HomeMy Public PortalAboutOrd. 1453ORDINANCE No. 1453 AN ORDINANCE AMENDING SECTION 12-16.6 OF CHAPTER 25 OF THE LYNWOOD MUNICIPAL CODE TO PROHIBIT FENCES AND WALLS IN THE FRONT YARD SETBACKS AND CERTAIN SIDE YARD SETBACKS OF EXISTING AND PROPOSED RESI- DENTIAL DEVELOPMENT OF SIX OR FEWER UNITS IN R-1, R-2 AND R-3 RESIDENTIAL ZONES. THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES ORDAIN AS FOLLOWS: Section 1. Chapter 25 of the Lynwoodl~lunicipal Code is hereby amended by amending Section 25-16.6 f. as follows: 25-16.6 Fences and Masonry Walls f. The following shall apply to fences and masonry walls in all residential zones: 1. A wall or fence not more than six (6) feet in height, as measured from the highest adjacent grade, may be constructed or maintained along the interior side or rear lot lines in any residential zone except where restricted by other provisions of this section. 2. Fences, walls and gates up to 6 feet in height may be constructed in any residential zone across the property at or behind the 20 foot front yard setback between side yard fences or walls and the sides of residential buildings. A fence or wall up to six (6) feet in height may be constructed in the street side yard of a corner lot if it is located at or behind the side yard setback and generally in line with the walls of the main structure ~_ garage. Upon appeal of a Department determination the Planning Commission may approve a fence, not to exceed 3 ft. if solid and 4 feet if wrought iron, in the front yard setback area for the corner portion of a corner lot adjacent to a major arterial street or in other situations where it can be demonstrated that a fence is necessary to prevent significant trespass or to protect the public health, safety or welfare. 3. In the R-2 and R-3 zones walls, fences or gates may be constructed or maintained in any required front yard of developments containing seven (7) or more units. Such wall or fence shall not exceed four (4) feet in height, except as provided in subsection 25-4.8d.13, provided that at least the upper one (1) foot is open to permit vision through the fence surface. The fence or wall shall be constructed of decorative material compatible with the residential structure and the general scheme of the neighborhood, specifically excluding chicken wire and fiberglass. 4. A wall or fence generally parallel and located within ten (iG) feet of a driveway shall nct exceed four (4) feet in height within the required front yard, provided that at least the upper one (1) foot is open to permit vision through the fence surface. Section 2.
