue Pedestrian Improvement Project - He said T. Grasso & Sons is proceeding with work on the Carteret Avenue Project. He said the contract work is approximately 75 percent complete. He said he anticipates completion of contract work by mid October 200 I. At approximately 7:58 P.M. Mayor Failace was noted absent. 2. Milik Street Rehabilitation - He said contracts are being executed with Tarheel Enterprises for the Milik Street Resurfacing Project. He said an outside progress project meeting was held on Thursday, September 27, 2001 to review and coordinate with the local businesses and address traffic safety issues. He said it is anticipated that contract work will be commence in the first week of October 200 I, and weather permitting, contract work will be completed by early November 2001. At approximately 8:00 P.M. Mayor Failace was noted present. At approximately 8:00 P.M. Borough Attorney Bergen was noted absent. . 3. Middlesex County Resurfacing Program - He said over the past several weeks, he has been coordinating milling, base repairs, and paving with Middlesex County Highway Department on various municipal side streets. He said he anticipates this work will be ongoing and all County paving will be complete by the first week in October 200 I. At approximately 8:02 P.M. Borough Attorney Bergen was noted present. 4. Base Repair Contract - He has been coordinating the work of DeFino Contracting with the Middlesex County Highway Department to accomplish various base repairs on roadways to be paved by the County. He said base repairs for all roads to be paved by the Middlesex County are complete. He said he anticipates using the remaining funds in the base repair contract to complete base repairs on Edwin Street, as well as possibly Barlick Street ITom East Cherry to Oak Lane. 5. Dorothy Street Pump Station - He said at this time, the majority of work for the pump station reconstruction project is complete. He said the project completion is expected within the next two weeks, and then a final inspection will be performed and the contract closed out. 6. Harrison Avenue Pump Station - He said he is proceeding with the design work for the replacement of Harrison Avenue pump station. He said he is currently finalizing architectural building plans, mechanical and electrical pump station drawings. He said he has met with representatives ITom Walgreens and the adjacent property owner to review the proposed pump station location and obtain the necessary temporary construction easement and permanent sanitary sewer easement within the Walgreen parking lot. He said he anticipates completing the design and advertising for the project for bids within the next several weeks. He said he is requesting Council authorization to advertise this project for bids. 7. Suspect Area Sewer Separation Project - He said the Star of the Sea Concrete Corporation is proceeding with work on the Suspect Area Sewer Separation Project. He said several new sanitary sewer mains have been installed and approximately 15 to 20 illegal connections have been properly connected to the sanitary sewer system. He said he is advising representatives of the New Jersey Department of Environmental Protection (NJDEP) of the correction of the illegal connections on a weekly basis. He said it is anticipated that this project work will continue through the year's end. 8. Grants and Loans: a. USEP A CSO Grant - he said we are awaiting final approval ITom the EP A for the CSO Grant. He said however, the Borough has received permission to advance the Suspect Area Sewer Separation Project which will be partially funded through this grant prior to receiving a formal response about the grant offer. b. DCA Low Interest Loan for Sewage Treatment Plant Demolition - He said he has recently received notice ITom the DCA regarding the low interest loan for the sewage treatment plant demolition. He said the DCA has graciously agreed to provide the Borough with a 20 year, zero interest loan, not to exceed $450,000.00 for the sewage treatment plant demolition. He said this low interest loan also covers all project soft costs. He said funding for this project was originally included in the 2000 Sewer Bond ordinance and now can be financed separately through the low interest loan program. He said he will advise the Borough Chief Financial Officer Patrick DeBlasio regarding this loan under separate cover. 9. Waterfront Park Improvements - He said in accordance with Council authorization, he is coordinating the completion of the final design plans and specifications for 4 Phase I of the Watemont Park improvements. He said the final design plans are being completed by James Guerra, Architect, and Maser Consulting. He said he anticipates receiving final plans and specifications on Friday, September 28, 2001. Borough Engineer Norbut stated under separate cover he is requesting an extension of the Green Acres Grant Agreement through May 2003 and is requesting extensions of all project permits. He said he is requesting Council authorization to advertise this Phase I project for public bids. He said he anticipates advertising the project in early October 2001 and awarding a contract and initiating construction in early November 2001. 10. Sewage Treatment Plant Demolition - He has completed plans and specifications for the demolition of the sewage treatment plant. He said two items remain to be included into the technical specifications. He said the removal of the underground storage tank found at the site and the soil testing associated with same and asbestos removal specifications. He said he anticipates that the asbestos survey will be completed within the next two weeks and the project can be advertised for bids in mid November 2001. He said he is requesting approval ITom the Mayor and Council to advertise the project for public bids. 11. Washington Avenue Streetscape Improvements - He said the project design for the Washington Avenue Streetscape Improvements Project has been completed. He said the contract was advertised for public bid on Monday, September 24, 2001. He said he anticipates receiving bids on Thursday, October 4, 2001. He said if favorable bids are received he will request Council award a contract at the October 4,2001 Council Meeting. He said the construction cost estimate for this work is approximately $70,000.00. 12. Washington Avenue, Roosevelt Avenue and Holmes Street Intersection Improvements - He said as requested the intersection improvement plans have been completed for the intersection of Washington Avenue, Roosevelt Avenue and Holmes Street. He said concept drawings have been submitted to the Middlesex County Engineer's Office for review, and are awaiting a request ITom the County for a review meeting with representatives of our office. 13. Health Department Building Handicap Ramp - He said he has contacted Laurel Associates, Architects, who have prepared handicap ramp design drawings and specifications for the Health Department Building. He said as discussed he is proceeding to obtain informal bids for the project. He said Laurel Associates reports that the recommended estimated cost of the improvements is approximately $15,000.00. He said he anticipates receiving bids and awarding a contract in late October 200 I. Mayor Failace asked Borough Engineer Norbut about Dunster andCoolidge. 5 SEPTEMBER 27,2001 AGENDA MEETING TO ADDRESS THE GOVERNING BODY CONT' DONALD NORBUT SEPTEMBER 27, 2001 AGENDA MEETING TO ADDRESS THE GOVERNING BODY CONT' DONALD NORBUT MlNUTESFOR APPROVAL RESOLUTIONS COMMUNICATIONS REPORTS MATTERS FOR DISCUSSION Borough Engineer Norbut stated that it is still on the list as a part of ... (inaudible).. . Mayor Failace asked about curb cuts. Borough Engineer Norbut stated it is near completion. Borough Attorney asked Borough Engineer Norbut about a few projects that have never been completed. He spoke about the Library and the Senior Citizen Center. He talked about bringing in a special site management company who would oversee the day to day operations and can help the Borough go against the bond company. He said he knows Borough Engineer Norbut knows of a company called C.C.M.S. who have done this type work. Borough Engineer Norbut said the company is called Consolidated Construction Management Services does a lot of this type of work. He said this company has been hired by Woodbridge Township directly ... (inaudible)... Borough Attorney Bergen said he would like to sit with this company to discuss the situation with the Library and Senior Citizen Center. Borough Engineer Norbut stated there were discussions about taking a small parcel of land and turning it into a Police memorial. He showed a rendering of a new monument that could be put on the triangle piece of land on Carteret Avenue. He said the area by Sullivan Field ... (inaudible)... improve the memorial in Carteret Park also. He said this would cost about $30,000.00 approximately for Carteret Avenue. He said if statues were added it would cost $50,000.00 MINUTES FOR APPROVAL: May 17 & June 7, 2001. RESOLUTIONS: I. Directing the Issuance of Various Raffle Licenses. 2. Refund of Tax and/or Sewer User Fees. 3. Approving Transfer of ABC License #1201-33-029-004 ITom Jenine D'Ary Meyer (Hide Away) to Anthony Acciardi (G. Bar, Inc.) 4. Budget Insertion - $2150.00, Re: Drunk Driving Enforcement Funds Grant. COMMUNICATIONS: 1. Planning Board - Resolution recommending amendment of Chapter 160 of the Code. Referred to the Engineer and the Borough Attorney. REPORTS: 1. Clerk's Office - September 2001. MATTERS FOR DISCUSSION: I. American International Recovery, Inc. - Request for payment ofliability claim Re: C. Pastronva. - OK 6 2. Glenn Savarese, Esq. - request for payment of workman's compensation claim, Re: B. Mickley. 3. NJ DOP - a) Certification of Eligibles for Appointment - Motor Broom Driver. One Provisional - S Relford. Date of Disposition: 12/17/01. OK Borough Clerk Barney stated that she got a call ITom the Department of Personnel regarding the Police Chief. She said the Mayor sent something to the Department of Personnel stating he wanted a test. She said the Council also sent something to the Department of Personnel waiving the test. She said the Department of Personnel is requesting that she has to be directed on how to answer this and that the answer must be in writing of what the final decision will be. Upon MMS&C by Councilmembers Santoro and Rios the Council voted to direct the Borough Clerk to advise the Department of Personnel to waive the test and to rank the applications. Upon individual roll call vote Councilmembers Fazekas, Reiman, Rios, Santoro and Sohayda voted in the affirmative. Councilmember Quinones voted no. 4. Job Posting - Senior Tree Trimmer - Council will look at applications and interview. 5. Robert Kately - Requesting resolution authorizing Bids for Cherry Picker. Councilmember Fazekas will get some quotes. At approximately 8:35 P.M. Councilmember Sohayda was noted absent. BUSINESS TO BE ADDED: Councilmember Rios stated he would first like to commend the Volunteer Firemen that went to New York and got involved with the Bucket Brigade. He said he would like to have commendations for the following Volunteer Firefighters for the Council Meeting: Jason Lombardi, Michael Menzoff Jr., Michael Spolizino, Brandon Rhodes, Christopher Wisniewski, and Ronald D'Omo. Councilmember Sohayda was noted present at approximately 8:40 P.M. Councilmember Rios stated there is a serious problem with the First Aid Squad responding to calls. He said he has a call out to Rural Metro to see what it would take for them to cover the weekends. Councilmember Santoro spoke about the Interlocal Agreement. She stated she got the approval. (Police Matter) Borough Attorney Bergen stated they want an indemnification agreement which he is sending to their attorney. He stated the Council just needs to authorize the Mayor to execute. A Resolution will be put on. SEPTEMBER 27, 2001 AGENDA MEETING MATTERS FOR DISCUSSION CONT' DISCUSSION NOTED ABSENT BUSINESS TO BE ADDED NOTED PRESENT 7 SEPTEMBER 27, 2001 AGENDA MEETING BUSINESS TO BE ADDED CONT' NOTED ABSENT NOTED PRESENT Councilmember Santoro also stated she would like commendations done for the Police Officers who went over to New York. She said she will wait to present them just to see if anyone else will be going over. Mayor Failace suggested waiting on fire as well just in case anyone else is going over. Councilmember Sohayda stated he informed Borough Engineer Norbut that by Reibis Liquors there is a problem with water spots so John is going to look into it as well as by Jody Gentile's house on Post Blvd where the Gas company dug up the road she made a complaint about the pavement. Councilmember Quinones stated there was a street sign down on the corner of Patrick and Monroe maybe someone can take a look at it. Councilmember Fazekas was noted absent at approximately 8:45 P.M. Councilmember Reiman stated there was a Planning Board meeting last night and part of the discussion that was taking place was the terminal manager ITom Kinder Morgan had reached out and through the CAPP, which is an association of the industries in town, may be looking to help partially fund a new ambulance for the town. He said the second thing is he thinks the Borough should look at impact fees. He said they could pass an ordinance requesting it or whatever can be done to require or request the Planning or Zoning Board to look at impact fees. He said he would also like to look at the Road Opening Permit. He said he received a letter ITom the New Jersey Conservation Foundation. He said he met with them a few weeks ago along with Councilmember Santoro, Borough Engineer Norbut, and Chief Financial Officer DeBlasio. He said the Borough may be looking at a possible million dollar grant to help with the Watemont Park. Mayor Failace stated that at the Town Meeting a few questions came up one regarding Roosevelt Avenue going over the bridge into West Carteret, can the Borough speak with the County about a sign on the bridge to turn left as well as a sign stating that there is a red signal ahead. Councilmember Fazekas was noted present at approximately 8:50 P.M. Councilmember Reiman stated on Washington Avenue next to Roosevelt Avenue where the little island is on the end has been deteriorating. He said he has reached out to Freeholder Polos to see if this can be improved. Councilmember Santoro stated she wanted to talk to Business Administrator Goldsack about employment. She asked if this was for open or closed. Borough Administrator Goldsack stated it would be for open. Councilmember Santoro stated after raises were given some department heads said their departments were left out. Business Administrator Goldsack stated it was an ongoing process. He said the process used was looking at the salaries that were currently 8 in existence and current titles to see if the titles were out of line with the responsibilities as well as the salaries. He said the responsibility for evaluating employees was not his. He said he did not evaluate any employee. He said the only thing he did was look at the structure and the responsibilities and made a recommendation based upon that. Councilmember Santoro asked where he got his information rrom. Borough Administrator Goldsack stated he used the payroll sheets. Councilmember Santoro referred to Business Administrator job description and asked how often he meets with the supervisors of all the departments with in the Borough. Business Administrator Goldsack stated when it is necessary. He said if they have issues.. . Councilmember Santoro asked if he has met with every department. Business Administrator Goldsack stated not on a yearly basis but if there are any issues that come up then yes. Councilmember Reiman noted absent at approximately 9:00 P.M. Councilmember asked Business Administrator's position was to correct any inconsistencies. Business Administrator stated that he was corrected inconsistencies. Councilmember Reiman was noted present at approximately 9:02 P.M. Mayor Failace stated in the past a desk audit would have been done. Councilmember Santoro asked the Business Administrator Goldsack why he didn't talk to Department Heads. Business Administrator Goldsack stated he evaluated titles and salaries not people. He said he did not want the Department Heads to be biased. Councilmember Santoro asked him about his daily responsibilities. She asked him to keep a log of what complaints are answered. She stated that in the Business Administrator's contract it states that he shall rerrain rrom accepting any outside employment which would impair his abilities to perform his duties as the Business Administrator. She stated she wanted to make sure that he is aware of this. Mayor Failace asked the Business Administrator ifhe had another job. Business Administrator Goldsack stated he does have another job but it does not affect his job as the Business Administrator. He stated he works as the Tax Collector in Guttenberg in the evenings since August 1st. Mayor Failace asked for a motion to go into Closed Session to discuss Personnel Matters and Contract Negotiations. SEPTEMBER 27, 2001 AGENDA MEETING BUSINESS TO BE ADDED CONT' NOTED ABSENT NOTED PRESENT 9 SEPTEMBER 27, 2001 AGENDA MEETING RESOLUTION #01-306 "RESOLUTION TO GO INTO CLOSED SESSION ADOPTED CLOSED SESSION HELD MEETING RE-OPENED ADJOURNED RESOLUTION #01-306 was introduced by the Mayor and referred to the Council for action. Upon MMS&C by Councilmembers Santoro and Reiman RESOLUTION #01-306 "RESOLUTION TO GO INTO CLOSED SESSION" was adopted. Upon individual roll call vote, Councilmembers Fazekas, Quinones, Reiman, Rios, Santoro and Sohayda voted in the affirmative. At approximately 9: 18 P.M., a Closed Session was held. Upon MMS&C by Councilmember Reiman and Sohayda and unanimous affirmative vote of the full Council present the Agenda Meeting was re-opened at approximately 10:26 P.M. Upon MMS&C by Councilmembers Santoro and Rios and unanimous affirmative vote of the full Council present, there being no further discussion, this meeting was adjourned at approximately 10:27 P.M. ubmitted, LEEN M.
